A Tale Of Two Civil Procedures, Pamela K. Bookman, Colleen F. Shanahan Jan 2022

A Tale Of Two Civil Procedures, Pamela K. Bookman, Colleen F. Shanahan

Faculty Scholarship

In the United States, there are two kinds of courts: federal and state. Civil procedure classes and scholarship tend to focus on the federal, but refer to and make certain assumptions about state courts. While this dichotomy makes sense when discussing some issues, like federal subject matter jurisdiction, for many aspects of procedure this breakdown can be misleading. When understanding American civil justice, two different categories of courts are just as salient: those that routinely include lawyers, and those where lawyers are fundamentally absent.

This essay urges civil procedure teachers and scholars to think about our courts as “lawyered” courts—which …

Reaching A Compromise Between Left And Right-Wing Parties, Claire Jimerson Jan 2022

Reaching A Compromise Between Left And Right-Wing Parties, Claire Jimerson

Williams Honors College, Honors Research Projects

With each new headline that emerges, America becomes more and more politically polarized, and compromise between the two extremes seems more and more impossible. Adding to this struggle is the fading spirit for reaching this compromise. Unfortunately, however, with each headline that emerges, the need for respect and compromise also becomes ever more urgent. The foremost issues of our time -- immigration, health care, gun control, and social justice, to name a few -- will remain issues if there is no leeway from either side. This paper will serve as an attempt at two things. First, it will look at …

Data Envelopment Analysis As A Benchmarking Application For Humanitarian Organizations, Dan Rodman Jan 2022

Data Envelopment Analysis As A Benchmarking Application For Humanitarian Organizations, Dan Rodman

Theses and Dissertations

Humanitarian aid organizations are under tremendous pressure and competition for donor funds to sustain their operations. However, donor contribution levels have remained relatively stagnant over the past five years and are unlikely to grow in the foreseeable future. Additionally, donor policies and mandates have added pressure on humanitarian aid organizations to comply with new and more complex requirements.

Many humanitarian aid organizations work in some of the most challenging areas of the world, where conflict, famine, environmental, economic, and cultural challenges are prevalent. Given all these factors, a novel form of performance and efficiency measurement is needed to evaluate the …

Ransomware Warfare: Exploring Global And Private Negotiations To Help U.S. Victims Respond To The Threat, Karina Nad

Cardozo Journal of Conflict Resolution

By weaponizing technology, now more than ever before, cybercriminals are transforming the cyberworld into their new hunting ground. Almost daily, news headlines alert us to a new malicious cyber threat or major data breach. The evolution of cybercrime has created a malicious online environment, or "malspace," that is now inhabited by hacker groups and espionage units from all over the world. As a global concern, the use of powerful online capabilities by hacker groups has led to the "militarization" of cyberspace. Closer to home, critical infrastructure, valuable personal data, and access to medical care has been compromised at alarming rates …

Africana Legal Studies: A New Theoretical Approach To Law & Protocol, Angi Porter Jan 2022

Africana Legal Studies: A New Theoretical Approach To Law & Protocol, Angi Porter

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: In 1743, a group of enslaved Africans from various estates in French colonial New Orleans gathered, held a musical ceremony sung in their native language, and discussed the actions and fate of a slaveholder named Corbin. Earlier, Corbin had threatened to shoot one of the enslaved Africans in this group, and Corbin’s brother then actually shot that person with a gun loaded with salt. Now, as the group of Africans gathered, they determined that Corbin had to die. Two months later, Corbin disappeared and was never found.

If we use a traditional (Western) legal framework to describe this …

Artificial Intelligence And National Security, Ryan Laverick Jan 2022

Artificial Intelligence And National Security, Ryan Laverick

Williams Honors College, Honors Research Projects

As technology advances at an exponential rate, it is becoming increasingly important to consider the ramifications of that technology in the geopolitical environment, and especially as it pertains to American national security. One of the most important categories of technological innovation that will likely disrupt the global balance of geopolitical power, especially along the US-China axis, is the advent and growing sophistication of artificial intelligence. In order to address the new and evolving national security challenges that will accompany this disruption, this paper seeks to define and explain the disparity in artificial intelligence capabilities between the United States and China. …

The Balance Of Convertibility: Manipulating External Support In Civil War, Kimberly L. Wolfe Jan 2022

The Balance Of Convertibility: Manipulating External Support In Civil War, Kimberly L. Wolfe

Browse all Theses and Dissertations

Despite the pervasive trend in civil war of multiple sponsors backing rebels or the government, there is surprisingly minimal analysis on how the balance of support influences conflict duration. Building on the research of Sawyer et al. (2017), who find that the “fungibility” of external support leads to longer civil war, this thesis contributes a new scoring method for analyzing the balance of “fungible” (hereafter “convertible”) support among combatants (rebels versus government), discovering that a balance of convertibility contributes to shorter conflict. Convertible resources are those that combatants manipulate to enhance their warfighting capacity, such as funding, while troops or …

Idyllic History: The Role And Agency Of Women And Religion In Contemporary Bollywood, Kushma Singh Jan 2022

Idyllic History: The Role And Agency Of Women And Religion In Contemporary Bollywood, Kushma Singh

Honors Undergraduate Theses

The intent of this thesis is to explore the directorial choices made by Ashutosh Gowariker, in his film Jodhaa Akbar (2008), and Sanjay Leela Bhansali, in his films Bajirao Mastani (2015) and Padmaavat (2018), in order to evaluate the representation of women and the Muslim religion. Through use of mise en scene, I discuss lighting choices, visual display and use of color and how these elements create and support the stories Bhansali and Gowariker have chosen. I also rely on the recorded history of the time periods as well as the literature to contextualize the films.

The Amorphous Nature Of Hackers: An Exploratory Study, Kento Yasuhara, Daniel Walnycky, Ibrahim Baggili, Ahmed Alhishwan Jan 2022

The Amorphous Nature Of Hackers: An Exploratory Study, Kento Yasuhara, Daniel Walnycky, Ibrahim Baggili, Ahmed Alhishwan

Annual ADFSL Conference on Digital Forensics, Security and Law

In this work, we aim to better understand outsider perspectives of the hacker community through a series of situation based survey questions. By doing this, we hope to gain insight into the overall reputation of hackers from participants in a wide range of technical and non-technical backgrounds. This is important to digital forensics since convicted hackers will be tried by people, each with their own perception of who hackers are. Do cyber crimes and national security issues negatively affect people’s perceptions of hackers? Does hacktivism and information warfare positively affect people’s perception of hackers? Do individual personality factors affect one’s …

Impact And Coping Strategies Among Vulnerable Groups: An Urban-Rural Resilience Trajectory Of The Covid-19 Pandemic, Rizki Fillali, Ana Rosidha Tamyis, Sulton Mawardi, Hening Wikan Sawiji Jan 2022

Impact And Coping Strategies Among Vulnerable Groups: An Urban-Rural Resilience Trajectory Of The Covid-19 Pandemic, Rizki Fillali, Ana Rosidha Tamyis, Sulton Mawardi, Hening Wikan Sawiji

Masyarakat: Jurnal Sosiologi

The COVID-19 pandemic has had profound effects on the livelihoods of vulnerable groups. Previous studies have indicated that vulnerable groups in urban areas suffer more economic impacts than their counterparts in rural areas, largely due to mobility restrictions, social and physical distancing measures, and pre-pandemic vulnerabilities, exacerbating the challenges that urban groups face to survive. This article examines variations in the impacts and coping strategies of vulnerable groups in selected urban and rural areas in Indonesia during the COVID-19 pandemic, and determines how these impacts and coping strategies have shaped the trajectory of community resilience. The article argues that although …

Tightwire Of National Interests And Publicity In The Evolved Process Of Democratization And Constitutional Transformation: Lessons From Taiwan, Hsin-Hsuan Lin Jan 2022

Tightwire Of National Interests And Publicity In The Evolved Process Of Democratization And Constitutional Transformation: Lessons From Taiwan, Hsin-Hsuan Lin

Cardozo International & Comparative Law Review

Achieving an optimal balance between government secrecy and democratic accountability has led to long-standing questions in the discussion of contemporary constitutionalism. To address the complex contemporary phenomenon of government secrecy within a democratic society, a more in-depth understanding of its tension with democratic accountability and transparency is essential. This article provides a descriptive overview of Taiwan's legal system, its legal implications in relation to government secrecy, and its normative implications. The article begins with a historical background of Taiwan's legal system, focusing on legal reform as it relates to government secrecy. The article investigates the complex interactions between the administrative, …

An Analysis Of The Methods Of Interpretation Of The Leviticus 11 Dietary Laws In Second Temple And Early Christian Non-Canonical Sources, Ani Ionut Constantin Jan 2022

An Analysis Of The Methods Of Interpretation Of The Leviticus 11 Dietary Laws In Second Temple And Early Christian Non-Canonical Sources, Ani Ionut Constantin

Master's Theses

Background of the Research

Numerous commentators and theologians have written in recent centuries about clean and unclean animals. These distinctions are also referred to as dietary laws, and they are found in Leviticus 11 and Deuteronomy 14. For example, Walter Houston wrote in 1993 in the Journal for the Study of the Old Testament, Supplement Series 140 about the prohibition, its explanation, and its implications; Vic Lockman extended the study through the New Testament in 1997 in his work The Dietary Laws of the Bible; and Jordan D. Rosenblum in 2016 in his work The Jewish Dietary Laws in the …

The Case For Alternate Media Requirement Expressions In Systems Engineering, Jason Kolligs Jan 2022

The Case For Alternate Media Requirement Expressions In Systems Engineering, Jason Kolligs

Dissertations

“Requirements” are often presented as a necessary, if not mandated, component or tool of the systems engineering process. Despite their place in engineering, low quality requirements are the first potential mistakes of an engineering project and their effects are potentially felt downstream in the form of increased costs and schedule overruns. Innovations to improve requirements engineering have historically omitted the requirement media. This research provides the rationale and process heuristics to include alternate media requirement expressions within systems engineering which shifts accountability to higher context requirement expressions that may require less cognitive load while decreasing effort and schedule thereby potentially …

Out Of The Gutter, Into The Gram: A Comical Message And A Digital Medium, Tala Majzoub Jan 2022

Out Of The Gutter, Into The Gram: A Comical Message And A Digital Medium, Tala Majzoub

Comparative Literature M.A. Essays

By analyzing three different comics on Instagram by the Lebanese political cartoonist, the Art of Boo, this essay argues that comics generate political meaning through emulating the medium of Instagram on the one hand, and by inviting the audience to become active participants on the other. Although a lot has been written about digital activism and political cartoons in the Arab world, little has been theorized about what makes this form of political artistic expression and dissent powerful on digital platforms. By drawing on Scott McCloud’s Understanding Comics, this essay demonstrates that the medium of comics operates as a …

Gambling: The Dialogue Of Excess In Lanval And The Franklin’S Tale, Fanrui Shao Jan 2022

Gambling: The Dialogue Of Excess In Lanval And The Franklin’S Tale, Fanrui Shao

Comparative Literature M.A. Essays

Marie de France’s Lanval and Chaucer’s The Franklin’s Tale are two medieval stories based on the Breton form of poetry called the lai. Both texts focus on rash actions, in particular thoughtless utterance, committed by virtuous foreigners, and the consequences that ensue. On the surface, the outsiders suffer xenophobia and the disfavor of the local patriarchy. But their true problem is the “excess” that they carry with them. Communities censor the circulation of this excess, i.e., all people, objects and relationships that either come from outside or deviate from local norms. Reading excess in these tales through the lens …

Understanding Challenges And Solutions With Systemigrams: Application To Electronic Medical Record Systems, Amit Malhan, Laquanda L. Johnson, Robert Pavur

Journal of International Technology and Information Management

The medical field is becoming bigger and more complex in the 21st century, diseases both emergent and re-emergent are on the rise and are costing lives around the world. Evolution of many diseases has made people find a reason to seek medical care in healthcare centers. This has led to increased development of health care facilities as peoples’ urge to get quality diagnosis and treatment rises. However, in the past patients ended up waiting a long time in their efforts to obtain these services. These wait times were due to the lack of proper documentation and recording of the personal …

Assessment Of Information Literacy And Fake News Identification Of Benguet State University Freshmen: Implications For Library Literacy Program, Daniel Jr Balbin Jan 2022

Assessment Of Information Literacy And Fake News Identification Of Benguet State University Freshmen: Implications For Library Literacy Program, Daniel Jr Balbin

Library Philosophy and Practice (e-journal)

The world is experiencing a rapid and massive spread of misinformation referred to as “infodemic” (WHO, 2020, cited by Salvi, et al., 2021). Despite information literacy had been a long-offered solution to information problems (Horton, 2007) and studies discovered that accurate identification of fake news was significantly associated with information literacy (Jones-Jang, et al., 2021), approaches to IL instruction must be updated and must adapt to the changing information society and environment (SCONUL, 2018; Rutledge and LeMire, 2017).

It aimed to determine the level of information literacy and fake news identification of the students. It also determined if there is …

Rose Island’S Role As Part Of The Naval Torpedo Station At Newport, Zachary N. Russell, Jeroen Van Den Hurk Ph.D.

Research

This paper documents Rose Island's role as part of the Naval Torpedo Station at Newport and was the continuation of Islands of the Narragansett Bay Interdisciplinary Project. As a large portion of Rose Island’s eighteenth and mid-nineteenth century history has been documented, the continuation of documenting Rose Island’s twentieth century history includes its role as part of the Naval Torpedo Station at Newport. After researching the Torpedo Station in Newport, it was discovered that Rose Island played a small but vital role in this large military installation. It was used for ammunition storage, but its role is just as important …

International Child Law And The Settlement Of Ukraine-Russia And Other Conflicts, Diane Marie Amann Jan 2022

International Child Law And The Settlement Of Ukraine-Russia And Other Conflicts, Diane Marie Amann

Scholarly Works

The Ukraine-Russia conflict has wreaked disproportionate harms upon children. Hundreds reportedly were killed or wounded within the opening months of the conflict, thousands lost loved ones, and millions left their homes, their schools, and their communities. Yet public discussions of how to settle the conflict contain very little at all about children. This article seeks to change that dynamic. It builds on a relatively recent trend, one that situates human rights within the structure of peace negotiations, to push for particularized treatment of children’s experiences, needs, rights, and capacities in eventual negotiations. The article draws upon twenty-first century projects that …

The components of each stage have similarities as well as differences, which make each unique in its own right. As the film-making and the movie industry may have much we can learn from, some of these will be covered under the different sections of the paper, for example, "Writing Powerful Narratives," depiction of emotional elements, specific industry-driven developments as well as the "cultural considerations" in both. For medical simulation and simulation-based education, the corresponding stages are as follows: DevelopmentPreproductionProductionPostproduction andDistribution. The art of sim-making has many similarities to that of film-making. In fact, there is potentially much to be learnt …

Satirical Dissent: The Subversive Messaging Of Ad Reinhardt’S 1946 And 1961 Art Comics How To Look At Modern Art In America, Julie A. Schumacher Jan 2022

Satirical Dissent: The Subversive Messaging Of Ad Reinhardt’S 1946 And 1961 Art Comics How To Look At Modern Art In America, Julie A. Schumacher

Dissertations and Theses

Through a close analysis of Ad Reinhard's 1946 and 1961 art comics "How to Look at Modern Art in America,” examined in the context of their times, this paper will argue that Reinhardt’s idealist view and involvement with abstraction, as he saw it in its “purest” form, was intrinsically formed and shaped by his Marxist anticapitalistic perspectives in response to his concurrent time. When these works are examined through the lens of Reinhard’s socialist politics, a parallel narrative surfaces where “pictures artists” also signifies capitalism and its capacity to harmonize and contaminate.
