Giving Voice To The Victims Of The Insurgency In Eastern Uganda In The Late 1980s And Early 1990s: A Phenomenological Research Study, Lawrence Egulu
Department of Conflict Resolution Studies Theses and Dissertations
After five years of protracted guerilla warfare, Uganda’s current President Yoweri Museveni capturedpower in January 1986, displacing the preceding regime that had been dominated by Northern politicians and Eastern Ugandans (army and police). Feeling humiliated, deprived, and out of government, several rebel insurgencies erupted, among which was the Uganda People’s Army in the Teso region. The experiences of the affected population at the hands of the army, rebels, and the Karamojong cattle raiders from the North East have remained largely unexplored, unheard, and undocumented outside of the region, and neither have how the victims made meaning of their conditions. The …

This study explored the experiences and perceptions of faculty members at an institution of military education participating in a Faculty Learning Community (FLC) focused on educational technology utilization during the 2022-2023 academic year. As the Department of Defense (DoD) emphasizes the importance of technology capabilities and workforce development, understanding faculty experiences in these settings becomes crucial for effective technology integration in teaching and learning. Utilizing a participatory action research (PAR) design, the study collected data through faculty artifacts, researcher reflexive journals, semi-structured interviews, bi-monthly meeting minutes, videos, and presentation materials. The research questions focused on the change of participants' understanding …

Analysis Of The Mortuary Patterns At The Burns Site (8br85) At Cape Canaveral Space Force Station And The State Of Florida, Melanie M. Langgle
Honors Undergraduate Theses
The Burns Site, located in Cape Canaveral, Florida, is an ancient burial mound that presents a unique archaeological puzzle characterized by its distinctive mortuary practice known as 'radial burials.' This paper explores the origins and significance of radial burials within the broader framework of indigenous mortuary practices in Florida, from the Late Archaic through the Malabar II period (750 – 1565 AD). The research investigates and cross-references previous studies on ancient burial mounds in the Southeastern United States using quantitative and qualitative analysis. The study aims to gain insights into the cultural, social, and historical contexts that shaped the Burns …

Enhancing Fairness And Compassion In Military Disciplinary Proceedings, Rinat Kitai-Sangero
Enhancing Fairness And Compassion In Military Disciplinary Proceedings, Rinat Kitai-Sangero
Cardozo International & Comparative Law Review
This Article critically assesses the disciplinary proceedings carried out by judicial officers within the military, shedding light on the absence of crucial procedural guarantees, such as the right to legal representation and an impartial judge. After comparing the Israeli disciplinary proceedings with the Summary Court-Martial system in the United States and considering arguments used to justify the lack of procedural guarantees, the Article emphasizes the emotional distress experienced by soldiers who feel powerless due to power imbalances with their commanders and the severity ofprison sentences they may face. While the Article primarily focuses on the Israeli army, its main arguments …
Reuniting "Active" And "Direct" Participation: The International Criminal Court's Dph Divorce In Lubanga, Josef Danczuk
Reuniting "Active" And "Direct" Participation: The International Criminal Court's Dph Divorce In Lubanga, Josef Danczuk
Cardozo International & Comparative Law Review
Throughout treaty-making processes and turn-of-the-century international criminal tribunal decisions, scholars and judges alike determined that the terms "direct" and "active," when referring to participation in hostilities, were synonymous. However, the International Criminal Court ("ICC'), in interpreting the Rome Statute in the Lubanga case, determined that they were not, creating disparity between interpretations of the same terms within International Criminal Law ("ICL") and the Law of Armed Conflict ("LOAC"). Not only is the ICC's interpretation legally wrong, it is also practically unworkable and distorts the well-established doctrine of DPH as defined in LOAC. Lubanga may have broadened protectionfor child soldiers, but …

Blinded By The Light: Resolving The Conflict Between Satellite Megaconstellations And Astronomy, David A. Koplow
Blinded By The Light: Resolving The Conflict Between Satellite Megaconstellations And Astronomy, David A. Koplow
Vanderbilt Journal of Transnational Law
The sudden emergence of large constellations of small satellites in low altitude orbits represents one of the most dramatic contemporary innovations in outer space. Promising low-cost, low-latency global communications and spectacular capacities for remote sensing of the Earth, these satellites will soon number in the tens of thousands, sponsored by diverse corporations and countries around the world. But this proliferation of spacecraft comes at a steep cost in unavoidable interference with ground-based astronomy: as the satellites overfly the observatories, they block the views of remote objects and phenomena, leaving obliterating white streaks on the collected imagery, and obscuring access to …
Temporary Protection For Ukrainians In The European Union: Why Now And When Again?, Maryellen Fullerton
Temporary Protection For Ukrainians In The European Union: Why Now And When Again?, Maryellen Fullerton
Vanderbilt Journal of Transnational Law
In 2022, the Russian invasion of Ukraine produced an unprecedented wave of temporary immigration protections throughout the European Union (EU). Within the first few months of the war in Ukraine, over 4 million displaced individuals had registered for temporary protection. EU States distant from Ukraine sheltered hundreds of thousands of displaced families, while Poland and other EU States that border Ukraine sheltered more than 2 million. This groundswell response marked a striking departure from just seven years earlier, when the EU Commission and EU Council failed to use readily available laws to provide a temporary protection program for Syrians displaced …
Addressing Unlawful Cyber Operations In Armed Conflict Through Human Rights Bodies Instead Of The International Criminal Court, Zachary R. Orr
Addressing Unlawful Cyber Operations In Armed Conflict Through Human Rights Bodies Instead Of The International Criminal Court, Zachary R. Orr
Vanderbilt Journal of Transnational Law
Although the ICC-or other similarly-situated international criminal tribunals-could soon see the first cyber war crime prosecution, two glaring issues persist. First, the universe of conduct that could give rise to such a prosecution is limited. Second, heavy reliance on the war crimes framework fails to provide a forum for redress of many harms caused by other unlawful cyber operations in armed conflict. The fragmented nature of international law and its enforcement mechanisms requires solutions that harness the full range of the integrated architecture of the international system. Cyber operations might soon feature at the ICC, but only a fraction of …
Does Personality Traits And Security Habits Influence Security Of Personal Identification Numbers? The Context Of Mobile Money Services In Tanzania., Daniel Ntabagi Koloseni
Does Personality Traits And Security Habits Influence Security Of Personal Identification Numbers? The Context Of Mobile Money Services In Tanzania., Daniel Ntabagi Koloseni
Journal of International Technology and Information Management
Security is an important ingredient in financial transactions; as such, it is imperative that attention should be paid to enhancing the security habits and user behaviours of mobile payment services. Establishing a link between security habits, personality characteristics, and security behaviours provides a new dimension to studying security behaviours regarding mobile money services. Therefore, this study investigates how personality traits affect security behaviours and habits and how security habits mediate the link between personality traits and PIN security practices. The study found that conscientiousness, openness to experience, extroversion and security habits influence PIN security practices, while conscientiousness, agreeableness, and neuroticism …

Experimental Assessment Of Laser Scarecrows For Reducing Avian Damage To Sweet Corn, Sean T. Manz, Kathryn E. Sieving, Rebecca N. Brown, Page E. Klug, Bryan M. Kluever
United States Department of Agriculture Wildlife Services: Staff Publications
Background
Birds damage crops, costing millions of dollars annually, and growers utilize a variety of lethal and nonlethal deterrents in an attempt to reduce crop damage by birds. We experimentally tested laser scarecrows for their effectiveness at reducing sweet corn (Zea mays) damage. We presented 18 captive flocks of free-flying European starlings (Sturnus vulgaris) with fresh sweet corn ears distributed on two plots where laser and control treatments were alternated each day and allowed each flock to forage over 5 days. In 16 trials, fresh sweet corn ears were mounted on wooden sticks distributed from 0 …

Living Charity: Beata Caterina, The Pizzicaiuoli Altarpiece And Lived Religion In Fifteenth-Century Siena, Susan A. Nolan
Theses
This thesis examines charity as a key element of early modern experience in the context of the Pizzicaiuoli altarpiece (1447). Painted by well-known artist Giovanni di Paolo, the altarpiece was commissioned by the Sienese guild of grocers, the Pizzicaiuoli, and was situated in the church of the Santissima Annunziata, located in the hospital of Santa Maria della Scala in Siena. The central focus of the altarpiece is the main panel depicting the Presentation of Christ in the Temple (Presentation), which is surrounded by iconic images of saints. Below the Presentation scene, in a predella (the lowermost horizontal component of …
An Entangled But Separate System: Examining The Experiences Of Colonial Offenders In Western Australia, 1829-1868, Emily Lanman
An Entangled But Separate System: Examining The Experiences Of Colonial Offenders In Western Australia, 1829-1868, Emily Lanman
Theses
Crime and punishment are omnipresent features of Western Australia’s colonial history. The establishment of a colony on invaded Noongar boodja in 1829 is indicative of the first criminal act. Within six months, a system of incarceration had been established for British offenders. Despite this, the importation of male imperial convicts from Britain and Ireland between 1850 and 1868 has become synonymous with the colony’s penal history. The historiographical preoccupation with imperial convicts ignores the people convicted within the colony, and subsequently, their lived experiences have been overlooked. This is to the detriment of understanding offenders, their motivations, and their interactions …
Why The Supreme Court Rejected The Prospect Theory Of Copyright Scope, Michael W. Carroll
Why The Supreme Court Rejected The Prospect Theory Of Copyright Scope, Michael W. Carroll
Cardozo Arts & Entertainment Law Journal
In Google LLC v. Oracle America, Inc. ("Google v. Oracle"), and again in Andy Warhol Found. for the Visual Arts, Inc. v. Goldsmith ("Warhol"), the parties and various amici presented the Court with a variety of arguments about the relationship between a copyright owner's right to make derivative works from a protected work and a user's right to make fair uses of that same work. At bottom, these arguments were about the proper, or even optimal, scope of copyright.
This Essay argues that these arguments were instead grounded in a form of "prospect theory" of copyright scope that …
Chinese Masculinities During The Maoist Era: Representations Of Model Men, Daniel L. Izadirad Mr.
Chinese Masculinities During The Maoist Era: Representations Of Model Men, Daniel L. Izadirad Mr.
Graduate Thesis and Dissertation post-2024
This thesis analyzes male characters from Maoist era movies, novels, and posters to argue that the Importance of Wen masculinity, a man’s intellectual and artistic talents, was downplayed, and even feminized while the importance of Wu masculinity, a man’s martial and athletic talents, was increased and encouraged as these forms of media came under increasingly stringent regulation from the Chinese Communist Party. This thesis examines sources from 1949-1976 dividing them into three periods: the Early People’s Republic (1949-1965), the Early Cultural Revolution (1966-1969), and the Late Cultural Revolution (1970-1976). Each chapter studies revolutionary protagonists and counterrevolutionary antagonists and explores how …
Toward Best Practices For Trade-Security Measures, Harlan G. Cohen
Toward Best Practices For Trade-Security Measures, Harlan G. Cohen
Faculty Scholarship
The global economy is increasingly being weaponized. Citing security concerns from traditional defence to economic competitiveness, health emergency, and climate crisis, states are turning to sanctions, tariffs, export controls, investment screening, and subsidies. But while economic statecraft is becoming common, rules remain scarce. Questions about notice, duration, proportionality, harm minimization, compensation, retaliation, and/or rebalancing lack clear answers and seem almost theoretical. Once, we might have hoped the World Trade Organization (WTO) would play a role in developing such rules. But in the absence of an Appellate Body and in the face of state rejections of review, WTO’s deliberative processes have …
Resilience And Resistance: Culture, Conversion, And Survival Among The Stockbridge Mohicans, Mariah N. Ramdeen
Resilience And Resistance: Culture, Conversion, And Survival Among The Stockbridge Mohicans, Mariah N. Ramdeen
Dissertations and Theses
This thesis investigates the history of conversion among the Mohican band in Stockbridge, Massachusetts from the 1730s to the 1740s. Focusing on the praying town under the ministry of Reverend John Sergeant at Stockbridge in 1736, I seek to reconstruct the resistance and survivance at the heart of the Stockbridge Mohicans’ experience. My research will explore why the Mohicans chose to establish the Stockbridge praying town and why they chose to convert to Christianity, the religion of the Puritan colonizers. I will also explore how they used their conversion to promote their own community goals. While praying towns were designed …
Garland V. Cargill: It’S A Duck! Except At The Supreme Court . . ., Maureen Johnson
Garland V. Cargill: It’S A Duck! Except At The Supreme Court . . ., Maureen Johnson
Chapman Law Review
Garland v. Cargill may go down as one of the most notorious cases ever handed down by the Supreme Court. By a 6-3 tally, “bump stocks”—which essentially turn semi-automatic weapons into machine guns—were deemed outside the purview of the National Firearms Act of 1934 (NFA). Initially, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) determined that bump stock-converted weapons did not fall within the statutory definition of a machine gun. Amidst a bipartisan outcry following the 2017 Las Vegas Massacre, the ATF changed course, determining that bump stock conversions were indeed “machine guns” and therefore prohibited by the NFA. …
Reporting On Un Security Council: Decoding Media Bias, Alessandra Loiero
Reporting On Un Security Council: Decoding Media Bias, Alessandra Loiero
Dissertations and Theses
This thesis explores Western media's representation of the United Nations (UN), focusing on the Security Council's role in global conflict resolution. It examines how UN-accredited correspondents perceive the effectiveness of the Security Council, particularly when the body faces deadlock. The study employs text analysis techniques to identify biases and perceptions in media coverage, using The New York Times' reporting on the Ukraine conflict as a case study. It illuminates framing effects in journalistic narratives, revealing how journalists subtly interject their views when reporting, often revealing unrealistic expectations and shedding light on the limitations of the UN's mandate or its inability …
Serving With Pride: Analyzing Lgbtq+ Personnel Policy In The U.S. Military, Sonja Woolley
Serving With Pride: Analyzing Lgbtq+ Personnel Policy In The U.S. Military, Sonja Woolley
CMC Senior Theses
This thesis examines the evolution of LGBTQ+ personnel policies in the U.S. military, analyzing how these changes reflect broader social transformations and the military’s role as both a mirror and catalyst in societal shifts. It traces the historical roots of discriminatory practices against queer and transgender servicemembers, identifying key periods of reform and resistance. Using institutional theory to dissect the mechanisms of policy adaptation, this paper focuses on coercive, mimetic, and normative isomorphism, which illustrate the complex interplay between external societal pressures, internal demands for legitimacy, and the professionalization of the military. Through detailed case studies, the thesis highlights how …
Shaping Modern Europe: Evaluating Napoleon Bonaparte's Governance And Impact On European Statecraft, William R. Thurman
Shaping Modern Europe: Evaluating Napoleon Bonaparte's Governance And Impact On European Statecraft, William R. Thurman
CMC Senior Theses
This thesis explores Napoleon Bonaparte’s profound impact on Europe, examining the leadership, military strategies, and reforms that reshaped European governance and law. Retracing Napoleon’s rise to power from the chaos of the French Revolution to the height of the Empire, it highlights the political acumen and strategic genius that enabled him to seize power and dominate Europe. Napoleon's reign is illustrated both as a quest for power and as a transformative movement to modernize Europe through systematic reforms in administration, law, and education.
Central to Napoleon’s vision was the Napoleonic Code, which revolutionized legal systems around the world by emphasizing …
Auden: Body/Mind, Basil Lloyd-Moffett
Auden: Body/Mind, Basil Lloyd-Moffett
CMC Senior Theses
On one hand Auden appears the most cerebral of poets. It is said that when he arrived at school, aged eight, he professed himself excited to study the different psychological types, and the cryptic verse that was to emerge over a decade later bears the scars of his reading, psychological or otherwise, as clearly as the relentlessly analytical Dichtung und Wahrheit and other late works.Absorbing and repurposing philosophical, psychological, religious, and scientific works was an essential part of his artistic strategy, and led to credible accusations of plagiarism on a number of occasions. And just as his collaborators and friends mocked …
The Impact Of Armed Drones On Human Security Goals, Sarath Kakani
The Impact Of Armed Drones On Human Security Goals, Sarath Kakani
CMC Senior Theses
The rapid proliferation of armed drones around the globe has sparked a debate on their benefits and their tradeoffs. Through a traditional security perspective, drones are the ideal weapon of the future: incredible technological capabilities lend tactical advantages to any military that owns drones. They allow actors to strike at enemy combatants without no risk to their own troops and minimal risk to any civilian bystanders. Yet through a nontraditional human security lens, armed drones have been nothing short of a disaster in protecting civilians and reducing collateral damage. The tactical advantages they lend users are some of their most …
The Trilateral Challenge: The Impact Of Russian And Chinese Nuclear Threats On U.S. Strategy, Catherine Murphy
The Trilateral Challenge: The Impact Of Russian And Chinese Nuclear Threats On U.S. Strategy, Catherine Murphy
CMC Senior Theses
The article explores the United States’ nuclear deterrence strategy in the context of rising nuclear threats from Russia and China. The U.S. arsenal has 1,770 deployed warheads across intercontinental ballistic missiles (ICBMs), submarine-launched ballistic missiles (SLBMs), and bombers. A posture set by the presidential administration continues to reject a No First Use policy, focusing on modernization and renewed arms control with Russia and China. Russia, with 1,674 deployed warheads, suspended the New START Treaty following its invasion of Ukraine. China’s secretive nuclear program estimates 500 warheads, projecting growth and emphasizing its ICBM stockpile. The China-Russia partnership poses a significant risk …
For Richer Or Poorer: The Warren Court's Relationship To Socioeconomic Class, Nicole Jonassen
For Richer Or Poorer: The Warren Court's Relationship To Socioeconomic Class, Nicole Jonassen
CMC Senior Theses
The U.S. Constitution does not enshrine socioeconomic rights. Why does this matter? Many argue that socioeconomic rights have value in and of themselves because they secure certain minimum conditions of human dignity, but socioeconomic rights also have instrumental value because abject material deprivation often makes traditional political and civil rights meaningless. In this thesis, I explore the relationship between U.S. constitutional law and socioeconomic rights through an analysis of the Warren Court’s decisions regarding socioeconomic class. In Chapter 1, I present existing literature on socioeconomic rights, socioeconomic rights in the American context, and what many scholars see as the Warren …
