Penneast Pipeline And The Policy Implications Of The Private Use Of Eminent Domain, Emily C. Wood Jan 2025

Penneast Pipeline And The Policy Implications Of The Private Use Of Eminent Domain, Emily C. Wood

Georgia Law Review

This Note considers the modern implications of the takings power in light of PennEast Pipeline Co. v. New Jersey, a 2021 U.S. Supreme Court decision holding that states do not have the right to exercise state sovereign immunity against private parties holding congressionally delegated authority. Against current environmental conditions and recent takings power history, this Note then examines the delegation power of Congress and the public policy implications of the present administrative scheme—as compared to the typical exercise of the federal eminent domain power. Finally, this Note argues that the current administrative scheme ultimately removes important decisions impacting local …

Visible, Invisible: (Levantine) Arab American Men On Mental Health, Nesreen Jaber

Theses and Dissertations

To address the dearth in psychological research and practice in regards to Arab American men, this study examined the lived experiences of seven Levantine (Belad Al Sham) Arab American men with origins in Palestine, Lebanon, and Iraq. Semi-structured interviews, Interpretive Phenomenological Analysis (IPA), and a Liberation Psychology framework were utilized to explore their definitions of mental health, their experiences of stigma, their experiences with mental health therapy, and their attitudes towards psychology and therapy. A total of seven superordinate themes emerged that highlighted the roles of gendered stigma, cultural incongruence in therapeutic praxis, Eurocentric norms in psychology, and conceptualizations of …

Targeted And Ticketed: Student Ticketing And The Perpetuation Of The School-To- Prison Pipeline, Jasmine Richardson-Rushin, Angelica Jimenez, Gwendolyn Walker, Hannah Benton Eidsath

UC Law Journal of Race and Economic Justice

The National Center for Youth Law (NCYL) is a non-profit organization working to end the harms of the juvenile, municipal and criminal legal systems, including by decriminalizing normal adolescent behavior, ending financial consequences, and improving children’s access to adequate developmentally appropriate treatment. Our work prioritizes eradicating the school-to-prison pipeline, and abolishing harmful fines, fees and economic sanctions through the Debt Free Justice Campaign (DFJ).

In school districts across the nation, students receive fees and fines as consequences for school-based behavior. Students are policed and ticketed for age-appropriate behaviors and disciplinary matters such as littering, truancy, and underage drinking and smoking. …

“Prisoners Of The Union”: Emporium Capwell And The Decline Of Concerted Activity Against Racial Discrimination, Andrew Hull Jan 2025

“Prisoners Of The Union”: Emporium Capwell And The Decline Of Concerted Activity Against Racial Discrimination, Andrew Hull

UC Law Journal of Race and Economic Justice

This paper tracks the development of judicial understanding of labor unions’ status under Section 9 of the National Labor Relations Act as the “exclusive representative” of employees for the purposes of bargaining with the employer, focusing on the how the Supreme Court case Emporium Capwell v. Western Community Addition has led to a gradual restriction of the scope of protected concerted activity by workers suffering discrimination. This ossification reveals how rigid, overly theoretical understanding of the law that is divorced from practical contexts often leads to reinforcing racial disparities in a capitalist mode of production. I further argue Emporium Capwell …

Developing A Graphql Mesh Federated Api Gateway: Rapid Integration Of New Endpoints Into A Predefined Schema, Noah Kolczynski Jan 2025

Developing A Graphql Mesh Federated Api Gateway: Rapid Integration Of New Endpoints Into A Predefined Schema, Noah Kolczynski

Dissertations, Master's Theses and Master's Reports

The Navy’s Undersea Warfare Decision Support System (USW-DSS) uses data from an ever growing number of sensors, accessible through an equally growing number of Application Programming Interfaces (APIs). Due to the lack of standardization among these sensors and APIs, as the system has continued to grow, the challenge of collecting and using these data has become increasingly prevalent. Previous work at Michigan Tech, in collaboration with engineers at ARiA (Applied Research in Acoustics LLC), introduced a GraphQL Mesh federated API gateway. The gateway would enable the combination of diverse API sources into a predefined hierarchical structure. This report follows the …

The Lived Experiences Of Physical Therapy Educators During Ethics Instruction, Erin Simunds Pt Jan 2025

The Lived Experiences Of Physical Therapy Educators During Ethics Instruction, Erin Simunds Pt

Doctorate in Education

Physical therapy educators must prepare students to navigate the ethical complexity and pressures of clinical practice. However, limited evidence exists regarding the best pedagogical strategies to develop future clinicians' ethical skills. This study aimed to explore how physical therapy ethics educators integrated their personal and professional experiences with academic elements when designing and implementing ethics instruction. The research draws from the semi-structured interviews of eight educators teaching ethics in Midwestern physical therapy programs to discover instructional patterns supporting student engagement with the content. Participants' narratives specified how curriculum design considerations, critical thinking dispositions, and organizational alignment factors influenced their approach …

Evolutive Regime Assertion For The International Military Laws Of Outer Space: U.S. Legal Problems And Solutions Relating To The International Law Of Space Warfare, Matthew Lively

South Carolina Journal of International Law and Business

This article has three interrelated purposes. It 1) makes several novel contributions to and unite problematically disparate pieces of space law scholarship, 2) illustrates a disconnection between U.S. strategic space policies and the U.S. practice of military operations in outer space, 3) offers a new framework for international military space law, Evolutive Regime Assertion, that could remedy that connection and advance U.S. strategic interests while enhancing the safety of space operations for all the world. Evolutive Regime Assertion is mostly a prescriptive framework, but some of its elements are descriptive as well. In advancing the utility of the framework, this …

An ‘Arsenal For The Supply Of Ammunition For The Defence Of Vaccination’: The Jenner Society And Anti-Anti-Vaccinationism In England, 1896–1906, Matthew L. Newsom Kerr Jan 2025

An ‘Arsenal For The Supply Of Ammunition For The Defence Of Vaccination’: The Jenner Society And Anti-Anti-Vaccinationism In England, 1896–1906, Matthew L. Newsom Kerr

History

Although historians have given close attention to the anti-vaccination movement that gripped late-Victorian England, relatively little scholarship explores how doctors and health officials responded or asks what strategies and assumptions structured how they might oppose the vaccine opponents. This article traces the advent and actions of the Jenner Society, a smallpox vaccination advocacy group founded in 1896 by Dr. Francis Bond. His goal was to publicly confront the leading anti-vaccinationists and to effectively conduct an anti-anti-vaccination campaign. The Jenner Society appeared amidst disputes over how and even whether vaccination should be publicly debated – disputes shaped both by long-standing attitudes …

A Crucible For Allotment And Assimilation: The Referendum For Ratification Of The Sioux Act Of 1889 On The Standing Rock Agency, Richard Keith Smith Jan 2025

A Crucible For Allotment And Assimilation: The Referendum For Ratification Of The Sioux Act Of 1889 On The Standing Rock Agency, Richard Keith Smith

Master's Theses or Doctor of Nursing Practice

Determining post-Civil War national policy regarding American Indians was a tedious process. Many entities could describe themselves as stakeholders in the process, stakeholders who were beholding motivations which they would describe as significant. Those motivations would, to varying degrees, take the interest of Native Americans into consideration. It was in the liminal environment of volatile policy adjustments that American Indians were compelled to make decisions regarding their future. The Dakota (Sioux) represented a crucible for the recently approved General Allotment Act of 1887. The rise of progressive tribal leadership was a primary reason for the sudden passage of the Sioux …

Inheriting Power And Pain: An Examination Of Intergenerational Influences In The Stories Of Black Women In Professional Leadership Positions, Angela Banks

Antioch University Dissertations & Theses

This study aimed to explore the stories of Black women in professional leadership roles. Grounded in a Black feminist perspective (Crenshaw, 1989) and informed by historical and intergenerational trauma (Brave Heart, 1999), this study utilized Black storytelling as a methodological framework and employed thematic analysis to examine the narratives of participants. A total of nine Black women in leadership positions across various industries participated in one-on-one interviews. The findings revealed four key themes: (1) What I saw and what others saw in me: Community leadership, (2) Instilled values: The Strong Black Woman Schema, (3) The only one: Sole representation and …

Marked By Valor: The “Lost” History Of The 6th United States Colored Troops, Heavy Artillery, Daniel William O’Sullivan Jan 2025

Marked By Valor: The “Lost” History Of The 6th United States Colored Troops, Heavy Artillery, Daniel William O’Sullivan

CGU Theses & Dissertations

“Marked by Valor: The ‘Lost’ History of the 6 th U.S.C.T., Heavy Artillery,” argues that the camaraderie of having been a Black Union soldier solidified a sub-culture of Black veterans and their families in Natchez, Mississippi, that cohered throughout the Reconstruction period using the tools and the affiliations first gained in slavery and strengthened during the soldiers’ time in the army. Underlying this narrative is an interpretation of Southern history that maintains that we cannot understand the events of the postwar period—not only for Black veterans, but to some extent all freed people—if we do not understand all that came …

Samuel Štefan Osuský’S Critique Of Church And Society In The Face Of Totalitarianism, Michal Valčo, Katarína Valčová Jan 2025

Samuel Štefan Osuský’S Critique Of Church And Society In The Face Of Totalitarianism, Michal Valčo, Katarína Valčová

Occasional Papers on Religion in Eastern Europe

This paper provides a systematic review analysis of the relevant works of Slovak philosopher and theologian Samuel Štefan Osuský (1888-1975), focusing on his critical perspective concerning the responses of the Church (mainly the Evangelical Lutheran Church of Augsburg Confession in Slovakia) and society to the ideological and political dangers of fascism and Nazism in 20th-century Central Europe. Drawing on his major writings, including his prophetic 1937 lecture "Filozofia boľševizmu, fašizmu a hitlerizmu" [The Philosophy of Bolshevism, Fascism, and Hitlerism] and the courageous 1942 "Pastiersky list k židovskej otázke" [Pastoral Letter on the Jewish Question], we explore Osuský’s diagnosis of institutional …

The Return Of War In International Politics, Chick Edmond, Nkenglefack Dessailly Forku Jan 2025

The Return Of War In International Politics, Chick Edmond, Nkenglefack Dessailly Forku

Political Science & Geography Faculty Publications

This article examines the resurgence of war in international politics after the Cold War. It contends that interstate wars have declined after 1990 and there was high optimism for stability and a cooperative international order, but contemporary conflicts have evolved into complex intrastate and asymmetric confrontations involving non-state actors, ethnic and religious divisions, resource competition, and geopolitical rivalries. The paper uses a constructivist approach and secondary qualitative data to identify and explore key drivers of this trend such as the rise of terrorist and insurgent groups, the politicization of identity, disputes over scarce resources, erosion of international norms, and intensifying …

A Forgotten Piece Of History: The Story Of The First Municipal Council Of Colombo, Sri Lanka, Chandra Richard De Silva

History Faculty Publications

The website of the Municipal Council of Colombo asserts that it was founded in 1865 (Colombo Municipal Council, 2015). This is also the story that is recounted in scholarly histories of Colombo, in modern websites and in popular accounts of the history of the city. The objective of this article is to demonstrate that Colombo had a municipal council as early as the sixteenth century and to illuminate the story of its existence for over 70 years - until well into the seventeenth century. Mocking The Malicious: Investigating John Heartfield’S Anti-Nazi Photomontages, Abigail J. Emory Jan 2025

Mocking The Malicious: Investigating John Heartfield’S Anti-Nazi Photomontages, Abigail J. Emory

Capstone Showcase

In this paper, I will discuss John Heartfield’s Dada infused photomontages, which he made in the 1930s following the rise of Adolf Hitler. During their ascension to power the Nazi regime used propaganda to glorify Hitler. The Nazi party also used a visual campaign to attack their enemies and people they deemed “inferior.” Throughout this time of media poisoning, John Heartfield created his photomontages that attacked everything the Nazis stood for. His anti-Nazi works for the Communist magazine Arbeiter Illustriere Zeitung (AIZ), covered a variety of angles including mocking Hitler as a person, pointing out the party’s greed, and exposing …

Operation Dumbo Drop: Cultural Memory, And Representations Of The Vietnam War In The 1990s, Sylvie Kromer Jan 2025

Operation Dumbo Drop: Cultural Memory, And Representations Of The Vietnam War In The 1990s, Sylvie Kromer

Scripps Senior Theses

In 1995, the film Operation Dumbo Drop was released by Walt Disney Pictures. This film, based on a true story of elephants being airlifted across Vietnam in 1968 by the American military, holds a unique position as a rare family-friendly comedy about the Vietnam War. As a reflection of 1990s-era cultural memory of the Vietnam War, the film rehistoricizes and sanitizes the war, following a similar trend in other pieces of media from the same era. Operation Dumbo Drop must be seen in this context and as a product of the moment in which it was made. In taking a …

Love Is Dead In The Restless West: Hippies, Manson, And California Culture, 1966-1970, Rebecca Allen Jan 2025

Love Is Dead In The Restless West: Hippies, Manson, And California Culture, 1966-1970, Rebecca Allen

Scripps Senior Theses

Though an extreme aberration from most of the hippie counterculture of the 1960s, Charles Manson’s ultimately murderous cult arguably represents something particular about American culture in the late sixties, in which youthful hostility towards the status quo sometimes grew radical, and in the case of the Manson Family cult, extremely violent. By the mid-sixties, more and more young people began to feel alienated by a culture they felt no longer embodied their larger aspirations, and as a result, were drawn to the emerging counterculture that embraced alternative lifestyles that frequently clashed with the traditional sensibilities of their parents’ generation. After …

Military Spouses And Family Support: A Human Services Perspective, Hannah L. Prewitt Jan 2025

Military Spouses And Family Support: A Human Services Perspective, Hannah L. Prewitt

Integrated Studies

Abstract

Mental health problems among service members and veterans continue to be one of the many challenges that service members encounter. Clearly, the cultural, structural, and institutional barriers that exacerbate these concerns need to be urgently identified. Extensive interventions include resiliency training, policies assuring confidentiality, and awareness campaigns; however, stigma is a powerful reason why service members avoid mental health treatment. The paper reviews the development of military mental health awareness throughout history, the multidimensional construct of stigma, public, self, and structural forms, and the role of perceived career risk in modulating help-seeking behavior. Social identity theory and labeling theory …

U.S. And Russian Responses To The Syrian Civil War: A Comparative Analysis, Grace Dewitt Jan 2025

U.S. And Russian Responses To The Syrian Civil War: A Comparative Analysis, Grace Dewitt

Williams Honors College, Honors Research Projects

The Syrian Civil War was among the most devastating conflicts in the 21st century and was defined by the involvement of various international actors, including the United States (U.S.) and Russia. The Syrian conflict was sparked by the Arab Spring movement. The Asad regime, which controlled the Syrian government at the time of the Arab Spring, reacted violently to the civilian protests and calls for reform. This led to the formation of organized rebel groups, creating a complex and violent civil war. The U.S. and Russia, as well as other international actors such as Turkey and Iran, became involved in …

Getting The Reader To Say “Yes”: Applying Negotiation Principles From The Books Getting To Yes And Getting Past No To Achieve Effective And Persuasive Legal Writing, Patricia G. Montana

Faculty Publications

This Article explores the relationship between the strategies of principled negotiation and effective persuasive legal writing as articulated in the best-selling books, Getting to Yes and Getting Past No. Though there is substantial scholarship advocating adding a negotiation component to legal writing instruction, there is little scholarship addressing how to apply the concepts of principled negotiation to persuasive writing itself. In this Article, the Author explains the foundational concepts of principled negotiation and then shows how they relate and apply to drafting an effective piece of persuasive legal writing. Looking at written advocacy through a negotiation lens reinforces good …

Latent Classes Of Comorbid Clinical Presentations For Patients With Psychogenic Non-Epileptic Seizures, Joseph W. Tu Jan 2025

Latent Classes Of Comorbid Clinical Presentations For Patients With Psychogenic Non-Epileptic Seizures, Joseph W. Tu

Master's Theses and Doctoral Dissertations

Psychogenic non-epileptic seizures (PNES) are episodes of motor, sensory, and/or cognitive seizures without detectable epileptic activity. The integrative cognitive model conceptualizes PNES as an activation of learned mental representations of a seizure often combined with concurrent physiological arousal. PNES are not treatable by antiepileptic medications and are often accompanied by psychiatric and medical comorbidities, complicating treatment following diagnosis. Further, individuals with PNES often incur greater medical costs through hospital admissions and emergency department visits. Multidisciplinary care including behavioral health interventions like cognitive behavior therapy have demonstrated initial success at reducing seizure frequency but impacts on healthcare utilization are unknown. Patients …
