The Diversity Rationale For Affirmative Action In Military Contracting, Hugh B. Mcclean

Section 8(a) of the Small Business Act (the ‘‘8(a) program’’) is a federal contracting program that permits the government to award certain contracts to members of designated racial groups that own small businesses. Courts have denied facial challenges to the program, but have upheld challenges alleging the program is unconstitutional as applied to particular industries. As a result, the military is banned from using the program in at least one industry, and inherits significant risk when using the program in other industries. The government has never articulated a diversity rationale to justify the use of race-conscious measures in the military …

In 2011, the Department of Defense (DoD) released its Strategy for Operating in Cyberspace, which officially recognized cyberspace as an operational domain akin to the traditional military domains of land, sea, air, and space. This monograph examines the 2015 DoD Cyber Strategy to evaluate how well its five strategic goals and associated implementation objectives define an actionable strategy to achieve three primary missions in cyberspace: defend the DoD network, defend the United States and its interests, and develop cyber capabilities to support military operations. 'A Prey To Their Teeth': Puritan Sermons And Ministerial Writings On Indians During King Philip's War, Gregory Michna

Faculty Publications - History & Political Science

King Philip’s War encouraged the construction of barbaric Native American typologies by puritan ministers through sermons and wartime histories. While select Algonquians in New England invested in a hybridized identity as a “Praying Indian” during the decades before the war, martial circumstances encouraged ministers to emphasize indigenous savagery, which outweighed earlier efforts to demonstrate the Christian piety of native converts. English texts outlining God’s providential wrath linked the contemporaneous war to Old Testament punishments meted out to the Hebrews. This typological reading of current events also superimposed the characteristics of heathen barbarians on Native Americans irrespective of their allegiance, offering …

Is the survival of constitutional democracy in America at serious risk? Given the actions of the Trump administration, and given the decline of democracy and concomitant rise of authoritarianism the world over, there is genuine cause for alarm. In light of these fears, it is worth remembering that the authors of The Federalist Papers were notably pessimistic about the survival chances of republican government. The law of free speech reflects a settled decision that, at the time that law was adopted, the dangers were worth tolerating. But people keep dreaming up nasty new things to do with speech. This article considers whether Clausewitz’s account of the nature of war is universal to all wars, in order then to assess how far his concept of victory is universal. While aspects of Clausewitz’s concept of war are still universal, others are not. Accordingly, his theory of victory is not universal to all wars, and especially not to wars fought against transnational terrorist networks.

This article examines the potential implications of the combinations of robotics, artificial intelligence, and deep learning systems on the character and nature of war. The author employs Carl von Clausewitz’s trinity concept to discuss how autonomous weapons will impact the essential elements of war. The Definition Of Slave Labor For Criminal Enforcement And The Experience Of Adjudication: The Case Of Brazil, Carlos H. B. Haddad

Michigan Journal of International Law

The paper examines the intersections and differences between “slave labor” as used in the Brazilian domestic sphere and “slave labor” as applied to international law. The former shows an approach centered on criminal law, as opposed to human rights law. This paper explains why degrading working conditions and debilitating workdays should continue to be prohibited and punished. It also compares the sanctions of the Brazilian Criminal Code with those of similar crimes in other jurisdictions. It concludes with a discussion of the current bill proposed by Senator José Sarney, which would replace the current definition with one that more closely …

This Article examines how the government’s speech in the War on Terror can threaten free speech, equal protection, and due process values. It focuses primarily on the constitutional harms threatened by the government’s speech itself (what some call a form of “soft law”), rather than on situations in which the government’s speech may be evidence of a constitutionally impermissible motive for its “hard law” actions.

The Post-Revolutionary Roles Of Fidel Castro: A Semiotic Analysis Of Cuban Political Posters, 1959-1988, Meghan Elizabeth Payne

Theses and Dissertations

This study employs semiotic methods to identify the post-revolutionary roles of former Cuban President Fidel Castro in order to classify the transformations of his character portrayal over time. Informed by Goffman's framing theory as well as suggestions of agenda-setting and priming, this qualitative study analyzes 19 propaganda posters for communications of encoded messages. In this medium, the research explores thematic patterns of sociopolitical and sociocultural signs which add to the richness of Castro's appeal. Rare earth elements (REE) contain unique chemical and physical properties such as lanthanum, are found in small concentrations, need extensive precise processes to separate, and are critical components of modern technologies such as laser guidance systems, personal electronics such as IPhones, satellites, and military weapons systems as varied as Virginia-class fast attack submarines, DDG- 51 Aegis destroyers, the F-35 Joint Strike Fighter, and precision guided munitions. The U.S. has some rare earth resources, but is heavily dependent on access to them from countries as varied as Afghanistan, Bolivia, and China.
