Culture, Religion, And Homonegativity, Erica Cecelia Dawn Leach Jan 2018

Culture, Religion, And Homonegativity, Erica Cecelia Dawn Leach

Online Theses and Dissertations

The purpose of this study was to connect possible factors that may influence homonegativity within an individual. Specifically, we hypothesized that a) high amounts of societal threats and high levels of tightness will predict orthodox orientation, which will be associated with higher levels of homonegativity, b) high amounts of societal threats and high levels of tightness will predict intrinsic orientation, which will be rated with higher levels of homonegativity, c) high amounts of societal threats and high levels of tightness with extrinsic orientation will predict high on levels of homonegativity, d) low amounts of societal threats and looseness with extrinsic …

The Popular But Unlawful Armed Reprisal, Mary Ellen O'Connell Jan 2018

The Popular But Unlawful Armed Reprisal, Mary Ellen O'Connell

Journal Articles

The United States and Iran carried out armed reprisals in Syria during 2017 in the wake of chemical and terror attacks. Despite support for their actions even by countries such as Germany and France, retaliatory uses of force are clearly prohibited under international law. International law generally prohibits all use of armed force with narrow exceptions for self-defense, United Nations Security Council authorization, and consent of a government to participate in a civil war. Military force after an incident are reprisals, which have been expressly forbidden by the UN. Prior to the Trump administration, the U.S. consistently attempted to justify …

Urban Exile: City Poetry By Modern American Women, Hatley Clifford Jan 2018

Urban Exile: City Poetry By Modern American Women, Hatley Clifford

Graduate Theses, Dissertations, and Problem Reports (ETD)

Urban Exile: City Poetry by Modern American Women examines women's experience of urbanism in the early twentieth century, as depicted in the poetry of four modernist American women writers: Edna St. Vincent Millay, Amy Lowell, Evelyn Scott, and Lola Ridge. I bring to light a common experience of urban exile: a persistent state of insecurity, displacement, damage, and marginalization of women in cities. My work brings women and American women's poetry into the critical conversation about city literature, a conversation that has mostly focused on the experience of men in cities told by male writers. Recuperating the theme of urban …

America’S Relation To World Order: Two Indictments, Two Thought Experiments, And A Misquotation, Philip C. Bobbitt Jan 2018

America’S Relation To World Order: Two Indictments, Two Thought Experiments, And A Misquotation, Philip C. Bobbitt

The State is undergoing a crisis of legitimacy owing to its inability to cope with novel problems of weapons proliferation, transnational threats including climate change, a fragile global financial infrastructure, cultural influences carried by electronic communications, and an undemocratic regime of human rights law. These fatal inadequacies are summoning forth a new constitutional order, the latest in a series of century-spanning archetypal regimes that have arisen since the Renaissance and the collapse of feudalism. A backlash against the harbingers of this new order, however, is crippling the development of those modes of action that are required to deal with the …

Sparking King's Revolution, Bernard E. Harcourt Jan 2018

Sparking King's Revolution, Bernard E. Harcourt

Faculty Scholarship

Fifty years ago, Martin Luther King, Jr., protested our country’s counterinsurgency war in Vietnam. King passionately decried the bombings and civilian deaths, the destruction of families and villages, and the herding of the population into “concentration camps.” King denounced our imperialist arrogance and urged “a radical revolution of values.” From the pulpit at Riverside Church in New York City, King declared: “These are revolutionary times.” Indeed they were. And if anything, they have become even more so today.

Effect Of Military Deployment On Diabetes Mellitus In Air Force Personnel, Irene Folaron, Mark W. True, Jana L. Wardian Phd, Tom J. Sauerwein, Alan Sim, Joshua M. Tate, Alexander G. Rittel, Lee Ann Zarzabal, Sky D. Graybill Jan 2018

Effect Of Military Deployment On Diabetes Mellitus In Air Force Personnel, Irene Folaron, Mark W. True, Jana L. Wardian Phd, Tom J. Sauerwein, Alan Sim, Joshua M. Tate, Alexander G. Rittel, Lee Ann Zarzabal, Sky D. Graybill

Journal Articles: Hospital Medicine

Introduction: Military deployments relocate service members to austere locations with limited medical capabilities, raising uncertainties whether members with diabetes can participate safely. Military regulations require a medical clearance for service members with diabetes prior to deployment, but there is a dearth of data that can guide the provider in this decision. To alleviate the lack of evidence in this area, we analyzed the change in glycated hemoglobin (HbA1c) and body mass index (BMI) before and after a deployment among active duty U.S. Air Force personnel who deployed with diabetes.

Materials and Methods: A retrospective analysis was conducted using HbA1c and …

Critique & Praxis: A Pure Theory Of Illusions, Values, And Tactics, And An Answer To The Question: "What Is To Be Done?", Bernard E. Harcourt Jan 2018

Critique & Praxis: A Pure Theory Of Illusions, Values, And Tactics, And An Answer To The Question: "What Is To Be Done?", Bernard E. Harcourt

Faculty Scholarship

We are going through an unprecedented period of political instability. With the rise of the alt-right and of xenophobic sentiment, and the fallout of neoliberal government policies, our political future is at stake. These times call for the type of critical theory and praxis that gave rise to the Frankfurt School in the 1920s and to the critical ferment of the 1970s. Yet, in the face of our crises today, contemporary critical theory seems disarmed.

Critical theory is in disarray because of a wave of anti-foundational challenges in the 1960s that shattered the epistemological foundations of the Frankfurt School. The …

Boycotting The Boycotters: Turnabout Is Fair Play Under The Commerce Clause And The Unconstitutional Conditions Doctrine, Marc A. Greendorfer Jan 2018

Boycotting The Boycotters: Turnabout Is Fair Play Under The Commerce Clause And The Unconstitutional Conditions Doctrine, Marc A. Greendorfer

Campbell Law Review

Organized boycotts are among the most powerful means of expressing a viewpoint. Boycotts have become so prevalent and persuasive in American politics and culture that many local and state governments have adopted this form of expression as well, particularly through laws and policies that prohibit state funds from being invested in, or spent to contract with, parties whose actions the state finds objectionable. While the First Amendment status of many boycotts has been robustly covered in court opinions and scholarly works, the constitutionality of state and local governments responding in kind with their own boycotts is not as well understood. …

The First Congressional Debate On Public Carry And What It Tells Us About Firearm Regionalism, Mark Anthony Frassetto Jan 2018

The First Congressional Debate On Public Carry And What It Tells Us About Firearm Regionalism, Mark Anthony Frassetto

Campbell Law Review

In the aftermath of District of Columbia v. Heller, a prominent issue remains unresolved: whether, or to what extent, the Second Amendment protects an individual right to keep and bear arms outside of the home. This Article explores this unresolved issue through a newly uncovered source, the congressional debates surrounding the District of Columbia's public carry law in the 1890s.

These debates provide new insights into the understanding of the right to keep and bear arms in the years following the drafting and ratification of the Fourteenth Amendment. Two conclusions can be drawn from the debate. First, there was no …

Gap Analysis For Student Attendance At Collegiate Athletic Events: A Demonstration Project Update, Michael Latta, Mark Mitchell Jan 2018

Gap Analysis For Student Attendance At Collegiate Athletic Events: A Demonstration Project Update, Michael Latta, Mark Mitchell

AMTP Proceedings 2018

The day after winning the 2016 NCAA College World Series, Coastal Carolina moved from the Big South Conference to the Sun Belt Conference. This move required a ‘step-up transition’ in Football from Football Championship Series (FCS) to Football Bowl Series (FBS) competition. This transition will require increased investment in student scholarships, facilities, and travel. And, the University must increase its average paid attendance for home football games by 50% more than its former stadium capacity. Researchers in the business school updated an earlier study of student attendance at collegiate athletic events in order to provide value-added and impactful information to …

When Terrorists Govern: Protecting Civilians In Conflicts With State-Building Armed Groups, Mara R. Revkin Jan 2018

When Terrorists Govern: Protecting Civilians In Conflicts With State-Building Armed Groups, Mara R. Revkin

Faculty Scholarship

Many existing U.S. counter-terrorism policies, including those governing targeting and detention, rely on an empirical assumption that terrorist groups are primarily military organizations. This assumption may be appropriate in the case of al-Qaeda, but it fails to describe terrorist groups that engage not only in warfare but also in governance and state-building such as the Islamic State, a self-declared “caliphate” that—at the height of its expansion in 2014—claimed sovereignty over an estimated 34,000 square miles and 10 million civilians. This Article identifies a category of “state-building” terrorist groups that can be distinguished by the following characteristics: (1) the presence of …

Between the foundation of Constantinople as capital of the eastern half of the Roman Empire in 330 CE and its sack by the Fourth Crusade in 1204 CE, the Byzantine Empire underwent a full cycle from political-economic stability, through rural insecurity and agrarian decline, and back to renewed prosperity. These stages plausibly correspond to the phases of over-extension (K), subsequent release (Ω) and recovery (α) of the Adaptive Cycle in Socio-Ecological Systems. Here we track and partly quantify the consequences of those changes in different regions of Anatolia, firstly for rural settlement (via regional archaeological surveys) and secondly for land …

Demonstration And Damnation: William Blake's Eternal Death Of Unbelief, Joshua Schouten De Jel Jan 2018

Demonstration And Damnation: William Blake's Eternal Death Of Unbelief, Joshua Schouten De Jel

School of Law, Humanities and Social Sciences

In Blake’s mythopoeia, as well as his personal eschatology, belief is the source of life itself; all creative acts, all visionary episodes, stem from an individual’s belief. “Eternal Death,” which is the cycle of Generation, is the result of unbelief. Francis Bacon, Isaac Newton, and John Locke were, for Blake, the triumvirate of culpable votaries for the propagation of rational reductionism which had led to the reification of “Natural Religion” in the form of Deism and Rational Dissent in England and, with the addition of Rousseau and Voltaire, of the apotheosis in France of the Cult of Reason. The French …

The Gundlach Collection : A Study Of Projectile Points From The Albeni Falls Reservoir, Jeffrey Cortlund Johnson

EWU Masters Thesis Collection

A formerly private collection of projectile points belonging to the Kalispel Tribe of Indians Cultural Resources Program provides stylistic, temporal, and geographic information for sites in the Albeni Falls Reservoir, Idaho. Specifically, there are 462 artifacts from 24 sites based on information derived from the collector’s and tribal archaeologist’s notes. Depositional information is unknown and artifacts are as surface finds. Analyses performed in this study include the morphological and technological dimensions of style, geographic and temporal distribution of artifacts by site, comparative results of obsidian x-ray fluorescence, and high-resolution photography. The results demonstrate the collection as a pragmatic dataset yielding …

The Duty To Disobey Illegal Nuclear Strike Orders, Anthony J. Colangelo Jan 2018

The Duty To Disobey Illegal Nuclear Strike Orders, Anthony J. Colangelo

Faculty Journal Articles and Book Chapters

This Article argues there is a legal duty to disobey illegal nuclear strike orders. Failure to carry out this duty may result in criminal and civil liability.Because nuclear weapons are quantitatively and qualitatively different from conventional weapons, typical legal calculations regulating their use under the laws of war or humanitarian law, as well as human rights law, change along with the change in weaponry. At least five “unique characteristics” of nuclear weapons ominously distinguish them from conventional weapons in ways that promise only to increase civilian death and suffering. First, quantitatively, the blast power, heat, and energy generated far outstrip …

Cybersecurity, including the security of information technology (IT), is a critical requirement in ensuring society trusts, and therefore can benefit from, modern technology. Problematically, though, rarely a day goes by without a news story related to how critical data has been exposed, exfiltrated, or otherwise inappropriately used or accessed as a result of supply chain vulnerabilities. From the Russian government's campaign to influence the 2016 U.S. presidential election to the September 2017 Equifax breach of more than 140-million Americans' credit reports, mitigating cyber risk has become a topic of conversation in boardrooms and the White House, on Wall Street and …

Uncovering The Lost Knowledge Of The Imagination In Films, Seda, Daniel A. Jan 2018

Uncovering The Lost Knowledge Of The Imagination In Films, Seda, Daniel A.

Journal of Conscious Evolution

Films have forever changed the way in which humans perceive reality and have provided significant opportunities to spread knowledge in ways that are both entertaining and deceptive. Uncovering the lost knowledge of the imagination shifts an individual’s perceptions of a shared experience and exposes film’s persuasive power to penetrate the psyche. This paper explores the constitutions of reality and how humans are able to tap into other realms of consciousness through mediums of creative expression. Topics such as the origins of life, the hidden knowledge of secret societies, and the burgeoning full disclosure movement for truth are discussed as a …

Promoting International Cybersecurity Cooperation: Lessons From The Proliferation Security Initiative, Duncan B. Hollis, Matthew C. Waxman

Faculty Scholarship

Global efforts by states to cooperate through international rules in combating cyber threats have generated mixed results, at best. In this paper, we examine the architecture of the Proliferation Security Initiative (PSI) as a possible model for future cybersecurity cooperation among interested states. We identify several features of PSI’s architecture (rather than its substantive focus on non-proliferation) for further analysis, including PSI’s low entry costs, tiered structure, and flexibility, as well as its leveraging of both territorial jurisdiction and state consent. We conclude that, despite several hurdles visible in the scope of its membership and its legal framework, PSI still …

Asymmetric Constitutional Hardball, Joseph Fishkin, David E. Pozen Jan 2018

Asymmetric Constitutional Hardball, Joseph Fishkin, David E. Pozen

Faculty Scholarship

Many have argued that the United States' two major political parties have experienced "asymmetric polarization" in recent decades: The Republican Party has moved significantly further to the right than the Democratic Party has moved to the left. The practice of constitutional hardball, this Essay argues, has followed a similar – and causally related – trajectory. Since at least the mid-1990s, Republican officeholders have been more likely than their Democratic counterparts to push the constitutional envelope, straining unwritten norms of governance or disrupting established constitutional understandings. Both sides have done these things. But contrary to the apparent assumption of some legal …

The Two Conversions Of John Newton: Politics & Christianity In The British Abolitionist Movement, Megan Keller Jan 2018

The Two Conversions Of John Newton: Politics & Christianity In The British Abolitionist Movement, Megan Keller

CMC Senior Theses

This thesis interrogated the relationship between abolition and the evangelical revival in Britain through the life of John Newton. Newton, though not representative of every abolitionist, was a vital figure in the movement. His influence on Hannah More and William Wilberforce along with his contributions to the Parliamentary hearings made him a key aspect of its success. How he came to fulfill that role was a long and complex journey, both in terms of his religion and his understanding of slavery. He began his life under the spiritual direction of his pious, Dissenting mother, became an atheist by nineteen, and …
