A Secret Police: The Lasting Impact Of The 1986 Foia Amendments, A.Jay Wagner Jan 2018

A Secret Police: The Lasting Impact Of The 1986 Foia Amendments, A.Jay Wagner

College of Communication Faculty Research and Publications

The 1986 Freedom of Information Act amendments were passed as a last-minute rider to Reagan-era War on Drugs legislation. The three pieces – a broad restructuring of Exemption 7, the law enforcement exemption; the addition of exclusions for law enforcement and intelligence requests; and introduction of a new fee structure – have had a lasting impact on FOIA implementation and contribute to the contemporary inability to affect police transparency. Review of the 1986 FOIA amendments’ legislative history documents the White House’s determination to loosen law enforcement oversight and congressional appeals to exaggerated fears of illicit drug users. The study considers …

The Story Of The Berlin Tunnel: What The Operations Narrative Teaches Us About Covert Conflict In An Ongoing Cold War, Jonathan Collier Jan 2018

The Story Of The Berlin Tunnel: What The Operations Narrative Teaches Us About Covert Conflict In An Ongoing Cold War, Jonathan Collier

Graduate Thesis Collection

Operation Gold (1953-56) was a collaborative covert operation between the American CIA and British SIS. The two major objectives: firstly, rebalance the state of affairs in covert activity, which the KGB had been dominating heading into the 1950s. Secondly, gain more detailed, valuable information on the state of Soviet forces throughout Europe and gain prior warning of possible information. The technological nature of the operation marks it as the beginning of a move away from traditional espionage. Understanding the narrative of Operation Gold establishes a firm foundation on which to address the development of covert activity into the modern day. …

Altruistic Punishment Theory And Inter-Group Violence, Clayton Besaw Jan 2018

Altruistic Punishment Theory And Inter-Group Violence, Clayton Besaw

Electronic Theses and Dissertations

This dissertation explores the role of altruistic punishment, the act of punishing outsiders perceived to harm members of one's group at a personal cost, in explaining individual motivations to participate in inter-group violence. It first develops a social theory of this type punishment. This theory argues that an egalitarian social logic may be key to understanding motivations of parochial altruism, and that one's social environment may influence thresholds of anger needed to induce punishment behavior. Empirically, it conducts two survey-experimental studies. The first experiment utilizes subject partisan identity in the context of American politics and hypothetical acts of violence to …

The Tragic City: Black Rebellion And The Struggle For Freedom In Miami, 1945-1990, Porsha Dossie Jan 2018

The Tragic City: Black Rebellion And The Struggle For Freedom In Miami, 1945-1990, Porsha Dossie

Electronic Theses and Dissertations

This thesis examines the creation of South Florida's tri-ethnic racial hierarchy during the postwar period, from 1945-1990. This racial hierarchy, coupled with discriminatory housing practices and police violence, created the necessary conditions for Dade County's first deadly uprising in 1968. Following the acquittal of several officers charged in the killing of an unarmed black businessman, a second uprising in 1980 culminated in three days and three nights of violent street warfare between law enforcement and black residents in Miami's northwest Liberty City neighborhood. The presence of state sanctioned violence at the hands of police in Liberty City set the stage …

Violence, Religion And Politics: The Late Republic And Augustan Age, Matthew Tuggle Jan 2018

Violence, Religion And Politics: The Late Republic And Augustan Age, Matthew Tuggle

Electronic Theses and Dissertations

Religion in the Late Republic was fused to politics. This study considers the relationship between violence, religion, and politics in the Late Republic and Augustan Age. It contends that Roman religion could encourage or discourage violence based upon the circumstances. The strain of Roman expansion on its political and religious institutions contributed to the civil discord that characterized the Late Republic, which created circumstances that were flexible enough for perspectives on each side to see the violence as justified. The ambition of a tribune, a sacrosanct office, could lead to circumvention of the traditional practices of the Senate, causing a …

Reconciling Quasi-States With The Crime Of Aggression Under The Icc Statute, Sascha Dominik Bachmann, Yasser Abdelkader Jan 2018

Reconciling Quasi-States With The Crime Of Aggression Under The Icc Statute, Sascha Dominik Bachmann, Yasser Abdelkader

Emory International Law Review

On June 11, 2010, a binding definition of the crime of aggression was finally adopted at the Review Conference of the Rome Statute in Kampala, Uganda. The Rome Statute¿s definition of the crime of aggression reflecting on existing practice leads to the assumption that State-like entities that lack universal recognition will not be covered by the Court¿s jurisdiction of the crime of aggression. Lack of clear definition of ¿State¿ in the Rome Statute gives the first indication of the implied exclusion of State-like entities from the scope of the crime of aggression. However, the most recent interpretation of the term …

Deliberative Constitutionalism In The National Security Setting, Mary B. Derosa, Milton C. Regan Jan 2018

Deliberative Constitutionalism In The National Security Setting, Mary B. Derosa, Milton C. Regan

Georgetown Law Faculty Publications and Other Works

Deliberative democracy theory maintains that authentic deliberation about matters of public concern is an essential condition for the legitimacy of political decisions. Such deliberation has two features. The first is deliberative rigor. This is deliberation guided by public-regarding reasons in a process in which persons are genuinely open to the force of the better argument. The second is transparency. This requires that requires that officials publicly explain the reasons for their decisions in terms that citizens can endorse as acceptable grounds for acting in the name of the political community.

Such requirements would seem to be especially important in the …

Orson Scott Card’S “Artifact Or Artifice”: Where It Stands After Twenty-Five Years, Jeff Lindsay Jan 2018

Orson Scott Card’S “Artifact Or Artifice”: Where It Stands After Twenty-Five Years, Jeff Lindsay

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

When Orson Scott Card wrote “The Book of Mormon: Artifact or Artifice?” in 1993, he applied keen skills as an author of fiction to help readers understand how to detect the many hidden assumptions an author brings into a text. Subtle details such as the choice of what to explain or what not to explain to readers can quickly reveal the era and environment of the author. The value of Card’s analysis is reconsidered in light of extensive Book of Mormon studies since 1993 and has been found, for the most part, to have withstood the test of time well, …

Standing Rock, The Sioux Treaties, And The Limits Of The Supremacy Clause, Carla F. Fredericks, Jesse D. Heibel

Publications

The controversy surrounding the Dakota Access Pipeline (“DAPL”) has put the peaceful plains of North Dakota in the national and international spotlight, drawing thousands of people to the confluence of the Missouri and Cannonball Rivers outside of Standing Rock Sioux Reservation for prayer and peaceful protest in defense of the Sioux Tribes’ treaties, lands, cultural property, and waters. Spanning over 7 months, including the harsh North Dakota winter, the gathering was visited by indigenous leaders and communities from around the world and represents arguably the largest gathering of indigenous peoples in the United States in more than 100 years.

Ambiguity Of High Prf Waveforms In Time Difference Of Arrival Passive Detection Systems, Mark Thomas Fleming Jan 2018

Ambiguity Of High Prf Waveforms In Time Difference Of Arrival Passive Detection Systems, Mark Thomas Fleming

Theses

This thesis documents the research on ambiguity in target position measurements by a time difference of arrival passive detection system when receiving waveforms with a high pulse repetition frequency. The thesis includes a detailed derivation of a set of multilateral equations used to compute target position estimates. A pulse correlation algorithm designed to mitigate the ambiguity incurred with high pulse repetition frequency waveforms is discussed. Simulation is used to analyze the performance of the pulse correlation algorithm.

Flannery O'Connor And Monster Theory, Katlyn Sutton Jan 2018

Flannery O'Connor And Monster Theory, Katlyn Sutton

Theses

This study will assert that Flannery O'Connor's fiction falls into the genre of horror based on the frequent occurrences of monstrousness within her works. This study proposes that there is a hierarchal system of monstrousness that can be observed in O'Connor's writing. The first level of monstrousness observed can be found through reading O'Connor's works through the author's social critique of post-World War II culture. The second level of monstrousness can be found within the characters of O'Connor's fiction. The characters who are deemed monsters are both influenced by O'Connor's social critique and the role of God within the specific …

Nobody Wanted To Speak On The True Disposition Of The World : Challenging American Historical Narratives In The Underground Railroad, Tia J. Smith Jan 2018

Nobody Wanted To Speak On The True Disposition Of The World : Challenging American Historical Narratives In The Underground Railroad, Tia J. Smith

Theses

The Underground Railroad borrows from the logic of science fiction, the epic, and the historical novel to both critique American post racialism and to upend the nation’s incomplete historical narrative of social progress. This thesis begins with approaching sf using the novel’s racial influences to contemplate science fiction criticism. It then examines the text’s adoption of the genre’s critical apparatus as a method to explore contemporary American racial politics. I analyze the novel’s structure, use of primary sources, and reenactments of historical events, interpreting them as tools to illustrate the novel’s view of the United States as an institution mired …

Source Localization Of Tripolar Electroencephalography, Christopher Toole Jan 2018

Source Localization Of Tripolar Electroencephalography, Christopher Toole

Open Access Dissertations

Knowing where sources of electroencephalography (EEG) signals are located in the brain can help with diagnosis and surgical planning for patients with epilepsy. Source localization of signals acquired on the scalp is an ill-posed problem since there are an infinite number of inverse configurations that can result in the same potential distribution on the head surface. Therefore, additional constraints to the source space must be used to find a unique solution. Distributed source methods constrain the source space to a large number of dipoles distributed on the cortical surface or within the brain, but they yield an underdetermined solution. Used …

Here Comes The Monkey! : Best Practices For Using Student Test Scores As Part Of The Teacher Evaluation Process Based On An Analysis Of Legislation And Litigation In Early-Adopting Race To The Top States, Julie Dausey Oziemkowski

Graduate Research Theses & Dissertations

Numerous lawsuits have been filed against school officials since the first Race to the Top (RTTT) monies were awarded in 2011, requiring school districts in participating states to incorporate student scores on standardized tests into their teacher evaluation processes. This study researched the history of standardized testing in the United States from Horace Mann to Common Core, the timeline of education reform in the United States, changes to state statutes in response to the federal Race to the Top program, and litigation filed in early-adopting RTTT states in response to the student growth component. It concludes with findings that provide …

The Meaning Of A Woman's Work: Refugees, Statelessness, Nationality, And The Women's International League For Peace And Freedom, 1918-1931, Monica Burney

Masters Theses

This work analyzes how the Women's International League for Peace and Freedom (WILPF) sought to influence how the League of Nations approached questions of nationality and statelessness between 1918 and 1931. Especially important were the WILPF's efforts to aid women and children who remained in Turkey following the Armenian genocide, as well as the organization's efforts to address the statelessness crisis that arose following the dissolution of Austria-Hungary. Their activism helped to pressure the League of Nations into creating the Commission of Enquiry on Deported Women and Children in Turkey and Asia Minor. Their efforts to end statelessness culminated in …

Reduction Of Ketones To Alcohols And Tertiary Amines Using 1-Hydrosilatrane, Sami E. Varjosaari Jan 2018

Reduction Of Ketones To Alcohols And Tertiary Amines Using 1-Hydrosilatrane, Sami E. Varjosaari

Graduate Research Theses & Dissertations

1-Hydrosilatrane is an easily synthesized, stable, solid silane which can be made into an efficient reducing agent in the presence of a Lewis base, by taking advantage of the properties of hypervalent silicon. Due to the simplicity of use and handling, 1-hydrosilatrane has the potential to be an appealing alternative to other more widely used reducing agents. Aromatic and aliphatic ketones were readily reduced with 1-hydrosilatrane in the presence of potassium tert-butoxide. The discovery of diastereoselectivity in the reduction of menthone, a chiral ketone, led to enantioselective reductions of prochiral ketones using chiral Lewis base activators. Enantiomeric excesses of up …

Under Pressure: Explaining Backlash Against Civil Society In The Andean Community, Noah Anders Levine Jan 2018

Under Pressure: Explaining Backlash Against Civil Society In The Andean Community, Noah Anders Levine

Pomona Senior Theses

In this thesis, I consider the trend of increasing backlash against civil society around the world. I focus on Ecuador and Peru, both democratic countries that have placed restrictions on NGOs receiving foreign funding. I examine both countries in terms of changes over time in the regulatory environment for NGOs. I ask: What factors motivated these changes? I analyze the countries with respect to three possible explanations: defending sovereignty against foreign powers, stifling internal dissent, and seeking rents. In answering this question, I draw upon the laws in question, press releases, and news reports as well as interviews with NGO …

This dissertation consists of three studies that explore the potential for relational reasoning to advance research on the facilitation of expertise in complex audit domains. Study One seeks to explicate the potential that theory and methods from relational reasoning and associated research have to advance the audit expertise research stream. The implications for future research on facilitating auditing expertise are discussed in synchrony with future research questions, including whether or not such strategies will be effective in domains with more than minor relational complexity. Studies Two and Three experimentally examine the use of metacognitive skills intended to enhance relational knowledge, …

Corporate Cybersecurity: The International Threat To Private Networks And How Regulations Can Mitigate It, Eric J. Hyla Jan 2018

Corporate Cybersecurity: The International Threat To Private Networks And How Regulations Can Mitigate It, Eric J. Hyla

Vanderbilt Journal of Entertainment & Technology Law

Cyberattacks are occurring at an accelerating pace. Foreign nations are increasingly utilizing hacking as a tool for economic gain, acts of aggression, or international political expression. At risk are US consumers'personal data, private firms' bottom line, and the economies'integrity. In response, federal and state lawmakers have issued a series of disparate, uncoordinated policies seeking to strengthen cybersecurity practices. However, recent events indicate that these policies are less than ideal. This Note suggests that a unified response to cybersecurity is required and calls for the establishment of a single, central federal agency with authority over all cybersecurity regulations. Such an agency …

Legal Jurisdiction And The Deterritorialization Of Data, Paul Schiff Berman Jan 2018

Legal Jurisdiction And The Deterritorialization Of Data, Paul Schiff Berman

GW Law Faculty Publications & Other Works

Electronic data—everything from e-mails and text messages to Facebook and Instagram posts to Twitter pronouncements to drone warfare data to search algorithms to financial transactions to cloud data storage—travels around the globe with little relationship to physical territory. In addition, all of this data is often in the custody and control of data intermediaries such as Google, Facebook, Twitter, Apple, Microsoft, Amazon, private military contractors, and so on.

Three important consequences flow from this ubiquitous technology-enabled, data-driven global societal activity. First, the territorial location of data becomes increasingly arbitrary and substantively unimportant. If I, as a U.S. citizen based in …
