The Politics Of Access: Examining Concerted State/Private Enforcement Solutions To Class Action Bans, Myriam E. Gilles Apr 2018

The Politics Of Access: Examining Concerted State/Private Enforcement Solutions To Class Action Bans, Myriam E. Gilles

Articles

Procedural and substantive constraints on the ability of ordinary people to access the civil justice system have become all too commonplace. The “justice gap” owes much to cuts in funding for legal aid and court administration, heightened pleading standards, ever-rising costs of discovery, increasingly restrictive views on standing to sue, and the co-opting of small claims court by businesses seeking to collect debts, among other obstacles in the path to the courthouse. But the most consequential impediment, surely, is the enforcement of mandatory arbitration clauses with class action bans, which bar consumers and employees from bringing or being represented in …

Mobile Bullying Among Rural South African Students: Examining The Applicability Of Existing Theories, Michael Eddie Kyobe Prof., Lucas Mimbi Dr, Phillimom Nembandona, Sive Mtshazi

The African Journal of Information Systems

Mobile bullying, which is one form of cyberbullying, is escalating in schools in South Africa. Research can contribute to better understanding of the nature of this aggression, and provide guidance in determining appropriate interventions and administration of justice. However, studies into cyberbullying tend to focus mainly on the urban environment. Rural South Africa involves a large percentage of mobile phone users and experiences in relatively different cultural and social-economic conditions. Lack of research on rural mobile bullying calls into question the applicability of existing theories of crime and cyberbullying to the rural context and their effectiveness in guiding legal and …

The Next Recruits: 16–18-Year-Olds And The United States' War On Terror, Mary E. Moyer

Capstone Collection

For many who experienced it directly or indirectly, 9/11 marked a dramatic shift as the United States processed the attacks and went from a country at peace to a country at war. Though the attacks themselves were geographically targeted, 9/11 was a nationally traumatic event and resulted in the formation of a collective memory and national narrative across the country. With the War on Terror, the military became synonymous with patriotism, as leaders and the media invoked the trauma of Pearl Harbor and the glories of World War II. Military records from the time describe patriotism as the motivation behind …

Russian Cyber Aggression And The New Cold War, Mason Shuya Apr 2018

Russian Cyber Aggression And The New Cold War, Mason Shuya

Journal of Strategic Security

Tensions between the United States and the Russian Federation have broken out into a new Cold War following Russia's actions in Ukraine. Following the seizure of Crimea and the fomenting of civil war in the Donbass, Russia was punished by an international contingent of states following the American lead in sanctioning Russia and isolating it from the world stage. With the sanctions having caused a great deal of damage to the Russian economy, the Russian government struck back by attacking the 2016 US Presidential election. Gambling on candidate Donald Trump, Russia hoped to strike the US at its heart and …

A Study Of Flight Simulation Training Time, Aircraft Training Time, And Pilot Competence As Measured By The Naval Standard Score, Aaron D. Judy

Doctor of Education (Ed.D)

The purpose of the study was to investigate the relationships between US Navy T-45C flight simulation training time, actual aircraft training time, and intermediate and advanced jet pilot competence as measured by the Naval Standard Score (NSS). Examining the relationships between US Navy T-45C flight simulation time and actual aircraft flight time may provide further information on flight simulation training versus actual aircraft training to aviation authorities, flight instructors, the military aviation community, the commercial aviation community, and academia. The study was non-experimental, correlational, causal-comparative with an emphasis upon the establishment of mathematic and predictive relationships using archival data from …

The Strategic Implications Of The Cártel De Jalisco Nueva Generación, Nathan P. Jones Apr 2018

The Strategic Implications Of The Cártel De Jalisco Nueva Generación, Nathan P. Jones

Journal of Strategic Security

Most security analysts now view the Cártel de Jalisco Nueva Generación (CJNG) as the most powerful organized crime group (OCG) in Mexico. This article explores the strategic/security implications of the rise of this new and aggressive group by providing an in-depth historical case study. The case study shows that the CJNG is a highly resilient and geographically dispersed entity that draws upon the experience of its members, which studied under the tutelage of the Milenio and Sinaloa cartels. Since 2015 the CJNG has begun “adopting orphan” criminal cells left in the wake of the US and Mexican kingpin strategy and …

Defining A Class Of Cyber Weapons As Wmd: An Examination Of The Merits, Benjamin B. Hatch Apr 2018

Defining A Class Of Cyber Weapons As Wmd: An Examination Of The Merits, Benjamin B. Hatch

Journal of Strategic Security

This article examines the merits of defining a class of offensive destructive cyber weapons as weapons of mass destruction (WMD). It analyzes the growing danger of destructive cyber weapons in the future joint operating environment and the devastating effects they may have in the physical domain. Further, it outlines evidence that specifically coded, offensive destructive cyber weapons would meet the spirit and intent of the three academic conditions for categorization as WMD. It argues the merits of categorizing a class of destructive cyber weapons as WMD, and addresses important factors required to examine advantages afforded to policy makers. Towards this …

Percepción Y Periodismo: Bohemia In 1950s Cuba, Jeffrey E. O'Brien Apr 2018

Percepción Y Periodismo: Bohemia In 1950s Cuba, Jeffrey E. O'Brien

LSU Master's Theses

Bohemia is perhaps one of the most popularly used sources among Cuban historians because of its array of content. For the vast majority of scholars, the use of Bohemia’s content is utilized to put the nature of the Cuban Revolution in perspective. Rarely have historians ever analyzed Bohemia itself, as a publication. What is intriguing is that historians who analyze the Cuban Revolution usually conclude the leit motif of the insurrection evolved around—and was prompted by—the rupture of the constitutional order. Bohemia, as a magazine committed to democracy—free speech, transparency, fair elections, and so on—provides an important way to see …

Peace Education In Kenya: Tracing Discourse And Action From The National To The Local Level, Kathleen Louise Zanoni Apr 2018

Peace Education In Kenya: Tracing Discourse And Action From The National To The Local Level, Kathleen Louise Zanoni

Doctoral Dissertations

Recent Presidential elections in Kenya (2017) resulted in a contested re-run election and demonstrated the presence of systemic corruption, a culture of impunity, and a continued rift among civil society. Deep wounds were awakened during this recent election triggering past grievances from the post-election violence in 2007-08. It is critical and timely to explore various cross-sectoral peacebuilding approaches at the national and local levels to increase the capacity of individuals to act as agents of peace. However, peacebuilders often overlook the possibilities that exist within formal education to foster spaces of resistance against direct, structural, and cultural forms of violence. …

Fault Lines: Geopolitical Rivalry In The East China Sea, Nicholas A. Dalton Apr 2018

Fault Lines: Geopolitical Rivalry In The East China Sea, Nicholas A. Dalton

Honors Theses

The Senkaku Islands dispute in the East China Sea stands as a major territorial dispute between the People’s Republic of China (PRC) and Japan. This dispute has periodically reemerged in the interactions between these two states between 1895, when the Senkaku Islands were definitively administered by Japan, and the present day. The dispute has undergone significant changes both in its emphasis by the PRC and Japan as well as what the dispute is about. At its early stages, the Senkaku Islands dispute was largely ignored by both China and Japan. Between 1971 and 1978, when the Senkaku Islands dispute became …

The International Committee Of The Red Cross Managing Neutrality In An Increasingly Public, Media-Hungry World, Mercedes C. Ramsey Apr 2018

The International Committee Of The Red Cross Managing Neutrality In An Increasingly Public, Media-Hungry World, Mercedes C. Ramsey

Honors Theses

One of the oldest humanitarian non-governmental organizations (NGOs), the International Committee of the Red Cross (ICRC) has long been a cornerstone around which all other humanitarian NGOs are built. The ICRC conforms to strict principles regarding their behavior and practices so that they can provide aid to those who need it around the globe. As NGOs began using both traditional and social media to their advantage to promote certain causes, the media and public began to push back, pressuring humanitarian NGOs to adopt some causes or speak out on others. Through analyzing ICRC media communications during both the Nigerian Civil …

Victims Of Their Own Reluctance: A Legal Analysis Of The United States And The Mine Ban Treaty, Ashley Flood Apr 2018

Victims Of Their Own Reluctance: A Legal Analysis Of The United States And The Mine Ban Treaty, Ashley Flood

Honors Thesis

This paper offers a legal analysis of the United States’ failure to join the 1997 Mine Ban Treaty under the parameters of the Law of Armed Conflict. The Law of Armed Conflict sets forth the four basic principles that govern the actions in warfare while the Mine Ban Treaty prohibits the use, stockpiling, production and transfer of anti-personnel mines. As civilians and children are falling victim to landmines every day, the International Committee of the Red Cross pushed for an international policy change that would help the humanitarian assistance as well as place an outright ban on an entire class …

“For The Homeland”: Die Deutsche Hausfrau And Reader Responses To World War I, Julie Sliva Davis Apr 2018

“For The Homeland”: Die Deutsche Hausfrau And Reader Responses To World War I, Julie Sliva Davis

History Theses & Dissertations

When the Great War broke out in the summer of 1914, many German Americans living in the United States expressed renewed support and loyalty for Germany in the German-language press. While scholars have thoroughly examined the collective experiences and sentiments of German Americans in the U.S. during World War I, particularly in their press, German-American women and their press have remained largely underrepresented. Notably, however, as evidenced by the largest nationally circulated monthly women’s journal of the time, Die Deutsche Hausfrau (The German Housewife), German-American women did indeed use their press as well to convey increasingly pro-German rhetoric in support …

Family Law And The New Access To Justice, Rebecca Aviel Apr 2018

Family Law And The New Access To Justice, Rebecca Aviel

Fordham Law Review

This Article explores whether the optimistic prospect suggested by this experience—of reform that promotes rather than inhibits access-to-justice values—is inherently limited to family law. Does the experience with family court reform offer insights that transfer to other contexts, or is family law simply too exceptional? On the one hand, family law disputes are unique in some truly important ways. It is difficult, for example, to conceive of a convincing analogue for postdivorce parenting, and what we mean by “justice” can be fundamentally different for domestic-relations litigants than for others. On the other hand, reform in family court has been driven …

7 Essential Keys To Success: Developing The Spiritual Discipline In The Leader, Bernard Winchester Apr 2018

7 Essential Keys To Success: Developing The Spiritual Discipline In The Leader, Bernard Winchester

Doctoral Dissertations and Projects

To deny that some leaders have problems, and others do not, is to deny Scripture, history, and experience. All leaders may not have as many problems as some, but all leaders do have problems. These problems are not always produced by the grass-roots membership. Leaders are often the cause of the very problems they see and deplore in the church. It is apparent that this is true when a leader has dishonored the moral standards or departed from sound doctrine. It is more often true when the leader has been indolent, failed to plan his work or work the plan, …

The observational part of the REP14-MED experiment was conducted in June 2014 in the Sardo-Balearic Basin west of Sardinia (western Mediterranean Sea). Two research vessels collected high-resolution oceanographic data by means of hydrographic casts, towed systems, and underway measurements. In addition, a vast amount of data was provided by a fleet of 11 ocean gliders, time series were available from moored instruments, and information on Lagrangian flow patterns was obtained from surface drifters and one profiling float. The spatial resolution of the observations encompasses a spectrum over 4 orders of magnitude from O(101 m) to O(105 m), and …
