Wrong Conclusion, No Resolution: United Nations Security Council Resolution 2334'S Erroneous Conclusions On The Legality Of Israeli Settlements In Judea, Samaria, And Jerusalem, Howard L. Bressler

Cardozo International & Comparative Law Review

The article challenges the prevailing view that Israeli settlements in Judea, Samaria, and Jerusalem are illegal under international law. It argues that the right of Jews to settle in these areas is rooted in the League of Nations Mandate for Palestine and reaffirmed by Article 80 of the UN Charter, which protects existing rights under international instruments. The analysis contests the validity of UN Security Council Resolution 2334 and asserts that neither the Geneva Convention nor customary international law prohibits Israeli settlements in these territories.

“Assault Weapon” Myths, E. Gregory Wallace

Southern Illinois University Law Journal

Four federal circuit courts have rejected Second Amendment challenges to “assault weapon” bans. The main target of these bans is the civilian AR-15, the most popular rifle in America. Most recently, the en banc Fourth Circuit in Kolbe v. Hogan took the unprecedented step of declaring that the AR-15 is not a protected firearm under the Second Amendment because it is functionally equivalent to the military M16. These courts have based their decisions upholding bans on the AR-15 and other “assault weapons” on certain factual claims about how these firearms operate.

World War I differed from wars of the past in a variety of ways. Thus, it created a host of modern medical and psychological problems for soldiers, military leaders, and physicians to overcome such as shell shock. Since shell shock was a relatively new phenomenon in warfare, the medical and military communities were uncertain about how to interpret its appearance and decrease its occurrence in their armed forces. This dissertation traces the consolidation of a classical Christian framework for demonology in the theological corpus of John of Damascus (c. 675 – c. 750), an eighth century Greek theologian writing in Jerusalem. When the Damascene sat down to write, I argue, there was a great variety of demonological options available to him, both in the depth of the Christian tradition, and in the ambient local imagination. John’s genius lies first in what he chose not to include, but second in his ability to synthesize a minimalistic demonology out of a complex body of material and integrate it into a …

Since the Guatemalan genocide against Maya populations (1981-1983), domestic and international human rights groups have organized truth commissions, forensic exhumations, and legal cases. These efforts to secure justice have achieved minimal success, prompting a reconsideration of the relationship among narrative testimony, visual testimony, and institutional standards of truth. Engaging the ideas of visual studies scholar, Nicholas Mirzoeff, I argue for the political importance of testimony that is critical of such standards, including those enforced by human rights’ legal paradigm. Following Mirzoeff’s understandings of “visuality” and “countervisuality,” I analyze “visual testimony” as that which acknowledges the dynamic interplay between word and …

The article critiques the differing interpretations of proximate cause under the Anti-Terrorism Act (ATA) by the Second and Seventh Circuits, arguing that the Seventh Circuit's more relaxed standard, as articulated in *Boim III*, should be adopted universally. The Second Circuit's strict standard, requiring a direct link between the defendant's actions and the terrorist act, is seen as undermining the ATA's purpose of providing remedies for victims. In contrast, the Seventh Circuit's approach, which considers the fungibility of money and imposes liability for material contributions to terrorist organizations with knowledge or reckless disregard, aligns better with the statute's intent to hold …

Nazi Germany invaded the Soviet Union on 22 June 1941. Hitler’s plan to annihilate Germany’s Eastern neighbor and populate the vast Russian expanse with his own people was as ambitious as it was adventuristic. Although it began successful, the Russo-German War quickly devolved into a quagmire as Russian troops outfought their German opponent and beat them back to Berlin. Contrary to prevailing historiography, the Wehrmacht’s loss on the Eastern Front cannot be solely attributed to a failure to equip German troops with proper winter clothing, an inadequate logistics network or Hitler’s interference in military decisions. Bankruptcy is a market for corporate control. Current bankruptcy practice offers two alternative mechanisms for effectuating changes in control of a firm: (1) a pre-plan all-asset sale under section 363(b) of the Bankruptcy Code; or (2) an asset sale or recapitalization pursuant to a plan of reorganization under section 1129 of the Code. Pre-plan sales under section 363(b) are fast, but lack the procedural protections associated with a restructuring or sale pursuant to a plan. Plan confirmation can be costly and uncertain, however. Restructuring support agreements (“RSAs”)—contractual agreements to support a future restructuring that has certain agreed-upon characteristics—appear to offer …

Rock has carefully crafted and persuasively argued a historically well-documented and powerful account of the struggles of African-Americans to achieve some level of equality and justice within the Seventh-day Adventist Church. Because of the paucity of this information within the larger Adventist historiography, his book is a much-needed work that fills a vacuum. It should be read by all Adventist leaders concerned about justice and equality within the organization.

Using Grime as a case study, I employ the analytical framework I created, that is, Musicological Discourse Analysis (MDA) as a holistic mode of analysis to contextualize Grime sociologically and musicologically. This method retheorizes genre, providing a more specific, useful, and detailed musical classification system; the sonic footprint timestamp (SFT). The MDA framework provides a generic mode of musical analysis for research projects in sociology, cultural studies, and the social sciences fields. Functional cotton fibers have a wide range of applications in domestic, commercial, and military settings, and so enhancing the properties of these materials can yield substantial benefits. Herein, we report the creation of functional fibers that are self-cleaning, anti-microbial, and protective against UV radiation. A uniform, and high surface area films of TiO2 were deposited on cotton fibers and gold/silver nanoparticles were directly incorporated on the nanostructured TiO2 surface. The synthetic method is simple and the produced TiO2 film is homogenous and the nanoparticles were shown to be effectively distributed on the surface using a simple photocatalytic reduction method. …

"In this paper I want to begin with the neoclassical supply and demand model of markets (SDM), whose static equilibrium consequences predicted outcomes far more accurately than were anticipated in laboratory experimental tests of the theory actuated by Jevons (1862, 1871; Smith, 1962). This article shares the World War I experiences of Chaplain Calvin S. Smith, son of Latter-day Saint Church President Joseph F. Smith. From 1910-1913 he served as a missionary from The Church of Jesus Christ of Latter-day Saints. Chaplain Smith was one of three Latter-day Saint chaplains who served in WWI. After commissioning, he reported for service to Camp Lewis, Washington. He saw extensive combat during three major offensives: St. Mihiel, Meuse-Argonne, and Lys-Scheldt with service in France and Belgium. He was wounded twice. In this dissertation, we study marked random measures that model stochastic networks (under attacks), status of queueing systems during vacation modes, responses to cancer treatments (such as chemotherapy and radiation), hostile actions in economics and warfare. We extend the recently developed time sensitivity technique for investigating the processes’ behavior about a fixed threshold to a novel time sensitive technique in three important directions: (1) real-time monotone stochastic processes; (2) two-dimensional signed random measures; and (3) antagonistic stochastic games with two active players and one passive player.
