Maine Law Review

Debates over the validity of Federal Rules of Civil Procedure have historically centered on the "substantive rights" restriction of the Rules Enabling Act of 1934. While Supreme Court decisions from Sibbach v. Wilson & Co. through Hanna v. Plumer and beyond have arguably deprived the restriction of any practical force, scholars have consistently favored a more rigorous interpretation of the directive that federal rules not "abridge, enlarge, or modify any substantive rights." Introduction

The Vestibular/Ocular Motor Screening (VOMS) was created as a brief clinical screening tool for identifying vestibular and ocular motor symptoms and impairments post-concussion. It was found to have predictive validity in correctly identifying concussed athletes from healthy controls. In 2018, the Military Acute Concussion Evaluation 2 (MACE2) replaced the original Military Acute Concussion Evaluation (MACE); the most prominent change between the MACE and MACE2 was the addition of the VOMS. Despite its adoption into military medicine, it is not known if the addition of the VOMS to the MACE2 is acutely helpful, and if it provides additional information for …

Ai-Enhanced Qualitative Research: Insights From Adele Clarke’S Situational Analysis Of Ted Talks, Natalija Mazeikiene, Judita Kasperiuniene

The Qualitative Report

This study explores the integration of ChatGPT-4 into the qualitative research process, focusing on the methodology of Situational Analysis by Adele Clarke and analysing TED Talks transcripts. Findings show ChatGPT's ability to process data quickly in initial coding, formulating broader categories reflecting Clarke's complexity of “situation,” recognising human and non-human elements, discourses, debates, and issues, temporal and spatial. In analysing data for different map types (situational, social worlds and arenas, positional), ChatGPT-4 “understands” their different analytical purposes, recognising different levels of abstraction and theoretical structuring. Starting in the 1970s, individuals, businesses and the public have increasingly benefited from policies prohibiting smoking indoors, saving thousands of lives and billions of dollars in healthcare expenditures. Smokefree policies to protect against secondhand smoke exposure, however, do not fully protect the public from the persistent and toxic chemical residues from tobacco smoke (also known as thirdhand smoke) that linger in indoor environments for years after smoking stops. Nor do these policies address the economic costs that individuals, businesses and the public bear in their attempts to remediate this toxic residue. Raising Awareness About Type 2 Diabetes In Adolescents Through Theatre: A Quasi-Experimental Pretest-Posttest Study, Margaret Curry

Education for preventing type 2 diabetes in adolescents should be a high priority among school officials and healthcare providers. The purpose of this research study was to educate adolescents on type 2 diabetes and to increase awareness about this disease. The Health Promotion Model developed by Nola Pender was used as the theoretical framework for this study. A quasi-experimental before-after design was used. The seventh and eighth-grade students enrolled in physical education classes at a local school were recruited. Of the 57 students recruited, 47 completed the study. A diabetes education program geared towards kindergarten through eighth grade was used. …

The medieval period in Europe saw the development of vernacular literatures, grown out of oral tradition and classical mythology, in which epic poems were a means of preserving culture, sharing a moral code, and offering solace in times of hardship. These epic poems, usually transcribed or translated in monastic scriptoria, were passed down through generations and enabled the sharing of memory via storytelling. In many ways, this early literature, rooted as it was in both the religious and the secular aspects of life in this time, was as much a part of the identity of the various European peoples as …

J.R.R. Tolkien’s alliterative verse play, “The Homecoming of Beorhtnoth Beorhthelm’ s Son,” is his critical and creative response to the Old English poem “The Battle of Maldon.” Tracing his influence on “Maldon” criticism through his “Ofermod” essay, which posits a continuum of alliterative poems dealing with the nature of heroism, from Beowulf to Sir Gawain and the Green Knight, the discussion then turns to how Tolkien can claim a place in that tradition and how critics have applied his ideas about war and heroism to some of his other works, especially The Lord of the Rings. In the longstanding debate surrounding Major League Baseball’s exemption from federal antitrust laws, recent legal developments and Supreme Court dynamics call for a reexamination of the Supreme Court’s 1922 Federal Baseball decision. Drawing parallels between the Court’s landmark decision in Dobbs v. Jackson Women’s Health Organization and the potential reconsideration of Baseball’s exemption, this paper explores the factors at play and the implications for the future of the sport.

The transition from linear to on-demand consumption of music, films and other copyrighted content on platforms like Spotify, Netflix and YouTube has given rise to the question whether authors and performers receive a fair share of streaming revenues. While these revenues are substantial and right holders may have the opportunity to control access to copyright-protected content on the basis of copyright protection, it is often not the creators themselves who benefit from growing streaming revenue and reinforced access controls. How should education governance respond to increasing polarized perspectives? Drawing on contemporary African American pragmatism, Knight-Abowitz and Sellers’s article "Pragmatist Thinking for a Populist Moment: Contingency and Racial Re-valuing in Education Governance" interrogated the critical case of Black Lives Matters and anti-critical race theory protests in the USA education governance and concluded that inquiry and deliberation are needed to embrace more pluralistic forms of democracy. In our response, in which we engage with decolonial, agonistic, and speculative theories, we share Knight-Abowitz and Sellers’s analytical framings.
