Since 1993, the Judicial Conference Committee on International Judicial Relations has coordinated outreach and exchange activities of the federal judiciary in support of rule-of-law initiatives. While the Federal Judicial Center has endeavored to publicize the Committee’s work, and members of the Committee have on occasion written and spoken about their work for the Committee, the scholarly treatment of the Committee remains sparse. What discussion does exist in the academic literature tends to depict the Committee in one of two ways. First, the Committee formed in response to the emergence of newly independent states after the 1991 Soviet collapse. Those states …

An obligation of good faith and fair dealing is implied in every common law contract and is codified in the Uniform Commercial Code (“U.C.C”). The terminology differs: Some jurisdictions refer to an “implied covenant;” others to an “implied contractual obligation;” still others to an “implied duty.” But whatever the label, the concept is understood by the vast majority of U.S. lawyers as a matter of commercial rather than entity law. And, to the vast majority of corporate lawyers, “good faith” does not mean contract law but rather conjures up an important aspect of a corporate director’s duty of loyalty.

The common law engages with social media in a manner that overlaps with defamation: seeking to balance the competing interests of free speech and protection of reputation. Employment law prompts a question as to how the law on this topic is developing. Adjudication of the concept of business reputation is the comparative focal point. Canadian employment law is developing a balance between protecting business reputation and workers’ free speech (though there are issues arising therein). This article discusses the impact of neoliberal ideologies of security governance on the laws of armed conflict, and describes how neoliberal practices of privatisation, outsourcing, and risk management within the security sector have facilitated the legalisation of atrocities. Neoliberal mentalities of governance have significantly impacted military administration in combat operations by decentralising control, by promoting discretion and freedom of action down the chain-of-command, and by institutionalising intent-based orders and standing Rules of Engagement. In the legal scholarship, the 'new governance' mode of governance advances an administrative arrangement where decision-making is shared amongst a range of actors, both public and private. The flexible, responsive, and collaborative governance orientation is intended to counter the ill effects of a coercive, top-down, state-centric, command- and-control approach to governance. Critics contend the new governance framework can displace the interests of local communities, disempower individuals, and dislodge basic human rights. The U.S. military has adopted such an adaptive approach in its own governance structure, which in this article is referred to as: the new governance "mentality." This mentality of …

A review of certain themes in the literature discussing football (soccer) in contemporary law and society, with emphasis on commodification and juridification and reference to the 2014 World Cup. Drawing on a variety of literatures it is proposed that to better understand legal dimensions of football, it is useful to review globalization theories rooted in social, economic, and cultural conditions, and contrasts the recent rapid development of literature on football in the social sciences with a narrower treatment in legal literatures. The use of the moving image in public space extends the techniques of cinema— namely superimposition, montage and apparatus/dispositif—threatening either to dehistoricize and distract or to provide new narrative and associative possibilities via public art. These techniques also serve as helpful tools for analysis drawn from cinema studies that can be applied to examples of the moving image in public space. One of the most memorable moments of the 2014 Academy Awards was Ellen DeGeneres’s famous selfie taken with Bradley Cooper, Meryl Streep, and other famous friends. This so-called “Oscar Selfie” has been estimated to be worth millions of advertising dollars for the event’s sponsor, Samsung. DeGeneres’ use of selfies as a promotional tool was novel method of documenting Hollywood’s greatest night which proved an undeniable successful. Uniquely among all industrialized nations, the United States extended no copyright protection to sound recordings until 1972. The individual aural representation captured for playback could only be protected by the common or statutory laws of individual states. This feature was carried forward into the comprehensive revision of the Copyright Act implemented on January 1, 1978. Although the Copyright Act contained a sweeping provision that brought works created prior to the legislation under federal protection, pre-1972 sound recordings were specifically exempted. Fine arts teachers are often the only specialists in their subject area at a school, placing them in a new situation without a mentor to guide them through the process. At the most elementary level, this honors study is concerned with political tension and its ability to procure political health. The study begins with a discussion in political theory, examining the contemporary theory of agonism, which accepts conflict as an inevitable fact of pluralist political society and defends it as necessary for the maintenance of democracy. The study identifies agonism’s origins in the ancient Greek agon, but also emphasizes that the first formal exposition of agonal political ideas comes in Machiavelli’s Discourses on Livy. Female sexuality is constantly restricted in public discourse in the United States. To combat this, Sophia Wallace created the Cliteracy campaign: a project that sought to challenge the stigmatization of female genitals. Wallace’s attempt to create a new language regarding female sex and sexuality revealed critical implications for how we discuss sex in American culture. For an in depth analysis, I utilized feminist, materialist, and social movement rhetorical lenses. This study revealed that while text is viewed as an objective mode of communication, however, it is ingrained with hierarchical societal constraints.
