Instrumental Music And The First Amendment, Alan K. Chen

This Article critically examines what would seem to be, but is not, an easy free speech question: whether instrumental music falls within the scope of the First Amendment. The Supreme Court has long recognized that musical expression is “speech,” but has never analyzed why this is the case. Similarly, scholarly literature is surprisingly bereft of any comprehensive examination of whether there are sound theoretical or doctrinal foundations for treating purely instrumental music as a form of constitutionally protected expression. At the direction of the Air Sea Battle (ASB) Office, and with the concurrence of the Chief of Naval Operations, Global ’14 continued to focus on the Air-Sea Battle (ASB) Concept. While Global ’12 looked at the war fighting implications associated with concept implementation, Global ’13 and Global ’14 examined the command and control (C2) of cross-domain operations (XDO) in future Anti-Access/Area-Denial (A2/AD) environments. This paper presents an adaptive thermal comfort model study in the tropical country of Malaysia. A number of researchers have been interested in applying the adaptive thermal comfort model to different climates throughout the world, but so far no study has been performed in Malaysia. For the use as a thermal comfort model, which better applies to hot and humid climates, the adaptive thermal comfort model was developed as part of this research by using the collected results from a large field study in six lecture halls with 178 students. Using Implan To Evaluate The Economic Contribution Of 4-H To Colorado And Individual Counties, Rebecca Hill

Current economic conditions have made it essential for Extension programs such as 4-H to justify continued public investments. Past studies have examined the positive youth development aspects of 4-H, but do not look at the economic contributions of the program. Using individual record book data for the state of Colorado, the study reported here analyzes the contribution of 4-H to both the state economy and individual counties. We find that Colorado 4-H contributes over $45 million dollars and 242 employees to the state economy.

Context awareness is an approach that has been receiving increasing focus in the past years. A context aware device can understand surrounding conditions and adapt its behavior accordingly to meet user demands. Mobile handheld devices offer a motivating platform for context aware applications as a result of their rapidly growing set of features and sensing abilities. This research aims at building a situational awareness model that utilizes multimodal sensor data provided through the various sensing capabilities available on a wide range of current handheld smart phones. A Proposed Segmented Precast Concrete Spherical Cap: Geometry, Structural Stability And Construction, Maha Kenawy

This study proposes the design and construction of a concrete spherical cap composed of uniformly-shaped precast doubly-curved panels based on spherical division techniques. A numerical structural analysis is conducted to study the failure behavior of the segmented structure and the capacity of the joints by using finite element modeling techniques to model the concrete material behavior, boundary conditions and intermediate joints of the precast panels. An experimental analysis is conducted to verify the capacity of the structure and the reliability of the modeling techniques, and to study the feasibility of the proposed panel prefabrication and assembly method. The New York Philharmonic Strike of 1973 is a story waiting to be told. The sole volume to mention it, John Canarina's The New York Philharmonic, devotes less than two pages to it. Until now, the full story has lain buried in archival documents, newspaper articles, and the memories of those who experienced it firsthand. This document represents the first comprehensive examination of this event. The research upon which it is based consists of: interviews with the New York Philharmonic members; research in the New York Philharmonic Archives; newspaper articles and reviews. The purpose of this project is to show that contemporary art forms, specifically popular music, film and comics/graphic novels, are capable of, and do in many cases work as philosophical pieces. I believe that an analysis of these mediums will reveal instances in which the works of art explicate established philosophical theories, expand upon them, and in some cases invent new theories.
Each new medium of art gets examined by philosophy in its turn and its merits as a unique art form are debated. From these arguments it is possible to extrapolate the ways in which these works can become …

Employing methods from print and material culture studies, this dissertation explores the economic, social, and cultural dynamics of theatrical touring during a period, 1835-1861, when the ultimate symbols of anxiety over rising industrialization, migration, and urbanization--con artists and prostitutes or "confidence men and painted women"- were associated with both theatre and transportation. I argue that touring was central to the spread of theatre culture and is therefore critical to understanding U.S. popular culture. This project examines how geographic movements, as well as the circulation of extra-theatrical materials like newspapers and photographs, were instrumental not only for performers who attempted to …

This dissertation consists of two chapters, largely self-contained, each dedicated to a different piece by Belgian composer Henri Pousseur (1929-2009). The first chapter presents a detailed survey of Pousseur's opera, Votre Faust, attempting to address all major aspects of this vast, ambitious work: origins and reception, compositional design, relationship with the Western operatic and literary tradition, formal experimentations, and harmonic innovations. The second chapter presents a detailed analysis of a work representative of Pousseur's more recent output, Les Litanies d'Icare (1993) for piano solo, focused on Pousseur's trademark techniques of parametric, serial design (technique des groupes), and …

This project is an exploration of eight plays, four from Argentina, four from Ireland, comprehending the period between 1990 and 2003. Both countries share a strong tradition of national theatre that, from its beginnings, was closely intertwined with the development of the nation state. Theatre functions in Argentina and Ireland as a medium through which representations of what it means to be Irish or Argentine have been explored, questioned, and contested. This study proposes that the influence of nineteenth century French Judaism on the Jewish communities of the Middle East from approximately 1910‐1956 has had an indelible influence on the evolution of Franco- Jewish‐Arab literature today. From the late nineteenth century, the education of the Jews of the Ottoman Empire was provided by the Paris based Alliance Israélite Universelle, an organization established by French Jews with the purpose of emancipating disadvantaged Jewish communities outside of France. The result was the establishment of Franco‐Jewish-Arab communities that regarded French education as a means of both social and economic advancement. Although the curriculum of …

Instead of describing poetry as a set of constraints or history of practices, Muriel Rukeyser calls it "one kind of knowledge." Dark Matter heeds Rukeyser's call, theorizing a poetics of the "scholar's art," in which documentary investigation, autobiographical exploration, and formal innovation are mutual, interwoven concerns. The dissertation pairs American poets Susan Howe (b. 1937) and Muriel Rukeyser (1913-1980), reading their hybrid works not through the received categories of American poetry, or through common generic and disciplinary divisions, but using an inductive methodology that takes its lead from the poets. The period 1949-1953 was one of the most inhuman times in Czechoslovak history. Almost immediately after the Communists violently took over the country in 1948, the Communist party started a campaign of terror in order to spread fear. It made the society weak and obedient. The terror never disappeared completely but it lost its enormous intensity after Stalin's death in 1953. The end of 1940s and beginning of 1950s was a time of political trials with the party insiders. This dissertation sets out to examine the finales of Robert Schumann's Piano Sonatas (opp. 11, 14, 22 [original finale]), and Fantasie (op. 17), with an especial focus on their form, which can be broadly categorized as parallel form. The introduction examines historical criticisms of Schumann's large-scale works, pointing out some of the idiosyncratic features found in Schumann's finales. Each chapter will present a comprehensive analysis of one of the finales. I make use of color diagrams in the formal analyses, which expeditiously and efficiently elucidate the repeating patterns of thematic and transitional materials; they also visually reflect the actual …

This project seeks to explain the prevalence of narratives that feature sexual violence against women in the tradition of the Anglophone novel. To this end, it posits the existence of a sadistic reading practice that coincides with readers' sympathetic identification. A sadistic reader takes pleasure in the bodily violation of the woman at the center of a novel; such a reader enters the text expecting violence, and experiences a sense of narrative gratification when the inevitable violation plays out. These expectations emerge from repeated interactions with a literary tradition in which victimized heroines are routine. To explore such sadism, I …

In the notorious "Cannibal Cop" case, New York police officer Gilberto Valle was accused of conspiring to kidnap, kill, and eat various women of his acquaintance. Valle claimed a "fantasy defense," arguing that his expression represented not conspiracy agreement, but fantasy role-play. His conviction and subsequent acquittal raised questions about the freedom of speech, thoughtcrime, and the nature of conspiracy law. Because the essence of conspiracy is agreement, it falls into the category of crimes in which pure speech is the actus reus of the offense. The present investigation focuses on how masculinities are conformed and represented in the plays of two generations of Mexican playwrights, the New Dramatists of Mexico and the younger Sixth Generation in an attempt to reflect upon recent conceptualizations of gender as well as contemporary changes in society mainly due to globalization and the impact of feminism and gay movements. Pneumonia kills 11% of children under the age of five in Egypt yearly. Studies suggest that health educational cartoons are effective ways to educate children about healthy practices to prevent diseases. The literature suggests that children tend to learn better from and imitate same-gender models more than opposite-gender models. Healthy Egyptians, a non-governmental organization, developed a health educational cartoon to educate young children on the preventative practices of pneumonia through a boy called Montasser as the main character. This thesis explores the work of two storytelling groups in Cairo through different conceptual frameworks. Affect, class politics, marginalization, art and the political are the main lenses through which I delve into the work of the groups in an attempt to understand a condition in which such groups exist and what it means to be part of a storytelling community in Cairo. Moreover, through my analysis I try to question the approaches of each group towards the issues they address, why and how they choose to tell certain stories.
