This Note will analyze industry concerns relating to the practice of granting above-the-title producer credit to individuals solely for contributing or bundling a share of a production’s capitalization, specifically by asking whether moneybundling Broadway co-producers are acting as unregistered broker-dealers in violation of applicable Security Exchange Commission (“SEC”) registration requirements. In Section I of this Note, I provide a history of Broadway producing models, so as to understand how today’s dominant model developed. In Section II, I unpack that model by describing the structure of theatrical investment vehicles and identifying the different types of Broadway producers. In Sections III and …

Judicial Conflicts And Voting Agreement: Evidence From Interruptions At Oral Argument, Tonja Jacobi, Kyle Rozema

This Article asks whether observable conflicts between Supreme Court justices—interruptions between the justices during oral arguments—can predict breakdowns in voting outcomes that occur months later. To answer this question, we built a unique dataset based on the transcripts of Supreme Court oral arguments and justice votes in cases from 1960 to 2015. We find that on average a judicial pair is seven percent less likely to vote together in a case for each interruption that occurs between them in the oral argument for that case. A headteacher recruitment crisis continues in the primary education sector (Howson & Sprigate, 2011; Rhodes et al., 2008). This research offers a voice for an increasingly marginalised group and synthesises the experiences of 15 primary headteachers, including retired, experienced and new school leaders against the changing educational scenery of four decades. An extended metaphor describing a changing epistemological landscape is utilised (Pascale, 2011), including dramaturgical discourse (Goffman, 1974). The research assesses whether the lived experiences of school leaders evidence a supposed movement away from the ‘freedom’ of the ‘secret garden’ of the pre-National Curriculum era to a time of reducing …

This article examines the tentative beginnings of Gerald Lopez's decades-long project of using storytelling as a method to describe, understand, and analyze the work of lawyers. It evaluates his 1984 article, Lay Lawyering, for its contributions to the development of narrative as a descriptive, explanatory, and critical device for compre­hending the complex and fraught work of lawyers. It begins with a detailed critique of the four parts of Lay Lawyering. In the article, Lopez first identifies problem solving and stock stories as the key concepts defining the work of the lawyer and then tells three stories from three perspectives about …

In the early 1960s, Ursula Le Guin wrote ‘The Masters’, a short novel that offers a sharp contrast to the ‘maths for all’ discourse of contemporary mathematics education reforms. Le Guin writes of a world – Edun – where ‘mathematical prohibition’ is law. Mathematical reason is banned for all people by the Priests of Edun, and failure to obey is punishable by death. Despite the threat of this totalitarian anti-math regime, some citizens create a collective heterotopia in which they practice mathematics in secret. Le Guin’s story is an opportunity to conduct a thought experiment: ‘what if maths became forbidden?’ …

This dissertation used classroom observations, movement mapping, instructor interviews, and student focus groups to examine the ways in which both instructors and students navigated the classroom spaces they were assigned in upper-level, discipline-specific courses. By focusing on three diverse disciplines (writing and rhetoric, education, and chemistry), this dissertation makes arguments about how the design of classroom spaces (as well as the tools that are housed therein) support, facilitate, and detract from a student's ability to develop a disciplinary identity, which is defined here as the social and linguistic construction of a practitioner of a discipline that is shaped by the …

Our theatre practices are just as diverse and rich as everything else in our history and often are products of the climate in which they are created. Medieval European churches utilized the stage to convey their truths to peasants and church services can be described as nothing less than a spectacle. Complete with flying set and prop pieces and grand entrances with echoing chants made for quite a sight. In this way theatre was a teaching tool.
