Vaccine Passports And The Right To Exclude: How The Court’S Holding In Cedar Point Nursery V. Hassid Could Light Fire To The Debate On The Constitutionality Of Vaccine Passport Requirements And Bans, John A. Kuzora
Campbell Law Review
The COVID-19 pandemic gave America its biggest health crisis in the last one hundred years. In efforts to resolve this crisis, several state governments have issued various types of public health measures. Three of these measures are Vaccine Mandates, Vaccine Passport Requirements, and Vaccine Passport Bans. This Comment explores the legality of these three public health measures through the unique lens of the Fifth Amendment Takings Clause. Specifically, this Comment focuses on how both Vaccine Passport Requirements and Bans infringe on property owners’ rights to include and exclude unvaccinated patrons. This, in turn, results in a physical taking under the …

The Tulsa Race Massacre: Teaching and Learning Resources
Items in this bibliography were selected for their illustrative power and are intended to serve as an introduction to some of the source material available digitally to those interested in doing historical research related to the African American community of Tulsa, Oklahoma, roughly 1910-1921. The researchers strove for balance, including materials that describe the development of North Tulsa and “Black Wall Street” before the notorious race massacre of 1921. Transcripts of news reports of that event are also included in the final section of the bibliography.

Contemporary Films And Contemporary Issues: An Introductory Film Class Curriculum, August W. Liguori-Chien
Liberal Studies (MA) Final Essays
Teachers spend years teaching students to interpret texts. This interpretive skill is deemed vital in our education system, but little time is devoted to developing students’ ability to interpret film, the most popular media students engage with. Film is an incredible amalgamation of words, motion, and music. The world of film offers students incredible opportunities to interpret, analyze, and be moved. If our students must be able to interpret literature shouldn't they also be able to do the same in the immense world of film.
This class will not focus exclusively on the history of film or the classically taught …
Leveling Up To A Reasonable Woman's Expectation Of Privacy, Victoria Schwartz
Leveling Up To A Reasonable Woman's Expectation Of Privacy, Victoria Schwartz
University of Colorado Law Review
Various privacy law doctrines involve a reasonable expectation of privacy or similar analyses that take into account social privacy norms. For the most part, however, neither courts nor scholars have explicitly grappled with whether courts descriptively do or normatively should consider gender in deciding what constitutes a reasonable expectation of privacy. This is despite the fact that, in various scenarios, a reasonable woman’s expectation of privacy might vary from a man’s in light of different lived experiences, biological differences, and existing societal gendered privacy norms.
This Article addresses how courts do and should take into account a reasonable woman’s expectation …

Lost Causes: Confederate Demobilization And The Making Of Veteran Identity, Tracy L. Barnett
Lost Causes: Confederate Demobilization And The Making Of Veteran Identity, Tracy L. Barnett
Civil War Book Review
Bradley R. Clampitt explores the “emotional lives” of Confederates as they transitioned from soldiers to civilians in Lost Causes: Confederate Demobilization and the Making of Veteran Identity. Reviewer Tracy L. Barnett writes that by using a large sample of sources including letters, journals, and questionnaires collected from Tennessee soldiers who fought in all the war’s theaters, Clampitt reveals “the Confederate mindset and details the on-the-ground process of southern demobilization” as the soldiers moved from the battlefront to the homefront.

Active Learning In Flipped Classroom And Tutorials: Complementary Or Redundant?, Matthew J. Mason, Angela M. Gayton
Active Learning In Flipped Classroom And Tutorials: Complementary Or Redundant?, Matthew J. Mason, Angela M. Gayton
International Journal for the Scholarship of Teaching & Learning
Cambridge undergraduates have regular active-learning opportunities in small-group tutorials, in which they solve problems and discuss ideas based on course material. Would they see any value in performing similar tasks in flipped-classroom settings, or would they regard the introduction of a second active-learning modality as redundant? Following the replacement of traditional lectures with flipped teaching within three physiology courses, with tutorials ongoing, questionnaire responses showed that students felt that they learned and understood more, and felt better-prepared for exams. Although similarities were recognised, the context of the active learning evidently made flipped classroom and tutorial teaching feel very different, probably …

Anxious, Disconnected And ‘Missing Out’, But Oh So Convenient: Tertiary Students’ Perspectives Of Remote Teaching And Learning With Covid-19, Melissah B. Thomas, Helen Widdop Quinton, Zali Yager
Australian Journal of Teacher Education
The higher education sector has learnt a great deal in the online delivery shift due to Covid-19, however, student voice has been underrepresented in literature. This paper reveals 15 student perspectives, including both international and domestic students, who were studying a Master of Teaching (Secondary) at one university in Melbourne, Australia, during heightened social distancing restrictions. The inductive thematic qualitative data analysis collected through semi-structured interviews showed opportunities and challenges of learning experiences. Emergent themes found affordances of convenience and challenges of relational and structural aspects of teaching and learning. Relational aspects of learning were more challenging, including peer collaboration, …

Sustainable Canons: Gadamer's Hermeneutics And Theatre, Charles A. Gillespie
Sustainable Canons: Gadamer's Hermeneutics And Theatre, Charles A. Gillespie
Catholic Studies Faculty Publications
This essay investigates Gadamer's hermeneutic theory and its application to theatre. Attention to Gadamer's views of theatre and performative interpretation provides a foundation to theorize a more sustainable canon. Classics that constitute a sustainable canon operate within a tradition through a community of interpretation that continually returns to interpret them anew. This structure also describes the theatrical repertoire. Several of Gadamer's central themes find easy analogues on stage: play, the history of effect (Wirkungsgeschichte), the participation of an audience in the fusion of horizons, and art's making present continuity the past. Gadamer provides a framework for understanding the …
Turning Over Stones: Advocating For Stronger Reporting Requirements For Opportunity Zones, Blake Stocke
Turning Over Stones: Advocating For Stronger Reporting Requirements For Opportunity Zones, Blake Stocke
Saint Louis University Law Journal
In 2017, Congress passed Sections 1400Z-1 and 1400Z-2 into the Internal Revenue Code, effectively codifying new tax legislation dubbed ‘Opportunity Zones.’ This legislation, which received bipartisan support, was meant to provide investors with a tax break to incentivize investment in low-income communities. The Opportunity Zone program is a substantial tax expenditure for Congress, and one that proponents believe can attract investment into parts of the United States suffering from diminutive economic growth. However, critics doubt this program will benefit those living in distressed communities, and fear that Opportunity Zones will instead promote gentrification while giving wealthy investors unnecessary tax breaks. …
