Effects Of The Covid-19 Crisis On Seafarers And Shipping, Raphael Baumler, María Carrera-Arce, Johan Hollander, Magnus Broström, Karolina Stark

Reports

The report is a testament to the remarkable resilience of the ships and port interface, and the adaptability of port workers and seafarers during the COVID-19 crisis. It also brings to light the vulnerabilities and trends within the sector. The ability of these workers to manage the shockwave ensured that trade flow continued, sustaining the world. However, this period had severe impacts on their livelihoods, starkly highlighting the industry’s inadequate consideration of its human element and the rapid pace of digitalization. The research employed a unique combination of quantitative and qualitative approaches to explore and cross-validate information. This included an …

Rethinking The "No-Duty" Rule: How Deshaney Can Be Reformed To Enable Objective, Coherent Analysis And Protection For More Victims Of Crime, Annaliese Brellis Jan 2024

Rethinking The "No-Duty" Rule: How Deshaney Can Be Reformed To Enable Objective, Coherent Analysis And Protection For More Victims Of Crime, Annaliese Brellis

Journal of Criminal Law and Criminology

“Failure-to-protect” cases, situations in which crime victims do not receive reasonably relied-upon police protection, receive troubling treatment under the law. This problem originated with the Supreme Court case DeShaney v. Winnebago County Department of Social Services, which held that litigants cannot bring a substantive due process claim for failure-to-protect cases. In doing so, the Court espoused a distinction between state action and inaction that relied upon unsound assumptions about state obligations and paltry factual analysis. DeShaney is troublesome because it provides only two situations in which failure-to- protect cases can be successful: physical, involuntary police custody and the state-created-danger …

The Brady Database, Brandon L. Garrett, Adam M. Gershowitz, Jennifer Teitcher Jan 2024

The Brady Database, Brandon L. Garrett, Adam M. Gershowitz, Jennifer Teitcher

Journal of Criminal Law and Criminology

The Supreme Court’s landmark ruling in Brady v. Maryland turns sixty this year. The Brady doctrine, which requires the government to disclose favorable and material evidence to the defendant, is one of the most frequently litigated criminal procedure issues. Yet, despite decades of Brady cases in federal and state courts, we still know relatively little about how Brady claims are litigated, adjudicated, and what such claims can tell us about the criminal justice system writ large. Scholars are in the dark about how often Brady violations occur, whether it is primarily the fault of prosecutors or the police, whether violations …

An Updated Practical Guide To Taking And Defending Depositions, Gary Gildin Jan 2024

An Updated Practical Guide To Taking And Defending Depositions, Gary Gildin

Faculty Scholarly Works

The deposition offers a singular opportunity to handcuff the deponent to an irreversible script. Consequently, both the attorney taking the deposition and defending counsel must prepare for and conduct the deposition with equal if not greater care than the trial.

Traditionally, lawyers have used the deposition to discover facts relating to the legal elements and the credibility, perception, and recollection of the witness. However, recent breakthroughs in neuroscience as to how the brain makes decisions have revealed a different genre of evidence that will drive how the trier of fact will decide the case. Today an attorney taking a deposition …

Beyond Medical Tourism: Pressured Exits And Global Health Justice, Medha D. Makhlouf Jan 2024

Beyond Medical Tourism: Pressured Exits And Global Health Justice, Medha D. Makhlouf

Faculty Scholarly Works

Too often, people living in the United States are compelled to take extreme measures to get the medical care they need. Most often, due to the cost, they delay or go without care. They also decline to fill prescriptions or take less medication than prescribed. Many rack up enormous debts to health care providers and other lenders. Others stand in long lines for free clinics, or they spend hours filling out applications for hospital financial assistance programs and gathering copious documentation to support them. Some people seek care from alternative providers or traditional healers because of cost concerns, while others …

Can Medical-Legal Partnerships Do More To Advance Reproductive Justice After Dobbs?, Medha D. Makhlouf, Natasha Rappazzo Jan 2024

Can Medical-Legal Partnerships Do More To Advance Reproductive Justice After Dobbs?, Medha D. Makhlouf, Natasha Rappazzo

Faculty Scholarly Works

The medical-legal partnership (MLP) and reproductive justice (RJ) movements both seek to solve complex problems, serve diverse populations with intersectional challenges, and resolve community conditions that impact people’s ability to reach their highest health potential. Yet MLPs have been overlooked as a strategy to advance reproductive health and justice. MLP has distinct advantages for advancing RJ, and many MLPs might already be doing RJ work without referring to it by name. By intentionally adopting an RJ strategy and explicitly addressing the unmet social and legal needs that limit people’s ability to plan their reproductive futures, MLPs can better serve their …

Forbidden Purposes: A New Path For Limiting Criminalization, Raff Donelson Jan 2024

Forbidden Purposes: A New Path For Limiting Criminalization, Raff Donelson

Journal of Criminal Law and Criminology

Activists and scholars have often complained that the American criminal justice system makes choices about criminalization and sentences based on nefarious reasons. For instance, critics have claimed that criminalization and sentencing decisions are made to provide cheap prison labor to the government or private industry, to boost the private prison industry, to offer employment in rural communities in the form of jobs managing correctional facilities, or to empower police to harass undesirables and remove them from public spaces. These accusations are very alarming, and the evidence may not confirm activists’ worst suspicions. But, supposing the extraordinary evidence could be adduced, …

Police Diversity Theory, Trevor George Gardner Jan 2024

Police Diversity Theory, Trevor George Gardner

Journal of Criminal Law and Criminology

In light of both the tragic death of Tyre Nichols in Memphis at the hands of Black police officers and the mixed results of studies of Black same-race policing, this Article proposes a conceptual framework by which to better understand the utility of police diversity. The framework maps the relational possibilities among three factors: (i) the Black officer’s approach to same-race policing; (ii) the Black officer’s performance in the context of same-race policing; and (iii) the policing priorities of the Black communities the Black officer is taken to represent.

Responsive to the conceptual framework for police diversity theory, the Article …

Comparative Analysis Of Form And Compass Schools In Feng Shui Architecture, Yu Peng Huang, Pat Seeumpornroj

NAKHARA (Journal of Environmental Design and Planning)

This study examines the relationship between different approaches to Feng Shui architecture, beginning with the origin of Feng Shui architecture in the Zhou and Qin Dynasties and the influence of Confucianism and Daoism. We then compare the Form and Compass Schools of Feng Shui architecture, providing insights into the design principles and spatial form analysis of traditional courtyard houses in Chaoshan and Beijing, China. This study emphasizes the need for a comprehensive understanding of Confucianist and Daoist principles in architectural practices and identifies their design criteria, safety factors, and sustainability aspects. DepthmapX software was used to analyze spaces of social …

A Quest For Gender Equity: Exploring The Existing Positioning Of Children And Teachers In An Early Childhood Classroom In Karachi Pakistan, Nasima Shakeel, Dilshad Ashraf Jan 2024

A Quest For Gender Equity: Exploring The Existing Positioning Of Children And Teachers In An Early Childhood Classroom In Karachi Pakistan, Nasima Shakeel, Dilshad Ashraf

Institute for Educational Development, Karachi

Within the framework of Sustainable Development Goals, children are recognized as active change agents in the global development agenda (The Lancet, 2022). Research has established that engaging young children has the potential to promote gender equity and reduce other inequities in society (UN Women 2020). Despite this, limited research has been conducted on gender equity issues in education and early childhood education particularly in Pakistan (Pardhan & Pelletier, 2016). In response to this gap, collaborative action research was conducted to explore the possibilities of creating a gender-equitable learning environment in an early childhood classroom in Karachi Pakistan. This paper presents …

Go With The Flow: The Psychology And Ethics Of Atomic Motion In Lucretius, Sophia Ophelia Tobár Jan 2024

Go With The Flow: The Psychology And Ethics Of Atomic Motion In Lucretius, Sophia Ophelia Tobár

Graduate School of Arts and Sciences

Lucretius innovates upon prior Epicurean philosophers by making the discussion of atomic movement in his didactic epic not just a complement to his exegesis of Epicurean philosophy, but in developing new scientific explanations for Epicurean doctrine through the principles of atomic motion. I claim that Lucretian tranquility is a kinetic phenomenon, an approach which provides new insight on the psychological and the ethical elements of his philosophy, and allows his On the Nature of Things to be brought into a fuller conversation with current scholarship on Epicurean psychology and ethics. I examine how atomic movement is emulated on the individual/psychological …

The New Yellow Dog Contract: Mandatory Arbitration Agreements And Collective Action Waivers In The Aftermath Of Epic Systems, Eric Lundy Jan 2024

The New Yellow Dog Contract: Mandatory Arbitration Agreements And Collective Action Waivers In The Aftermath Of Epic Systems, Eric Lundy

Nevada Law Journal Forum

Since the 1980s, the Supreme Court has consistently found arbitration agreements in employment contracts to be enforceable, citing a strong national policy favoring arbitration. This line of cases came to its apogee in 2018 with Epic Systems Corp. v. Lewis. The Court held that the statutory right to engage in concerted activities for the purpose of mutual aid or protection did not confer upon employees the right to bring class actions against their employer when they had signed an arbitration agreement with a collective action waiver. While the Court’s decision was widely criticized in the academic community, it sent a …

Antagonism Reduces The Effect Of Childhood Polyvictimization On Reported Psychological Distress In Adulthood, Benjamin Carsten Jan 2024

Antagonism Reduces The Effect Of Childhood Polyvictimization On Reported Psychological Distress In Adulthood, Benjamin Carsten

CURE Proceedings

The cumulative effects of childhood maltreatment (CM), or polyvictimization, are associated with increased distress. Personality traits moderate the association between trauma and distress. The present study administered questionnaires to undergraduate students (N = 485). The following hypotheses were formed: 1) Negative Affectivity (NA), Detachment, Disinhibition, Antagonism, and Psychoticism would be significantly positively correlated with distress; 2) the personality trait domains of NA, Detachment, and Psychoticism would moderate the relationship between polyvictimization and psychological distress, and; 3) the positive correlation between polyvictimization and distress would be significantly stronger than the positive correlation between total scores on the Childhood Trauma Questionnaire …

Perceived Linguistic And Non-Linguistic Barriers Facing Saudi Female Partners Learning English, Samah Mohamad Dulli

Electronic Theses and Dissertations

The partners of the Saudi students who come to the United States on scholarships to earn a degree (Bachelor's, Master's, or Ph.D.) are eligible for full scholarships as well. However, most of them fail to proceed in earning a degree or fulfill the language proficiency requirement needed to join an academic degree program. This study surveys between 10 to 20 adult female partners of Saudi university students to elicit their opinions on how much English they think they will learn during their partner scholarship time in academic and non-academic settings. This study investigates the female partners of the Saudi degree …

Punishing Poverty: An Examination Of Financial Disadvantage And Out-Of-School Suspension, Joshua Rosenbaum Jan 2024

Punishing Poverty: An Examination Of Financial Disadvantage And Out-Of-School Suspension, Joshua Rosenbaum

Electronic Theses and Dissertations

School suspension is often a response by officials to address deviant behavior within the school setting. While studies have examined various causes and consequences of school suspension, there is a dearth of literature focusing on the effects of financial disadvantage on school discipline (i.e., school suspension). Given that out-of-school suspension is a reliable predictor of juvenile justice involvement later in life, it serves as an important outcome variable in preventative criminology. Using data from the National Longitudinal Study of Adolescent to Adult Health (Add Health), the purpose of the current study is to analyze the relationship between financial disadvantage and …

Supervisory Alliance And Counselor Self-Efficacy Trends Within The Internship Experience: A Single-Case Research Design, Dylan Wren

Electronic Theses and Dissertations

Supervision provides one of the primary avenues for fostering growth and development within counselors-in-training. This supervision also impacts the evolution of counselor self-efficacy, allowing supervisors to influence supervisee’s belief in themselves and their abilities. As such, counselor education programs and state licensing boards require supervised experiences for counselors-in-training. How effective are such experiences, as measured by counselor self-efficacy and supervisory alliance? A single-case research design was employed with three participants, tracking their responses over six weeks on the Counselor Self-Efficacy Inventory and Supervisory Working Alliance Inventory - Trainee measures. Results indicated that the experience had been effective in increasing counselor …

Examining Information Systems Use To Facilitate The Workplace Accommodation Process, Shiya Cao Jan 2024

Examining Information Systems Use To Facilitate The Workplace Accommodation Process, Shiya Cao

Statistical and Data Sciences: Faculty Publications

BACKGROUND: The workplace accommodation process is often affected by ineffective and inefficient communications and information exchanges among disabled employees and other stakeholders. Information systems (IS) can play a key role in facilitating a more effective and efficient accommodation process since IS has been shown to facilitate business processes and effect positive organizational changes.

OBJECTIVE: Since there is little to no research that exists on IS use to facilitate the workplace accommodation process, this paper, as a critical first step, examines how IS have been used in the accommodation process.

METHODS: Thirty-six interviews were conducted with disabled employees from various organizations. …

Land trusts in the U.S. play an important role in preventing the loss of farmland to development. Farmers seeking affordable land may benefit from these conservation efforts. Yet the distribution of these benefits across farmer groups is unclear. This study asks: To what extent are land trusts meeting the needs of farmers and gardeners from marginalized backgrounds? Interviews with land trust staff and focus groups with marginalized farmers and gardeners in New England, USA reveal discrepancies in how diversity and land access are discussed. Access to adequate, affordable land was a serious concern among farmers and gardeners, yet few land …

Tackling Bias In Sport: Recognizing The Impact Of Identities, Meg Hancock --Assoc. Prof. Jan 2024

Tackling Bias In Sport: Recognizing The Impact Of Identities, Meg Hancock --Assoc. Prof.

Vanderbilt Journal of Entertainment & Technology Law

Studies suggest participation in organized sports--from childhood to adulthood--promotes positive physical, social, emotional, and intellectual benefits that impact individuals and their communities over a lifetime. Sports participation in early childhood and adolescence also leads to higher self-esteem, greater wage-earning potential, lower health costs, reduced chronic disease, and lower levels of depression. In adulthood, participating in sports provides social connection, personal enjoyment, and improved health. In US society, sports are often viewed as a popular, viable, and sustainable avenue for social mobility. While the benefits of sports participation are unequivocal, the visibility and influence of star athletes, along with the way …

United States Policies Related To Military-Connected Domestic Abuse: A Review And Analysis, Mary C. Highfill Jan 2024

United States Policies Related To Military-Connected Domestic Abuse: A Review And Analysis, Mary C. Highfill

Social Work Dissertations - Archive

This dissertation is comprised of three papers on United States Military policies related to domestic violence and abuse. The Department of Defense recognizes domestic abuse as a serious problem that interferes with mission readiness and causes harm to individuals. Significant work has explored antecedents of abuse, rehabilitation programs for abusive Service Members, and the experiences of uniformed survivors. However, relatively few empirical studies have investigated the policies that circumscribe domestic abuse and violence and the military’s response thereto.

The first article is a mapping review that synthesizes the peer-reviewed and gray literature related to U.S. Military policies related to domestic …
