Crawford's Revolutions, Edward K. Cheng, Monica A. Miecznikowski Jan 2024

Crawford's Revolutions, Edward K. Cheng, Monica A. Miecznikowski

University of Michigan Journal of Law Reform

Crawford v. Washington, the starting point for the Supreme Court’s modern Confrontation Clause jurisprudence, has long been described as a “revolution.” At the time of the Crawford decision, it was perfectly natural for commentators to view it as revolutionary: The case upended the existing doctrinal framework under Ohio v. Roberts, which grounded Confrontation in hearsay doctrine. In its place, the Supreme Court placed Confrontation doctrine on originalist underpinnings, requiring that any “testimonial” statement be subject to cross-examination. The resulting uncertainty was destabilizing, and in the intervening years, courts, practitioners, and commentators alike have struggled to predict and interpret …

R. V. J.J., Judicial Discretion And The Charter, Lisa Dufraimont Jan 2024

R. V. J.J., Judicial Discretion And The Charter, Lisa Dufraimont

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

In R. v. J.J., the Supreme Court of Canada upheld the new Criminal Code admissibility rules for the complainant’s private records held by the accused and the new procedural regime governing admissibility of private records and evidence of the complainant’s other sexual activity. The Court considered claims that these provisions violated section 7 and section 11(c) and 11(d) of the Canadian Charter of Rights and Freedom, and a six-member majority rejected all these claims. This paper analyzes a key theme in the majority judgment: discretion. The majority emphasized that one reason the new regime complies with the Charter is that …

Limitations And Potential Dark Sides Of Transformational Leadership: The Case Of The Founder And Former Ceo Of Theranos, Wenjuan Guo, Junnan Cui, Lucy Arendt, Jamie O'Brien

Faculty Publications - Accounting

Transformational leadership is widely recognized as an effective leadership style; however, it is important to recognize its potential misuse, where it may serve a leader’s self-interests at the expense of others, both inside and outside the organization. In this article, we present an experiential exercise that uses the case of Theranos and its founder and former CEO, Elizabeth Holmes, to highlight the limitations and potential dark sides of transformational leadership. In this exercise, students watch three YouTube videos about Holmes, identify the characteristics of Holmes that match transformational leadership, and discuss issues with her leadership style. This exercise can be …

Subjective Costs Of Tax Compliance, Jonathan H. Choi, Ariel Jurow Kleiman Jan 2024

Subjective Costs Of Tax Compliance, Jonathan H. Choi, Ariel Jurow Kleiman

Minnesota Law Review Vols. 106:2 onward (2021-present)

This Article introduces and estimates the “subjective costs” of tax compliance, which are costs of tax compliance that people experience directly and individually. To measure these costs, we conducted a survey experiment assessing how much taxpayers would pay to reduce the unpleasantness associated with filing a tax return. The experiment revealed that taxpayers are more concerned about inadvertent mistakes in their tax filings than the time spent on compliance. Respondents also only ascribed meaningful value to eliminating all tax compliance work; they ascribed essentially no value to marginal time savings. Additionally, taxpayers were indifferent between simplification services offered by a …

This article delves into the significant contributions of blind musicians to the evolution of the Spanish guitar. It begins by examining the presence of blind musicians before the 1800s, highlighting their connection to plucked instruments, the monopoly of street music maintained by the Brotherhood of the Blind, and their influence on traditional music and poetry. The discussion then explores the political motivations behind the dissolution of the brotherhood. Therapist Self-Disclosure In Teletherapy Early In The Covid-19 Pandemic: Associations With Real Relationship And Traumatic Distress, Xiaochen Luo, Katie Aafjes-Van Doorn, Vera Békés, Tracy A. Prout, Leon Hoffman

Counseling Psychology

The usefulness of therapists' self-disclosure (TSD) in psychotherapy remains controversial, and little is known regarding the potential risks and benefits of TSD in times of global crisis such as the COVID-19 pandemic and in teletherapy. We examined two independent samples of therapists (N = 1705; Study 1) and patients (N = 772; Study 2) on their perceptions of increases in TSD during the transition to teletherapy early in the COVID-19 pandemic (spring 2020). Approximately 20% of therapists and 14% of patients reported perceptions of definite increases in TSD. Therapists' top reasons for increased TSD were therapists' heightened distress …

Impossibility Of Artificial Inventors, Matt Blaszczyk Jan 2024

Impossibility Of Artificial Inventors, Matt Blaszczyk

Fellow, Adjunct, Lecturer, and Research Scholar Works

Recently, the United Kingdom Supreme Court decided that only natural persons can be considered inventors. A year before, the United States Court of Appeals for the Federal Circuit issued a similar decision. In fact, so have many the courts all over the world. This Article analyses these decisions, argues that the courts got it right, and finds that artificial inventorship is at odds with patent law doctrine, theory, and philosophy. The Article challenges the intellectual property (IP) post-humanists, exposing the analytical and normative perils of their argumentation, and recommends against getting rid of the nominally central place of humans in …

Rethinking Crime And Punishment: Women Who Kill Their Abusers In South Africa, Rebecca Gore Jan 2024

Rethinking Crime And Punishment: Women Who Kill Their Abusers In South Africa, Rebecca Gore

Michigan Journal of Gender & Law

The battered women’s movement in the United States was galvanized in the 1970s and ushered in a paradigm shift in how we understand domestic violence. For women who kill their abusers, the movement attempted to incorporate their lived experiences of domestic violence into legal doctrine. Decades later, the battered women’s movement has generated criticisms such as stereotyping women, failing to take an intersectional lens, and over-reliance on the carceral system. These lessons from feminists in the United States present cautionary tales for other contexts, especially for unequal societies impacted by domestic violence, crime, and mass incarceration. Prompted by personal experiences …

The Effects Of Early Developmental Co-Exposure To Alcohol And Nicotine Via E-Cigarettes On Anxiety- And Motor-Related Behaviors In Mice, Carley Cirafesi Jan 2024

The Effects Of Early Developmental Co-Exposure To Alcohol And Nicotine Via E-Cigarettes On Anxiety- And Motor-Related Behaviors In Mice, Carley Cirafesi

West Chester University Master’s Theses

Thirty percent of people who report consumption of alcohol while pregnant simultaneously report consuming nicotine. Prenatal co-exposure to alcohol and nicotine has increased with the popularity of electronic cigarettes due to their presumed safety, yet e-cigarette use may have a greater impact on fetal development than traditional cigarettes. Prenatal exposure to alcohol or nicotine is associated with increased anxiety-related behaviors and impaired motor coordination later in life, yet it is unknown whether prenatal co-exposure to alcohol and nicotine exacerbates these effects, particularly via e-cigarettes. This project examined the effects of co-exposure to alcohol and nicotine via e-cigarettes during early development …

Online Faculty Professional Development And Community As Nexus, John Zubizarreta, Beata M. Jones, Marca V. C. Wolfensberger

National Collegiate Honors Council Monographs: Chapters

Our goal is to share ideas and experiences related to the design of dynamic, interactive professional development opportunities that focus on learning skills for managing remote or online teaching but more importantly that create a relationship-rich sense of community. Our Honors International Faculty Learning Online (HIFLO) model is a successful example in honors, but it offers reasonably adaptable strategies that can be used in future virtual professional development ventures inside or outside of honors. No matter what other topics may be addressed in later Honors International Faculty Institute (HIFI) or HIFLO seminars, the essential principle of community will always be …

Online Education, Honors, And The Engaged University: Modeling Experiential Learning For Fully Online Students At Fort Hays State University, Kevin S. Amidon, Gregory Atkins

National Collegiate Honors Council Monographs: Chapters

This essay outlines the principles upon which the Fort Hays State University Honors Online initiative will be based and proposes ways of achieving successful honors outcomes in student-centered ways that are appropriate and meaningful to both on-campus and online cohorts. We propose a structure guided by a Community of Inquiry (COI) framework that respects and reflects the social, cognitive, and academic needs of diverse students as individuals and groups. This results in a concentric curricular model in which the student’s academic major field provides a broad, encompassing space for inner fields of co-curricular experiential learning and service. Honors staff work …

The Indiana University–Purdue University Indianapolis (IUPUI) Honors College developed a multi-layered strategy to foster interpersonal connection and a sense of belonging among incoming students as well as continued opportunities for engagement among the entire community of scholars. Via social media posts and takeovers, peer mentor commitment, and virtual activities organized and led by students, along with more traditional face-to-face events, our new students developed connections, relationships, and a sense of identity as honors scholars. Our continuing students took on new leadership roles in the honors college, displaying their talents and contributing in ways they had not before in face-to-face formats. …
