Mysterizing Religion, Marc O. Degirolami Jan 2023

Mysterizing Religion, Marc O. Degirolami

Faculty Publications

(Excerpt)

A mystery of faith is a truth of religion that escapes human understanding. The mysteries of religion are not truths that human beings happen not to know, or truths that they could know with sufficient study and application, but instead truths that they cannot know in the nature of things. In the Letter to the Colossians, St. Paul writes that as a Christian apostle, his holy office is to “bring to completion for you the word of God, the mystery hidden from ages and from generations past.” Note that Paul does not say that his task is to make …

Copyright’S Capacity Gap, Andrew Gilden, Eva E. Subotnik Jan 2023

Copyright’S Capacity Gap, Andrew Gilden, Eva E. Subotnik

Faculty Publications

Most areas of law require that individuals meet a certain threshold of capacity before their decisions — e.g., to marry, to enter into a contract, or to execute an estate plan — are given legal effect. Copyright law, by contrast, gives legal effect to creative decisions by granting the decisionmaker many decades of exclusive rights so long as they are a human being and have demonstrated a “creative spark.” This Article examines the overlooked consequences of this gap in capacity standards between copyright and other areas of law. It shows that this gap has produced numerous opportunities for vulnerable creators …

Humanizing Virtual Dispute Resolution, Elayne E. Greenberg Jan 2023

Humanizing Virtual Dispute Resolution, Elayne E. Greenberg

Faculty Publications

(Excerpt)

How might neutrals and advocates foster interpersonal dynamics when conducting arbitrations and mediations virtually, consistent with the ethical obligations of each profession and the ethical underpinnings of each process?

Virtual dispute resolution for commercial dispute resolution has become the new normal. Yet, the dispute resolution listserves are still peppered with posts from mediators and arbitrators who, although publicly extolling their own commitments to their impartiality and neutrality, are also simultaneously voicing their strong preferences for conducting their dispute resolution processes in person. According to these neutrals, they are unable to attain the same results when the process is conducted …

High Anxiety: Racism, The Law, And Legal Education, Elayne E. Greenberg Jan 2023

High Anxiety: Racism, The Law, And Legal Education, Elayne E. Greenberg

Faculty Publications

Conspicuously absent from the United States’ ongoing discourse about its racist history is a more honest discussion about the individual and personal stressors that are evoked in people when they talk about racism. What if they got it wrong? The fear of being cancelled - the public shaming for remarks that are deemed racist - has had a chilling effect on having meaningful conversations about racism. What lost opportunities!

This paper moves this discussion into the law school context. How might law schools rethink their law school curricula to more accurately represent the role systemic racism has played in shaping …

Assessing The Entrepreneurship Ecosystem In Egypt Through A Gender Lens, Hala Wasef Hattab

Business Administration

Purpose: According to the Egyptian Start-up Ecosystem Report (ITIDA, 2021), Egypt has one of the foremost start-up ecosystems on Africa, both in terms of levels of start-up activity and inward investments. Yet the county lags in terms of women’s participation in founding start-ups. According to the latest Global Entrepreneurship Monitor report for Egypt, the entrepreneurial activity rate for women was 5.7%, while that of Egyptian men was 16.7%, despite women’s positive attitudes towards entrepreneurship. Methodology: The current research has an exploratory nature and aims at analysing entrepreneurship ecosystem in Egypt through a gender lens to highlight the factors that are …

Fostering Reading: Supporting Foster Children Through Virtual Learning, Evette Harrell, Leah Washburn-Moses Jan 2023

Fostering Reading: Supporting Foster Children Through Virtual Learning, Evette Harrell, Leah Washburn-Moses

Mid-Western Educational Researcher

Professional literature presents evidence that foster care agencies, foster parents, and educators are unprepared to meet the distinctive educational needs of foster youth. Although there is a general lack of evidence on specific interventions developed for foster youth, some studies have addressed the impact of tutoring. This paper studies the impact of a pilot program that paired 15 teacher candidates with 15 foster youth for virtual reading tutoring as part of a college course. Data were collected from youth, parents, and teacher candidates through surveys and focus groups. The results of this study suggested that the tutoring relationship produced several …

Publishing In A Peer-Reviewed Journal, Sherri Lyn Horner, Christy Galletta Horner Jan 2023

Publishing In A Peer-Reviewed Journal, Sherri Lyn Horner, Christy Galletta Horner

Mid-Western Educational Researcher

In our first installment of a series of short articles, we focus on demystifying the publishing process. We first review terminology that is important for authors to understand yet is not clearly defined in easily accessible ways. Then, we describe the publishing process, beginning with preparing and submitting a manuscript, and ending with either publication or a recommendation to submit to another outlet. We provide a visual flowchart to illustrate the steps and multiple pathways in this process. Finally, we present the advice we collected from eight individuals involved in the publication process at MWER: the two current editors and …

All Means All … Maybe: Mtss Policy And Practice Across States In The United States, Aimee Howley, Darcey M. Allan, Nora L. Howley, Tanis Furst

Mid-Western Educational Researcher

Across the United States, State Education Agencies (SEAs) are using tiered strategies, such as Multi-Tiered System of Supports (MTSS) frameworks, to ensure that all students, including diverse learners, receive equal, high-quality education. However, little is known about the extent to which SEAs are encouraging use of MTSS to address the needs of students with moderate-to-severe cognitive disabilities. The present study aimed to examine how SEAs conceptualize and support the implementation of MTSS as an approach to inclusionary education. Data were collected through interviews with key informants in SEAs across 19 states. Members of the research team identified and coded portions …

Household Food Insecurity And Student Behavior: The Impact Of One School's Second Breakfast Program, Bradley S. Witzel, Elizabeth Wall-Bassett

Mid-Western Educational Researcher

Household Food Insecurity (HFI) is a frequent challenge for children living in poverty that impacts social, emotional, and behavioral development. Federally assisted meal programs, such as the National School Breakfast Program, address HFI for students living in poverty through free or reduced-price breakfast. However, there are challenges for students to take advantage of this opportunity, and it is underutilized. In this research, all middle school students at a high poverty school were offered a free of charge meal alternative called Second Chance Breakfast. Since this program was started, student participation in school breakfast increased and behavior incidences in school dropped …

Increasing Historically Underserved And Underrepresented Student Completion In Stem Pathways At A Hispanic-Serving Institution: An Action Research Study, Inez F. Olive, Kyle J. Winslow, Osurè L. Brown, Eric R. Marshall

Educational and Organizational Learning and Leadership Dissertations

There is a demand for accountability for higher education institutions to increase student completion, specifically for institutions that enroll many students from historically underserved and underrepresented populations (HUUP). Meanwhile, labor market analysis presents a demand for skilled and diverse workers in science, technology, engineering, and mathematics (STEM) fields. Hispanic-serving institutions (HSI) have an advantage when supporting student completion to meet this workforce demand. This inquiry employed participatory action research (PAR) through a partnership with an HSI in rural Washington State. Using transformative worldview as the theoretical framework, this study aimed to determine the influence of completion planning for STEM students …

Advancing Equity-Minded Leadership Practices To Improve Educational Outcomes For Black Immigrant Students: A Phenomenological Case Study, Charmaine Caroline Marshall

Educational and Organizational Learning and Leadership Dissertations

As schools become increasingly diverse, there has been increasing demand for accountability for school districts to seek to improve student performance (Portz, 2021). A qualitative phenomenological research study was used to explore how school leaders in Seattle Public Schools were responding to the academic needs of Somali immigrant students, the largest Black immigrant group in the district. By using equity mindedness as the theoretical framework, the research study examined how the response to Somali immigrant students might also promote positive outcomes for other historically marginalized and underserved students. This study recruited participants who were former and current school principals, members …

Mindfulness And Identity Awareness: Tools To Support Teachers And Leaders Towards Diversity, Equity, And Inclusion (Dei) Practices In Schools, Joslyn Williams Jan 2023

Mindfulness And Identity Awareness: Tools To Support Teachers And Leaders Towards Diversity, Equity, And Inclusion (Dei) Practices In Schools, Joslyn Williams

Educational and Organizational Learning and Leadership Dissertations

Black women are too often at the assault of policies that inflict harm and often forced to seek legal redress after exhausting all nonlegal avenues available that are supposed to ensure that learning occurs in harm-free spaces (Ward, Hardaway, and Njoku, 2022). The examination of the place and work of spirituality, reflection, and the power of remembering (Dillard, 2019) is explored through narratives of Black women, highlighting two case studies of educators from perspectives within private and public institutions.

A need exists to explore and describe the experiences of Black women teacher-leaders as they engage with diversity, equity, and inclusion …

A Portrait Of The Artist’S Heirs In Mediation: Adr Techniques To Prevent And Resolve Disputes Following An Author’S Death, Nicholas Beudert

Cardozo Journal of Conflict Resolution

If an author's work is powerful enough, or popular enough, it's likely that at some point someone will want to write about her. For scholars embarking upon these projects, the author's body of published work can provide insight into her psyche, but correspondence and other unpublished materials can also be valuable. Copyright law covers all of these materials, and when the author dies, she can bequest her copyright as she would the rest of her estate (if she hasn't transferred it during her lifetime). The recipient of these copyrights may now treat the copyrights as her own, as though she …

Caring For Fat Bodies: Bridging The Gap Between Intention And Practice In Primary Care, Sadie Pile Jan 2023

Caring For Fat Bodies: Bridging The Gap Between Intention And Practice In Primary Care, Sadie Pile

Doctor of Nursing Practice Projects

Healthcare providers work hard to support patients in optimizing their health. Typical care prioritizes use of the body mass index (BMI) which has widely been criticized for its ineffectiveness at measuring health, and which perpetuates a white European male body as “normal”. From individual care to public health policy, the measurement of health through BMI and thinness has created and enforced weight stigma. Literature over the past 20 years has continued to demonstrate the negative health impacts of weight stigma, not only in harming physiological, psychological, and behavioral health, but also in fact contributing to weight gain. Notably, the research …

At The Heart Of Leviathan: A Hobbesian Reading Of Joseph Conrad's Heart Of Darkness, Bethany Lilleyman Jan 2023

At The Heart Of Leviathan: A Hobbesian Reading Of Joseph Conrad's Heart Of Darkness, Bethany Lilleyman

Theses

This thesis demonstrates how a historical-philosophical reading of Joseph Conrad’s Heart of Darkness (1899) through the lens of Thomas Hobbes’ thought can provide new understandings of Conrad’s critique of empire, by extending existing literature on the novella’s historical and politico-philosophical ideas. As Conrad’s use of a literary-impressionistic style has often left readers debating the text’s meaning, the once-canonical novella has come under the intense scrutiny of both readers and scholars alike. This scrutiny intensified with the rise of postcolonialism in the late 1970s, which focused on the novella’s controversial representations of race and imperialism. Tensions surrounding the text have also …

Outlier State: Elite Rhetoric As A Window To Western Australian Regionalism, David Jones Jan 2023

Outlier State: Elite Rhetoric As A Window To Western Australian Regionalism, David Jones

Theses

Western Australia was the last of the Australian self-governing British colonies to agree to join the Australian Federation in 1900 and voted to secede, by a significant electoral margin, in a referendum held in 1933. Some have even argued the State has been a reluctant member of the Federation since this momentous vote. If this is the case, what evidence is there that can justify this perception, and possibly point to enduring underlying factors supporting this Western Australian regionalism sentiment and identity? Many of the drivers which led to the successful secession referendum in 1933 still exist today. The State …

Supporting Pregnant People In Prenatal Physical Activity & Exercise: Brief In-Service Training Integrating The 6 Rs Framework To Facilitate Counseling By Healthcare Professionals, Morgan Frazier

Doctor of Nursing Practice Projects

Studies show that physical inactivity in pregnancy is attributed to pregnant people receiving inadequate and incomplete prenatal physical activity and exercise (PAE) counseling from healthcare professionals (HCPs). There is a gap in the knowledge translation of prenatal PAE guidelines and pregnant people are uncertain how to safely engage in PAE. The purpose of this quality improvement project was to evaluate the effect of an online brief in-service training integrating the 6 Rs Framework on Rainier Valley Birth & Health Center HCPs’ (i.e., Certified Nurse-Midwives and Licensed Midwives) attitudes, beliefs, knowledge, and practices pertaining to antenatal PAE. Quantitative data was collected …

Evaluating The Effectiveness Of Family-Based Treatment Education On Provider's Knowledge, Anticipatory Use, And Attitudes Who Treat Adolescent Patients Diagnosed With Anorexia Nervosa, Treven Back

DNP Projects

Background. Anorexia Nervosa is a chronic, disabling, and costly disease with a higher mortality rate than any other psychiatric illness. Because of the need for medical, psychiatric, and nutritional care, treatment is complex. The current literature supports Family-Based Treatment as a first-line treatment for adolescent patients diagnosed with Anorexia Nervosa. However, a gap exists between translating family-based treatments into clinical practice. Literature shows that education and understanding providers' attitudes and beliefs are the first steps to successfully implementing family-based treatments.

Purpose. This DNP project aimed to evaluate the effectiveness of a family-based treatment education intervention on providers' attitudes, knowledge, and …
