Torts, Kelly Cahill Timmons Dec 2025

Torts, Kelly Cahill Timmons

Mercer Law Review

2024–2025 was a big year for tort law in Georgia, particularly on the legislative side. Governor Brian Kemp achieved his primary goal for the 2025 legislative session, working with the Georgia General Assembly to enact significant tort reform measures. These measures change Georgia law on the collateral source rule, the relevance of seatbelt evidence, and—most notably—in the area of negligent security. All of these changes benefit tort defendants. The Supreme Court of Georgia also made its mark on tort law during the Survey period, deciding several cases involving the liability of professionals and adopting rules that— more often than not—benefited …

Between Relevance And Remedy: Trial Court Discretion In Georgia Evidence Law, John E. Hall Jr., W. Scott Henwood, Rebekah Mabe Dec 2025

Between Relevance And Remedy: Trial Court Discretion In Georgia Evidence Law, John E. Hall Jr., W. Scott Henwood, Rebekah Mabe

Mercer Law Review

The admissibility of evidence in Georgia civil litigation continues to rest on a foundational principle: deference to the trial court’s discretion. Georgia appellate courts have consistently reaffirmed that evidentiary rulings—particularly those involving complex or fact-sensitive considerations—will not be disturbed absent a clear abuse of discretion. This standard reflects the institutional competence of trial courts, which are uniquely positioned to evaluate the credibility of parties, assess the probative value of evidence, and manage the presentation of issues throughout the course of litigation. While portions of Georgia’s Evidence Code closely mirror the Federal Rules of Evidence—permitting persuasive use of federal case law …

Insurance, Jessica M. Phillips, Rebecca E. Strickland, Kori E. Wagner Dec 2025

Insurance, Jessica M. Phillips, Rebecca E. Strickland, Kori E. Wagner

Mercer Law Review

During this Survey period, the courts in Georgia issued several meaningful decisions in the area of insurance. In the first party context, the court reinforced its disfavor for litigants taking inconsistent legal positions to their benefit by reinforcing the robust application of the doctrine of judicial estoppel. In addition, Georgia courts revisited the propriety of the manner in which an insurance carrier evaluates actual cash value for the purposes of determining recovery for diminution in value in property claims involving damage to automobiles. Finally, courts expanded the ability of plaintiffs to recover damages for claims other than breach of contract …

Workers’ Compensation, H. Michael Bagley, J. Benson Ward Dec 2025

Workers’ Compensation, H. Michael Bagley, J. Benson Ward

Mercer Law Review

This Survey period saw notable decisions from Georgia’s appellate courts addressing issues including a potential limiting effect on employees’ misrepresentations in the hiring process, the refusal of suitable light duty work, and application of the exclusive remedy provision to civil suits. There was no notable legislation, as the legislature was instead occupied with the “tort reform” bill, Senate Bill 68, which includes virtually no reference to workers’ compensation.

I Can’T Even With This Thesis: A Syntactic And Pragmatic Analysis, Ester Luna

Yale Working Papers in Grammatical Diversity

This project focuses on the construction I can’t even, a sentence coined in the early 2000s that expresses a speaker’s strong emotion to the point where they are lost for words. The most typical emotion conveyed using I can’t even is exasperation, as in example (1), but it can also be an indication of extreme happiness, like in (2).

  • (1) He tried to get my number AGAIN. I can’t even.
  • (2) You came all the way from New York to watch me perform? I can’t even.

While the modal can and the adverb even normally require the …

Effectiveness Of Picture Exchange Communication System On Functional Communication For Saudi Children With Autism Spectrum Disorder (Asd), Mohammed Albahrani Dec 2025

Effectiveness Of Picture Exchange Communication System On Functional Communication For Saudi Children With Autism Spectrum Disorder (Asd), Mohammed Albahrani

Electronic Theses and Dissertations

Autism Spectrum Disorder (ASD) is a complex neurodevelopmental disorder characterized by restricted interests, repetitive or inflexible behaviors, and challenges with communication and socialization (Flannery & Wisner-Carlson, 2020). Children with expressive communication disorders, including those with ASD, can benefit from using Augmentative and Alternative Communication (AAC) as a tool to improve their communication skills (Chazin et al., 2016). The AAC approach helps them learn and communicate more effectively by addressing various needs, such as making requests, commenting, or responding to questions (Mirenda, 2001). Many families, special education classrooms, and inclusive settings have adopted the Picture Exchange Communication System (PECS), an evidence-based …

Substantial Contribution Of Woody Components To Rainfall Interception In Chinese Forests: Insights From A Refined Analytical Model, Zhi-Ang Chen, Zhi-Yun Jiang, Wei He, John T. Van Stan Ii, Et. Al. Dec 2025

Substantial Contribution Of Woody Components To Rainfall Interception In Chinese Forests: Insights From A Refined Analytical Model, Zhi-Ang Chen, Zhi-Yun Jiang, Wei He, John T. Van Stan Ii, Et. Al.

Biological, Geological, and Environmental Faculty Publications

Assessing rainfall interception (I-R) is a critical yet uncertain aspect in hydrological cycle, particularly the quantification of relative contributions from leaves and woody components (e.g., branches, stems, and trunks) to I-R. Nevertheless, the role of woody components in I-R estimation remains largely unexplored and thereby has been constantly overlooked. This study addressed this challenge and refined the widely-used Gash model to distinguish woody interception (I-W) from leaf interception (I-L). We incorporated the spatial variability of vegetation traits alongside satellite data in 2019 into the refined model, and spanned China's major forest types. The refined model showed a strong agreement with …

Control Techniques And Design Of Load-Side Controls For The Mitigation Of Late-Time High-Altitude Electromagnetic Pulse, Connor A. Lehman, Rush Robinett, Wayne Weaver, David G. Wilson Dec 2025

Control Techniques And Design Of Load-Side Controls For The Mitigation Of Late-Time High-Altitude Electromagnetic Pulse, Connor A. Lehman, Rush Robinett, Wayne Weaver, David G. Wilson

Michigan Tech Publications

This paper introduces a novel control archetype designed to mitigate high-altitude electromagnetic pulse (HEMP) (Formula presented.) disturbances on the power grid, as well as information on performance and specifications of different control laws for the controller archetype. This method of protection has been overlooked in the literature until now. A controlled voltage supply is placed on the load-side of a transformer, diverting unwanted power from the transformer core to prevent saturation. The controlled voltage source is modeled using four control laws: an integral controller (capacitor), Linear Quadratic Regulator (LQR), an energy storage minimized feedforward control law, and a Hamiltonian feedback …

Structural Framework And Tectonic Implications From Field Investigations In The Ramelau Mountains, Timor-Leste, Tanner A. Nielsen

Theses and Dissertations

Recent advances in petroleum exploration off the southern coast of Timor-Leste and emerging mineral discoveries onshore have underscored the need for a more comprehensive structural understanding of the nation's geology. Although new structural models have been proposed for other parts of Timor, limited progress has been made toward developing detailed models for the Ramelau Mountains, which presents the highest structural relief of the Timor Ranges. Previous mapping in this area has been largely reconnaissance in nature and focused primarily on surface bedrock geology. This study presents a new 1:62,500-scale geologic map and a geometric structural analysis of the Ramelau region …

Faculty Research 2025

Cardiomyocytes endure physical stress from the myocardium environment while generating their own mechanical strains. The force generated by sarcomeres is transmitted both longitudinally to adjacent sarcomeres and laterally to the cytoskeleton via intermediate filaments. This mechanical stimulus impacts other organelles, including the nucleus, thus playing a vital role in sensing and signaling nuclear adaptations. However, there is limited understanding of how changes in cardiac contractility affect nuclear mechanics. Here, we sought to investigate the effects of hyper- and hypo-contractility in nuclei of human induced pluripotent stem cell-derived cardiomyocytes (hiPSC-CMs) bearing TNNT2 pathogenic variants associated with hypertrophic (HCM) or dilated (DCM) …

The Neverending Manifestations Of Gambling In Children’S Spaces, Brandon M. Malave Dec 2025

The Neverending Manifestations Of Gambling In Children’S Spaces, Brandon M. Malave

Capstones

The pervasiveness of gambling in American culture has gotten out of control. Unlike traditional casinos of that are easily recognizable by their slot machines and blackjack tables, these contemporary forms of gambling lurk in spaces that children frequent, specifically within popular culture. My experiences in contemporary gambling within the computer game Counter-Strike and trading card games like Magic: The Gathering, is following along the century long trend of exploiting culture to generate wealth. Should this continue, gambling will continue to manifest in spaces that it should never be allowed to exist in.

Gowanus Faces A Hidden Threat Beneath Its Neighborhood Boom, Emma J. Rosenberg Dec 2025

Gowanus Faces A Hidden Threat Beneath Its Neighborhood Boom, Emma J. Rosenberg

Capstones

This article investigates urban redevelopment, climate change and environmental contamination in Brooklyn’s Gowanus neighborhood. The Gowanus Canal itself has been a designated EPA Federal Superfund Site since 2010, this designation does not apply to the land surrounding it where legacy industrial contamination still exists. This includes coal tar from former manufactured gas plants which poses a risk to groundwater and indoor air. Under a 2021 rezoning plan, large-scale residential redevelopment is rapidly moving forward, rising groundwater and increased flooding associated with climate change may exacerbate contaminants. Utilizing agency documents, Community Advisory Group meetings, and conversations with residents, advocates, officials and …

Amidst The Struggles, Nyc Actors Say The Pursuit Of Their Craft Is Always Worth It, Allison Dubrow Dec 2025

Amidst The Struggles, Nyc Actors Say The Pursuit Of Their Craft Is Always Worth It, Allison Dubrow

Capstones

Despite high ticket prices and safety concerns, Broadway has had a record-breaking season, surpassing pre-pandemic box office revenue largely due to star-driven productions. While the industry is financially thriving, many NYC actors struggle to make a livable wage and rely on non-acting jobs to support themselves. The uncertainty of auditions and booking work makes sustaining an acting career especially difficult in such a competitive city. This project highlights the contrast between Broadway’s success and the resilience it takes for actors to survive and pursue their craft in New York City.

Relief, At A Cost: New Bill Forces Landlords To Offer Ac, But Leaves Tenants With The Bill, Niamh Mcauliffe

Capstones

As summers in New York City are getting hotter and hotter every year due to climate change, lack of home air conditioning is a serious issue. A newly passed City Council bill would require landlords to provide air conditioning upon tenant request. While advocates see the legislation as a necessary step to protect tenants from the dangers of extreme heat, there are still unresolved questions around energy affordability, costs and implementation.

A Genetic Interaction Between Ded1 And Hat1 In Saccharomyces Cerevisiae Reveals A Role For Hat1p In Cytoplasmic Rna Granule Accumulation, Audrey J. Panko, Aidan Winters, Nicholas R. Rothbard, Angela K. Hilliker Dec 2025

Hilliker

Biology Faculty Publications

Ded1p is an essential translation initiation factor that interacts with and is modulated by eIF4F. Ded1p also promotes the assembly and disassembly of stress granules, which contain nontranslating mRNAs and translation initiation factors. As Ded1p affects both mRNA storage and translation initiation, regulation of Ded1p's function may affect whether mRNAs are translated or localized to cytoplasmic RNA granules. To identify regulators of Ded1p in Saccharomyces cerevisiae, we screened for overexpression suppressors of the severe growth defect conferred by high levels of Ded1p. We found that overexpression of HAT1, a lysine acetyltransferase, can suppress the growth defect conferred by …

Amp: Single-Shot Ultra-Wide Fisheye-To-Cubemap Pnp Pose Estimation, Ryan M. Raettig, Richard R. Nyquist, Scott L. Nykl, Clark N. Taylor, Christine M. Schubert Kabban

Faculty Publications

Estimating the position and orientation of a rigid object from an image is critical for situational awareness in robotics and autonomous systems. This study explores relative pose estimation using an ultra-wide fisheye camera for unmanned aircraft inspection vehicles. Ultra-wide fisheye lenses introduce radial distortion and capture features beyond the rectilinear image plane, rendering rectilinear Perspective-n-Point (PnP) algorithms inadequate. Designing a bespoke ultra-wide fisheye localization algorithm requires consideration of both the feature detection method and the pose estimator itself. This study proposes a novel method that combines (1) a fisheye-to-cubemap reprojection, (2) a You Only Look Once (YOLO) convolutional neural network …
