Free Speech For Me But Not For Airbnb”: Restricting Hate-Group Activity In Public Accommodations, Sabrina Apple Apr 2024

Free Speech For Me But Not For Airbnb”: Restricting Hate-Group Activity In Public Accommodations, Sabrina Apple

Vanderbilt Law Review

As digital services grow increasingly indispensable to modern life, courts grow inundated with novel claims of entitlement against these platforms. As narrow, formalistic interpretations of Title II permit industry leaders to sidestep equal access obligations, misinformed interpretations of First Amendment protections allow violent speech and conduct to parade uninhibited. Within the mistreatment of these two established doctrines lies a critical distinction: the former is in desperate need of modernization to fulfill its original intent, and the latter is in desperate need of restoration for the same ends. This climate creates conditions ripe for doctrinal upheaval. This Note considers how the …

Coming Home Again: Television Sitcom Revivals, Brandon K. Hedgepeth Apr 2024

Coming Home Again: Television Sitcom Revivals, Brandon K. Hedgepeth

Communication & Theatre Arts Theses

This thesis argues that the success of television situational comedy revivals correlates with television’s technological affordances as they have evolved over the past half-century. Specifically, three revival series are examined within this study, consisting of The New Leave it to Beaver (1983-1989), Fuller House (2016-2020), and The Conners (2018-Present). This paper uses the revival case studies to showcase their parallel relationship with the introduction of cable television and streaming media, alongside the resurgence of broadcast television to highlight the changing media landscape and the intertwined nature between technological advancement and the revival form. The study’s investigation of how nostalgia intersects …

Effectiveness Of Aerial Monitoring Of Spatial And Temporal Changes Of Santa Catalina Island Rhodolith Beds, Charnelle Wickliff Apr 2024

Effectiveness Of Aerial Monitoring Of Spatial And Temporal Changes Of Santa Catalina Island Rhodolith Beds, Charnelle Wickliff

Capstone Projects and Master's Theses

The distribution and abundance of rhodolith beds off Santa Catalina Island, California are impacted by natural and anthropogenic factors. These complex, unattached coralline habitats provide food and shelter for important species; however, little is known about temporal variation in bed cover and distribution. Abiotic factors like heavy storms and surge can change bed boundaries and shape. Anthropogenic factors, such as disturbance from mooring chains, can create patchiness within beds. Studies of bed distribution and tracking changes in habitats have historically been done using labor-intensive SCUBA diving. This approach has excellent resolution at small scales but is limited in the temporal …

Mut: Human-In-The-Loop Unit Test Migration, Yi Gao, Xing Hu, Tongtong Xu, Xin Xia, David Lo, Xiaohu Yang

Research Collection School Of Computing and Information Systems

Test migration, which enables the reuse of test cases crafted with knowledge and creativity by testers across various platforms and programming languages, has exhibited effectiveness in mobile app testing. However, unit test migration at the source code level has not garnered adequate attention and exploration. In this paper, we propose a novel cross-language and cross-platform test migration methodology, named MUT, which consists of four modules: code mapping, test case filtering, test case translation, and test case adaptation. MUT initially calculates code mappings to establish associations between source and target projects, and identifies suitable unit tests for migration from the source …

Deep Reinforcement Learning For Dynamic Algorithm Selection: A Proof-Of-Principle Study On Differential Evolution, Hongshu Guo, Yining Ma, Zeyuan Ma, Jiacheng Chen, Xinglin Zhang, Zhiguang Cao, Jun Zhang, Yue-Jiao Gong

Research Collection School Of Computing and Information Systems

Evolutionary algorithms, such as differential evolution, excel in solving real-parameter optimization challenges. However, the effectiveness of a single algorithm varies across different problem instances, necessitating considerable efforts in algorithm selection or configuration. This article aims to address the limitation by leveraging the complementary strengths of a group of algorithms and dynamically scheduling them throughout the optimization progress for specific problems. We propose a deep reinforcement learning-based dynamic algorithm selection framework to accomplish this task. Our approach models the dynamic algorithm selection a Markov decision process, training an agent in a policy gradient manner to select the most suitable algorithm according …

Discovering Significant Topics From Legal Decisions With Selective Inference, Jerrold Tsin Howe Soh Apr 2024

Discovering Significant Topics From Legal Decisions With Selective Inference, Jerrold Tsin Howe Soh

Research Collection Yong Pung How School Of Law

We propose and evaluate an automated pipeline for discovering significant topics from legal decision texts by passing features synthesized with topic models through penalized regressions and post-selection significance tests. The method identifies case topics significantly correlated with outcomes, topic-word distributions which can be manually interpreted to gain insights about significant topics, and case-topic weights which can be used to identify representative cases for each topic. We demonstrate the method on a new dataset of domain name disputes and a canonical dataset of European Court of Human Rights violation cases. Topic models based on latent semantic analysis as well as language …

The Thermodynamics And Structure Of Tumor Suppressor P53 And Helical Mutants Binding To Inhibitors Mdm2 And Mdmx At The Primary And Secondary Sites, Pirada Serena Higbee Apr 2024

The Thermodynamics And Structure Of Tumor Suppressor P53 And Helical Mutants Binding To Inhibitors Mdm2 And Mdmx At The Primary And Secondary Sites, Pirada Serena Higbee

USF Tampa Graduate Theses and Dissertations

p53 is an intrinsically disordered protein that is a tumor suppressor. The transactivation domain is split into two parts (TAD1 and TAD2). These TADs bind to inhibitors MDM2, and a homolog, MDMX, but TAD1 binds with greater affinity. MDM2 is an E3 ubiquitin ligase that leads to the degradation of p53. MDMX is not an E3 ubiquitin ligase, but it does prevent p53 from binding to DNA, thus preventing its tumor suppressor role.

Previous research showed that increasing p53 helicity by mutating prolines to alanines increased p53's helicity but not the length of the helix. The increase in helicity increased …

I’M Not Lovin’ It: Re-Thinking Fast Food Advertising, Brody Shea, Michael S. Sinha

All Faculty Scholarship

In 1971, the Federal Trade Commission (“FTC”) and the Food and Drug Administration (“FDA”) agreed to prevent injury and deception to the consumer in advertising, detailing their respective roles in a Memorandum of Understanding (“MOU”).1 The MOU proscribes that the FTC regulates truth in advertising relating to foods, drugs, devices and cosmetics while the FDA controls labeling and the misbranding of foods, drugs, devices, and cosmetics shipped in interstate commerce.2 The MOU has been amended and an addendum added since 1971, but the material provisions have remained consistent for over a half-century.3

Importantly, the FDA and the …

Radiation therapy (RT) is one of the most commonly used anticancer therapies. However, the landscape of cellular response to irradiation, especially to a single high-dose irradiation, remains largely unknown. In this study, we performed a whole-genome CRISPR loss-of-function screen and revealed temporal inherent and acquired responses to RT. Specifically, we found that loss of the IL1R1 pathway led to cellular resistance to RT. This is in part because of the involvement of radiation-induced IL1R1-dependent transcriptional regulation, which relies on the NF-κB pathway. Moreover, the mitochondrial anti-apoptotic pathway, particularly the BCL2L1 gene, is crucially important for cell survival after radiation. BCL2L1 …

Diffuse-type gastric adenocarcinoma (DGAC) is a deadly cancer often diagnosed late and resistant to treatment. While hereditary DGAC is linked to CDH1 mutations, the role of CDH1/E-cadherin inactivation in sporadic DGAC tumorigenesis remains elusive. We discovered CDH1 inactivation in a subset of DGAC patient tumors. Analyzing single-cell transcriptomes in malignant ascites, we identified two DGAC subtypes: DGAC1 (CDH1 loss) and DGAC2 (lacking immune response). DGAC1 displayed distinct molecular signatures, activated DGAC-related pathways, and an abundance of exhausted T cells in ascites. Genetically engineered murine gastric organoids showed that Cdh1 knock-out (KO), KrasG12D, Trp53 KO (EKP) accelerates tumorigenesis with immune evasion …

Examining The Effects Of Social Group Persecution And Traumatic Humiliation In Survivors Of Torture, Tilda Cvrkel

Clinical Psychology Dissertations

Refugees and asylum seekers account for 34.4 million people worldwide (UNHCR, 2021), and up to 40% of this population are survivors of torture (UNHCR, 2017). The Istanbul Protocol (United Nations, 2022) describes one of the explicit ends of torture as the severing of a person from their community, a breaking of their dignity and humanity. This may be done explicitly, through acts of traumatic humiliation. Traumatic humiliation includes acts such as forcing victims to eat religiously forbidden food, forced posing or touching others in culturally taboo sexual ways, forced nudity or clothing that reflects misgendering (such as “emasculating” clothing), widespread …

Landau Damping Of Dust Acoustic Solitary Waves In Nonextensive Dusty Plasma, Najah Kabalan, Mahmoud Ahmad, Ali Asad

Baghdad Science Journal

Dust acoustic (DA) solitary waves have been investigated under the influence of Landau damping in space dusty plasma with q-nonextensive velocity distributed of ions. The effect of the Landau damping, and nonextensive parameter q of the ions on DA solitary structures has been illustrated by a numerical solution of the Landau damping modified KdV equation. By applying the reductive perturbation technique (RPT) Korteweg-de Vries (KdV) an equation with an additional Landau damping term for our model has been derived. This study showed that the density of dusty particles plays an essential role in appearance or disappearance of DA solitary waves …

The Intrusive State: Restrictions On Gender-Affirming Healthcare For Minors, Exceptions To The Doctrine Of Parental Consent, And Reliance On Science And Medical Expertise, Lois W. Weithorn

UC Law Journal

The provision of gender-affirming medical care to transgender or gender diverse (“TGD”) youth is currently the subject of substantial controversy despite an overwhelming consensus in the healthcare community as to the safety and potential benefits of recommended treatments. Much of the debate is fueled by misinformation and inaccurate characterization of research and practice. Against this backdrop, twenty-three states enacted restrictions or complete prohibitions on access to gender-affirming medical care for adolescents between 2021 and the time of this writing in early 2024. The policies typically place healthcare practitioners who provide such services at risk of license revocation. Some statutes create …

Washington Cares: Other States Should Too, Evelyn Wynn Apr 2024

Washington Cares: Other States Should Too, Evelyn Wynn

UC Law Journal

The United States is facing a growing challenge in financing long-term care as the population ages and the demand for these services continues to grow. The cost of long-term care can be exorbitant, with many individuals and families struggling to afford the care they need. The baby boomer generation and their families are facing the challenges of aging, which will be exacerbated by a lack of funding for long-term care. Given unmarketable private insurance policies and Medicaid’s spend down strategy, among other issues, the United States needs a feasible financing solution for long-term care.

In response to this challenge, Washington …

Labor Law’S Preemption Problem: Glacier Northwest And What The Fate Of Garmon Means For American Workers, Alexander S. Whistler Apr 2024

Labor Law’S Preemption Problem: Glacier Northwest And What The Fate Of Garmon Means For American Workers, Alexander S. Whistler

UC Law Journal

The Supreme Court’s 2022–2023 term was, unsurprisingly, terrible for millions of Americans. From the environment to affirmative action to student loan forgiveness, the Court remained committed to its project of reshaping the nation’s laws in its conservative image. But despite its well-demonstrated antipathy for organized labor, the Court in Glacier Northwest v. International Brotherhood of Teamsters managed to leave a long-standing, purportedly worker-friendly doctrine in federal labor law largely intact. Glacier Northwest presented the question of whether an employer may sue a union in state court for damages over a strike that allegedly causes property destruction, or whether, under the …

Spiritual Fathering: Does It Really Make A Difference?, Jeffrey A. Jacob Apr 2024

Spiritual Fathering: Does It Really Make A Difference?, Jeffrey A. Jacob

Doctor of Ministry (DMin)

The importance and impact of having a father in the home is undisputable. Statistics dictate that the effect of fatherlessness on children is devastating. Could it be that having a spiritual father or mother involved in a believer’s life makes a verifiable difference as well? This dissertation will investigate the effects of spiritual fathering as evidenced by the spiritual disciplines of those who identify as having a strong spiritual father or mother. The Apostle Paul said, “Even if you had ten thousand guardians in Christ, you do not have many fathers, for in Christ Jesus I became your father through …

Evangelship: Mobilizing A Culture Of Discipleship That Leads To Evangelism In A Multiethnic Latino Context, Lawrence D. Perez

Doctor of Ministry (DMin)

Discipleship and evangelism in America today are eroding. Where traditionally the church sees discipleship and evangelism as separate entities, this research project argues for the unification of the two. This project explores “Evangelship,” the uniting of evangelism and discipleship, to see if the combined approach and perspective could offer a better way to engage the North American population. The driving question for this project is “Can the integration of evangelism and discipleship create a culture that accelerates and advances the Great Commission at U-Turn Covenant Church (U-Turn)?” To answer this question, the study aims to establish a discipleship framework that …

Multiply Alabama: Moving From Church Planting To Church Multiplication By Multiplying Leaders And Churches In The Alabama Ministry Network, David P. Strahan Apr 2024

Multiply Alabama: Moving From Church Planting To Church Multiplication By Multiplying Leaders And Churches In The Alabama Ministry Network, David P. Strahan

Doctor of Ministry (DMin)

The Alabama Ministry Network has had anemic success in planting over 150 churches since 1980. However, there has still been a ten percent decline in the total number of churches due to churches closing, churches withdrawing, or churches merging. This project studies how AMN can move from addition (church planting) to multiplication (church multiplication) to avoid further regression. The Biblical literature review examines the scriptural premise to multiply. It also discovers the church planting models of Jesus, the early church, and Paul The project used mixed research methods to develop a pathway towards church multiplication within AMN in four phases. …

Menossance ™: Post-Maternity Strategies, Elizabeth Pursell

Theses

Inside the private lives of middle-aged women, significant suffering unfolds in silence. The universal “change” is shrouded in shame. The obstacles particular to women during midlife include physical, emotional, financial, professional, familial, and societal. Many suffer through the indignities of menopause while adjusting to an “empty-nest” (Gullette, 2002, p.554). Droves of middle-aged women are also part of the so-called “Sandwich Generation” (Hong, 2002, p. 358). They are sandwiched between the responsibilities of their children and their elders, all while tenuously balancing careers and menopause. As described in Umma’s Table, “The sandwichgeneration [is] impossibly caught between multigenerational responsibilities, navigating labyrinthine sociomedical …
