Show And Tell: Writing Constitutional Law Casebooks When The Law Doesn't Matter, William D. Araiza
Show And Tell: Writing Constitutional Law Casebooks When The Law Doesn't Matter, William D. Araiza
William & Mary Bill of Rights Journal
Writing a constitutional law casebook today presents significant challenges. One reason among several stands out: law matters less—indeed, sometimes very little—to those charged with interpreting our constitutional law and implementing our constitutional system.
This Essay examines this challenge and explains how my contribution to the constitutional casebook genre attempts to answer it. It argues that the current moment requires instructors, and the books they use, to “show”—that is, to demonstrate to their students both the handiwork of those interpreters and implementers and alternative pathways. Sometimes, however, practical considerations preclude such showing. In those situations, “telling” may be required. But regardless …
Overruled Cases As A Tool For Inculcating Legal Realism, Michael C. Dorf
Overruled Cases As A Tool For Inculcating Legal Realism, Michael C. Dorf
William & Mary Bill of Rights Journal
The changes wrought by Dobbs and Students for Fair Admissions v. President and Fellows of Harvard College (SFFA) are hardly the only examples of momentous changes to constitutional law in the last few years. Doctrines involving the religion clauses of the First Amendment, the Second Amendment, the scope of the president’s removal power, and much more have been changing rapidly since Amy Coney Barrett replaced Ruth Bader Ginsburg in the fall of 2020, thereby solidifying a conservative supermajority on the Supreme Court. I imagine that the strengthening of the major questions doctrine, the overruling of Chevron deference to federal administrative …
What Should A Constitutional Law Casebook Be?, William Funk
What Should A Constitutional Law Casebook Be?, William Funk
William & Mary Bill of Rights Journal
What is the purpose of a “casebook”? It is not a “hornbook,” designed to summarize or explain the law in a specific area, generally aimed at law students or lawyers to provide a straightforward statement of the law. It is not a “treatise,” a comprehensive, systematic exposition of the law in a particular field, involving an in-depth analysis and interpretation of the law. And it is not a “study aid,” supplementary material designed to help students do better in their classes. It is the book used by professors in their classes. For professors of constitutional law, it is a tool …
Teaching Firearms Law: One Big Opportunity And Three Pedagogical Challenges, Joseph Blocher, Jacob D. Charles, Darrell A.H. Miller
Teaching Firearms Law: One Big Opportunity And Three Pedagogical Challenges, Joseph Blocher, Jacob D. Charles, Darrell A.H. Miller
William & Mary Bill of Rights Journal
The U.S. Supreme Court’s groundbreaking 2008 decision in District of Columbia v. Heller ushered in a new era for the Second Amendment: one in which the right to keep and bear arms, long dormant as a matter of practical impact and even “embarrassing” as a matter of legal scholarship, vaulted into the front ranks of constitutional law. The Court itself has only revisited the Amendment a few times since then—albeit once by revolutionizing the doctrine. Meanwhile, lower courts have issued thousands of decisions giving shape to the right, while scholars have generated work that is increasingly deep, diverse, and challenging. …
Intellectual Integrity, Collaboration, And The Market, Mark Tushnet
Intellectual Integrity, Collaboration, And The Market, Mark Tushnet
William & Mary Bill of Rights Journal
My reflections are those of someone who co-edited/co-authored two casebooks that were commercially and intellectually successful and one that was intellectually but not commercially successful. I start with the assumption that people decide to do a casebook because they find that existing materials don’t do some things they think ought to be done in the course (and do some things that aren’t really necessary for teaching purposes). That is, doing a casebook is at the outset an intellectual project.
Executing that project runs up against some constraints almost immediately. A simple one is that you might well think that you …
What Belongs In A Constitutional Law Casebook?, Ernest A. Young
What Belongs In A Constitutional Law Casebook?, Ernest A. Young
William & Mary Bill of Rights Journal
This Essay argues that constitutional law cannot (and should not) be an autonomous subject within the legal curriculum. This argument echoes a long-standing debate about whether law itself is an autonomous scholarly discipline. The answer to that question is surely, as Allan Farnsworth put it, “sometimes YES and sometimes NO.” But this Essay does not focus on law’s autonomy from other disciplines, such as political science, psychology, or economics. Rather, I consider the extent to which constitutional law should overlap with other legal subjects, such as legal history, administrative law, or statutory interpretation. My conclusion is that, at least in …
Generational Impact: How U.S. Government Generative A.I. Use Reinvigorates Copyright-Based Takings Concerns, Sophia Tully
Generational Impact: How U.S. Government Generative A.I. Use Reinvigorates Copyright-Based Takings Concerns, Sophia Tully
William & Mary Bill of Rights Journal
This Note argues (1) that the unique character of government copyright infringement supports a copyright holder’s use of the Takings Clause of the Fifth Amendment, as opposed to reliance on the Copyright Act for downstream Gen A.I. suits; (2) that Gen A.I. developers may wage similar claims once asserting authorship rights and copyright over their outputs; and (3) that the viability of federal government copyright infringement as a regulatory taking could change the way legal actors deal with copyrighted material. More modestly assessed, an answer on whether the Takings Clause protects copyrights would offer much needed guideposts as intellectual property …

Background: α-synuclein (α-syn) deposition in the mid-brain region is one of the hallmark pathologies of Parkinson's disease (PD). The key steps involve the transformation of α-synuclein into a toxic oligomer and insoluble fibrillar aggregates.
Objective: To understand the role of curcumin-glucoside in the prevention of α-syn aggregation, a mechanistic approach.
Methods: In the present study, we synthesized a novel molecule, curcumin-glucoside (Curc-gluc), to improve the water solubility and partition coefficient, making the molecule with high bioavailability. The present study is focused on understanding the α-syn aggregation kinetics in the presence and absence of Curc-gluc, curcumin (Cur), copper (Cu), and iron …
Prostitution In Video Games: Stigma, Violence And Male Pleasure, Laura Aguilera-Ávila, Lara Escobar Hernández
Prostitution In Video Games: Stigma, Violence And Male Pleasure, Laura Aguilera-Ávila, Lara Escobar Hernández
Dignity: A Journal of Analysis of Exploitation and Violence
Prostitution has traditionally been framed in society as a space significantly determined by patriarchal hierarchies, in addition to being affected on many occasions by stigmatisation and violence. The representation of prostitution and of those who practice it in the media is a topic of special interest, since the discourses and messages disseminated by the media play a fundamental role in socialisation. Video games are not exempt from this debate: with millions of players worldwide and a special reach among young people, they are among the most influential media outlets today. This qualitative research analyses a series of titles, both AAA …
Nursing Students’ Attitudes Regarding Technical Standards For Entrance Into A Bachelor Of Science In Nursing Program, Jordyn Cook
Nursing Students’ Attitudes Regarding Technical Standards For Entrance Into A Bachelor Of Science In Nursing Program, Jordyn Cook
Honors Theses
Admission into a Bachelor of Science in Nursing program requires students to meet specific criteria including a non-negotiable set of technical standards. Technical standards encompass physical abilities including twisting, bending, and handling objects of varying weights (Good Samaritan College of Nursing and Health Science, n.d.). While physical capabilities may hold significance in bedside nursing, the American Nurses Association does not establish specific physical qualifications (American Nurses Association, 2010). Due to admission criteria and technical standards, individuals with disabilities are rarely found among career nurses and nursing students (Leslie & Miller, 2020).
This study aims to determine nursing students’ attitudes towards …

Zinc-Based Amendments And Zn-Solubilizing Beneficial Bacteria Mitigate Lead-Induced Toxicity In Chickpea (Cicer Arietinum L.), Mohammad Shahid, Mohammad Abul Farah, Khalid Mashay Al-Anazi, Leonard Koolman
Research Outputs: 2025-Present
Lead (Pb) is a toxic metal that disrupts plant physiological processes and poses significant human health risks. Fertilizers, nanomaterials, and mineral-solubilizing plant growth-promoting rhizobacteria (PGPR) support phytoremediation as an emerging, eco-friendly strategy for metal detoxification by improving nutrient availability and minimizing metal toxicity in plants. This study explored the interactions of Zn-fertilizer, zinc-oxide nanoparticles (ZnO-NPs), and Zn-solubilizing Enterobacter cloacae (Zns-Ec) in mitigating Pb-induced phytotoxicity in 50, 100, and 150 mgPbkg −1 soil-stressed chickpea. Under Pb stress. Zn, ZnO-NP and Zns-Ec significantly (p < 0.05) improved root biomass (23.4, 52.3, and 71.4%), chl a (21.2, 26.5, and 39.8%), and carotenoids (26.7, 29.7 and 45.7%) in chickpea subjected to 50 mgPbkg −1 soil. Zn, ZnO-NP and Zns-Ec interactions reduced lipid peroxidation (LPO), hydrogen peroxide (H 2O 2) …

Counseling, Leadership, and Research Methods Faculty Publications and Presentations
This forum contribution considers the complexities and importance of gender in the historiography of LGBTQ+ college students. After a brief introduction, we focus on four key areas in the existing historiography: women's romantic relationships in the late nineteenth and early twentieth centuries, higher education leaders' enforcement of gender norms and purges of LGBTQ+ students through the mid-twentieth century, the gender dynamics within LGBTQ+ student organizations from the 1970s onward, and trans and other LGBTQ+ students' expansion of gender possibilities, including through the use of drag. In so doing, we argue that gender analysis is important to the historiography of LGBTQ+ …

Despite growing interest in task-based language teaching (TBLT), limited empirical work has examined how different rhetorical task types influence second language (L2) writing development, especially in relation to affective variables, such as writing anxiety. Existing research in TBLT has largely focused on cognitive dimensions, often neglecting individual differences in learners' emotional responses. Moreover, Long's (2014) call to use first language (L1) data as a benchmark in TBLT remains underexplored, complicating the interpretation of L2 performance patterns. To address these gaps, we examined the impact of task type and writing anxiety on the written performance of 140 university students (70 L1 …

Purpose: Real-time risk monitoring is critical but challenging in intensive care units (ICUs) due to the lack of real-time updates for most clinical variables. Although real-time predictions have been integrated into various risk-scoring systems to aid monitoring, existing systems do not address uncertainties in risk assessments. We developed an enhanced risk monitoring framework based on commonly used systems like the Sequential Organ Failure Assessment (SOFA) score by incorporating uncertainties to improve the effectiveness of real-time risk monitoring in ICUs.Methods: This study included 5,351 patients admitted to the Cardiothoracic ICU in the National University Hospital in Singapore. We developed machine learning …

Riding The Waves Of Power: Power Fluctuation, Cognitive Energy, And Goal Pursuit, Hae-Lueng Rose Kim, Trevor A. Foulk, Michael Schaerer, Jake Gale, Eric A. Anicich
Research Collection Lee Kong Chian School Of Business
A central finding in the power literature is that experiencing elevated power facilitates employees’ goal-relevant cognitions and behaviors. In this work, we suggest that the relationship between power and goal pursuit is more complex than previously assumed. Specifically, we examine how experiencing power fluctuation—alternating states of high and low power during the workday—can uniquely promote employees’ goal-relevant behaviors beyond the effect of static power. Integrating insights from the Dynamic Equilibrium Model of Organizing (DEMO) and the Model of Proactive Motivation (MPM), our work demonstrates that power fluctuation can facilitate employees’ cognitive energy, in a way that enhances their goal-relevant cognitions …

Autoethnography, Poetic Performance Narratives, And Pláticas As Dialogues Of Radical Love, Miryam Espinosa-Dulanto
Bilingual and Literacy Studies Faculty Publications
This piece examines Autoethnography, Poetic Performance Narratives, and Pláticas as decolonial methodologies that challenge the coloniality of knowledge and center voices historically excluded from academic discourse. These approaches honor traditions rooted in community, solidarity, and radical love, presenting lived realities without oversimplification while inviting readers to inhabit contradictions and imagine ethical possibilities for equity. Grounded in Latin American and Chicana/Latina/Indígena feminist scholarship, this work situates these practices within a legacy of decolonial epistemologies that resist dominant Western paradigms and affirm lived experience as a site of theory-making. Through this lens, the piece seeks to: (1) bear witness to shared experiences, …

Exploring Glycosomes As Therapeutic Targets For Trypanosoma Brucei, Sabrina Sutton Pizarro
Exploring Glycosomes As Therapeutic Targets For Trypanosoma Brucei, Sabrina Sutton Pizarro
All Dissertations
Trypanosoma brucei is a protozoan parasite which causes human African trypanosomiasis and the livestock wasting disease, nagana. These parasites have highly specialized peroxisomes, called glycosomes, which house a variety of essential metabolic pathways, including glycolysis. Glycolysis is the sole means of energy production in the infective life stage of T. brucei making glycosomes and the glycolytic pathway promising targets for therapeutic strategies. In this work, we have studied the glycosome as a therapeutic target from multiple perspectives. The first portion of this work addresses drug trafficking. The efficacy of small-molecule inhibitors of glycosomal enzymes is restricted by the rate of …
Purifying Circular Rna Therapeutics, Karen Guillen-Cuevas
Purifying Circular Rna Therapeutics, Karen Guillen-Cuevas
All Dissertations
Circular RNA (circRNA) has emerged as a promising therapeutic modality due to its enhanced stability and resistance to exonuclease degradation compared with linear mRNA. However, its stability and functionality depend strongly on achieving high purity, and current methods such as size-exclusion chromatography suffer from peak overlap, low yields, and poor scalability. This dissertation addresses these limitations by developing ultrafiltration-based strategies to purify circRNA directly from in vitro transcription (IVT) and self-splicing (circularization) reactions. First, the feasibility of ultrafiltration was demonstrated using polyethersulfone membranes, where sieving coefficients and critical flux values of circRNA, precursor RNA, and nicked RNA were measured to …

The primary issue that faces the humanity is climate change and because of that greenhouse gases (GHGs) emissions are rising. The consequences of this issue have emphasized the necessity for replacing the dominant method of electricity generation, which mostly utilizes fossil fuels, to be centered on access to all, green, low-cost, and renewable sources of energy. Currently, photovoltaics (PV) and wind turbines are the two technologies so far that can convert the source of renewable energy, which is produced by sun irradiance and wind respectively, into large-scale electric power that can be distributed into the electricity grid. The work in …
Thermal Management Of Power Electronic Converters In Electric Motor Drives Using Active Thermal Control And Active Cooling, S M Imrat Rahman
Thermal Management Of Power Electronic Converters In Electric Motor Drives Using Active Thermal Control And Active Cooling, S M Imrat Rahman
All Dissertations
The application of power electronic converters (PEC) in electric vehicles (EVs) has significantly increased due to their enhanced controllability and flexibility. Additionally, Permanent Magnet Synchronous Machines (PMSMs) are favored in EVs for their higher torque, efficiency, performance, and heat dissipation capabilities compared to asynchronous machines. The reliable operation of power converters in PMSM drives is crucial for EV operation, and this is driving interest in developing innovative and sustainable technologies that ensure the safe and reliable functioning of PECs. One of the main challenges in achieving reliable PECs is designing effective thermal management systems to control junction temperature and reduce …
Machine Learning-Enabled Safety-Critical Model Predictive Control For Uncertain Dynamical Systems, Hossein Nejatbakhsh Esfahani

The demand for processed foods has led to increased use of synthetic phenolic antioxidants (SPAs), notably tert-butylhydroquinone (TBHQ), to inhibit lipid oxidation and prolong shelf life. While TBHQ is deemed safe at regulated levels, concerns arise from studies indicating potential adverse effects such as oxidative stress, genotoxicity, and impaired immune function. To investigate TBHQ's immunomodulatory effects, RAW 264.7 murine macrophages were pre-treated with TBHQ and subsequently stimulated with lipopolysaccharide (LPS) or polyinosinic-polycytidylic acid (poly I:C, PIC) to simulate bacterial or viral challenges. Results demonstrated that TBHQ at high non-cytotoxic doses reduced nitric oxide and IL-10 production while promoting phagocytosis and …
Leveled Homomorphic Encryption Schemes: Noise And Precision Control, Kyle Yates
Leveled Homomorphic Encryption Schemes: Noise And Precision Control, Kyle Yates
All Dissertations
Homomorphic encryption allows for computations on encrypted data without exposing the underlying plaintext, enabling secure and private data processing in various applications such as cloud computing and machine learning. In this thesis, we conduct a comprehensive worst-case noise analysis for three prominent leveled homomorphic encryption schemes: Brakerski-Gentry-Vaikuntanathan (BGV), Brakerski-Fan-Vercauteren (BFV), and Cheon-Kim-Kim-Song (CKKS). We propose modifications to these schemes and their residue number system (RNS) variants, ensuring fresh encryption noise falls under a constant bound. For BFV and BGV, we design and prove parameter conditions which guarantee certain homomorphic circuit evaluations return ciphertexts containing noise within a fixed bound. For …

Ecological interactions such as predation are vital to shaping the distribution of organisms. For interactions to occur, organisms must undertake movement, such as dispersal, that places them in proximity to the organisms with which they may interact. Geographically isolated wetlands (GIW) are productive and biodiverse ecosystems, but little is known on broad geographic scales about the determinants of their fauna. Fishes have difficulty colonizing GIW, whereas amphibians and macroinvertebrates are adept overland dispersers – though they may be sensitive to top-down control by fishes. To better understand these phenomena, I sampled 10-20 wetlands each at nine regions in North and …

In the past decade, a paradigm shift in the design of metal alloys has been observed. These new alloys are commonly referred to as high entropy alloys (HEAs), multi-principal element alloys (MPEAs), or complex, concentrated alloys (CCAs). In contrast to conventional alloys, which consist of one main element (for example 80%) with other elements in small amounts, HEAs are made of four or more main elements ranging from 5 to 35% each element. Due to the large presence of multiple elements, HEAs have shown substantial material property improvements over conventional alloys such as steel. For example, they have high ductility …
