Stop The Work Stoppages: A Mixed-Mode Dispute Resolution Process To Prevent An Nba Lockout Or Strike, Kyle Cohen Jan 2026

Stop The Work Stoppages: A Mixed-Mode Dispute Resolution Process To Prevent An Nba Lockout Or Strike, Kyle Cohen

Cardozo Arts & Entertainment Law Journal

The note argues that the NBA and NBPA should incorporate a mixed-mode dispute resolution clause—specifically a "neg-med-arb" (negotiation-mediation-arbitration) process—into future collective bargaining agreements (CBAs). By transitioning from negotiation to mediation and finally to binding arbitration, the league can ensure a successor agreement is reached in time to prevent lockouts or strikes that disrupt the season.

Dancing On The Edge Of Copyright: Why Copyright Law Should Protect Short Dance Routines, Tianai Song

Cardozo Arts & Entertainment Law Journal

The note argues that the Copyright Act should be amended to extend legal protection to short dance routines, regardless of their complexity or duration. This expansion aims to prevent the unauthorized appropriation of distinctive movements and ensure that creators, particularly those from Black and marginalized communities, are fairly recognized and compensated.

Beyond The Rings: Housing Inequalities In Olympic Host Cities, Audrey Hansen Jan 2026

Beyond The Rings: Housing Inequalities In Olympic Host Cities, Audrey Hansen

Cardozo Arts & Entertainment Law Journal

The note argues that hosting the Olympic Games consistently leads host cities to violate their citizens' right to adequate housing through displacement, gentrification, and the criminalization of homelessness. By analyzing historical patterns and current preparations for the 2028 Los Angeles Games, the analysis contends that the traditional single-city hosting model is unsustainable and harmful.

Youtube Journalists And The Future Of The Fourth Estate: The Fine Line Between Journalism And Entertainment, Stephan Toljan Jan 2026

Youtube Journalists And The Future Of The Fourth Estate: The Fine Line Between Journalism And Entertainment, Stephan Toljan

Cardozo Arts & Entertainment Law Journal

The note argues that the legal distinction between professional journalists and social media actors has blurred due to the universal accessibility of public digital platforms. It proposes eliminating the requirement of institutional affiliation for the reporter's privilege, suggesting instead that any individual who satisfies the Von Bulow factors regarding the intent to disseminate information to the public should be eligible for the privilege.

Generative Ai And The Myth Of Creativity, Abdi Aidid Jan 2026

Generative Ai And The Myth Of Creativity, Abdi Aidid

Cardozo Arts & Entertainment Law Journal

It has become almost commonplace to observe that artificial intelligence is straining the boundaries of intellectual property law. Artists and other creators are especially uneasy about the extent to which generative AI systems may displace original works or, when they function as creative aids, provide little in the way of meaningful IP protection. Beneath these concerns, however, lies a more fundamental doctrinal tension: despite its frequently invoked justifications, IP law has never been primarily concerned with rewarding creativity or effort. Courts have longfavored formalistic approaches and minimal thresholds for originality, deliberately avoiding judgments about artistic or aesthetic merit. Similarly, they …

Does My Job Love Me? - A Story Of Transforming While Investigating Newly Qualified Teachers’ Knowledge Of And Practices In Early Reading., Ali Beaman

School of Law, Humanities and Social Sciences Theses

For nearly 50 years, a vast amount of evidence shows that a Phonological Awareness (PA) deficit is a primary risk factor for reading difficulties (Wagner and Torgesen, 1978 and Kilpatrick, 2012, 2016, 2019). The initial aim of my research in early 2019 was to investigate, over a period of a year, Newly Qualified Teachers’ (NQTs’) knowledge of and practices in early reading, with a specific focus on NQTs' knowledge and understanding of PA. Policy for Education in England requires all teachers to show effective early reading education (Rose, 2009 and Department for Education and Employment, 1998a). According to the Teachers’ …

Plymouth Naval Command: A Study Of Interservice Co-Operation During The Second World War, James Bartle Jan 2026

Plymouth Naval Command: A Study Of Interservice Co-Operation During The Second World War, James Bartle

School of Law, Humanities and Social Sciences Theses

This thesis examines the role of ideas of interservice co-operation in the operations of Plymouth Naval Command during the Second World War. The importance of naval shore commands has been a significant omission from studies of the war at sea. Located at strategic points around Britain, they were vital in controlling the flow of convoy shipping, while also co-ordinating attacks against enemy surface forces and submarines. This was achieved using a marriage of air and sea power between the Royal Navy and Coastal Command, a relationship that was developed during the 1920s and 1930s. Using Plymouth Command as an entry …

Navigating The Digital Shift In Mozambique: Teacher Agency And Digital Learning In Schools, Clive Ruraca Jan 2026

Navigating The Digital Shift In Mozambique: Teacher Agency And Digital Learning In Schools, Clive Ruraca

School of Law, Humanities and Social Sciences Theses

The educational technology industry frequently promotes the idea of a significant paradigm shift, proposing that technology can supplant traditional, transmission-based pedagogies such as ‘tell and practice’ approaches. In theory, this perspective positions digital tools as catalysts for systemic educational reform, capable of replacing rote learning with dynamic, technology-supported models (Voogt et al., 2013; Wang et al., 2024; Casilli & Posada, 2019). Employing an interpretative, empirical methodology, involving questionnaires and interviews with secondary school teachers. Data from this study are used to explore teachers’ experiences with digital learning tools through the lens of Activity Theory. This study examines the digital shift …

6g And Autonomous Vehicles: The Future Of Intelligent Transportation, Ali Yavari, Hamid Bagha, Negin Foroughimehr, Philip Branch Jan 2026

6g And Autonomous Vehicles: The Future Of Intelligent Transportation, Ali Yavari, Hamid Bagha, Negin Foroughimehr, Philip Branch

Staff Scholarship - Australia & Dubai

Connected autonomous vehicles are expected to become increasingly widespread in the coming decade, fundamentally transforming the utilization of communication networks across urban environments. These vehicles are highly data-intensive and continuously exchange information with surrounding vehicles, infrastructure, and cloud services to enable perception, decision making, and control. This constant connectivity imposes unprecedented loads on existing communication technologies such as mobile 5G broadband networks, which must handle massive volumes of real-time data transmission with low latency and high reliability requirements. This study examines how large scale deployment of connected autonomous vehicles could affect the performance and scalability of 5G networks, with a …

Synergistic Ph-Shift And Heat Treatment For The Recovery Of Protein Isolates From Ham Processing Brine: Evaluation Of Protein Ingredient Quality, Structure, And Functional Properties, Anim Ujong, Carlos Álvarez, Brijesh K. Tiwari, Shay Hannon, Uma Tiwari Jan 2026

Tiwari, Shay Hannon, Uma Tiwari

Research Outputs: 2025-Present

Ham processing generates significant volumes of brine, a saline wastewater with untapped potential. This study compared three protein recovery methods: direct centrifugation, moderate heat treatment (75 °C), and a combined pH-shift-mild heat (PSMH) approach (65 °C). Both the PSMH method and moderate heat precipitation produced protein concentrates with the highest initial protein contents (62.15%–62.81%), which increased to 91.65%–95.59% purity after desalting, with NaCl levels reduced to <1.5%. Amino acid analysis revealed that PSMH-derived proteins had the highest total amino acid content (96.58 g/100 g). Sodium dodecyl sulphate-polyacrylamide gel electrophoresis confirmed improved recovery of muscle proteins, while Fourier transform infrared spectroscopy indicated that moderate heat treatment reduced the α-helix/β-sheet ratio. Proteins recovered using PSMH exhibited the highest water and fat binding capacities and maintained solubility across a broad pH range. They also exhibited strong foaming ability, although they showed slightly lower foam stability than proteins recovered by other methods, and they demonstrated emulsifying properties that were optimal under mildly alkaline conditions. Overall, PSMH presents a sustainable and efficient strategy for recovering functional proteins from ham brine for use in food and feed applications.

Echoes Across Borders: Comparative Criminal Law And Justice In The Us Landscape, Alessandro Corda Jan 2026

Echoes Across Borders: Comparative Criminal Law And Justice In The Us Landscape, Alessandro Corda

Fordham International Law Journal

Despite its substantial promise to deepen understanding of domestic criminal laws and their operation, offer alternative approaches to policy challenges, and foster cross-cultural dialogue, comparative criminal law and justice remains only modestly visible in the United States—both in academic discourse and policymaking circles. After tracing the trajectory of comparative criminal law and justice in the United States and examining the primary factors contributing to its marginal status in legal scholarship and reform debates, this Article investigates the reasons for its limited prominence through an analysis of findings from a web-based survey of faculty specializing in criminal law, criminal procedure, and …

International Law Duties Not To Recognize, Not To Assist, And To Cooperate Against Peremptory Norm (Jus Cogens) Violations, Diane A. Desierto

Fordham International Law Journal

Peremptory norms (jus cogens) are the highest norms of international law. When these norms are violated, all States and international organizations have, at a minimum, three international legal duties to discharge while the violation is occurring: (1) the duty of non-recognition, where no State or international organization should recognize the situation caused by the violation; (2) the duty of non-assistance, where no State or international organization should render any aid or assistance to maintain this situation caused by the violation; and (3) the duty of cooperation, where all States and international organizations should cooperate to bring the violation to …

Transportation Needs And Commuting Stress Among Hospitality Employees: A Perspective From The Las Vegas Strip Corridor, Mehmet Erdem, Shashi Nambisan, Jehun Moon, Billy Bai, Juliana Byzyka, William Werner, Bethany Khan

ICHRIE Research Reports

This study examines the determinants of commute-related stress by integrating behavioral and situational perspectives within Las Vegas contexts. Grounded in the spillover theory, this study conceptualizes commuting stress as a cross-domain process in which strain generated during commuting extends into broader psychological outcomes. Employing an ordinary least squares (OLS) regression model, this study identifies the key components associated with commuting stress using survey data from 1,224 union workers in the Strip Corridor in Las Vegas. Findings reveal that experiential and situational factors play a dominant role in shaping stress perceptions. Specifically, traffic disruptions and behavioral adaptations (e.g., leaving earlier) emerge …

School of Biological and Marine Sciences

Significant progress has been made in advancing priority actions to conserve manta and devil rays, yet implementation and enforcement of protective measures often fall short, leaving most mobulid populations at risk of overfishing. Drawing on a literature review, fisheries databases, agency reports, and expert interviews, we assess global trends in mobulid catch and mortality. We examine both targeted and incidental catch, in small (<15 m, ‘SV’) and large (>15 m, ‘LV’) vessel fisheries to identify hotspots with the highest risk of fisheries-related mortality and population decline. We estimate global fisheries catch at 264,520 (184,407–344,987) mobulids per year, with SV fisheries accounting for 87 % …

Establishing A Nonmedical Cannabis Market In Virginia: Implications For Equity, Craig Dearfield Phd, Anna Grace Causey, Rowan Baylosis, Nakeina E. Douglas-Glenn Phd Jan 2026

Establishing A Nonmedical Cannabis Market In Virginia: Implications For Equity, Craig Dearfield Phd, Anna Grace Causey, Rowan Baylosis, Nakeina E. Douglas-Glenn Phd

Research Institute for Social Equity

Virginia passed an adult-use (recreational; non-medical) cannabis law that went into effect on July 1, 2021. Allowing adult possession of cannabis requires the passage of laws and regulations that govern this market (often similar to tobacco or alcohol) due to the intoxicating nature of cannabis and to ensuring the safety of the production processes. Establishing a formal retail market can also address harms related to public health and criminal justice, and benefit state agencies and residents. In order to maximize benefits, Virginia must implement the market with an equity perspective to ensure just treatment for all residents and organizations.

Reforma Alutsista Dan Sumber Daya Alam: Menjawab Tantangan Hukum Internasional Dan Perdamaian Dunia, Wildan Azkal Fikri, Rohadhatul Aisy

Jurnal Hukum & Pembangunan

This study departs from the paradox of the failure to achieve world peace despite the existence of an established international legal regime. It addresses three main objectives: (1) identifying the key factors that undermine world peace; (2) analyzing the failure factors of international law to realize global peace; and (3) formulating a responsive international legal architecture to future peace agendas. The study employs a critical descriptive method with a socio-legal (non-doctrinal) approach, drawing on the analytical frameworks of neorealism, great powers oligarchy, and Third World Approaches to International Law (TWAIL). The qualitative analysis is conducted by examining power relations, the …

Asset Forfeiture As An Animal Welfare Law: A Case Study On South Carolina's Bond-Or-Forfeit Statute, Morgan Mercer Jan 2026

Asset Forfeiture As An Animal Welfare Law: A Case Study On South Carolina's Bond-Or-Forfeit Statute, Morgan Mercer

Animal Law Review

This Comment examines South Carolina’s 2024 bond-or-forfeit statute (H.B. 3682) as a case study in the growing trend of extending existing legal frameworks to promote animal welfare. Traditionally, asset forfeiture treats animals purely as property subject to seizure. However, by shifting the costs of caring for seized animals from public agencies to the animals’ owners, H.B. 3682 embeds a concern for animal well-being into a framework historically focused on economic and property interests. This Comment argues that bond-or-forfeit statutes are part of a broader trend toward recognizing animals as sentient beings with welfare interests distinct from their owners’ property rights. …

Environmental Protection In War: Beyond Humans And Nature, Alexandra Huneeus, Pablo Rueda-Saiz Jan 2026

Environmental Protection In War: Beyond Humans And Nature, Alexandra Huneeus, Pablo Rueda-Saiz

Articles

War is not just a human tragedy-it is an environmental catastrophe. Across the globe, armed conflicts leave behind oil-slickened rivers, poisoned soils, and forests reduced to barren landscapes. These harms last for generations, but they are not borne equally. The peoples who live most intimately with the land-drawing from it food, water, culture, and identity-suffer the most enduring losses. Their very existence as a people may be put at risk.

This Article asks: How have the laws of war addressed environmental destruction, and, more specifically, what protection do they afford to communities whose very existence is bound to the places …
