Predictability And Adaptation In Law And Other Markets (Chapter In A Coming Book: Research Handbook On Law And Time), Saul Levmore Jan 2024

Predictability And Adaptation In Law And Other Markets (Chapter In A Coming Book: Research Handbook On Law And Time), Saul Levmore

Coase-Sandor Institute for Law & Economics Research Paper Series

People and enterprises that are subject to the law find it useful to know what the law is at present, but then also to anticipate future rules. If laws are stable this is easily done. Stability is more common where the judicial branch is concerned, because precedents are often valued, and for good reason. They are more often followed by judges than by those involved in other methods of lawmaking. But in all of lawmaking, and even in the private sphere, there is value to consistency and certainty. And yet, surprises can be attractive if they are not confronted on …

Growing Critical Information Literacy In Our General Education Program By Grounding Ourselves In An Ethics Of Care, Drew Wallace, Perri Moreno, Catherine Baird

University Libraries Scholarship and Creative Works

Montclair State University will begin implementing its new general education curriculum, known as Montclair Core, in the Fall 2024 academic term. Following years of collaborative conversations among university stakeholders, including the library, critical information literacy (CIL) was adopted as a foundational value in the new curriculum. Embedding CIL into the Montclair Core represents an incredible opportunity for the library to cultivate new partnerships and share our expertise more broadly with students and faculty. However, this opportunity also poses a number of challenges to an already under-resourced Research and Reference Services (RRS) department at the Harry A. Sprague Library. After years …

An Assessment Of The Hotel Customers’ Robotic Service Quality Perceptions: Scale Development And Validation, Ahmet Hacikara Jan 2024

An Assessment Of The Hotel Customers’ Robotic Service Quality Perceptions: Scale Development And Validation, Ahmet Hacikara

Graduate Thesis and Dissertation 2023-2024

"Hotel customers' interactions with service robots are becoming increasingly common, raising questions about how these interactions impact their experience. To address this gap in knowledge, this dissertation develops and validates a novel robotic service quality (ROBOQUAL) scale. Drawing on social exchange theory, the study examines the reciprocal relationship between hotel customers and artificially intelligent service robots, exploring how robotic service quality influences customers' perceptions of experience quality, satisfaction, and word-of-mouth intentions. The research employs focus-group studies, exploratory factor analysis (EFA), confirmatory factor analysis (CFA), and partial least squares equation modeling (PLS-SEM) to develop and validate the ROBOQUAL scale."

Through Smoke And Mirrors: Excluding Malingering Expert Testimony Under The Daubert Standard, Chunlin Leonhard, Christoph Leonhard Jan 2024

Through Smoke And Mirrors: Excluding Malingering Expert Testimony Under The Daubert Standard, Chunlin Leonhard, Christoph Leonhard

Georgia Law Review

Because of science’s claim to objectivity, scientific testimony is persuasive and often outcome-determinative. Our adversarial system incentivizes litigants to proffer scientific evidence to support their positions. The task falls on trial judges as gatekeepers to distinguish valid scientific evidence from junk science. Drawing this line is difficult because scientific evidence covers a broad spectrum. The United States Supreme Court has set forth the standard of admissibility of scientific evidence in Daubert and its progeny (the Daubert Standard). Trial judges are supposed to admit scientific evidence only if reliable and relevant under the Daubert Standard. But three decades after Daubert, …

Statutory Solutions For Stealthing: How States Should Amend Their Laws To Address Nonconsensual Condom Removal, Lauren Harter Jan 2024

Statutory Solutions For Stealthing: How States Should Amend Their Laws To Address Nonconsensual Condom Removal, Lauren Harter

Georgia Law Review

In recent years, growing awareness of “stealthing”—a term used to describe the act of removing a condom before or during sex without a partner’s consent—has led to widespread condemnation of the act as a form of sexual assault. However, legislatures across the United States have been slow to amend or add to their laws to specifically address stealthing, leaving countless victims without recourse. To date, only four states have successfully amended their laws to create civil penalties for stealthing, and not one treats stealthing as a crime. In an age where bodily autonomy seems increasingly at risk, it is imperative …

Storm-Generated Molluscan Thanatocoenosis Along A Carbonate Paleoshoreline: Southern Eleuthera Island, The Bahamas, Ilya Val Buynevich, Michael Savarese, H. Allen Curran, Tara Ingalsbe Jan 2024

Storm-Generated Molluscan Thanatocoenosis Along A Carbonate Paleoshoreline: Southern Eleuthera Island, The Bahamas, Ilya Val Buynevich, Michael Savarese, H. Allen Curran, Tara Ingalsbe

Geosciences: Faculty Publications

Concentrations of large mollusc shells in coastal deposits provide important information about the local malacofauna and potential transport agents, including extreme events [1-4]. Such accumulations are common in the rock record [5,6], with Quaternary examples serving as good time-averaged examples by combining aspects of both the modern biocoenoses and the fossil record. Death assemblages of local organisms (thanatocoenosis) and their preserved record (taphocoenosis) in carbonate settings, where granulometric spectrum may be very limited (e.g., ooilitic sand), can serve as important paleo-environmental indicators, especially when considered in combination with primary sedimentary structures (in outcrops or geophysical images) and in situ biogenic …

A New Method To Invert For Interseismic Deep Slip Along Closely Spaced Faults Using Surface Velocities And Subsurface Stressing-Rate Tensors, Hanna Elston, Michele Cooke, John Loveless, Scott Marshall Jan 2024

A New Method To Invert For Interseismic Deep Slip Along Closely Spaced Faults Using Surface Velocities And Subsurface Stressing-Rate Tensors, Hanna Elston, Michele Cooke, John Loveless, Scott Marshall

Geosciences: Faculty Publications

Inversions of interseismic geodetic surface velocities often cannot uniquely resolve the three-dimensional slip-rate distribution along closely spaced faults. Microseismic focal mechanisms reveal stress information at depth and may provide additional constraints for inversions that estimate slip rates. Here, we present a new inverse approach that utilizes both surface velocities and subsurface stressing-rate tensors to constrain interseismic slip rates and activity of closely spaced faults. We assess the ability of the inverse approach to recover slip rate distributions from stressing-rate tensors and surface velocities generated by two forward models: (a) a single strike-slip fault model and (b) a complex southern San …

Journal Articles: Oncology and Hematology

High-grade B-cell lymphoma not otherwise specified (HGBCL, NOS) has overlapping morphological and genetic features with diffuse large B-cell lymphoma (DLBCL) and Burkitt lymphoma (BL), leading to uncertainty in its diagnosis and clinical management. Using functional genomic approaches, we previously characterized HGBCL and NOS, that demonstrate gene expression profiling (GEP), and genetic signatures similar to BL. Herein, we characterize distinct HGBCL, NOS, cohort (n = 55) in adults (n = 45) and in children (n = 10), and compared the GEP, genomic DNA copy number (CN), and mutational spectrum with de novo DLBCL (n = 85) and BL (n = 52). …

Legal Risk And Accountability In Development Finance: Lessons From Jam V. International Finance Corporation, Michelle Harrison, Shannon Marcoux Jan 2024

Legal Risk And Accountability In Development Finance: Lessons From Jam V. International Finance Corporation, Michelle Harrison, Shannon Marcoux

Perspectives

In a landmark decision in 2019, the U.S. Supreme Court ruled in Jam v. International Finance Corporation that international organizations like the International Finance Corporation (IFC), the private lending arm of the World Bank Group, can be sued in U.S. courts, ending the “absolute immunity” from suit that they had long claimed. The Jam lawsuit arose out of IFC’s gross mishandling of the Tata Mundra coal-fired power plant project in Gujarat, India, which has destroyed the livelihoods, environment, and way of life of local communities living in its shadow. The lawsuit, and especially the clash between IFC’s sweeping assertions of …

Are The Mdbs Accountable? Reflecting On The Independent Accountability Mechanisms Of The Multilateral Development Banks, Susan Park Jan 2024

Are The Mdbs Accountable? Reflecting On The Independent Accountability Mechanisms Of The Multilateral Development Banks, Susan Park

Perspectives

The International Accountability Mechanisms of the Multilateral Development Banks provide important insights into how to hold intergovernmental organizations to account for their environmental and social impacts. This perspective identifies how the IAMs hold the Banks to account according to the six standard questions of accountability: who is accountable, to whom, for what are they accountable, and what are the standards, processes, and sanctions employed to demonstrate that the MDBs are accountable. This highlights what the IAMs can and cannot hold the MDBs to account for, and how this might shape further international grievance mechanisms for people seeking to defend their …

The River Of Accountability Mechanisms: Then And Now, Suresh Nanwani

Perspectives

In 1993, the river of international accountability mechanisms (IAMs) commenced from its source – the World Bank Inspection Panel (The Panel). In its journey the river was fed by the tributaries of similar accountability mechanisms from other development institutions, including four regional development banks – the Inter-American Development Bank in 1994, the Asian Development Bank in 1995, the European Bank for Reconstruction and Development in 2003, and the African Development Bank in 2006. It also welcomed other entities – bilateral institutions like Japan Bank for International Cooperation (2003) and Proparco (2018), United Nations Development Program (2014) and other organizations like …

The Effects Of Beaver Dam Anaolgs On Linked Aquatic-Terrestrial Communities In Western Headwater Streams, Michelle Elyse Fillion, Benjamin P. Colman, Rachel L. Malison Jan 2024

The Effects Of Beaver Dam Anaolgs On Linked Aquatic-Terrestrial Communities In Western Headwater Streams, Michelle Elyse Fillion, Benjamin P. Colman, Rachel L. Malison

Graduate Student Theses, Dissertations, & Professional Papers

In response to stream degradation resulting from the near eradication of American Beavers (Castor canadensis), managers of freshwater systems have turned to using beaver dam analogs (BDAs) as one means of restoring waterways from stream and riparian degradation. Though BDAs have been shown to restore physical traits of riparian areas, their influence on macroinvertebrates and linked aquatic-terrestrial systems is not well understood. To examine how BDAs influence aquatic habitats, macroinvertebrate communities, and riparian insectivores, we compared unrestored reference stream segments to BDA-restored segments with 7-14 BDAs in three western Montana headwater streams. We collected physical stream measurements and quantitative samples …

In the face of ongoing biodiversity loss and limited resources, the urgency for effective conservation strategies and planning is vital. This paper explains key components and principles of effective conservation planning, applicable across various temporal and spatial scales, institutional contexts, and motivations for conservation. These components encompass framing the conservation planning problem, devising solutions, and implementing strategies. Effective planning efforts are supported by principles such as formulating a clear purpose statement, establishing objectives, addressing critical uncertainties, integrating knowledge into decision-making processes, and embracing flexibility and iteration. Incorporating these elements into conservation planning enhances decision-makers' ability to make informed decisions, ultimately …

A Closer Look At Denali’S Alpine Wildlife: Assessing The Influences Of Climate And Vegetation Changes On Species In Alaska, Jennifer Lynn Wall Jan 2024

A Closer Look At Denali’S Alpine Wildlife: Assessing The Influences Of Climate And Vegetation Changes On Species In Alaska, Jennifer Lynn Wall

Graduate Student Theses, Dissertations, & Professional Papers

Climate change is amplified in polar regions and could have considerable consequences for biodiversity. Arctic and boreal regions, in particular, have warmed more than double the global average and are experiencing increasing precipitation, thawing permafrost, shrinking snow seasons, and increasing shrub- and tree-line encroachment. These changes are suspected to influence key alpine biodiversity, including species such as collared pikas (Ochotona collaris), hoary marmots (Marmota caligata), and Arctic ground squirrels (Urocitellus parryii). But, we have limited understanding of whether this is true and, if so, which factors drive distributional shifts in response to climate change. For this dissertation, I collected data …

Habitat Selection And Connectivity Of Mountain Lions (Puma Concolor) Across Anthropogenic Barriers On The Olympic Peninsula: A Multi-Method Comparison, Thomas R. Barbee Jan 2024

Habitat Selection And Connectivity Of Mountain Lions (Puma Concolor) Across Anthropogenic Barriers On The Olympic Peninsula: A Multi-Method Comparison, Thomas R. Barbee

Graduate Student Theses, Dissertations, & Professional Papers

Designing and maintaining effective wildlife corridors is an increasingly important conservation challenge in today’s fragmenting landscapes. GPS-based resource selection functions and camera-based occupancy models are both well-established staples of wildlife connectivity analyses and corridor planning, but each have notable trade-offs in cost and data resolution. Wildlife organizations worldwide rely heavily on camera-based occupancy modelling to plan wildlife corridors, especially where resource limitations or ethical concerns prohibit the use of GPS tags. If spatial connectivity maps from occupancy models could be shown to capture the essential elements of animal movement well enough to identify functionally equivalent corridors to those identified in …

Effects Of Mortality Risk And Ecological Conditions On Songbird Movement, Foraging, Parental Care, And Body Mass Management, Timothy Robert Forrester Jan 2024

Effects Of Mortality Risk And Ecological Conditions On Songbird Movement, Foraging, Parental Care, And Body Mass Management, Timothy Robert Forrester

Graduate Student Theses, Dissertations, & Professional Papers

Examining why species vary in behavior and life history strategies is a fundamental part of ecology and evolution. Yet, due to the difficulties of quantifying behavior in the field, we know surprisingly little about how species spend their time and energy daily, why interspecific differences occur, and what are the physiological and demographic consequences of these differences. In this dissertation, I use songbirds to examine the influence of ultimate selection pressures (e.g., mortality risk) and proximate ecological conditions (e.g., temperature) on foraging and reproductive behavior. I also examine the influence of reproductive behaviors on fitness correlates (e.g., body mass, reproductive …

To Revise Or Not To Revise: How Feedback Type, Interpersonal Liking, And Messenger Credibility Influence Revision, Rachel Jane Jensen Jan 2024

To Revise Or Not To Revise: How Feedback Type, Interpersonal Liking, And Messenger Credibility Influence Revision, Rachel Jane Jensen

Graduate Student Theses, Dissertations, & Professional Papers

Revisions inevitably occur during project creation and curation; many of which are influenced by received feedback. Previous research has highlighted the role goals, perceptions of self, and task complexity play in revision, but little research has examined how feedback type and an individual’s feelings toward their feedback giver influence revision. A quasi-experimental design examined how feedback type (additive, subtractive, or none), interpersonal liking for a feedback-giver, and perceived credibility of a feedback-giver affected students’ (n = 155) willingness to revise, self-reports of revision, and calculated actual revision score. Results indicated that participants in a feedback-receiving condition reported higher levels of …

Peoples Of India: The Use Of Craniometric Data To Distinguish A Separate Ancestral Group, Stephanie A. Craig Jan 2024

Peoples Of India: The Use Of Craniometric Data To Distinguish A Separate Ancestral Group, Stephanie A. Craig

Graduate Student Theses, Dissertations, & Professional Papers

The Peoples of India come from an area with a long history of migrations into and out of the area. This area is considered the second most diverse genetically outside of Africa. Many would group these people as Asian due to the country’s location. However, when studies are done on the skeletal remains from this area, the remains tend to give results of mixed or indeterminate ancestry unless the analyst is familiar with identifying Peoples of India. This study aims to determine the Peoples of India as a separate ancestral group separated from Asians, Europeans, and Africans. To do this, …

Drought Conditioning Conifer Seedlings For Post-Fire Management And Climate Change Adaptation, Anna C. Ross

Graduate Student Theses, Dissertations, & Professional Papers

Increased frequency, severity, and duration of drought and increased wildfire severity are together impacting forests of the western U.S. To encourage forest ecosystem resilience to these changing disturbance regimes, there is a need for novel silvicultural techniques that develop seedlings capable of establishing in hotter and drier climates. We evaluated the morphological and physiological effects of a drought conditioning treatment applied in a greenhouse on second- year ponderosa pine (Pinus ponderosa), western white pine (Pinus monticola), and western larch (Larix occidentalis) seedlings. Treatments included a well-watered control (75% of container capacity) and a water-limited …

A Comparison Of Concurrent Training And Moderate Intensity Continuous Training In Patients With Coronary Artery Disease, Amanda Alfaro-Chaverri, John Quindry, Charles Dumke, Brian Loyd Jan 2024

A Comparison Of Concurrent Training And Moderate Intensity Continuous Training In Patients With Coronary Artery Disease, Amanda Alfaro-Chaverri, John Quindry, Charles Dumke, Brian Loyd

Graduate Student Theses, Dissertations, & Professional Papers

Moderate intensity continuous training (MICT) is the most studied method in cardiac rehabilitation (CR) for patients with coronary artery disease (CAD). Traditionally, resistance training has been utilized as a secondary role in CR. Recent interest in the topic suggests that MICT and resistance training should be applied collectively, an approach termed concurrent training (CT). The collective understanding of the potential of CT in CR patients is currently lacking.

Purpose: The aim of this professional paper is to analyze scientific evidence regarding the efficacy and safety of CT versus MICT. The analysis will focus on five primary measurements: exercise capacity, cardiovascular …
