Multiple Proceedings And Abuse Of Procedure On Bri Disputes, Mariam Gotsiridze
Multiple Proceedings And Abuse Of Procedure On Bri Disputes, Mariam Gotsiridze
Research Collection Yong Pung How School Of Law
This article argues that specific mechanisms and best practices should be adopted by different players in the Belt and Road Initiative (BRI) dispute resolution ecosystem to mitigate the risks of multiple proceedings and abuse of procedure. Specifically, (i) states should enhance their multilateral and bilateral treaty practices; (ii) arbitral institutions should enhance their arbitral rules as well as cooperate with each other; and (iii) states should direct more efforts to dispute prevention and amicable dispute settlement. This article will explain what these best practices and mechanisms are.
Not Such Massively Discretionary Trusts: Proper Purposes Doctrine And Protectors As Means Of Control, Man Yip, Hang Wu Tang
Not Such Massively Discretionary Trusts: Proper Purposes Doctrine And Protectors As Means Of Control, Man Yip, Hang Wu Tang
Research Collection Yong Pung How School Of Law
Innovation in drafting trust deeds has been central to international trust practice resulting in the discretionary trusts being the norm in modern wealth management. In a seminal article, Lionel Smith observes that these trust drafting practices have ‘led to an increase in the dispositive discretions held by trustees’. His analysis deprecates this development where the ‘trustees’ dispositive discretions effectively govern the whole trust structure’—which he labels ‘massively discretionary trusts’. Smith goes on to detail the various legal risks entailed in massively discretionary trusts which generally arise from the fact that the explicitly identified residuary or default beneficiaries are usually not …

Constitutional, Governance Or Market Failures: China, Climate Change And Energy Transition, Henry S. Gao, Weihuan Zhou
Research Collection Yong Pung How School Of Law
Jinping announced China’s plan to further scale up its Intended Nationally Determined Contributions, aiming at achieving CO2 emissions peak before 2030 and carbon neutrality before 2060.2 A central element of the plan is reducing China’s heavy reliance on coal power. As a result, China’s use of coal already saw a steady decrease between 2013 and 2018. While coal demand increased in 2019 and 2020, new coal power plants approved in 2021 declined by approximately 58% compared to 2020.3 However, the good progress in energy transition was interrupted by the power outage sprawling over 20 provinces in China in September 2021, …
Within-Development Density And Housing Prices In Singapore, Eric Fesselmeyer, Haoming Liu, Louisa Poco
Within-Development Density And Housing Prices In Singapore, Eric Fesselmeyer, Haoming Liu, Louisa Poco
Research Collection College of Integrative Studies
This paper measures how much more households pay for less density in their immediate surroundings. Using transaction and administrative data and exploiting the introduction of a regulation that restricted the number of housing units for certain land lots, we find that households discount density: a 10% increase in within-development density decreases the price per square meter by 5%. Further, the mean price per square meter of the average development increased by 1%–3% after the regulation was introduced, while the amount of built-up space remained constant. The increase in total revenue suggests developers may underestimate the externality caused by density.

Measurement Of Regional Electric Vehicle Adoption Using Multiagent Deep Reinforcement Learning, Seung Jun Choi, Junfeng Jiao
Research Collection College of Integrative Studies
This study explores the socioeconomic disparities observed in the early adoption of Electric Vehicles (EVs) in the United States. A multiagent deep reinforcement learning-based policy simulator was developed to address the disparities. The model, tested using data from Austin, Texas, indicates that neighborhoods with higher incomes and a predominantly White demographic are leading in EV adoption. To help low-income communities keep pace, we introduced tiered subsidies and incrementally increased their amounts. In our environment, with the reward and policy design implemented, the adoption gap began to narrow when the incentive was equivalent to an increase in promotion from 20% to …

Infrared Investigation In Singapore (Iris) Observatory: Urban Heat Island Contributors And Mitigators Analysis Using Neighborhood-Scale Thermal Imaging, Clayton Miller, Vasantha Ramani, Clayton Miller
Research Collection College of Integrative Studies
This paper studies heat fluxes from contributors and mitigators of urban heat islands using thermal images and weather data. Thermal images were collected by a rooftop observatory between November 2021 and April 2022. Over the same period, weather stations were operating at several locations on a university campus in Singapore. From collected data, a method was defined to estimate sensible and latent heat fluxes from building façades, vegetation, and traffic. Before analyzing heat fluxes using the method, thermal images were calibrated against measurements made with contact surface sensors. Results show that the method can be used to study heat fluxes …

Racial inequality in public education is not inevitable, it is constructed. The law has been elemental in crafting racial inequality in public education. In this Article, I posit that lawmakers seeking to entrench racial inequality in and through public education do so by enacting laws designed to deny Black children access to education, defund public schools disproportionately attended by Black children, and divert many Black educators away from the public education system. This Article draws a through-line between laws enacted to prevent desegregation in the aftermath of the Brown v. Board of Education ruling—an era known as massive resistance—and recently …

U.S. Federal Indian Law is built upon presumptions that tribal sovereign power derives from land claims. But as the digital economy grows, land-based constraints on tribal authority effectively punish tribes who attempt to participate. This terrestrial notion of tribal sovereignty will also block tribes from engaging in the space economy once it matures. Land-centered sovereignty is embedded within the Indian Gaming regulatory framework. The Indian Gaming Regulatory Act’s (“IGRA”) “Indian Lands” requirement and its presumption of land-based casinos make Indian Gaming an expression of terrestrial sovereignty only. Online gambling and mobile sports wagering are not land-based and therefore are not …
The Effects Of The Hyper-Globalization Of Legalized Sports Betting On Match-Fixing And Competition Manipulation In The Olympics, Riley Helgren
The Effects Of The Hyper-Globalization Of Legalized Sports Betting On Match-Fixing And Competition Manipulation In The Olympics, Riley Helgren
UNLV Gaming Law Journal
The Supreme Court’s decision to strike down the Professional and Amateur Sports Protection Act (PASPA) in Murphy v. National Collegiate Athletic Association (NCAA) opened the floodgates for states to permit sports betting. With the expansion of online sportsbooks, individuals can place bets on virtually any sporting event from their smartphone. The legalization of online sports betting is quickly expanding worldwide and has created a multi-billion-dollar industry. The globalization of legal sports betting and lack of uniform regulations poses a threat to the Olympic Games by providing additional incentives for athletes, coaches, and officials to participate in match-fixing and competition manipulation. …

It should be noted that despite the general counterculture of SoCal in the late 1980s, at the time of Tribal's birth, the laid-back attitude of generation X (1965–80),4 which included apathy and disillusion with the political and 92 economic climate (that “grungy” college educated/tech savvy white American generation Xers experienced under Reagan's neo-liberalism and neo-conservatism), was vastly different to Black and Brown youth in major cities across the United States. Black and Brown people were marginalized on grounds of race, which was exacerbated by police brutality, neighborhoods flooded with drugs (Love, 2016) and weapons, horizontal violence (see Fanon, 2001) …

Quality Assurance Project Plan - West Plains Pfas, Chad Pritchard
EWU PFAS Research Collection
Assessing the impacts of poly- and perfluoroalkyl substances (PFAS) contamination across multiple aquifers and multiple sources requires a detailed understanding of the hydrogeologic framework to quantifiably determine PFAS sources. The West Plains of eastern Washington is an ideal natural laboratory to study the fate and transport of PFAS because the general geohydrologic framework has been established and collaboration with several related PFAS projects will maximize the use of grant funds. This project will help the population, environment, and commercial entities of the West Plains by building a transport model, delineating PFAS contamination, and using unique PFAS distribution at different locations …

Which Police Departments Make Black Lives Matter?, Robert Maranto, Wilfred Reilly, Patrick J. Wolf
Education Reform Faculty and Graduate Students Publications
Black Lives Matter (BLM) has gained support across racial lines and considerable financial backing. Yet it is unclear whether social science has responded with research likely to save Black lives. To encourage more applied research and related public discussion, we rank police departments in the 50 largest U.S. cities by their effectiveness in keeping homicides low and not taking civilian lives, while adjusting for poverty, which makes policing more difficult. We find enormous variation in police performance and offer qualitative evidence that this reflects organizational practices. We conclude with ideas for reform.
3F4 Hypergeometric Functions As A Sum Of A Product Of 2F3 Functions, Jack C. Straton
3F4 Hypergeometric Functions As A Sum Of A Product Of 2F3 Functions, Jack C. Straton
Physics Faculty Publications and Presentations
This paper shows that certain 3F4 hypergeometric functions can be expanded in sums of pair products of 2F3 functions, which reduce in special cases to 2F3 functions expanded in sums of pair products of 1F2 functions. This expands the class of hypergeometric functions having summation theorems beyond those expressible as pair-products of generalized Whittaker functions, 2F1 functions, and 3F2 functions into the realm of pFq functions where p < q for both the summand and terms in the series. In addition to its intrinsic value, this result has a specific application in calculating the response of the atoms to laser stimulation in the Strong Field Approximation.

Dhea: A Neglected Biological Signal That May Affect Fetal And Child Development, Natasha A. Bailey, Elysia Poggi Davis, Curt A. Sandman, Laura M. Glynn
Psychology Faculty Articles and Research
The stress-sensitive maternal hypothalamic–pituitary–adrenal (HPA) axis through the end-product cortisol, represents a primary pathway through which maternal experience shapes fetal development with long-term consequences for child neurodevelopment. However, there is another HPA axis end-product that has been widely ignored in the study of human pregnancy. The synthesis and release of dehydroepiandosterone (DHEA) is similar to cortisol, so it is a plausible, but neglected, biological signal that may influence fetal neurodevelopment. DHEA also may interact with cortisol to determine developmental outcomes. Surprisingly, there is virtually nothing known about human fetal exposure to prenatal maternal DHEA and offspring neurodevelopment. The current study …

Variation In Leaf Chlorophyll Concentration In Response To Nitrogen Application Across Maize Hybrids In Contrasting Environments, Kyle M. Linders, Dipak K. Santra, James C. Schnable, Brandi Sigmon
Department of Agronomy and Horticulture: Faculty Publications
Leaf chlorophyll concentration was measured for 84 publicly available maize hybrids grown under three nitrogen fertilizer treatments in two contrasting environments in Nebraska. The effect of nitrogen treatment on chlorophyll response was found to be significant (p < 0.05) for both locations. In Scottsbluff, chlorophyll concentrations increased significantly with increasing nitrogen rate, while no significant difference was found between medium and high nitrogen in Lincoln. Within equivalent nitrogen treatments, chlorophyll was more abundant in Lincoln than Scottsbluff for nearly every hybrid. Hybrid response was not consistent between environments, with approximately 11% of variance explained by genotype by environment interaction.
