Changes In Chapter 11 Success Levels Since 1980, Lynn M. Lopucki Jan 2015

Changes In Chapter 11 Success Levels Since 1980, Lynn M. Lopucki

UF Law Faculty Publications

This Article revisits the nine measures of success that Bill Whitford and I reported on in Patterns in the Bankruptcy Reorganization of Large, Publicly Held Companies, with twenty-six additional years of experience and data on 964 additional cases. My principal objective has been to determine whether Chapter 11 has become more or less successful by those measures. I conclude that Chapter 11 has become less successful by three of the seven LoPucki-Whitford criteria for which data are available. The courts confirm plans in a significantly smaller proportion of cases, a significantly smaller proportion of companies survive, and a significantly smaller …

Bankruptcy Survival, Lynn M. Lopucki, Joseph W. Doherty Jan 2015

Bankruptcy Survival, Lynn M. Lopucki, Joseph W. Doherty

UF Law Faculty Publications

Of the large, public companies that seek to remain in business through bankruptcy reorganization, only 70% succeed. The assets of the other 30% are absorbed into other businesses. Success is important both because it is efficient and it preserves jobs, communities, supplier and customer relationships, and tax revenues. This Article reports the findings of the first comprehensive study of the division into successful and failed reorganizations. Eleven conditions best predict companies’ survival prospects. First, a company that even hints in the press release announcing its bankruptcy that it intends to sell its business is highly likely to fail. Second, reorganizations …

Clear And Simple Deportation Rules For Crimes: Why We Need Them And Why It's Hard To Get Them, Rebecca Sharpless Jan 2015

Clear And Simple Deportation Rules For Crimes: Why We Need Them And Why It's Hard To Get Them, Rebecca Sharpless

Articles

In Padilla v. Kentucky, the U.S. Supreme Court held that defense attorneys have a Sixth Amendment duty to advise noncitizen clients of the "clear" immigration consequences of a proposed plea agreement. This Article argues that the Court's reference to clarity denotes predictability, not simplicity, and that defense attorneys must advise their clients of predictable immigration consequences, even if they are difficult to ascertain. The scope of this duty has broadened as the U.S. Supreme Court has made the crime-related deportation rules more determinate, although many rules remain complex. A legislative move to a regime of simple deportation rules would …

Communal Division And Constitutional Changes In Colonial Fiji, 1959-1970, Donald D. Johnson Jan 2015

Communal Division And Constitutional Changes In Colonial Fiji, 1959-1970, Donald D. Johnson

Open Access Theses

This essay examines the role of communal division in changes to Fiji’s constitution during the decade prior to Fiji becoming an independent state. Amicable relations between indigenous Fijians and Indians who migrated under indentured servitude began to crack in 1959 and broke open during political negotiations and the constitutional conference of the 1965. The subsequent election in 1966 solidified the political gains of fledgling parties and entrenched communal divides between the pro-Indian National Federation Party and the Alliance Party, theoretically race neutral, representing the interests of Fijians. By 1969 the political calculus of both the National Federation Party and the …

Process Development For Evaluating Utility Scale Solar At A Combined Heat And Power Facility, Samuel Joseph Landry Jan 2015

Process Development For Evaluating Utility Scale Solar At A Combined Heat And Power Facility, Samuel Joseph Landry

Open Access Theses

When considering the value of utility scale solar project and its impact, there are many variables to weigh and this can become a complex task without guidance. One key to a successful project is the ability to organize ideas and break down problems by sections. An array is only as valuable as the energy that it offsets. The rates that are offered in complex generation scenarios often vary from the more stable rates seen by residential spaces. Because of this, an investment in a solar array may not have the same straight forward payback as a residence. Essentially, the array’s …

Constructing Action-Oriented Organizations: Examining The Relationship Between Individual And Organizational Identity, Virginia Sanchez Jan 2015

Constructing Action-Oriented Organizations: Examining The Relationship Between Individual And Organizational Identity, Virginia Sanchez

Open Access Theses

A majority of the research on social entrepreneurship focuses on stories about individual entrepreneurs (Bornstein & Davis, 2010) and the characteristics that make entrepreneurs and their nascent organizations successful (Renko, 2012); this study instead puts the focus on organizational founders and members in an attempt to analyze how they made sense of critical moments in the organization’s early history and stories that helped to shape the organization’s identity and individual members’ identities. A total of 8 interviews were conducted with members of two organizations. Cultivadores (pseudonym) is an organization focused on the creation of psychosocial processes within the rural community …

Temporal Changes In Routine Health Markers And Their Association With Illness And Mortality Rates In Cats Naturally Infected With Feline Immunodeficiency Virus, Jamieson Nichols Jan 2015

Temporal Changes In Routine Health Markers And Their Association With Illness And Mortality Rates In Cats Naturally Infected With Feline Immunodeficiency Virus, Jamieson Nichols

Open Access Theses

Feline immunodeficiency virus is an important lentiviral infection in cats. Infection is life-long and results in immune compromise, increased susceptibility to opportunistic infections and early mortality. Infection is commonly referred to in three stages: acute, (asymptomatic) and end stage (symptomatic); although not all cats will progress to end stage disease. Acute infection lasts several months during which cats may have mild, transient anorexia, lethargy, fever, lymphadenomegaly and diarrhea. There is loss of mucosal and peripheral CD4 T cells, expansion of a subset of CD8 T cells, CD8βlow, and establishment of viremia during this period. Asymptomatic infection lasts a variable period …

Gaussian Processes With Built-In Dimensionality Reduction: Applications In High-Dimensional Uncertainty Quantification, Rohit Kaushal Tripathy Jan 2015

Gaussian Processes With Built-In Dimensionality Reduction: Applications In High-Dimensional Uncertainty Quantification, Rohit Kaushal Tripathy

Open Access Theses

Uncertainty quantification (UQ) tasks, such as model calibration, uncertainty propagation, and optimization under uncertainty, typically require several thousand evaluations of the underlying computer codes. To cope with the cost of simulations, one replaces the real response surface with a cheap surrogate based, e.g., on polynomial chaos expansions, neural networks, support vector machines, or Gaussian processes (GP). However, the number of simulations required to learn a generic multivariate response grows exponentially as the input dimension increases. This curse of dimensionality can only be addressed, if the response exhibits some special structure that can be discovered and exploited. A wide range of …

Constrained Optimized Command Shaping For Minimizing Residual Vibration In A Flexible-Joint Robot, Alok Agrawal Jan 2015

Constrained Optimized Command Shaping For Minimizing Residual Vibration In A Flexible-Joint Robot, Alok Agrawal

Open Access Theses

Joint flexibility is a natural trait of robotic manipulators, which limits fast point-to-point motion. Remedial measures are often employed to enable these systems to perform their goal in a desired manner. These measures range from either modifying the system dynamics such that the resonance is increasingly damped or by designing cleverly shaped input commands that avoid exciting the resonant modes altogether. In this work, a numerical framework for generating constrained shaped commands for a two-link flexible-joint robot is presented. To optimally select the design parameters for generating shaped commands, the effects of subjecting the optimization to mutually exhaustive constraints of …

Developing A Metadata Repository For Distributed File Annotation And Sharing, Samuel Wilson Jan 2015

Developing A Metadata Repository For Distributed File Annotation And Sharing, Samuel Wilson

Open Access Theses

Research data is being generated and modified at an increasingly accelerated rate. Iterations and derivations are being crafted at an almost equal velocity. With this increase comes a growing need to track the metadata about the data being generated. Where did this dataset originate? What exactly do the column headers mean? Who was the original publisher? Do I have the latest version of the data? This is to only name a few. As data is shared second or third-hand, or via alternative methods such as physical media or cloud based storage mechanisms, the veracity of the implicit metadata becomes circumstantial. …

An Investigation Into Syk's Ability To Interact With And Regulate Protein Arginine Methyltransferase Activity, Stephen Russell Tapaszi Jan 2015

An Investigation Into Syk's Ability To Interact With And Regulate Protein Arginine Methyltransferase Activity, Stephen Russell Tapaszi

Open Access Theses

Spleen Tyrosine Kinase (Syk) is a 72 kDa non-receptor protein-tyrosine kinase. It plays an essential role in B cell development and signaling downstream of many immune receptors. However, its expression is not limited to just B cells, as it has been shown to play a functional role in signaling in many other hematopoietic cell types such as thymocytes, mast cells, macrophages and natural killer cells. Its expression and roles have expanded since its original discovery; and it has now been associated with epithelial tissues as well as tumor progression and prognosis. A particular interest has focused on Syk and its …

Can We Put Photobiology To Work? Using Light To Manipulate The Nutritional And Sensory Properties Of Greenhouse Tomatoes, Michael Dzakovich Jan 2015

Can We Put Photobiology To Work? Using Light To Manipulate The Nutritional And Sensory Properties Of Greenhouse Tomatoes, Michael Dzakovich

Open Access Theses

While generally viewed within the context of plant growth and development, different qualities of light are also powerful elicitors of secondary metabolic pathways in plants that affect the nutritional value and flavor of edible tissues. Leveraging fundamental photobiology principles, our studies sought to use different qualities of supplemental light including ultraviolet-B (UV-B), UV-A, blue, red, and far-red as an environmental treatment to restore garden-grown flavor and nutritional attributes to greenhouse-grown tomatoes (Solanum lycopersicum); a commercially important crop that has a poor reputation compared to its garden-grown counterparts. To test our hypotheses, we used a battery of physicochemical analyses that included …

The Role Of Snow In Soil Thermal Dynamics Of The Arctic Terrestrial Ecosystems, Zhou Lyu Jan 2015

The Role Of Snow In Soil Thermal Dynamics Of The Arctic Terrestrial Ecosystems, Zhou Lyu

Open Access Theses

The vast area of permanent or seasonal snow cover is an essential component of terrestrial ecosystems in northern mid-to-high latitudes (45-90°N), which has insulation effects on the soil layer beneath it. The affected soil thermal regimes will impact soil carbon dynamics. Recent observations indicate that there are substantial changes in both snow cover extent and duration due to climate change in the area. It is important to understand the insulation effect historically so as to better quantify its role in affecting ecosystem carbon dynamics under changing climate in the future. This study incorporates the snow insulation effect by introducing a …

Job Mobility Among Young College Graduates, Kevin Camp Jan 2015

Job Mobility Among Young College Graduates, Kevin Camp

Open Access Theses

This study focuses on the question of whether job mobility relates to improved labor market outcomes among young college-educated individuals in the United States. I analyze unemployment duration, overeducation, and wage earnings among college graduates. The analysis centers around three specific questions: (1) Are there differences in labor market outcomes for those who migrate ("movers") and those who stay ("stayers")? (2) Did the recent economic crisis exacerbate the mover-stayer differences? (3) Do mover-stayer differences vary for individuals based on their demographic characteristics or where they live? I examine data on migrant status, location before and after a move, reasons for …

Bond V. United States: Choosing The Lesser Of Two Evils, David L. Sloss Jan 2015

Bond V. United States: Choosing The Lesser Of Two Evils, David L. Sloss

Faculty Publications

In Bond v. United States, Carol Anne Bond used toxic chemicals in an attempt to poison her husband’s lover. The federal government prosecuted Bond for violating the Chemical Weapons Convention Implementation Act of 1998 (the “CWC Act”). Congress enacted the CWC Act to implement U.S. obligations under the Chemical Weapons Convention (CWC), a multilateral treaty signed in 1993 that is designed to address the global threat posed by chemical weapons. Bond challenged the constitutional validity of the federal statute and urged the Court to overrule Missouri v Holland, a 1920 case holding that the combination of the Treaty Power and …
