The State Of Mobile Learning Implementation In Government Cabinet-Level Agencies And Departments, Algernon B. Corbett Jan 2015

The State Of Mobile Learning Implementation In Government Cabinet-Level Agencies And Departments, Algernon B. Corbett

CCAC Theses and Dissertations

As mobile technologies have increasingly become a part of personal and work environments, mobile learning is emerging as a viable alternative for training and education needs. Faced with the need for innovative and cost-efficient ways for training government employees, agencies and departments are considering the use of mobile learning. The availability of a wide range of mobile technology provides many options. Other than the Department of Defense, little is known about implementing mobile learning in United States government cabinet level agencies and departments. A concurrent, mixed methods case study was used to examine how organizations decide to use, implement and …

“It Broadens Your View Of Being Basque”: Identity Through History, Branding And Cultural Policy, Nina M. Ray, John P. Bieter Jan 2015

“It Broadens Your View Of Being Basque”: Identity Through History, Branding And Cultural Policy, Nina M. Ray, John P. Bieter

Marketing Faculty Publications and Presentations

The purpose of the paper is to address what is the impact of the synthesis between Basque history, branding identity and Law 8/1994 on Basque identity in the homeland and Diaspora. Naturally occurring brands combine history, anthropology, sociology, and marketing to explain the phenomenon of communities defined by a sense of place. Focusing on both the Basque Country and Basques in Boise, Idaho as one case study, the authors discuss how the naturally occurring brand and cultural policy of the Basque people became formalized 20 years ago with Law 8/1994. The article addresses who the Basques are and how they …

Digital Patent Infringement In An Era Of 3d Printing, Lucas S. Osborn, Timothy R. Holbrook Jan 2015

Digital Patent Infringement In An Era Of 3d Printing, Lucas S. Osborn, Timothy R. Holbrook

Scholarly Works

The digital revolution has now moved beyond music and video files. A person can now translate three-dimensional objects into digital files and, at the press of a button, recreate those items via a 3D printer or similar device. Just as digitization placed pressure on the copyright system, so will these digital computer-aided design (“CAD”) files stress the patent system. Patents directed to physical objects can now have their value appropriated not only by the transfer of physical embodiments but also by the transferring of CAD files designed to print the invention. We term this phenomenon digital patent infringement.

In this …

A Case For Weakening Patent Rights, Lucas S. Osborn, Joshua M. Pearce, Amberlee Haselhuhn

Scholarly Works

This Article contributes to the patent debate by observing that new and emerging technologies are radically altering the relative costs and benefits of the patent system. Although analysts cannot measure the patent system's numerous absolute costs and benefits, this Article demonstrates that new and emerging technologies are significantly reducing the research, development, and commercialization costs ("innovation costs") that are used by adherents to the incentive and prospect theories to justify the patent system's existence. All things being equal, if significantly, the relative need for the patent system has decreased and will continue to decrease. Thus, this Article argues that patents …

Comment: Retroactivity And The Future Of Sex Offender Registration In Maryland, Timothy J. Gilbert Jan 2015

Comment: Retroactivity And The Future Of Sex Offender Registration In Maryland, Timothy J. Gilbert

University of Baltimore Law Forum

Maryland’s statutory sex offender registration scheme requires certain convicted sex offenders residing in Maryland to register with the Department of Public Safety and Correctional Services (the Department), or to register with another law enforcement or correctional entity for certain lengths of time depending on the offense(s) for which they were convicted. Among them are potentially “thousands of Maryland sex offenders” who have been required to register for offenses committed before the enactment of Maryland’s registration scheme. Retroactive application of sex offender registration schemes like Maryland’s, under the direction of the federal Sex Offender Registration and Notification Act (SORNA), has prompted …

Let Freedom Ring: Broadening Foia's Public Domain And The Applicability Of The Waiver Doctrine, Kayla Berlin Jan 2015

Let Freedom Ring: Broadening Foia's Public Domain And The Applicability Of The Waiver Doctrine, Kayla Berlin

Loyola of Los Angeles Entertainment Law Review

This Comment examines the waiver doctrine, which requires the government to reveal information it could normally withhold under an exemption of the Freedom of Information Act (“FOIA”) because the information is deemed to have already entered the public domain. The Comment begins by tracing the origin of FOIA as an improvement upon the inadequate Administrative Procedure Act. Second, the Comment discusses the competing tests used in determining when information has entered the public domain—the D.C. Circuit’s permanent public record test and the Ninth Circuit’s unlimited disclosure test—as well as their application in a case involving the film Zero Dark Thirty. …

Whose Urban Forest? The Political Ecology Of Foraging Urban Nontimber Forest Products, Patrick T. Hurley, Marla R. Emery, Rebecca J. Mclain, Melissa R. Poe, Brain Grabbatin, Cari L. Goetcheus Jan 2015

Whose Urban Forest? The Political Ecology Of Foraging Urban Nontimber Forest Products, Patrick T. Hurley, Marla R. Emery, Rebecca J. Mclain, Melissa R. Poe, Brain Grabbatin, Cari L. Goetcheus

Institute for Sustainable Solutions Publications and Presentations

Drawing on case studies of foraging in Philadelphia, Pennsylvania and Mt. Pleasant, South Carolina, we point to foraging landscapes and practices within diverse urban forest spaces. We examine these spaces in relation to U.S. conservation and development processes and the effects of management and governance on species valued by foragers. These case studies reveal the everyday landscapes of urban foraging and suggest that ideas about what constitutes the suite of appropriate human-environment interactions in the sustainable city are contested and accommodated in diverse ways.

In The Name Of The Child: Race, Gender, And Economics In Adoptive Couple V. Baby Girl, Bethany Berger Jan 2015

In The Name Of The Child: Race, Gender, And Economics In Adoptive Couple V. Baby Girl, Bethany Berger

Faculty Articles and Papers

On June 25, 2013, the Supreme Court decided Adoptive Couple v. Baby Girl, holding that the Indian Child Welfare Act did not permit the Cherokee father in that case to object to termination of his parental rights. The case is ostensibly about a dispute between prospective adoptive parents and a biological father. This Article demonstrates that it is about a lot more than that. It is a microcosm of anxieties about Indianness, race, and the changing nature of parenthood. While made in the name of the child, moreover, the decision supports practices and policies that do not forward and may …

Quality Assurance In Private Higher Education : The Case Of Ghana, Linda Tsevi Jan 2015

Quality Assurance In Private Higher Education : The Case Of Ghana, Linda Tsevi

Legacy Theses & Dissertations (2009 - 2024)

This study explores private higher education and implementation of quality assurance procedures in Ghana, a country in West Africa. While focusing on the three main isomorphic classifications (coercive, mimetic and normative) of DiMaggio and Powell’s (1983) institutional theory, this study examines how regulatory measures are not only designed to enhance the quality of private higher education institutions, but also how they impact the efforts employed by private providers towards meeting quality assurance standards in the environment in which they are located. Using a qualitative methodology, participants from five private university colleges and two private chartered institutions are selected as constituting …

Characterizing Postmodernity : Developing Ethical Paradigms In The Novels Of David Foster Wallace, Thomas Patrick Cook Jan 2015

Characterizing Postmodernity : Developing Ethical Paradigms In The Novels Of David Foster Wallace, Thomas Patrick Cook

Legacy Theses & Dissertations (2009 - 2024)

“Characterizing Postmodernity: Developing Ethical Paradigms in the Novels of David Foster Wallace” argues that the critical discourse on David Foster Wallace’s novels neglects the relationship between Wallace’s postmodern aesthetics and the historical period of postmodernity out of which Wallace’s novels emerged, contending that this relationship not only accounts for the form of Wallace’s novels and their protagonists, but also points toward new understandings of postmodernity’s relationship to history. Focusing on the dialectic between historical conditions of late capitalism and the agency and action of characters with respect to consumerism, Wallace uses social conditions themselves as the primary antagonists to his …

Theories Of Political Resistance : The Making Of Resistance From The Sixteenth Century To The Present, Onur Bilginer Jan 2015

Theories Of Political Resistance : The Making Of Resistance From The Sixteenth Century To The Present, Onur Bilginer

Legacy Theses & Dissertations (2009 - 2024)

This study discerns political resistance from everyday resistance and then develops on a distinction between a morally and politically justifiable resistance and the kind that is not. Drawing on different historical periods, it demonstrates why the conceptual clarification and moral justification of political resistance cannot rely upon the categories of non-violence, visibility, and legality alone. This study has five main arguments. First, a genuine political resistance is collective and occurs in public. It is conducted with the cooperation of similar-minded people out in the open, as long as there is room for politics. Therefore, it is not hidden like everyday …

The Queen's Three Bodies : Representations Of Female Sovereignty In Early Modern Women's Writing, 1588-1688, Erin V. Casey-Williams Jan 2015

The Queen's Three Bodies : Representations Of Female Sovereignty In Early Modern Women's Writing, 1588-1688, Erin V. Casey-Williams

Legacy Theses & Dissertations (2009 - 2024)

Sovereignty, a mechanism of power around which a state is organized, has emerged as a way to understand the twenty-first-century biopolitical moment. Thinkers including Michel Foucault, Michael Hardt, Antonio Negri, and Roberto Esposito find sovereignty essential to understanding modern regimes of bodily domination and control. These thinkers look back to early modern England as an originary moment when older theories of sovereign power became attached to emerging modern political systems. Despite the sophistication of these arguments, however, no recent biopolitical theory accounts for the situation of women in historical or current system of power, nor do they discuss the role …

Gendered Patriots And Post-Revolutionary Ladies : Girl Guiding And Twentieth Century Mexican Girlhood, Maryann Kelly Jan 2015

Gendered Patriots And Post-Revolutionary Ladies : Girl Guiding And Twentieth Century Mexican Girlhood, Maryann Kelly

Legacy Theses & Dissertations (2009 - 2024)

Through the lens of the Guías de México (Girl Guides of Mexico), Gendered Patriots and Postrevolutionary Ladies examines Girl Guide efforts to advance international cooperation and peace by promoting international friendship among the world’s youth between 1919 and 1980. From its birth as a branch of the British Girl Guide Movement, Mexican Guides participated in the World Association of Girl Guides and Girl Scout’s (WAGGGS) international conferences, encampments, and global initiatives. During the first half of the twentieth century Western European and United States members established WAGGGS global agenda for social reform and the advancement of women and youth. At …

Preparation, Chemistry, And Characterization Of Hypervalent Organosulfur Fluorides, Paul R. Savoie Jan 2015

Preparation, Chemistry, And Characterization Of Hypervalent Organosulfur Fluorides, Paul R. Savoie

Legacy Theses & Dissertations (2009 - 2024)

Since the discovery of the pentafluorosulfanyl (SF5) group around the 1960s, progress in exploring the chemistry of aliphatic SF5-containing compounds stagnated because of a lack of efficient synthetic methods. More recent developments in the preparations of SF5-containing compounds afforded easier access to these compounds, and sparked great interest in exploring their chemistry. Chapter 1 discusses the development of efficient methods used to prepare SF5-containing aliphatic compounds.

Role Of Antibody Isotypes In Providing Passive Protection Against Ricin Toxin, Ipneet Kaur Dhaliwal Jan 2015

Role Of Antibody Isotypes In Providing Passive Protection Against Ricin Toxin, Ipneet Kaur Dhaliwal

Legacy Theses & Dissertations (2009 - 2024)

Ricin toxin is a glycoprotein produced by the castor bean plant, Ricinus communis. Ricin is an extraordinarily potent inducer of cell death and inflammation, especially following inhalation. The toxin’s enzymatic subunit (RTA) is transported via retrograde transport into the cytoplasm of mammalian cells by the toxin’s B subunit (RTB). Once in the cytoplasm, RTA inactivates ribosomes through cleavage of ribosomal RNA. In this study, I characterized a ricin-specific monoclonal IgA antibody (mAb) known as 23D7. I confirmed that 23D7 reacts with RTA and is effective at neutralizing ricin in a Vero cell cytotoxicity assay in vitro. To localize the epitope …

The Fiscalization Of Social Policy : Tax Expenditures And The Cultural Legacies Of Public Policies, Joshua Thomas Mccabe Jan 2015

The Fiscalization Of Social Policy : Tax Expenditures And The Cultural Legacies Of Public Policies, Joshua Thomas Mccabe

Legacy Theses & Dissertations (2009 - 2024)

This dissertation examines the politics behind the increasing use of tax expenditures as tools for social policy in the United States, Canada, and United Kingdom. Tax expenditures, particularly in-work and child tax credits, have grown into major components of social policy across a number of countries since the 1970s. While some scholars have noted this increasing "fiscalization" of social policy, our current theories of welfare states struggle to explain this expansion across all three countries in an era of "permanent austerity" as well as variation in the distribution of these tax credits between the U.S. on one hand and Canada …
