Exploring The Meaning Of Cohabitation: A Relationship Dialectics Perspective, Lindsey J. Thomas, Kristina M. Scharp Jan 2015

Exploring The Meaning Of Cohabitation: A Relationship Dialectics Perspective, Lindsey J. Thomas, Kristina M. Scharp

Iowa Journal of Communication

This study employed relational dialectics theory to investigate what cohabitation means to cohabiters. Cohabitation is an ambiguous relationship state (e.g., perceived as "more than dating" but "less than marriage") associated with negative outcomes. Scholars have empirically investigated cohabitation; however, little research explores what cohabitation means using a qualitative approach. Exploring the meaning of cohabitation can illuminate perceptions that might coincide with negative outcomes. Framed by Relational Dialectics Theory, a contrapuntal analysis of cohabiters' online stories (n=27) revealed three counter-discourses: Narratives of Cohabitation as a Normal Relationship, Cohabitation as an Easy Relationship, and Cohabitation as a Worthwhile Struggle. Each counter-discourse resisted …

A Tale Of Two Crises: A Structurational-Material Analysis Of Forgotten Stakeholders, Colleen Arendt Jan 2015

A Tale Of Two Crises: A Structurational-Material Analysis Of Forgotten Stakeholders, Colleen Arendt

Iowa Journal of Communication

This study applies a structurational-material lens to a case study of the deadly bridge collapse in Minneapolis, Minnesota to help explain why and how area small business owners became forgotten stakeholders in the wake of the collapse. By considering the relationship between materiality and structuration theory, this approach uncovers the influence that materiality has on the rules and resources stakeholders, as agents, draw upon in the aftermath of a crisis and helps explain why a key group of stakeholders were ignored by those who had the power to help them weather the crisis. Specifically, the objects, sites, and bodies of …

Higher Education Expenditures And Revenues : A Case Study On The University Of Northern Iowa, Thomas Keld Madsen Jan 2015

Higher Education Expenditures And Revenues : A Case Study On The University Of Northern Iowa, Thomas Keld Madsen

Honors Program Theses

Higher education costs have skyrocketed in recent years, leaving millions of students in copious amounts of debt. Facing problems with decreased support from state legislators, universities have increased tuition and fees to compensate. At the same time, university spending, especially in non-academic programs and services, has continued to rise. A fight as emerged between states and the schools residing in them for who is to blame for the increasing cost of higher education, and in the middle of the debate are schools such as the University of Northern Iowa (UNI). A medium-sized school, UNI faces decreasing financial support from the …

Examining Political Mobilization Of Online Communities Through E-Petitioning Behavior In We The People, Catherine L. Dumas, Daniel Lamanna, Teresa M. Harrison, S. S. Ravi, Christopher Kotfila, Norman Gervais, Loni Hagen, Feng Chen Jan 2015

Examining Political Mobilization Of Online Communities Through E-Petitioning Behavior In We The People, Catherine L. Dumas, Daniel Lamanna, Teresa M. Harrison, S. S. Ravi, Christopher Kotfila, Norman Gervais, Loni Hagen, Feng Chen

School of Information Faculty Publications

This study aims to reveal patterns of e-petition co-signing behavior that are indicative of the political mobilization of online “communities”. We discuss the case of We the People, a US national experiment in the use of social media technology to enable users to propose and solicit support for policy suggestions to the White House. We apply Baumgartner and Jones's work on agenda setting and punctuated equilibrium, which suggests that policy issues may lie dormant for periods of time until some event triggers attention from the media, interest groups, and elected representatives. In the case study presented, we focus on …

Intelligence Legalism And The National Security Agency’S Civil Liberties Gap, Margo Schlanger Jan 2015

Intelligence Legalism And The National Security Agency’S Civil Liberties Gap, Margo Schlanger

Articles

Since June 2013, we have seen unprecedented security breaches and disclosures relating to American electronic surveillance. The nearly daily drip, and occasional gush, of once-secret policy and operational information makes it possible to analyze and understand National Security Agency activities, including the organizations and processes inside and outside the NSA that are supposed to safeguard American’s civil liberties as the agency goes about its intelligence gathering business. Some have suggested that what we have learned is that the NSA is running wild, lawlessly flouting legal constraints on its behavior. This assessment is unfair. In fact, the picture that emerges from …

Consent Searches And Fourth Amendment Reasonableness, Alafair Burke Jan 2015

Consent Searches And Fourth Amendment Reasonableness, Alafair Burke

Hofstra Law Faculty Scholarship

This Article builds on a growing body of scholarship discussing the role of reasonableness in consent-search doctrine. Although the language of “voluntary consent” implies a subjective inquiry into the state of mind of the person granting consent, the U.S. Supreme Court has repeatedly injected an objective standard of reasonableness into its analysis of a citizen’s consent. Several scholars have characterized the Court’s consent jurisprudence as focusing not on true voluntariness but on the reasonableness of police conduct, which they argue is appropriate because the touchstone of the Fourth Amendment is “reasonableness.” While the renewed scholarly focus on the role of …

Intellectual Property And The Presumption Of Innocence, Irina D. Manta Jan 2015

Intellectual Property And The Presumption Of Innocence, Irina D. Manta

Hofstra Law Faculty Scholarship

Our current methods of imposing criminal convictions on defendants for copyright and trademark infringement are constitutionally defective. Previous works have argued that due process under the Sixth Amendment requires prosecutors to prove every element of a crime beyond a reasonable doubt, including the jurisdictional element. Applying this theory to criminal trademark counterfeiting results in the conclusion that prosecutors should have to demonstrate that an infringing mark needs to have traveled in or affected interstate commerce, which currently is not mandated. Parallel to this construction of the Commerce Clause, criminal prosecutors would also have to prove that Congress has the power …

Lgbtq Relationships, Barbara J. Stark Jan 2015

Lgbtq Relationships, Barbara J. Stark

Hofstra Law Faculty Scholarship

Perhaps nowhere in family law is this evolution more dramatic than in the burgeoning recognition of rights of lesbian, gay, bisexual, transgendered, and questioning (LGBTQ) couples. Within the past twenty- five years courts, legislatures, and international bodies have addressed the extent to which rights and obligations formerly reserved to heterosexual married spouses should be conferred on other partners.

Most western democracies now recognize same- sex unions, assuring the partners in such unions a range of rights and benefits, similar to but distinct from the rights and benefits enjoyed by married couples. Part A of this Chapter describes the legal mechanisms …

Replacement Migration And Governance: Migrant Domestic Workers In Egypt, Akm Ahsan Ullah Jan 2015

Replacement Migration And Governance: Migrant Domestic Workers In Egypt, Akm Ahsan Ullah

Asian Review

The paper examines how migrant domestic workers, children and adults, make their ways to Egypt and secure employment. The paper also analyzes international legal instruments that constitute the international legal framework governing migration and trafficking to draw connections between these legal instruments and the status of Asian migrant domestic workers in Egypt. This paper is based on qualitative research conducted between 2012 and 2013 with 16 child migrant workers and 25 adult migrant workers selected using snowball sampling. This study analyzes the circumstances of child and adult domestic workers. Adult domestic workers are generally freelancers, and usually stay in Egypt …

Nonpublic Competition And Public School Performance: Evidence From West Virginia, Richard J. Cebula, Joshua C. Hall, Maria Y. Tackett Jan 2015

Nonpublic Competition And Public School Performance: Evidence From West Virginia, Richard J. Cebula, Joshua C. Hall, Maria Y. Tackett

Economics Faculty Working Papers Series

In this study, we investigate whether nonpublic school enrollment affects the performance of public school districts. If homeschooling and private schools act as competition, public school districts test scores should be positively associated with nonpublic enrollment. Using data on West Virginia county school districts, and controlling for endogeneity with an instrumental variables approach, we find that a one standard deviation increase in relative nonpublic enrollment in a county is associated with statistically significant increases in public school district test scores. Our findings thus confirm that nonpublic enrollment and the competition it provides act to improve, rather than impede, public school …

Was Adam Smith Right About Religious Competition?, Peter J. Boettke, Joshua C. Hall, Kathleen M. Sheehan Jan 2015

Was Adam Smith Right About Religious Competition?, Peter J. Boettke, Joshua C. Hall, Kathleen M. Sheehan

Economics Faculty Working Papers Series

Adam Smith famously argued that increased competition in religion would result in more religious tolerance and that the benefits of competition in the marketplace would also be seen in religious instruction when many religious sects are tolerated. We use a cross-section of a maximum of 167 countries to explore whether increased religious competition results in less governmental regulation of religion and less governmental favoritism of religion. Our measure of religious regulation and favoritism comes from the Association of Religion Data Archives. Our empirical analysis also explores the influence of economic and political factors, including the size of the economy, openness …

The Limits Of Judicial Mechanisms For Developing And Enforcing International Environmental Norms: Introductory Remarks, Nienke Grossman, Jacqueline Peel Jan 2015

The Limits Of Judicial Mechanisms For Developing And Enforcing International Environmental Norms: Introductory Remarks, Nienke Grossman, Jacqueline Peel

All Faculty Scholarship

International courts and tribunals have played a key role in the development of principles and norms of international environmental law. Over the last two decades, such bodies have been asked to resolve a growing number of disputes that involve environmental issues. The types of issues considered by international courts and tribunals have also expanded in scope and complexity. For instance, disputes concerning environmental matters may involve claims of state responsibility, law of the sea questions, human rights issues, or trade and investment aspects.

Intra-Group Stigma: Examining Peer Relationships Among Women In Recovery For Addictions, Alana J. Gunn, Kelli E. Canada Jan 2015

Intra-Group Stigma: Examining Peer Relationships Among Women In Recovery For Addictions, Alana J. Gunn, Kelli E. Canada

Social Work Faculty Scholarship

This grounded theory study explores how women with histories of addiction perceive stigma while in treatment. In-depth interviews were conducted with 30 women participating in a residential drug treatment centre. Previous research has found that support from peers during recovery can be critical to managing illnesses. In fact, researchers have postulated that peers can be a more effective form of support than even family. This study extends existing literature indicating that peer support systems can be supportive, however they can also can be perceived as negative support that impose stigmas. Findings reveal that women perceive stigmas due to how various …

Closing The University/School Divide: A Grounded Theory Approach To Preparation Of Early Childhood/Elementary Education Teacher Candidates, Jennifer L. Summerlin

All ETDs from UAB

The purpose of this grounded theory study was to explore the most significant experiences in preparation for becoming early childhood/elementary educators, as perceived by teacher candidates and recent graduates of one southeastern university, school of education. This research study, conducted from a constructivist theoretical lens, and using a grounded theory methodology, sought to answer three research questions. First, what are the significant experiences, as perceived by recent graduates, from one southeastern school of education, in preparation for the multifaceted role of today's early childhood/elementary generalist? Secondly, what are the most significant experiences, as perceived by current teacher candidates involved in …

Decoding Nf1 Intragenic Copy-Number Changes, Meng-Chang Hsiao Jan 2015

Decoding Nf1 Intragenic Copy-Number Changes, Meng-Chang Hsiao

All ETDs from UAB

Genomic rearrangements may cause both Mendelian and complex disorders. Currently, several major mechanisms causing genomic rearrangements have been proposed such as non-allelic homologous recombination (NAHR), non-homologous end joining (NHEJ), fork stalling and template switching (FoSTeS) and microhomology-mediated break-induced replication (MMBIR). However, to what extent these mechanisms contribute to gene-specific pathogenic copy-number changes (CNCs) remains understudied. Furthermore, only few studies resolved these pathogenic alterations at the nucleotide-level. Accordingly, our aim was to explore which mechanisms contribute to a large, unique set of locus-specific non-recurrent genomic rearrangements causing the genetic neurocutaneous disorder neurofibromatosis type 1 (NF1). Through breakpoint-spanning PCR as well as …

Assessing Potential Diesel Exhaust Exposure In Truckers Resting At Truck Stops, Gumindenga Farayi Mabvuta Jan 2015

Assessing Potential Diesel Exhaust Exposure In Truckers Resting At Truck Stops, Gumindenga Farayi Mabvuta

All ETDs from UAB

The nature of long haul truck driving places workers in this occupation in a peculiar setting for chronic exposure to diesel exhaust which is a known carcinogenic. These drivers endure exposure to diesel exhaust in traffic and potentially greater exposure at truck stops where they park for rest breaks as mandated by DOT regulations. This study looked at the potential exposure to diesel exhaust in long haul truck drivers resting at truck stops where up to two hundred trucks are left idling for air conditioning and other reasons. Two different trucks were used consecutively over the 21 days of sampling. …
