The New Way Of War: Is There A Duty To Use Drones?, Oren Gross Jan 2015

The New Way Of War: Is There A Duty To Use Drones?, Oren Gross

Articles

Drones have become the poster child for America’s continuing fight against terrorism under President Obama, playing the role that torture had occupied during the Bush administration: a morally, legally, and politically controversial issue that drives a wedge between the United States and much of the rest of the world. Covert drone attacks orchestrated by the CIA around the world, including in areas that lie outside recognized war zones, raise a range of difficult questions that have been heavily debated by scholars, policy-makers and in the general media. However, that discussion has focused on whether states have the legal right to …

Valuing Illusion: A Comparative Analysis Of Jean Baudrillard And Eihei Dogen, Nicholas Boynton Jan 2015

Valuing Illusion: A Comparative Analysis Of Jean Baudrillard And Eihei Dogen, Nicholas Boynton

USF St. Petersburg campus Master's Theses (Graduate)

The purpose of this thesis is to explore the overlapping themes, ideas, and strategies of Jean Baudrillard and Eihei Dogen. The rationale for such an endeavor lies in the absence of any comparison of Baudrillard and Dogen, when there is a plethora of scholarship that places their respective philosophies into conversation with post-structuralism and Zen Buddhism. I approached this project from the perspective of examining how Dogen’s enigmatic ideas helped in understanding Baudrillard’s complex theory, and vice-versa. By looking more closely at each philosopher’s writing, themes, and concerns, I highlight ideas from separate and distinct socio-historical situations and find ways …

Librarian As Advisor: Information Search Process Of Undecided Students And Novice Researchers, Claire Walker Wiley, Judy Williams Jan 2015

Librarian As Advisor: Information Search Process Of Undecided Students And Novice Researchers, Claire Walker Wiley, Judy Williams

Library Faculty Scholarship

Faculty librarians who advise undecided students have found the experiences of novice researcher and advisee comparable: Both groups seek to solve a problem or answer a question by finding new information to add to their current understanding and knowledge base. As a result, librarians familiar with needs and stages of the research process may flourish as advisors to undecided students. In this article, we draw parallels between the needs of novice researchers and those of undecided students, and we advocate the use of an information-search model for all advisors working with undecided students.

USF St. Petersburg Campus Faculty Publications

Remarks delivered by Schnur at the second program of the "Pinellas by the Decades" centennial lecture series, Pinellas Room, Heritage Village, on 9 October 2011. The Pinellas County Communications Office videotaped the program and the actual lecture varies slightly from this printed document due to time constraints. The program, including questions, was approximately 63 minutes in length.

Jimbo's Handy Handbook Of Historiography : The Historiography Of The United States, James Anthony Schnur

USF St. Petersburg Campus Faculty Publications

Schnur, a graduate student in history at USF at the time, created this booklet as a study guide to assist in preparations for his comprehensive examinations in the USF History M.A. program. Although most of the focus is on historians prior to the 1970s, this booklet does provide biographical vignettes that may assist those interested in learning about various schools of thought in the American historical profession. Most of the information in this handbook came from Schnur's notes in various classes, as well as other helpful sources, such as the Dictionary of Literary Biography.

The Public Trust Doctrine In The Shadow Of State Environmental Rights Laws: A Case Study, Alexandra B. Klass Jan 2015

The Public Trust Doctrine In The Shadow Of State Environmental Rights Laws: A Case Study, Alexandra B. Klass

Articles

This Article looks at the relationship between state environmental rights statutes and the common law public trust doctrine. In addressing this issue, it focuses on the state of Minnesota, where, in the early 1970s, the state legislature enacted a far-reaching environmental rights statute, the Minnesota Environmental Rights Act (MERA), that served to codify many public trust principles. Beginning in the early 1970s and for the next forty years, litigants in Minnesota that might otherwise have brought common law public trust doctrine claims for environmental protection purposes instead channeled that litigation through MERA. As a result, Minnesota courts have rarely been …

The Liberal Case For Hobby Lobby, Brett Mcdonnell Jan 2015

The Liberal Case For Hobby Lobby, Brett Mcdonnell

Articles

The Supreme Court decision in Burwell v. Hobby Lobby Stores, Inc. has stirred strong objections from political liberals. Those objections are misguided, and the Court's opinion reflects core liberal values of social responsibility and tolerance of diversity. In the first half of its decision, the Court held that in some circumstances, for-profit corporations committed to religious goals may invoke the religious liberty protection of the Religious Freedom Restoration Act (RFRA). Liberals have treated this as an appalling and/or humorous extension of rights, which should apply only to humans. However, the Court's decision rightly recognizes that corporations can, and sometimes do, …

Defamation And The Government Employee: Redefining Who Constitutes A Public Official, Jeffrey Omar Usman Jan 2015

Defamation And The Government Employee: Redefining Who Constitutes A Public Official, Jeffrey Omar Usman

Law Faculty Scholarship

This Article embraces neither the narrow nor broad conceptualization of a public official employed currently by state and lower federal courts but instead suggests revisiting the Rosenblatt formulation and the one clear limitation set forth by Hutchinson that whatever the scope of public officialdom may be “it cannot be thought to include all public employees.” Though not all speech about government employees should be deemed to be related to their official capacity, all government employees should be considered public officials, and speech related to their official conduct should be safeguarded by the actual malice standard. To explain and support this …

Commercialization Of A Small, Lightweight, Low-Cost Seismic Borehole Receiver, Rachel Adams Jan 2015

Commercialization Of A Small, Lightweight, Low-Cost Seismic Borehole Receiver, Rachel Adams

Theses and Dissertations--Civil Engineering

Herein, conceptualization of a recently patented seismic borehole receiver and its components is developed for commercialization. The device is significantly cheaper, lighter, and smaller than existing technologies on the market. Additionally, it has the potential to achieve better seismic readings than its competitors via patented sensor-to-borehole coupling mechanism. It is the hope that the commercialization of this device will not only provide a more affordable alternative to engineers and geophysicists in the existing market, but the significant cost difference may open new seismic measurement opportunities in the developing world. Its compact size and light weight will increase mobility, allowing investigators …

Computer Models Of A Basement Involved Fault Propagation Fold During The Laramide Orogeny Around Las Vegas, New Mexico, Jerry Timothy Ford Jan 2015

Computer Models Of A Basement Involved Fault Propagation Fold During The Laramide Orogeny Around Las Vegas, New Mexico, Jerry Timothy Ford

Earth & Environmental Sciences Theses - Archive

Numerical geomechanical modeling is acceptable today for studying geologic structures and is readily accomplished by most computers used by geoscientists and engineers interested in studying geomechanics. Models should be simple so that too many discontinuities are not introduced. This study creates models of a thrust fault, developed and implemented using the computer program FLAC version 4.0 to simulate the structural evolution of a basement-involved fault propagation fold undergoing shortening and then compares them to a published cross section NW of Las Vegas, New Mexico. FLAC is a numerical 2D modeling program for modeling geologic materials and has large strain capability …
