The Supreme Court currently operates under the premise that if it finds one part of a law unconstitutional, it can strike down other parts as well. But it is not clear where the Court finds this power to declare laws inseverable. And that lack of clarity has created a doctrinal muddle wherein the Court applies several inconsistent tests. Society is consumed with celebrities, and celebrity identity has pervasive power. Two bodies of law are turned to when there is unauthorized exploitation of a celebrity¿s likeness or persona. One, Section 43(a) of the Lanham Act, is a federal trademark statute, and the other is the common law right of publicity. Congress designed Section 43(a) to protect consumers from mistakenly believing that a celebrity endorsed a particular product, while the right of publicity centers on the celebrity¿s economic interest in his or her own identity. Questions about polygamy are likely to dominate Western family law in the next generation. Two generations ago, contraception, abortion, and women¿s rights were the hot topics. This past generation, children¿s rights and same-sex rights have dominated public deliberation and litigation. On the frontier of Western family law are hard questions about extending the forms of valid marriage to include polygamy and extending the forums of marital governance to include religious and cultural legal systems that countenance polygamy. In this Essay, we argue that civil marriage should not be opened up to multiple parties. Our focus is on civil, not religious, marriage, and we address polygamy in general, rather than any particular form of it. We highlight the important distinction between opening up civil marriage to multiple parties on one hand and recognizing valid foreign polygamous marriages on the other. We contemplate how a country can coherently recognize valid foreign polygamous marriages, while at the same time decline to open up civil marriage to multiple parties. In Brown v. Buhman, the recent challenge to the Utah law criminalizing polygamy brought by the stars of the reality television show Sister Wives, a federal district court determined both that strict scrutiny was required and that strict scrutiny could not be satisfied. A significant factor in this result was the state¿s failure to mount a strong defense of the law, assuming that it could rely on long standing polygamy precedents such as the United States Supreme Court decision in Reynolds v. In the fall of 2010 and the spring of 2011, the Chief Justice of the Supreme Court of British Columbia presided over an unprecedented proceeding in Canadian legal history¿a ¿reference¿ hearing conducted at the trial court level into the constitutionality of Canada¿s criminal prohibition of polygamy. In this Article, Professor Turley explores the concept of social harm in the context of two recent cases in the United States and Canada over the criminalization of polygamy. The cases not only resulted in sharply divergent conclusions in striking down and upholding such laws respectively, but they offered strikingly different views of the concept of harm in the regulation of private consensual relations. Professor Turley draws comparisons with the debate over morality laws between figures like Lord Patrick Devlin and H.L.A. Hart in the last century. Much of the legal debate surrounding the challenge to ¿traditional¿ heterosexual marriage has involved questions of liberty, discrimination, and equal treatment. Similar moves have now been made by advocates for polygamous marriage, indicating that polygamous families may be on track to follow in the rainbow contrails of same-sex marriage. This Article argues that such an evolution is indeed likely, but for different reasons than commonly held. Instead, it applies the emerging paradigm of vulnerability theory to a recent suite of polygamy and same-sex marriage rulings, with particular focus on the figure of the ¿vulnerable¿ child. Recently, members of the Supreme Court have signaled a willingness to reconsider, and perhaps jettison, Seminole Rock. Seminole Rock has been widely accepted but surprisingly disconnected from any analysis of its origins and justifications. This Article¿the first historical explication of Seminole Rock deference¿argues that Seminole Rock cannot support the theoretical weight that subsequent courts and evolving administrative law doctrines have complacently put upon it. Seminole Rock was the product of its time¿the 1940s, an era of war-time price controls and a new age of administrative law. Later cases wrongly divorced Seminole Rock from that context. This Comment considers whether the federal conservatorship of Fannie Mae and Freddie Mac transformed these entities into state actors subject to constitutional constraints. In particular, it analyzes whether Fannie Mae and Freddie Mac must provide homeowners with due process¿namely notice and an opportunity to be heard¿when they initiate nonjudicial foreclosures. Application of the state action tests from Lebron and Brentwood Academy most persuasively suggest that nonjudicial foreclosures initiated by Fannie Mae and Freddie Mac must satisfy due process requirements. Although Rule 68 was designed to facilitate settlements, defendants have attempted to use Rule 68 offers to moot individuals¿ claims. These defendants argue that by offering their understanding of complete relief to a plaintiff, the claim should be mooted. In the past four decades, a circuit split has arisen over whether Rule 68 offers can moot claims and whether judgment should be entered for the plaintiff or the defendant. Expression eligible for copyright protection should be presumptively treated as speech for First Amendment purposes. Both copyright and the First Amendment share the goal of fostering the creation and dissemination of information. Copyright¿s authorship requirement furnishes the key link between the doctrines. This Essay examines where the two areas of law align and conflict in offering or denying protection. Using copyright law as a guide for the First Amendment offers three benefits. The lines between content-neutral, content-based, and viewpoint-based restrictions on speech remain unclear in key respects despite the critical importance that these characterizations hold within First Amendment jurisprudence. This Article will analyze the law concerning the boundaries between these categories of laws with respect to speech activities in public and limited forums. The Article argues that five categories of laws are inherently suspect under the Free Speech Clause and should be treated as such. Results of a field study designed to assess the extent of natural microbial infections in insects collected from agrarian fields surrounding Adana, Turkey, are reported. We identified and dissected specimens to assess the numbers of nodules. Formation of darkened melanotic nodules is the predominant cellular immune reaction to microbial and parasitic infection, and once formed, the nodules are permanently attached to internal surfaces. At least some nodules were found in 99% of 1200 examined specimens that were healthy in appearance. The number of nodules ranged approximately from 1 nodule/individual to >120 nodules/individual. The thinning of stream buffer zones (SBZs) is gaining popularity as a silvicultural management practice in order to reduce the risk of wildfire and insect hazard, provide economic return, and improve the effectiveness of SBZs. In this study, streamflow over a 1-year period was monitored at 2 small paired watersheds (treated vs. reference). The short-term impacts of a partial cutting within a SBZ as well as the relative effects of pastoral, forested, and clearcut areas on changes in downstream hydrology were examined. Molybdenum cofactor sulfurases (MCSUs) are important enzymes for plant development and response to environmental queues, including processes such as nitrogen metabolism and regulation of the abscisic acid levels in plant tissues. We cloned and sequenced MCSU gene from barley and performed in silico comparison with rice, tomato, and Arabidopsis. Physico-chemical properties and subcellular predictions were found to be similar in different plant species. All MCSUs had three critical domains: aminotransferase class-V (Pfam: PF00266), MOSC N-terminal beta barrel (Pfam: PF03476), and MOSC (Pfam: PF03473). Secondary structure analysis revealed that random coils were the most abundant, followed by α-helices and extended strands. …

To evaluate the genetic diversity in 48 winter bread wheat genotypes originating from different countries, an experiment based on randomized complete block design with 4 replications was carried out in drip irrigation and rain-fed conditions at the field station of the Transitional Zone Agricultural Research Institute, Eskişehir, Turkey in 2011 and 2012. Based on grain yield under rain-fed and irrigated conditions, drought tolerance indices, i.e. stress susceptibility index (SSI), stress tolerance index (STI), tolerance index (TOL), mean productivity (MP), and geometric mean productivity (GMP), were calculated to identify genotypes with better yield and drought tolerance. Modern computer capabilities enable complex slope stability problems to be analyzed using the finite element method (FEM), including three-dimensional slopes. This research presents the results of analyzing two- and three-dimensional, unreinforced and soil-nailed, reinforced slopes. Previously performed two-dimensional slopes were modeled as three-dimensional slopes in an effort to validate the modeling technique. The Shear Strength Reduction (SSR) Method was used throughout this study to determine the Factor of Safety (FOS). Both two- and three-dimensional FEM models compared well with conventional, two-dimensional Limit-Equilibrium (L-E) results. The West Virginia Divisions of Highways (WVDOH) utilizes the establishment of grass cover as a temporary and permanent management practice to mediate the effects of erosion on highway construction sites. Current West Virginia regulations include five seed mixtures for permanent applications that include combinations of nine species. Six of these species are identified as invasive, and all nine species are considered introduced or both native and introduced. A semi-structured interview was used to survey help-seeking attitude via questions about spirituality, therapy, and the connections between the two. Interpretative Phenomenological Analysis (IPA) was used to provide a framework for understanding how these factors potentially effect professional help-seeking attitudes in Black women and the role spirituality plays in developing help-seeking attitudes and the potential effect on professional psychological help. Ten interviews were conducted with Black women who lived or went to church in Akron, Ohio. Data from nine study participants were used and seven super-ordinate themes were found. To date, research in applied sport psychology has not examined consultants from the perspective of consultants as communicators in problem solving situations. The purpose of this study was to evaluate the impact of a partnership-based model of collaborative consultation on the acquisition and implementation integrity of Competent Learner Model and the subsequent impact on learner outcomes including the development of competent learner repertoires. Treatment integrity measures were collected to assess the impact on learner outcomes. The participants were one teacher and one student. A Multiple baseline across behaviors design was used. The synthesis of a novel series of pyridine and bipyridine derivatives is described via one-pot multicomponent reaction of 5-acetylimidazole, malonitrile (or ethylcyanoacetate or diethylmalonate), substituted benzaldehyde (or terephthaldehyde), and ammonium acetate in good yields. The structures of all the new compounds were elucidated on the basis of elemental analysis and spectral data. The antimicrobial activities of the synthesized compounds were screened and the results showed that most of such compounds exhibit considerable activities. Mesoamerican Sacred Geography And Archeological Landscapes: A Case Study In The Volcanic Highlands Of Michoacan, Mexico, Jarod Scott Drozdowski

US and Mexican teams have investigated the La Alberca Structure Complex with the community of Parangaricutiro. Their forest reserve, located near San Juan Nuevo in Michoacan, Mexico, contains several volcanic cones, including the famous Paricutin cinder cone. Sixteen earthen-rock structures have been mapped using aerial photography, GPS, GIS, and total station surveys. The structures range from 300 to 2,400 cubic meters in volume. The larger mound-like structures are traditionally called yacatas. Early radiocarbon dates for two of the three central structures (ca. 5200-2000 BCE) bracket dates for the Late Archaic burial in the La Alberca caldera. Arrangements of the larger …

Lhx2 is a protein that is expressed in a gradient across the developing neocortex and is involved in arealization, the process through which this structure is divided into functional fields. However, little is known on how Lhx2's graded expression across the neocortex actually regulates the locations and sizes of the neocortical areas. In an attempt to understand how Lhx2 performs its functions within the neocortex, a yeast two-hybrid screen was used to identify possible binding partners for Lhx2.
