This article examines the current challenges and legal controversies surrounding race-conscious Diversity, Equity, and Inclusion (DEI) initiatives in the private sector, focusing on the 2024 Eleventh Circuit ruling in* American Alliance for Equal Rights v. Fearless Fund Management, LLC*(“Fearless Fund”) and the impact of Trump-era executive orders targeting DEI programs. It distinguishes DEI from affirmative action, outlines the evolving legal landscape involving Title VII of the Civil Rights Act and Section 1981 of the Civil Rights Act of 1870, and analyzes how recent judicial decisions and executive actions have emboldened litigation against DEI efforts, often framed as “reverse discrimination.” The …

This article focuses on the historic ratification and ongoing challenges of the first Collective Bargaining Agreement (CBA) for Minor League Baseball (MiLB) players, signed in 2023, over fifty years after Major League Baseball (MLB) players first secured a CBA. It outlines the long-standing disparities between MiLB and MLB players, including delayed unionization, inadequate salaries, poor housing, limited health benefits, and restricted player mobility under the reserve clause. The article highlights key events leading to the CBA, such as the Senne lawsuit addressing wage violations and the controversial Save America’s Pastime Act, which exempted MiLB players from minimum wage laws. Criminal legal systems around the world rely heavily on defendants foregoing their right to trial and pleading guilty. However, legal scholars, social scientists, and practitioners have identified and empirically examined numerous problems with pleas, such as the high potential for coercion, innocent defendants falsely pleading guilty, and undue incentives in exchange for accepting plea offer. In this article, leading guilty plea experts (practitioners and researchers) were asked to identify what they considered to be the most urgent questions surrounding pleas. Across nine commentaries, three primary themes emerged. First were calls for increased transparency in pleas, specific to rules of discovery …

From The Great Recession To The Post-Covid 19 Pandemic U.S. Municipal Fiscal Condition: “Austerity Urbanism,” “Pragmatic Municipalism” And On-Going Explanatory Challenges, Mark Davidson, Kevin Ward
Geography
How much did the Great Recession change U.S. municipal budgetary and fiscal governance? According to an academic literature that subsequently emerged, the period saw a combination of both change and continuity. The work offered two distinct ways to explain and understand the emerging context: austerity urbanism and pragmatic municipalism. This paper reviews these explanations with the goal of showing how and why they developed contrasting conceptualizations. We argue differing epistemological approaches underpin the two competing approaches. Understanding these differences is, we argue, critical for moving forward. Private settlements have been consistently encouraged by the Singapore civil justice system. Depending on the context, the settlement may take on many forms, including consent orders and settlement agreements. This begs the question of whether the exact form of settlement matters, or whether a settlement “by any other name” suffices. This article proposes the concept of “sustainable settlements” – comprising the measures of ease of enforcement, finality, and confidentiality – to holistically appraise the effectiveness of settlement mechanisms. The immunity against Crown liability was abolished in the United Kingdom in 1948 based on the Diceyan notion of rule of law and deemed equality under the law between public officials and private persons. This paper analyses government vicarious liability in respect of the acts and omissions of public officers under the Singapore Government Proceedings Act with reference to the concept of deemed equality. What Are The Limits To Smart Innovation? The Digital Underground Initiative And New Frontiers Of “Smartness” In Singapore, Prerona Das, Orlando Woods, Lily Kong

This paper argues that the emergence of new frontiers of smart transformation, such as underground spaces, can pose significant challenges to the implementation of “smart” technological solutions. Exploring the case of Singapore’s Digital Underground initiative, we show that elements such as material complexity, co-ordination between stakeholders, and the availability of appropriate regulatory and administrative frameworks can problematize the implementation of subterranean smart initiatives. By considering multistake-holder perspectives on these “more-than-technological” factors, this paper offers lessons for urban planners, policymakers, and developers in cities around the world that are keen to leverage technology to unlock the potential of underground space.

The annual Women Waging Peace report provides a resource for policymakers and funders, created directly from the recommendations and priorities of women peacebuilders around the world. These findings have been drawn from peacebuilders working in different conflict contexts and across a range of sectors of peacebuilding work. Each year, the survey provides an analysis of the work of women peacebuilders, the progress they have made, and the challenges and opportunities they are facing. This past January, in conjunction with the issuance of a final regulation (T.D. 10022) that treats income from defined cloud transactions as income from services, Treasury and the IRS released a proposed regulation (REG-107420-24) on the sourcing of that income. In 2019 a Treasury official had asked the tax community for feedback on whether specific cloud transaction sourcing rules were needed, and the preamble to a 2019 proposed regulation asked for comments on “administrable rules for sourcing income from cloud transactions in a manner consistent with sections 861 through 865.” The feedback was “split almost evenly with regard to whether …

Nothing To Gain: The Disparate Impact Of The Capital Gains Tax Preference On Women And Persons Of Color, Ann M. Murphy

Tax preference provisions are scattered across the Internal Revenue Code, and the capital gains tax rate offers an enormous advantage for wealthy taxpayers. When first enacted, it was touted as eliminating the “lock-in effect” which caused investors to hold on to their investment property. Today, it is justified as encouraging investment and eliminating gains produced merely by the passage of time. The provision’s unequal benefits are hidden from the picture. Although not overtly dis-criminatory, the preference operates as a tax cut for the wealthy. Women and per-sons of color see little benefit from the lower tax rate. The difficulty of …

Across the world, developed economies use roughly the same framework to regulate entrepreneurial ventures raising capital. The minor differences in how developed countries regulate securities for emerging businesses lie primarily in their legal thresholds for fundraising caps, disclosure requirements, and the criteria for accredited investors. This uniform regulatory framework persists despite significant empirical evidence that the citizens of developed countries vary widely in their desire to pursue entrepreneurial opportunities, their perceptions of the number and quality of entrepreneurial opportunities available to them, and their perceptions of their own ability to succeed in entrepreneurship. Black immigrants in the United States navigate a dual identity as both Black and immigrant, yet their unique experiences remain underexplored in research on immigration and crime. While prior studies have documented generational differences and negative associations between immigration and crime, the intersection of race and nativity in shaping criminal justice contact for Black immigrants is unknown. Using data from the National Longitudinal Study of Adolescent to Adult Health, this study examines the role of race and nativity on various forms of criminal justice contact. In contemporary digital environments, exponential cyber threat growth has made cryptographic key generation a critical security challenge. Traditional Pseudo-Random Number Generators (PRNGs) and existing chaos-based methods often exhibit insufficient entropy, limited randomness quality, and inadequate resistance to statistical attacks. Current implementations frequently produce suboptimal entropy values and fail to meet modern cryptographic security standards and rigorous randomness testing protocols. This paper aims to design and implement an advanced cryptographic key generation system that combines Deep Q-Networks (DQN) algorithms with multiple chaotic maps to produce cryptographically secure stream key bits with high randomness and strong resistance to cryptanalytic attacks. The Blockchain algorithm has advanced the accountability and transparency of modern digital infrastructures. Enforcing responsible behavior and data integrity across distributed environments involves several key components, such as smart contracts, access control models, cryptographic techniques, and a decentralized identity framework. Because the blockchain ledger is immutable and transparent, once a transaction is recorded, it cannot be altered without detection, making fraudulent actions easily traceable and thereby ensuring accountability. However, the need for hybrid approaches that combine on-chain and off-chain solutions for an efficient reliability system introduces challenges, including privacy preservation, scalability, and regulatory compliance. Donald Trump’s election as president during November 2024 results in perhaps the most dramatic philosophical change in approach to governmental regulation in over ninety years. The Great Depression of the 1930s created a need for regulatory reform and resulted in the advent of such new regulatory frameworks as the U.S. Securities and Exchange Commission (SEC). It has been the purpose of the SEC to create and nurture efficient securities markets enabling vibrant capital formation while preventing fraud upon the investing public. This paper analyzes the problems of non-disclosure in the context of an asset sale between a buyer and a seller. The seller can have important information about the asset and can opportunistically decide not to disclose that information to the buyer, and the buyer may sue the seller ex post for remedy. The buyer and the court have a choice over different types of remedy. The paper considers three different remedy regimes: (1) no liability; (2) voidance; and (3) damages. Abstract Wheat canopy cover and greenness are useful crop performance indicators that provide significant insight into the performance of wheat crops. Understanding the effects of no-till and conventional tillage practices on winter wheat canopy cover and greenness will help inform agronomic decision making in wheat production. Therefore, the aim of this study was to assess the effects of no-till and conventional tillage practices on wheat canopy cover and greenness using drones.
