The past decade has seen an onslaught of high-profile litigation against the National Collegiate Athletic Association (NCAA). The litigation has almost exclusively consisted of claims alleging that some of the NCAA’s policies constitute anticompetitive practices under U.S. antitrust laws. In National Collegiate Athletic Association v. Alston, the Supreme Court ruled that, by limiting the education-related benefits schools were allowed to offer student athletes, the NCAA violated the Sherman Antitrust Act. However, the main takeaway from Alston was the concurrence by Justice Kavanaugh, which emphasized that while “the Court does not address the legality of the NCAA’s remaining compensation rules …

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาความรับผิดทางแพ่งของบริษัทแม่ต่อผู้เสียหายที่ได้รับผลกระทบจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก โดยเป็นการศึกษาวิจัยเอกสารจากบทบัญญัติกฎหมาย คำพิพากษาศาล หนังสือตำรา และบทความเชิงวิชาการที่เกี่ยวข้อง ทั้งในประเทศและต่างประเทศ ผลการศึกษาพบว่า ปัจจุบันพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 ยังไม่มีบทบัญญัติให้บริษัทแม่เข้ามารับผิดชอบในความเสียหายจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก หากบริษัทแม่มีส่วนร่วมในแหล่งกำเนิดมลพิษหรือกำกับดูแลบริษัทลูก แต่ขาดการยึดถือแหล่งกำเนิดมลพิษทางกายภาพหรือเจตนาเพื่อตนอย่างใดอย่างหนึ่งไป อันไม่ครบองค์ประกอบของการเป็นผู้ครอบครองที่ต้องรับผิดตามมาตรา 96 หากบริษัทแม่มีการกระทำที่ไม่คำนึงถึงความเป็นนิติบุคคลของบริษัทลูกที่ไม่ใช่การกระทำละเมิด หากแต่เป็นการใช้โครงสร้างความเป็นนิติบุคคลของบริษัทลูกในทางมิชอบ อันได้แก่ การใช้นิติบุคคลเป็นเครื่องมือเพื่อหลบเลี่ยงหรือรับหน้าที่หรือความรับผิด และการมีทรัพย์สินปะปนกัน ดังนั้น จึงสมควรกำหนดบทบัญญัติที่เกี่ยวกับความรับผิดของบริษัทแม่ภายใต้พระราชบัญญัติดังกล่าว เพื่อให้ผู้เสียหายในคดีมลพิษจะได้รับความเป็นธรรมในการเยียวยา

การวิจัยนี้เป็นงานวิจัยเอกสารซึ่งมีวัตถุประสงค์เพื่อศึกษาประเด็นหลักดังต่อไปนี้ 1) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายสามารถเป็นวัตถุแห่งการควบคุมความชอบด้วยรัฐธรรมนูญของไทยได้หรือไม่ 2) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายซึ่งกำหนดให้ใช้สัญชาติของสามีเป็นจุดเกาะเกี่ยวในความสัมพันธ์ระหว่างคู่สมรสและให้ใช้สัญชาติของบิดาในความสัมพันธ์ระหว่างบิดามารดาและบุตรขัดหรือแย้งกับหลักความเสมอภาคระหว่างเพศตามรัฐธรรมนูญของไทยหรือไม่ จากการศึกษาพบว่า พระราชบัญญัติว่าด้วยการขัดกันแห่งกฎหมาย พุทธศักราช 2481 ไม่ควรอยู่นอกขอบเขตของการควบคุมความชอบด้วยรัฐธรรมนูญ เนื่องจากการเลือกกำหนดจุดเกาะเกี่ยวของแต่ละลักษณะข้อกฎหมายล้วนได้รับอิทธิพลจากข้อความคิดที่ปรากฏอยู่ในกฎหมายแพ่งและระบบคุณค่าของสังคมในขณะที่ตรากฎหมาย นอกจากนี้ ยังไม่เคยปรากฏในคำวินิจฉัยของศาลรัฐธรรมนูญไทยที่เกี่ยวกับหลักความเสมอภาคระหว่างเพศว่า ศาลอาศัยเหตุผลที่ว่าระบบคุณค่าที่อยู่เบื้องหลังบทบัญญัติของกฎหมายขัดต่อหลักความเสมอภาคระหว่างเพศเพื่อวินิจฉัยว่าบทบัญญัติกฎหมายใดขัดต่อหลักการดังกล่าว แต่จะต้องเป็นกรณีซึ่งกฎหมายบัญญัติให้ปฏิบัติแตกต่างกันและส่งผลให้บุคคลเสียไปซึ่งสิทธิบางประการอย่างเป็นรูปธรรมด้วยเหตุแห่งเพศ ดังนั้น ผู้วิจัยเห็นว่าการวินิจฉัยความชอบด้วยรัฐธรรมนูญของบทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย ควรนำระบบคุณค่าที่อยู่เบื้องหลังการบัญญัติกฎหมายมาพิจารณาประกอบด้วย นอกจากนี้ ควรแก้ไขจุดเกาะเกี่ยวในกฎหมายขัดกันของไทยให้เป็นกลางทางเพศโดยให้สามารถรองรับการก่อตั้งครอบครัวในบริบทของความหลากหลายทางเพศ

Introduction: Medical students experience stress, anxiety, and depression at rates greater than those of the general population. Medical students also underutilize mental health services. There exists a need for a comprehensive, multivariate analysis of the reasons medical students do not pursue mental health services, and the undesirable mental health outcomes that are associated with these barriers. This study associates psychiatric phenomena of stress, anxiety, and depression within the context of barriers to use of mental health services in medical students.

This amici curiae brief, filed in Thomson Reuters Enterprise Centre GmbH and West Publishing Corp. v. ROSS Intelligence Inc. before the U.S. Court of Appeals for the Third Circuit, argues that Thomson Reuters failed to state a viable claim for copyright infringement against ROSS Intelligence. The amici—law professors specializing in copyright and technology—contend that Westlaw’s headnotes are uncopyrightable factual summaries of judicial opinions and that the West Key Number System has long been in the public domain. The PML::RARA fusion resulting from t(15;17) is the genetic hallmark of acute promyelocytic leukemia (APL), typically detected by cytogenetics and/or fluorescence in situ hybridization (FISH) studies. Rarely, APL patients present with normal cytogenetics and FISH findings, complicating diagnosis and delaying life-saving therapy. We report a 23-year-old male with clinical, morphologic and immunophenotypic features consistent with APL but negative for FISH studies. Despite prompt initiation of all-trans retinoic acid (ATRA) based on clinical suspicion, the patient succumbed to intracranial hemorrhage. Quantitative reverse transcriptase PCR (qRT-PCR) confirmed a long isoform PML::RARA fusion. A review of 34 published cytogenetics- and FISH-negative cases since …

The court found the landlord's notice of termination defective and insufficient to serve as a predicate for the proceeding. Mutual protection societies proliferated in the American Southwest during a period of rapid social change, 1870-1930, coincident with significant changes in the region’s political economy and increased competition for land and water resources. To resist encroachment and protect their natural resources, hispano communities in Colorado and New Mexico organized mutual benefit and protective associations known as mutualistas, with a large number concentrated in the San Luis Valley of Colorado as well as in many rural counties of northcentral New Mexico. Correctional nurses deliver care in environments marked by violent incidents, chronic understaffing, and moral distress. These conditions heighten occupational stress, jeopardize patient safety, and accelerate staff turnover, yet few U.S. jails provide evidence-based training in rapid self-regulation strategies. The purpose of this staff education project was to evaluate whether a 2-week curriculum could increase correctional nurses’ knowledge, attitudes, and self-reported skills (KAS) for on-shift mindfulness use. Pender’s health promotion model framed the intervention, Bloom’s taxonomy and Kirkpatrick’s evaluation model informed learning objectives and outcome levels. The use of compulsory prison labor in American jails and prisons has reached alarming levels. Despite the Thirteenth Amendment’s purpose of abolishing slavery in the United States, slavery-like conditions persist under the guise of compulsory prison labor. The Thirteenth Amendment created an important caveat to the prohibition of slavery in the United States: involuntary servitude is permissible as a punishment for crime. Across the country, incarcerated individuals are forced against their will to engage in physical labor with sub-standard safety protocols, endure physically and mentally abusive superiors, and receive little to no pay. The treatment of migrant children at the United States-Mexico border has become a contentious issue worldwide. International human rights frameworks set certain standards for the treatment of migrant children, and there are growing allegations that the United States has violated international legal obligations due to its inadequate detention conditions. This article argues that while the United States is not explicitly violating international treaties due to specific reservations, its border policies are in direct contradiction with global norms for the humane treatment of children. Kabwe, Zambia is among the most polluted cities, the result of nearly a century of lead mining and smelting. Despite the mine’s closure in 1994, an estimated 6.4 million tons of lead-contaminated waste continues to expose thousands of children to life-altering—and often irreversible—health consequences. This Article examines the Zambian government’s failure to remediate the environmental harm and protect children’s rights, analyzing both domestic legal obligations and international human rights treaties. The Supreme Court’s decision in Department of State v. Muñoz marks a significant shift in U.S. immigration law, reinforcing the doctrine of consular non-reviewability and weakening long-standing protections for family unity. Historically, marriage and family have been recognized as fundamental rights; yet, Muñoz limits judicial oversight of visa denials, allowing for indefinite separations between U.S. citizens and their non-citizen spouses. The Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA) has contributed to long-standing complexities in our understanding of habeas corpus and its function as a device for judicial inquiry into the constitutionality of imprisonment. Since its passage and subsequent interpretations by Congress and the courts, criminal defendants have faced heightened challenges in seeking federal review of their state convictions. This Note will discuss the need to exercise the taxing power of the federal government in an effort to restore immunization rates to their historically high levels. Recent spikes in unvaccinated children have resulted in global outbreaks of diseases that were near elimination. This Note's solution to the growing anti-vaccination movement is the implementation of a federal tax plan targeted at parents who—without a valid medical exemption—refuse to vaccinate their children against specific classes of vaccine-preventable diseases. There is no sense in declaring that an action is outside someone's scope of power after the action has already occurred. In much the same way, it does not matter whether someone may chop down a tree after the tree is down. Yet, the Florida Supreme Court's interpretation of the quo warranto writ in League of Women Voters of Florida v. Scott allows the figurative tree to be cut down and then later declares it should have been protected.
