Planning Ahead: A Holistic Approach To End-Of-Life Planning, Kristin Litzelman, Ashley Berghoff, Jennifer Abel, Carol Bralich, Jackie Carattini, Selena Freimark, Jenna Kink, Sara Richie
Journal of Human Sciences and Extension
End-of-life planning can be an intimidating, confusing, and emotional process, which may explain why only 37% of Americans have completed advance care directives. To address this need, we developed the Planning AHEAD (Advance directives, Handling financial changes, Estate planning, and Arriving at Decisions for the end of this life) curriculum. Planning AHEAD is a seven-session course designed to help participants make important decisions that reflect their end-of-life wishes and document this information to relieve stress for their loved ones. In the first two years of the program, Extension educators facilitated 45 Planning AHEAD series across Wisconsin, reaching over 600 participants. …

A Comprehensive Nutrition Education Program Promotes Behavior Change And Perception Of Food Access Across The Older Adult Age Span, Sarah Misyak, Camille Mcguire, Victor Olayemi, Maria Denunzio, Paige Harrigan, Elena Serrano
Journal of Human Sciences and Extension
Strategies to promote healthy behaviors among older adults are needed to mitigate vulnerabilities to negative health outcomes, especially for those with low income. Healthy Eating and Staying Active as We Age (HESA), a nine-lesson educational series for Supplemental Nutrition Assistance Program-eligible older adults, was created to promote health among aging audiences. The purpose of this study was to evaluate the behavior change of older adults following participation in HESA, which covers food resource management, nutrition, food safety, and physical activity behaviors, as well as perceived food affordability and accessibility, and to determine if HESA is appropriate across the age span …

Much Ado About Critical Race Theory, Matthew Patrick Shaw
Much Ado About Critical Race Theory, Matthew Patrick Shaw
Washington and Lee Law Review
This Article offers novel observation and critical intervention in the challenge to state laws which have been adopted, allegedly, to prevent the teaching of critical race theory
(CRT) in public schools. Against the trend of recent scholarship that understands these laws as curricular censorship of topical subjects and seeks to contest their validity on those grounds, this Article more accurately identifies them as pedagogical censorship: Limits on teaching methods, which raise different, potentially more dispositive questions about the states’ educational decision-making authority—questions that the U.S. Supreme Court has long sought to avoid. But exposing these so-called “anti-CRT” laws as neither …

Unsafe At Any Speed: "Safe Third Country Agreements" - Offshoring And Eroding Legal Protections Owed To Refugees And Asylum Seekers, Thomas Michael Mcdonnell
Elisabeth Haub School of Law Faculty Publications
Part I of this Article analyzes third country agreements and refugee transfer practices of the United States and the European Union. Part II demonstrates that, under international law, all countries are obligated to protect refugees and are prohibited from directly or indirectly sending them to a country where there is a substantial basis for believing that their life or freedom would be threatened. Part II will likewise show that the notion of "safe third country" transfer agreements and practices is often a fallacy, an oxymoron. Instead of keeping refugees safe, such agreements and practices seriously erode the fundamental non-refoulment obligation …

The Misconceived Personal-Benefit Requirement Of Insider Trading Law: About The Insecurities Markets, Kenneth R. Davis
The Misconceived Personal-Benefit Requirement Of Insider Trading Law: About The Insecurities Markets, Kenneth R. Davis
Denver Law Review
In Dirks v. SEC and Salman v. United States, the Supreme Court held that, under Section 10(b) of the Securities Exchange Act, tipper/tippee liability arises only if the tippee confers a benefit on the tipper. The ostensible justification for this rule arises from a mistaken premise. The error is rooted in the so-called classical theory of insider trading. When a corporate insider trades on material, nonpublic corporate information, the Supreme Court has held that the insider faces liability because that person profited from the trade. Building on this mistaken premise, the Court has held that when a tipper receives a …

Constitutional Dead Zones: Problematic Trends For Seizures Of Cell Phones Connected To The Recording Of Protests And Police Activity, Zachary R. Cormier
Constitutional Dead Zones: Problematic Trends For Seizures Of Cell Phones Connected To The Recording Of Protests And Police Activity, Zachary R. Cormier
Denver Law Review
Cell phones are free speech machines. They have been particularly important in recent social movements because they allow an individual to record protests or police activity and share such experiences with a world-wide audience on social media. In these circumstances, the Fourth Amendment’s protection of an individual’s unfettered property right to possess their cell phone overlaps with their First Amendment right to engage in these core free speech activities. Both rights are put to the test when there is conflict with police in connection with the recording. My survey of recent case law provides numerous examples where an individual’s cell …
"Fixing" The Classical Legal Tradition, Jamie G. Mcwilliam
"Fixing" The Classical Legal Tradition, Jamie G. Mcwilliam
Denver Law Review
A “moral turn” in jurisprudence—in which scholars and judges are making overt appeals to the classical legal tradition and its natural law principles—has been gaining steam. Originalism, with its focus on posited law, is increasingly viewed as a morally empty jurisprudence. But positive law is a necessary, though not sufficient, component of the classical tradition, providing the means for a society to advance the common good. With that in mind, this Article explains how certain core originalist theses provide a deeper understanding of the mechanics of how positive law fulfills its moral role. It, therefore, argues that these concepts should …

Texas S.B. 8 V. Rights: Restoring Judicial Power With The State Action Remedy, Kobi J. Grossman
Texas S.B. 8 V. Rights: Restoring Judicial Power With The State Action Remedy, Kobi J. Grossman
Undergraduate Honors Theses
While the constitutional right to an abortion was the law of the land in the U.S., Texas sought to restrict that right in line with their political agenda by passing S.B. 8 (2021), referred to as the “Texas Heartbeat Act”. This statute made access to abortions illegal past six weeks, or once a heartbeat is detected. The enforcement structure created in the law did not look to the state to exercise its role as the executor of the public good, but rather, to private citizens in creating a right of action for individuals to sue anyone who “aids or abets” …

The Colder War: Predicting Government Deception In The Arctic Conflict, Chisom Nnennaya Okorafor
Undergraduate Honors Theses
As rising temperatures increase the rate of polar ice cap melt, the Arctic is rapidly becoming a region of significant geopolitical interest, creating the potential for a revived Great Powers struggle. A key consideration surrounding potential conflict for democracies is the role of official government secrecy in foreign policy decision-making. This particular study examines the intersection of the two topics, creating a model of understanding and predicting U.S. government deception in conflicts. Specifically, this research identifies the gap between internal U.S. government knowledge and publicly broadcasted messaging surrounding the justifications for military and covert action. By analyzing case studies of …
The Jurisprudence Of Constitutional Entitlement, David Schraub
The Jurisprudence Of Constitutional Entitlement, David Schraub
William & Mary Bill of Rights Journal
Lawyers are accustomed to thinking of constitutional law as a familiar binary: Either a given governmental policy or practice is constitutional and therefore permitted, or unconstitutional and forbidden. But not all constitutional laws are created equal. A state practice which may be constitutional in concept (such as the death penalty) may, in some or many applications, violate specific constitutional rules and become impermissible. When a policy which has been affirmed to be constitutional in general repeatedly runs up against problems as-applied, a legal tension emerges: can the state implement the policy or not? This dilemma illuminates a third constitutional category: …
Ten Commandments In The Public Square And Public Schools, Mark David Hall, Andrea Picciotti-Bayer
Ten Commandments In The Public Square And Public Schools, Mark David Hall, Andrea Picciotti-Bayer
William & Mary Bill of Rights Journal
The Ten Commandments are of paramount importance to the Jewish and Christian faiths, and they are viewed by many as a source of Western law. In America, they have been (and are) taught in churches and synagogues, and throughout much of this nation’s history they have been taught by parents, tutors, and teachers in private and public schools. They are regularly displayed in courthouses and statehouse grounds, and some states have desired to display them in public schools. Predictably, those who would scrub religion from the public square have argued that Ten Commandment displays on public property violate the First …
Regulating Deception To Protect Democracy: Global Election Misinformation Regulations Analyzed Under U.S. First Amendment Doctrine, Stephanie Hoke
Regulating Deception To Protect Democracy: Global Election Misinformation Regulations Analyzed Under U.S. First Amendment Doctrine, Stephanie Hoke
William & Mary Bill of Rights Journal
This Note argues that the marketplace of ideas may not always be a workable theory for the election misinformation that pervades social media platforms. Social media is a unique medium because it does not have the same safeguards as television, radio, and newspapers that are used to filter out false claims and information. Due to the lack of safeguards and the algorithms that promote misinformed posts, social media platforms provide a thriving environment for election misinformation. In addition, the presence of online “echo chambers” and the speed at which misinformation can spread calls for some form of government regulation. In …

A Data-Driven Framework For Optimal Retail Store Location, Ming Hui Tan
Dissertations and Theses Collection (Open Access)
This study develops a data-driven framework for optimal retail store location planning that integrates road network analysis, mobility data and optimization techniques. By addressing the limitations of traditional approaches that rely on outdated census data and manual site selection, this research offers a scalable and adaptable solution for retail expansion in diverse urban environments. Chapters 1 and 2 establish the foundational context and theoretical underpinnings of this research. Chapter 1 introduces the research problem and motivation, highlighting the limitations of existing approaches and defining three key research objectives: automating candidate site identification, improving footfall estimation, and developing a scalable multi-site …

Factors Influencing Consumers’ Online Purchase Decisions: Evidence From Amazon.Com, Weiwei Li
Dissertations and Theses Collection (Open Access)
With the rapid expansion of cross-border e-commerce, platform sellers increasingly adopt diverse price formatsto influence consumer decision-making. In this context, consumers’ perceptions of and responses to price information have become a pivotal issue in understanding online purchase behavior. Using Amazon as the research setting, this study employs a dynamic panel model with monthly product-level data spanning January 2024 to June 2025 to investigate how different price formats—such as Prime-exclusive pricing and coupon mechanisms—affect consumers’ online purchase intentions when the out-ofpocket price is held constant. Furthermore, the moderating effect of promotional events is systematically examined.
Departing from prior research that largely …

Safe Sex In The Age Of Big Tech Feminism, Brenda Dvoskin, Thomas E. Kadri
Safe Sex In The Age Of Big Tech Feminism, Brenda Dvoskin, Thomas E. Kadri
Articles
Lawmakers and technology companies are regulating online sexuality in the name of feminism. Whereas libertarian ideals dominated early debates about internet governance, "safety" has become the rallying cry to regulate online activity in the age of Big Tech. Legislators across the political spectrum and companies around the world are devising interventions meant to keep people - and especially women safe from the risks of online sexuality. Through law and technology, they target everything from privacy invasions to unwanted messages to sexual deepfakes. We call this regulatory and ideological trend Big Tech feminism.
This Article interrogates the feminist strands animating Big …

Cultural Diagnosis And The Monsters Of Victorian England, Victoria Elizabeth Kuykendall
Cultural Diagnosis And The Monsters Of Victorian England, Victoria Elizabeth Kuykendall
Theses and Dissertations
This dissertation examines the representation of invisible disability and neurodivergence in nineteenth-century British literature, arguing that literary texts both reflect and shape cultural understandings of disability. While much scholarship has focused on visible or physical impairments in Victorian fiction, comparatively little attention has been given to characters whose behaviors, emotions, or identities align with what today might be described as neurodivergence.
Drawing on Disability Studies, Mad Studies, and cultural theory, I propose the concept of cultural Diagnosis as a framework for analyzing how fictional characters become “Diagnosable” within both their historical and contemporary cultural contexts. Through close readings of Arthur …
