Dammed Water Markets: How Western Water Transfer Markets May Be Inhibiting An Efficient Allocation Of Water, Robert Putka

Water transfer markets, in theory, provide a pareto-optimal solution to increasing water scarcity. The experience of municipal water purchasers, however, does not appear to square with theory. Indeed, municipal purchasers facing water supply shortfalls often pay comparatively exorbitant premiums for marginal units of water; this evidenced prices-paid differential is likely imputable to allocative inefficiency in water transfer markets—i.e., prices paid by municipal water purchasers are distorted above the marginal cost of supplying the water. Broadly, the hypothesized allocative inefficiency is a market failure in-and-of-itself, calling into question normative arguments that water transfer markets provide for an ideal mode of resource …

Scholars are engaged in deep debate about the transformative power of recent Supreme Court cases that appear to limit the role of agencies in making rules of law. In Loper Bright Enterprises v. Raimondo and West Virginia v. EPA, the Supreme Court overruled a longstanding doctrine of judicial deference to agency rules and prescribed more boundaries around the scope of such rules. Scholars have debated to what extent these changes will usher in new forms of judicial review that will transfer power from agencies to the courts.

The purse is mightier than the sword. In recent decades—from the Cold War to the War on Drugs to the War on Terror to Russia’s invasion of Ukraine—financial institutions have increasingly become the conduits for the United States government’s foreign policy. This Article argues there are deep and under-appreciated connections between the use of money and credit to influence geopolitics, which this Article terms “financial statecraft,” and the goals of financial regulation.

Recently though, gaming culture has been directly involved with social movements and forms of resistance that are contrary to these norms and values. Recent cases in which civilians involved themselves in the crime control process have garnered divided reactions, with some people supporting and others disapproving the civilians’ actions. Although existing research shows that perceptions of the police predict support of civilians involved in crime control, exact directions of the effects conflict. I address these conflicting findings by examining how people conceptualize police legitimacy and trust in the police, whether those conceptualizations align with scholarly definitions of legitimacy and trust, and explore if the two constructs differentially predict support of vigilantism. This dissertation examines the consequences of nursing home closures for access to care, local economic conditions, and resident health in the United States. As the long-term care system shifts toward home- and community-based services and the nursing home sector contracts, facility closures have become an increasingly important policy concern. Although closures may reflect necessary market restructuring in some settings, they may also reduce access, weaken local economies, and place pressure on surviving facilities. This study describes the development and initial validation of the Mentoring Engagement Scale (MES), a self-report instrument designed to measure a person’s level of engagement in professional mentoring. Despite emerging evidence that professional mentoring may serve as a protective factor against the burnout and stress associated with school counselors’ roles and responsibilities, existing measures of mentoring are limited by weak documentation of development procedures, mixed psychometric support, and limited practical applicability. This qualitative study examines how highly skilled foreign-national parents navigate parenting and educational decision-making within the context of cultural transition in the United States. While existing research on foreign-national parenting has largely focused on socioeconomically disadvantaged populations, less is known about families who possess substantial educational and professional capital. Despite these advantages, these parents encounter unique challenges related to institutional navigation, identity negotiation, and social constraints. As of late, my work has dealt with themes of collapse and comedy, pertaining specifically to faded ideals of individualism in art. My thesis installation, titled Pingbongbilladingdong, is a testament to this tension, portraying a reconstruction of the disheveled chaos of the artist’s studio. In this paper, I use this installation as a means to further explore the ways that abjection and comedy intersect in art, and how myself and others repurpose the faded glamor of Ab-Ex as a means to probe this overlap. Background and Objectives: Immigrants in the United States undergo acculturation — a process of sociocultural and behavioral adaptation to the host country. Increasingly, behavioral adaptations have been associated with cardiometabolic health and chronic disease risk. Metabolic syndrome (MetS), a cluster of conditions including abdominal obesity, elevated blood pressure, impaired fasting glucose, elevated triglycerides, and reduced HDL cholesterol, is a major risk factor for type 2 diabetes mellitus, cardiovascular diseases and other chronic diseases, including cancer. This research questions that legacy by repositioning aesthetics as a divinely grounded value, inspired by the Qur’anic vision of Paradise. In this celestial realm, beauty is not wasteful but a manifestation of divine perfection. Conceptually, the project reclaims ornament as a vital tool for contemplating metaphysical themes. Lewy Body Dementia (LBD), the second most common cause of dementia, shares underlying neuropathological features with Parkinson’s disease, including the aggregation of misfolded α-synuclein into Lewy bodies and Lewy neurites. Lung fibrosis (LF) is a progressive, irreversible pathological condition in the lungs that is ultimately fatal. Current drug treatments (nintedanib, pirfenidone, and nerandomilast) slow disease progression but cause significant systemic adverse effects due to oral administration. Transient receptor potential vanilloid 4 (TRPV4), a mechanosensitive ion channel, may play a role in LF progression and represent a novel anti-LF target. Ginkgetin (GKT), a natural biflavonoid, is a potent TRPV4 inhibitor with anti-inflammatory and antioxidative properties. Local lung delivery could achieve high local lung concentrations while minimizing systemic exposure. People with serious mental illnesses (SMI) die 15 to 20 years before their peers without mental illness primarily due to chronic physical health conditions. Preventative care and treatment for chronic physical health conditions primarily occurs through primary care, but the experience of people with SMI in primary care is understudied. This constructivist grounded theory dissertation explored the experiences of people with SMI in primary care. Theoretical sampling resulted in 19 participants who were adults with SMI and long-term anti-psychotic use. Data was collected through one-to-two-hour long intensive interviews. This article examines the scale, patterns, and political implications of racial violence in Texas between 1865 and 1868, arguing that white terror functioned as a systematic effort to suppress Black freedom and restore antebellum racial hierarchies. Drawing on Congressional testimony, Freedmen’s Bureau records, and the 1868 Report of the Special Committee on Lawlessness and Violence in Texas, the study reveals that violence was not random but structured along social, labor, and political lines. Murders, whippings, intimidation, and organized attacks—such as the Millican riot—intensified when freedpeople asserted labor autonomy or political rights. Despite nearly 900 reported murders, convictions were exceedingly rare, …

Text is a vehicle to convey information that reflects the writer’s linguistic style and communication patterns. By studying these attributes, we can discover latent insights about the author and their underlying message. This article uses such an approach to better understand patent applications and their inventors.

While prior research focuses on patent metadata (i.e., filing year or gendered inventor names), we employ machine learning and natural language processing to extract hidden information from the words in patent applications. Through these methods, we find that inventor gender can often be identified from textual attributes—even without knowing the inventor’s name. This ability …

Recent decisions by the Copyright Office have gotten so much media attention that many creators are unsure if they can secure copyright protection if they use AI as a creative tool. The proposed creative control paradigm can help us all tackle the challenge of determining when works created with the assistance of AI are copyrightable. Instead of relying on long-established nuanced precedent for protecting works generated with new technology, the Copyright Office asserts that any content generated with assistance from AI tools is unprotectable. In the aftermath of the 2022 U.S. Supreme Court ruling in Dobbs v. Jackson Women’s Health Organization removing federal constitutional protection for abortion, twenty states currently significantly restrict access to abortion. These state laws all include exceptions for the life of the pregnant person; most also exempt significant impairments to the pregnant patient’s health. Despite these exceptions, repeated accounts in the press and in court cases have shown pregnant patients in significant medical need being denied abortion care, resulting in serious injuries and, in some cases, death. Part I of this Article provides a detailed description of the origins of the Economic Community of West African States (ECOWAS). Part II describes its transformation from a sleepy trade bloc to a dynamic peace and security and human rights enforcement institution. Part III examines arguments about whether ECOWAS’s aggressive human rights enforcement is or is not legal under international law. Sovereign bond restructurings depend on collective voting mechanisms called Collective Action Clauses (CACs) in bond contracts. CACs let a bondholder supermajority modify the bond and bind dissenters to the outcome. But what if dissenters can avoid being bound by rushing to court and getting a judgment? Existing analyses suggest that the legal doctrine of merger and bar might cause the CAC to “merge” into a court’s judgment, effectively allowing judgment holders to escape the restructuring. Other bondholders would be unable to stop judgment holders from enforcing their judgments. Policymakers have long worried that this risk might undermine the contractual architecture …

Democracy is a compliance cost. At least, that is the modern conception of performative corporate governance. Structurally contingent legal and market characteristics mean that shareholder voting is now conducted with an unusual combination of zealous devotion to the voting process and general ambivalence as to substantive outcomes.

This dynamic arises because financial and voting rights are routinely decoupled, resulting in a fundamental transformation of the incentives, constraints, and power dynamics through which the world’s largest corporations are governed.
