This Essay argues that knowledge institutions are crucial to the ability of historically disadvantaged groups—including women—to correct the injustices they have suffered. In Part II, the Essay begins by defining knowledge institutions and explaining why they need legal recognition and protection in a constitutional democracy. Part III then argues that knowledge institutions are a resource for challenging conventional understandings and assumptions that may produce injustices not readily remedied through political processes. Knowledge institutions have served this role in several important constitutional battles in the United States—over racial equality, gender equality, and discrimination against same-sex couples. In the late twentieth century, the boom of forensic disciplines in criminal prosecutions helped drive mass incarceration to an all-time high. Yet scientific and legal inquiry revealed a disturbing truth: Most forensic methods accepted in criminal courts are entirely lacking in empirical support or scientific foundation—in other words, “junk science.” Forensic proponents have recently turned to computer algorithms, costly equipment, and proprietary trade secrets litigation to defend dubious techniques, ushering in a second wave of forensic reliance. But automated technology has masked rather than cured the foundational infirmities in these forensic fields.

Disarming Data: An Empirical Take On The Loaded Debate About Felon-In-Possession Of A Firearm, Jonathan Abel

This Article answers a crucial empirical question at the heart of the scholarly and judicial debates about the laws governing felon-in-possession of a firearm: How often do defendants charged with this offense have violent felony convictions? Using a comprehensive dataset of over 27,000 defendants charged in California from 2021 through 2024, the study provides a novel, large-scale analysis of how prosecutors deploy this most-common gun charge. The findings substantiate longstanding concerns that felon-in-possession is overbroad in its application to nonviolent felons—only 8.5% of defendants had a “violent felony” conviction as defined by California law, rising to just 28.8% under a …

The legal landscape for generative artificial intelligence (AI) and copyright is now shaped more by private settlements that overwhelmingly favor copyright holders than by courts or legislators. As AI companies rely on copyrighted materials to train their models, content owners have filed lawsuits challenging these practices. However, instead of clarifying fair use limits in court, most disputes are resolved through private settlements. These agreements impose licensing fees, content restrictions, and compliance requirements, creating a shadow regulatory system that governs how AI companies access and use training data. Despite enduring technical issues, like hallucinations and implicit bias, AI’s capabilities and potential benefits have created massive impetus toward adoption. Recent cases like Mata v. This article concerns gambling in Alaska in the period prior to statehood (1867– 1958). While the courts in this era did not generate very many gambling opinions, the ones they did issue provide a feel for what life was like in the region. In addition, Alaska’s current ban on most forms of gambling can be directly traced back to its first gambling law (1884).

Betting The House: Why The Safe Bet Act Is A Long Shot To Survive Constitutional Scrutiny Under The Commerce Clause And Anti-Commandeering Doctrine, Jared Weingard

The rapid expansion of legalized sports gambling following Murphy v. NCAA has raised concerns about problem gambling, predatory marketing, and inconsistent state regulations. In response, the SAFE Bet Act, introduced by Representative Paul Tonko, seeks to impose nationwide standards on sports betting. However, its framework raises significant constitutional concerns under the Commerce Clause and the anti-commandeering doctrine. This Article argues that the Act’s enforcement mechanism likely violates the Tenth Amendment by coercing states into compliance, conflicting with Supreme Court precedent on federal conditional spending and preemption.

This thesis examines how trust congruence and trust asymmetry shape leader-subordinate relationships and how these dynamics influence LTS and subordinate job performance. Trust congruence and trust asymmetry are defined by the degree of alignment between STL and SFT. Drawing on Self-Determination Theory, this study investigates these processes from the subordinate’s perspective using a mixed-method design that integrates qualitative interviews and quantitative analysis.

Results show that subordinate trust in leader (STL), subordinate felt trust (SFT) and leader trust in subordinate (LTS) are three distinct constructs. Trust asymmetry is prevalent, with subordinate often trusting more than they feel trusted. Asymmetry meaningfully shapes …

How Do Monetary Incentives Affect Prosocial Behavior Among Gig Workers?—Behavioral Experiments Based On Flashex, Peng Xue

The gig economy has reshaped labor markets. Motivating mobile, loosely contracted gig workers to engage in prosocial behavior is critical for platform governance. This paper uses a randomized field experiment on FlashEx in comparable Chinese cities to examine how monetary incentives affect delivery workers’ prosocial behavior and related economic outcomes.

The main findings of this study are as follows. First, monetary incentives significantly promote gig workers’ prosocial behavior, effectively increasing both the likelihood and frequency of their participation in altruistic acts. This effect is primarily driven by the “instrumental value” mechanism in the gig economy: the platform’s gold coin rewards, …

In an increasingly competitive global market characterized by accelerating technological iteration and rapidly evolving consumer demands, innovation has become a critical means for firms to adapt to dynamic changes and achieve competitive advantage. Grounded in dynamic capabilities theory and the resource-based view, this study empirically investigates the mechanisms through which product innovation and process innovation affect product performance, drawing on survey data from 215 products. It further examines the mediating role of product flexibility and the moderating effect of product positioning. This study is based on consumer movement trajectory data and examines the relationship between traffic spillover among stores within shopping centres and their rent ratios, responding to the practical limitation that traditional rental pricing mechanisms often overlook the dynamic structure of customer flows. Using micro-level consumer movement data and store rental data from three shopping centres in Shenzhen, Nanjing, and Chongqing, this paper constructs a store transition network reflecting customer movements between stores. This study examines the inconsistencies in various regulations regarding land and land management in Indonesia, which give rise to divergent interpretations and legal uncertainty—ultimately becoming a source of conflict that is not easily resolved. The study focuses on the protracted conflict among local residents living in 26 subdistricts in Surabaya who hold “Surat Ijo” certificates. The residents believe that, as certificate holders, they have the status of owners. Meanwhile, citing various laws and regulations on land governance, the Surabaya city government maintains that these certificates affirm the residents’ status as tenants of land assets owned by the Surabaya city government. …

Trees can redirect large volumes of rainwater to the base of their stems. This stemflow not only redistributes water but also channels canopy-derived solutes to the forest floor. Building on research showing canopy geometry and bark properties govern stemflow volumes, we examined how those same traits modulate the biogeochemical side of this flux. Over a 12-month period in Jamari National Forest (Brazil), we quantified stemflow volume and solute chemistry for 19 trees grouped by diameter at breast height (D: < 10, 10-20 and > 20 cm), crown area (CA: < 30, 30-60 and > 60 m(2)) and bark texture (smooth, fissured and rough).
