Metadata Decentralized: An Examination Of Folksonomy In Book Publishing, Dani Tellvik
Book Publishing Final Research Papers
Classification of materials as multifaceted and complex as books is fraught with competing needs and idiosyncratic forms of expression and organization. A publisher’s primary goal is to position their books in a way that will attract readers who find value in the books. Book Industry Standards and Communication (BISAC) codes, the list of industry-approved subject headings, are essential to a book’s metadata for North American publishers. They are used to strike the balance so that a book blends in to an established category while also standing out as a particularly compelling of unique expression or the chosen classification.

Internet Censorship In The Time Of A Global Pandemic: A Proposal For Revisions To Section 230 Of The Communications Decency Act, Braxton Johnson, Alex Dewsnup
Brigham Young University Prelaw Review
During the era of the novel coronavirus SARS-CoV-2, social media sites have justified removing inflammatory opinions pertaining to COVID-19 in attempts to protect and promote public health and safety by automatically categorizing such opinions as misinformation. While the intention of such censorship is noble, it raises the question of whether social media sites and internet service providers in general have too much power when it comes to controlling information. In an age where social media has become intrinsic to the dissemination and formation of opinion, the free exchange of ideas on the Internet is of prime importance, and any threat …
The Weakening Of The Voting Rights Act: A Proposal For Modernizing Preclearance, Breannan Perez
The Weakening Of The Voting Rights Act: A Proposal For Modernizing Preclearance, Breannan Perez
Brigham Young University Prelaw Review
The Voting Rights Act of 1965 was passed more than 58 years ago. However, despite its attempt to identity and address discrimination, many of its safeguards have been struck down by the Court. In fact, Section 4b aimed to eliminate voting procedures that were discriminatory in effect, but has since been deemed as unconstitutional. Such a ruling has weakened the VRA and has burdened minority voters. This article proposes a modernized preclearance formula that considers states’ voting rights violations and current voting data. Such a proposal is necessary as a disregard of any voter is a threat to the integrity …

Extending The Diversity Conversation: Fashion Consumption Experiences Of Underrepresented And Underserved Women, Lena Cavusoglu, Deniz Atik
Marketing Faculty Publications
This research brings in the voice of underserved and underrepresented women of various racial or ethnic origins and social classes, who have differing buying powers, sexual orientations, body shapes, and physical appearances, into the conversation of fashion diversity. Through a qualitative inquiry with 38 semi-structured in-depth interviews, the researchers analyzed the consumption experiences of diverse women to expose what the fashion scene is lacking. The study's main contribution is the depiction of overlooked diversity categories in fashion, such as the non-White and non-Black women of color, women of average sizes, and women with characteristics that the fashion industry has long …
The Troubles On The Brink Of Recurrence: Northern Ireland In A Post-Brexit World, Emma K. Bohner
The Troubles On The Brink Of Recurrence: Northern Ireland In A Post-Brexit World, Emma K. Bohner
Student Publications
The Troubles were a difficult and trying time for Northern Ireland beginning in the 1960s. The subsequent decades were filled with turmoil and violence, mainly centered in Belfast amongst the Protestant and Catholic groups. In 1998, peaceful means to ending the Troubles were accomplished through the Good Friday Agreement. The accord established peace primarily through implementing a new power sharing government, ending direct rule by the British, disarming the paramilitary groups and creating a soft border between Ireland and Northern Ireland. The European Union was a critical asset in negotiating terms for peace. The aid of the European Union helped …
Jurisgenerative Tissues: Sociotechnical Imaginaries And The Legal Secretions Of 3d Bioprinting, Roxanne Mykitiuk, Joshua Shaw
Jurisgenerative Tissues: Sociotechnical Imaginaries And The Legal Secretions Of 3d Bioprinting, Roxanne Mykitiuk, Joshua Shaw
Articles & Book Chapters
Three-dimensional ‘bioprinting’ is under development, which may produce living human organs and tissues to be surgically implanted in patients. Like tissue engineering and regenerative medicine generally, the process of bioprinting potentially disrupts experience of the human body by redefining understandings of, and becoming actualised in new practices and regimes in relation to, the body. The authors consider how these novel sociotechnical imaginaries may emerge, having regard to law’s contribution to, as well as its possible transformation by, the process of 3D bioprinting. The authors draw on Gilbert Simondon and corporeal, material feminists to account for these disruptions as ‘ontogenetic,’ in …

The Impact Of Stakeholder Orientation On Tax Avoidance: Evidence From A Natural Experiment, Gary Chen, Ani Manakyan Mathers, Bin Wang, Xiaohong Wang
Finance Faculty Research and Publications
We study the effect of stakeholder orientation on corporate tax avoidance. Using the staggered passage of constituency statutes across U.S. states between 1983 and 2006, we show that greater stakeholder orientation results in increased tax avoidance. We further find greater tax avoidance among firms with limited financial resources and that employees benefit from the change. Our results are consistent with stakeholder salience theory that resource-constrained managers prioritize the claims of salient stakeholders, such as employees, at the expense of secondary stakeholders, such as the government.
Restrictions On Worker Mobility And The Need For Stronger Policies On Anticompetitive Employment Contract Provisions, Donald J. Polden
Restrictions On Worker Mobility And The Need For Stronger Policies On Anticompetitive Employment Contract Provisions, Donald J. Polden
Faculty Publications
There is increasing concern in the United States about the difficulties that American workers are facing including concerns about limits on worker job mobility and how those limits affect workers’ wages and compensation, employee benefits, and finding their next job.2 Workers believe the challenges they face in changing jobs for better salary and benefits should be addressed so they have greater job mobility and opportunities for advancement. Workers are subject to restraints on job mobility across the spectrum of jobs, including those in executive-level positions as well as minimum- wage employees. Workers complain that they are not constrained in getting …

Characterizing the diet of imperiled species using minimally invasive methods is crucial to understanding their ecology and conservation requirements. Here, we apply a DNA metabarcoding approach to study the diet of the eastern massasauga rattlesnake (Sistrurus catenatus), a Federally Threatened snake found throughout the Great Lakes region. Eighty-three fecal samples collected across 10 different massasauga populations located in Michigan, USA, were sequenced, with 70 samples containing prey DNA. We used universal metazoan primers and developed a host-specific oligonucleotide blocker to characterize their diet. We identified at least 12 different prey species, with eastern massasaugas exhibiting opportunistic feeding and …
College Majors And Skills: Evidence From The Universe Of Online Job Ads, Steven W. Hemelt, Brad J. Hershbein, Shawn Martin, Kevin M. Stange
College Majors And Skills: Evidence From The Universe Of Online Job Ads, Steven W. Hemelt, Brad J. Hershbein, Shawn Martin, Kevin M. Stange
Upjohn Institute Working Papers
We use the near universe of U.S. online job ads to document four new facts about the skills employers demand from college majors. First, some skills––social and organizational––are demanded from all majors whereas others––financial and customer service––are demanded from only particular majors. Second, some majors have skill demand profiles that mirror overall demand for college graduates, such as Business and General Engineering, while other majors, such as Nursing and Education, have relatively rare skill profiles. Third, cross-major differences in skill profiles explain considerable wage variation. Fourth, although major-specific skill demand varies across place, this variation plays little role in explaining …

In vitro studies indicate the neurodevelopmental disorder gene myelin transcription factor 1-like (MYT1L) suppresses non-neuronal lineage genes during fibroblast-to-neuron direct differentiation. However, MYT1L's molecular and cellular functions in the adult mammalian brain have not been fully characterized. Here, we found that MYT1L loss leads to up-regulated deep layer (DL) gene expression, corresponding to an increased ratio of DL/UL neurons in the adult mouse cortex. To define potential mechanisms, we conducted Cleavage Under Targets & Release Using Nuclease (CUT&RUN) to map MYT1L binding targets and epigenetic changes following MYT1L loss in mouse developing cortex and adult prefrontal cortex (PFC). We found …

Charged Multivesicular Body Protein 4b Forms Complexes With Gap Junction Proteins During Lens Fiber Cell Differentiation, Yuefang Zhou, Thomas M Bennett, Thomas W White, Alan Shiels
2020-Current year OA Pubs
Charged multivesicular body protein 4b (CHMP4B) is a core sub-unit of the endosomal sorting complex required for transport III (ESCRT-III) machinery that serves myriad remodeling and scission processes of biological membranes. Mutation of the human CHMP4B gene underlies rare forms of early-onset lens opacities or cataracts, and CHMP4B is required for lens growth and differentiation in mice. Here, we determine the sub-cellular distribution of CHMP4B in the lens and uncover a novel association with gap junction alpha-3 protein (GJA3) or connexin 46 (Cx46) and GJA8 or Cx50. Immunofluorescence confocal microscopy revealed that CHMP4B localized to cell membranes of elongated fiber …

BACKGROUND: Negative cerebrospinal fluid (CSF) cultures at 2 weeks after antifungal treatment (early mycological clearance [EMC]) should be a treatment goal of cryptococcal meningitis (CM). However, EMC in human immunodeficiency virus (HIV)-negative patients with CM is poorly understood.
METHODS: We conducted a retrospective review of medical records and 1-year follow-up of 141 HIV-negative patients with CM with an initial positive CSF culture for
RESULTS: Of 141 patients, 28 (19.9%) had EMC failure. The 1-year mortality rate was 5.7% (8/141). Multivariate analysis showed that non-amphotericin B (AmB)-based regimens, baseline log
CONCLUSIONS: EMC failure in HIV-negative CM is attributed to non-AmB-based therapy …

The Ties That Bind Us: An Empirical, Clinical, And Constitutional Argument Against Terminating Parental Rights, Vivek S. Sankaran, Christopher Church
The Ties That Bind Us: An Empirical, Clinical, And Constitutional Argument Against Terminating Parental Rights, Vivek S. Sankaran, Christopher Church
Articles
This Article explores the unnecessary termination of a child's relationship with their parent from an empirical, clinical, and constitutional lens. Part I explores administrative data related to TPR, which like many child protection metrics, resembles nothing short of a wild west of practices and policies relating to how often and how fast child protection systems terminate parental rights. These data also reveal how TPR can unnecessarily delay legal permanency for children, particularly those children who are living with extended family, and how a State pursuing TPR can drain its own scarce resources, a system perpetually decrying insufficient resources. Part II …

Reflections On A Promise: Student Experiences At A Two-Year Promise Institution And Their Educational Aspirations, Danielle Lemmerman
Dissertations
College students and their families have to shoulder more of the burden in college costs due to rising tuition. To deter students from adding to the national student loan debt, promise programs have been launched to eliminate cost as a barrier to postsecondary education. Programs vary in design and may cover partial tuition, full tuition, or both tuition and fees. Currently, there is a dearth of research on the experiences low-income students have attending a promise eligible institution, especially at the community college level. This qualitative case study explores the ways in which low-income undergraduate students describe their experiences at …
The Interstellar Scintillation Of Psr J1614-2230, Lekshmi Rajagopal
The Interstellar Scintillation Of Psr J1614-2230, Lekshmi Rajagopal
Theses
Observations of the millisecond pulsar J1614-2230 as part of the NANOGrav 12.5 yr dataset were utilised to study the scintillation and interstellar medium along the line of sight of PSR J1614-2230. Modelling noise signals in pulsar line of sight allows for isolation of the raw signal and therefore more precise pulse period measurements. These are extremely useful in Pulsar Timing Arrays and in their potential to be used as cosmic detectors for the gravitational wave background. J1614 presented clear, distinguishable intensity variations in a long observation taken in March 2014 by B.J.Shapiro-Albert et al. (2020), which provided motivation to further …

Felicidad Aplataná: How Dominican Migrants Living In The Nordic Countries Make Sense Of Their Happiness, Ivanna Lajara
Dissertations
As globalization evolves and the number of migrants and cross-cultural interactions among world citizens increases, understanding various aspects of immigrants’ experiences, including their happiness and subjective well-being will become fundamental to organizations, governments, and societies. However, there are substantial cross-cultural differences in how people understand their happiness, make sense of experiences that influence happiness, and how large-scale social trends, such as globalization, relate to the individual migration perspectives (Uchida and Ogihara, 2012). Research affirms culture as a key factor influencing happiness (Ye et al., 2015) and living in a foreign country may not only impact one’s perspective on life, but …

Representative Sara Jacobs And Senator Dick Durbin Take Aim At The Dod Law Of War Manual - And Miss, Brian L. Cox
Cornell Law Faculty Publications
In a letter recently sent to the Department of Defense General Counsel, two lawmakers—Representative Sara Jacobs and Senator Dick Durbin— present a number of suggested revisions to the DoD Law of War Manual. In Part I, this Article conducts a critical assessment of the substantive suggestions. By adopting an approach that emphasizes maintaining the delicate balance between humanitarian considerations and military necessity, the critical assessment concludes that the suggested revisions to the Manual are inadvisable.
Part II then considers the Jacobs-Durbin letter in the broader context of public discourse and separation of powers. This component of the inquiry determines that …

Gender, Violence, And The Death Penalty, Sandra L. Babcock, Nathalie Greenfield
Cornell Law Faculty Publications
This article is the first in a series that will systematically explore how gender has affected the criminal proceedings of women currently on death row. For this inaugural article, we have undertaken the first—and, to our knowledge, only—comprehensive analysis of gender-based violence (“GBV”) in the lives of all women currently on death row, examining the prevalence of GBV and how it has shaped the lives and affected the criminal prosecutions of women facing execution. Our research reveals, for the first time, that almost every woman on death row in the United States has experienced GBV. Indeed, the great majority have …

Sunnier Days Ahead? Missouri’S Outlook After Missouri Supreme Court Finds Solar Panel Property Tax Unconstitutional, Maura Corrigan
Sunnier Days Ahead? Missouri’S Outlook After Missouri Supreme Court Finds Solar Panel Property Tax Unconstitutional, Maura Corrigan
Missouri Law Review
Many are aware of the inherent power that a constitution holds. Whether it be the timeless federal document signed in 1787, or a state constitution adopted decades later, a “constitution” in the United States comes with an authoritative voice that instructs the very principles and values the government has long established. Constitutions, by nature, stand the test of time; they create guidelines, structure, and, above all, a sense of justice that lies in the backdrop of every legal argument presented and every court decision rendered.

Like any other hardy administrative law article, this Note starts with Chevron. In 1984, the Supreme Court decided the landmark case, Chevron U.S.A. Inc. v. National Resources Defense Council, Inc. There, the Court said it will defer to an agency’s interpretation of a statute if that interpretation is reasonable. However, because some on the Court saw Chevron deference as “wrest[ing] from [c]ourts the ultimate interpretive authority to ‘say what the law is’ and hand[ing] it over to the Executive,” exceptions to Chevron deference have appeared like worms after a storm.
Revisiting The Original Congressional Debates About The Second Amendment, Dru Stevenson
Revisiting The Original Congressional Debates About The Second Amendment, Dru Stevenson
Missouri Law Review
Many scholars and courts have written about the historical background of the Second Amendment, either to emphasize its connection to state level citizen militias or to argue that the Amendment protects an individual right to own and carry guns for self-defense. While many authors have mentioned the original congressional debates about the Second Amendment, the literature is missing a thorough, point-by-point analysis of those debates, situating each statement in Congress within the context of the speaker’s background and political stances on issues overlapping with the right to keep and bear arms. This Article attempts to fill this gap by providing …
