Corruption And Judges' Personal Independence In The Judiciary Of Bangladesh: One Bad Apple Can Spoil The Bunch, S M. Solaiman
Corruption And Judges' Personal Independence In The Judiciary Of Bangladesh: One Bad Apple Can Spoil The Bunch, S M. Solaiman
Cardozo International & Comparative Law Review
Corruption appears to have been an inexorable crime in Bangladesh for decades. More deplorably, the magnitude of judicial corruption has profoundly increased the miseries of litigants. The situation is so awful that the nation's two successive Attorney Generals have publicly raised the issue to two consecutive Chief Justices of Bangladesh at their felicitation gatherings organized by lawyers of the Supreme Court of Bangladesh soon after their appointments as the nation's top judges. Consistently, empirical findings of Transparency International, a German-based organization, and Transparency International Bangladesh have unequivocally revealed the practice of a large extent of judicial corruption. These allegations are …
A Framework For Culturally Responsive Lesson Design, Dedrick Griffin
A Framework For Culturally Responsive Lesson Design, Dedrick Griffin
Education Doctorate Dissertations
Due to institutional and systemic barriers along with outdated instructional strategies that do not engage an increasingly diverse classroom, BIPOC students in STEM courses have not experienced the same course completion and success rates as their White and Asian counterparts. This qualitative, descriptive multi-case study utilizes an intuitive framework designed with the theoretical tenets of culturally responsive pedagogy to guide four community college STEM instructors in the creation of a culturally responsive lesson plan for their respective courses. The study examines their experience through interviews, lesson plan analysis, and student surveys.
The purpose of the study was to investigate if …
An Investigative Analysis Of Fernando Sor’S Introduction And Variations On “O Cara Armonia” From Mozart’S The Magic Flute, Luke James Nolan
An Investigative Analysis Of Fernando Sor’S Introduction And Variations On “O Cara Armonia” From Mozart’S The Magic Flute, Luke James Nolan
Theses and Dissertations
Fernando Sor provides directions for fingering his Introduction and Variations on “O Cara Armonia” in the specific beaming and notation of the work. Although there are numerous publications of Sor’s Op. 9, most fail to provide elegant fingerings for his difficult passages. In these editions, the editor either failed to understand Sor’s intentions rendered in the notation, or disregarded Sor’s technical practices in favor of modern technical practices. Both avenues will lead to a disastrous reproduction of the work. While the piece may offer a challenge for the guitarist, the technical difficulties of Sor’s Op. 9 should not be readily …
Curiosities Of Standing In Trade Secret Law, Charles T. Graves
Curiosities Of Standing In Trade Secret Law, Charles T. Graves
Northwestern Journal of Technology and Intellectual Property
Standing under the Uniform Trade Secrets Act – the right to pursue a misappropriation claim – is a vexing question when compared to patent, copyright, and trademark law. Instead of requiring ownership or license rights as a condition to sue, courts often find that mere possession of an asserted trade secret suffices for standing, even when the provenance of the information is murky. In some cases, courts even allow trade secret plaintiffs to claim intellectual property rights in the preferences and desires expressed to them by their customers in lawsuits designed to stop former employees from doing business with those …

Compulsory Licensing: A Potential Solution To The Antitrust Dilemma Of Technology Standards Setting, Shen Peng
Northwestern Journal of Technology and Intellectual Property
The Constitution grants patent owners exclusive rights over their inventions to “promote the Progress of Science.”1 This clause was drafted based on the belief that monetary incentives granted to the first inventor, such as the proceeds from selling and licensing the invention, will foster new ideas and accelerate innovation to the benefit of the public welfare. However, when the first inventor is the sole benefactor of the rewards from the innovation, subsequent innovation may be stifled.
For instance, the first person to invent the idea of a mobile phone but lacking the right to use the underlying technologies essential to …
From Coffee Houses To Internet Speech: Civility And Moderation Within The Contemporary Public Sphere, Leslie Brown , '23
From Coffee Houses To Internet Speech: Civility And Moderation Within The Contemporary Public Sphere, Leslie Brown , '23
Senior Theses, Projects, and Awards
This thesis explores the ways in which discourse occurring in online discussion forums can become toxic and fail as spaces that create public opinion within the contemporary public sphere. After a literature review of Habermas’ bourgeois public sphere and other scholars who connect the bourgeois sphere to our current iteration of the public sphere on the internet, an ideal type of a contemporary public sphere is constructed. Using this ideal type, the ways in which multiple online discussion spaces fall short of realizing the potential of the public sphere and the culture of discussion that has been cultivated within them …
Sentience And Sapience In The One Ring: The Reality Of Tolkien’S Master Ring, Larry L. Burriss
Sentience And Sapience In The One Ring: The Reality Of Tolkien’S Master Ring, Larry L. Burriss
Mythlore: A Journal of J.R.R. Tolkien, C.S. Lewis, Charles Williams, and Mythopoeic Literature
In this paper, the author proposes J.R.R. Tolkien’s Ring of Power actually possesses (within the fantasy “frame”) both sentience (consciousness) and sapience (the ability to think and act). Numerous other writers have investigated the literary and mythic origins of the One Ring, but there appears little discussion, beyond its creation, of how and why the Ring does what it does. The author here uses Tolkien’s own writing (rather than the myriad of fan speculation or the numerous adaptations of the Tolkien canon) to show the One Ring has, within the frame of the story, an innate ability to think and …

Vitamin E: A Simple Treatment For Complicated Diseases, Adhiraj Dasgupta, Sristi Das, Sandipta Ghosh, Krishnendu Acharya
The Thai Journal of Pharmaceutical Sciences
Vitamin E, which belongs to a class of lipid-soluble vitamins, is considered one of the most essential nutrients for the well-being of humans but can solely be obtained through diet. This Vitamin E group includes all the tocol and tocotrienol derivatives which are reported to exhibit diverse biological activities as evident from a literature survey. However, the current pharmacotherapies mainly target the different oxidation processes of the body that have been linked to numerous disease conditions such as cancer, arthritis, atherosclerosis, aging, and others. On that note, Vitamin E has multiple important roles within the body and recent studies indicate …
Community Participation And Perspectives Of Ambondrolava Mangrove Restoration Project, Nadine Shannon
Community Participation And Perspectives Of Ambondrolava Mangrove Restoration Project, Nadine Shannon
Independent Study Project (ISP) Collection
Madagascar’s mangrove forests are intertidal ecosystems that provide numerous valuable ecosystem services but are nonetheless under pressure from large amounts of deforestation. On the southwestern coast of Madagascar, the village of Ambondrolava practices community led management of the mangrove and its resources. This research project studied the evolution of the mangrove area using GIS data, and investigated, through interviews, the relationship between the local community of Ambondrolava and the organizations that manage the mangrove ecosystem. From 2000 to 2018, the zone of the mangrove has experienced a net loss in area every year, despite reforestation efforts. Most community members interviewed …

Telegraph, Telephone And The Internet: The Making Of The Symbiotic Model Of Surveillance States, Dongsheng Zang
Articles
In the early 2000s, shortly before the September 11 attacks, Daniel J. Solove noted that computer databases in the United States were controlled by public as well as private bureaucracies. In that sense, Solove argued, the "Big Brother" metaphor "fails to capture the most important dimension of the database problem." In his 2008 Lockhart lecture, constitutional law scholar Jack M. Balkin argued that the United States has gradually transformed from a welfare and national security state to a National Surveillance State: "a new form of governance that features the collection, collation, and analysis of information about populations both in the …

Procedural Posture And Social Choice, Michael Risch
Procedural Posture And Social Choice, Michael Risch
Minnesota Law Review Vols. 106:2 onward (2021-present)
Lawyers, judges, and professors have always been interested in the way cases unfold procedurally—their procedural posture. To date, however, nobody has provided a generalized theoretical framework to explain how procedural posture influences outcomes. This Article uses social choice theory to fill that void, providing much-needed insight into the ways that trial court litigation is influenced by the procedural agenda. Social choice theory considers how individual preferences translate to the collective desire. It is a messy business. One key insight of social choice theory is that whoever controls the decision agenda can control the outcome. This Article conceptualizes trial court litigation …

Removing Barriers--Not Children: How West Virginia Can Prevent Further Harm To Children, Emily R. Mowry
West Virginia Law Review
West Virginia has one of the highest rates of children in foster care—and thus removed from their families—in the United States. Recent scientific and social science research has shown that removing children from their parents’ home is a traumatic event in and of itself, causing further harm to children already experiencing abuse and neglect. Federal legislation in the past ten years requires that states make reasonable efforts to address issues of abuse and neglect prior to removing children from their homes. West Virginia, for many reasons, is not doing so. West Virginia’s state child welfare agency, Department of Health and …

Incorporating Variability In Kytc Planning And Project Development, Reginald Souleyrette, Teng Wang, Riana Tanzen, Arnold Stromberg
Kentucky Transportation Center Research Report
Transportation planning and design decisions are typically made using point estimates of traffic and safety measures. This report addresses the uncertainty of data used to make these decisions. It focuses on two data elements — project safety ratings and volume estimates from traffic counts. For safety ratings, the Kentucky Transportation Cabinet’s Strategic Highway Investment Formula for Tomorrow (SHIFT) crash history score is used as a case study. Confidence intervals are developed for the Cabinet’s new safety metric, which incorporates estimates of future crashes by severity as well as excess expected crashes above safety goals. For traffic counts, the report develops …
The Pieces That Make The Self: Finding Balance Between Social And Individual Identity In Frances Burney’S Evelina And Virginia Woolf’S Mrs. Dalloway, Jenna King
English Senior Capstone
In their novels Evelina and Mrs. Dalloway, Frances Burney and Virginia Woolf pursue an understanding of the pieces of one’s “self.” Through the journeys of Evelina Anville and Clarissa Dalloway, Burney and Woolf explore how a woman’s identity is formed by both her social role and her individuality. Although the social settings examined in the two novels vary greatly due to differences in both time period and the main characters’ stages of life, Evelina’s and Clarissa’s stories are united by their shared goal of gaining understanding of and ownership over themselves. Ultimately, both Evelina and Mrs. Dalloway argue for …
Implementing Social-Emotional Supports With Coaching In A Preschool Program, Ashley Harvey
Implementing Social-Emotional Supports With Coaching In A Preschool Program, Ashley Harvey
Master's Theses & Capstone Projects
Research findings show that coaching paired with professional development around a set of identified instructional practices is one way to increase teacher use of these practices. Combining coaching and professional development can be used to train teachers in the Pyramid Model. Studies show that effective Pyramid Model implementation can positively improve student relationships and adult-to-student relationships as well as increase positive behaviors in schools. With these research findings in mind, a school improvement plan was created to add professional development opportunities on the use of Pyramid Model Practices to improve social-emotional instruction in a preschool program in Eastern Iowa. Executing …

Two Paradoxes Of Crypto, John O. Mcginnis, Henry F. Fradella
Two Paradoxes Of Crypto, John O. Mcginnis, Henry F. Fradella
Chapman Law Review
"A lot of financial innovation is now encompassed by the term 'crypto'—Bitcoin, Ethereum, stablecoins, crypto-exchanges, and digital central bank currencies, to name just a few. But what we should think about these financial innovations and what, if anything, the law should do about them depends on making sharp distinctions among different phenomena that are covered by the same meme. In this brief talk, I will argue that one distinction is central: to what degree are the financial innovations decentralized, in that they are not controlled by the government or any intermediary? If the financial innovations are genuinely decentralized and transparent, …
The Anything Asset: The Tax Classification Of Cryptocurrency, Nfts, Daos And Other Digital Assets, Billy Abbott
The Anything Asset: The Tax Classification Of Cryptocurrency, Nfts, Daos And Other Digital Assets, Billy Abbott
Chapman Law Review
"The rapid rise (and, in some cases, swift fall) of the digital asset economy has been incessantly chronicled in the business and legal press for a decade. 1 From Bitcoin and other cryptocurrencies, to decentralized autonomous entities ('DAOs') and non-fungible tokens ('NFTs'), 2 new asset classes and business models have burst onto the scene, with lawmakers and government regulators struggling to keep up. In some cases, the lack of a legal framework is precisely what 'Web3' proprietors want; but, it should come as no surprise that governments do not view digital assets as exempt from the rules that apply to …

Is Corporate Law Nonpartisan?, Ofer Eldar, Gabriel Rauterberg
Faculty Scholarship
Only rarely does the United States Supreme Court hear a case with fundamental implications for corporate law. In Carney v. Adams, however, the Supreme Court had the opportunity to address whether the State of Delaware’s requirement of partisan balance for its judiciary violates the First Amendment. Although the Court disposed of the case on other grounds, Justice Sotomayor acknowledged that the issue “will likely be raised again.” The stakes are high because most large businesses are incorporated in Delaware and thus are governed by its corporate law. Former Delaware governors and chief justices lined up to defend the state’s …
Replacing Notorious: Barret, Ginsburg, And Postfeminist Positioning, Calvin R. Coker
Replacing Notorious: Barret, Ginsburg, And Postfeminist Positioning, Calvin R. Coker
Faculty and Staff Scholarship
This essay offers a rhetorical reading of Amy Coney Barrett’s confirmation hearings to make sense of how widespread outrage over replacing the late Ruth Bader Ginsburg with a conservative idealogue was resolved through the invocation of postfeminist motherhood. I argue that GOP Senators and Barrett herself positioned her nomination as the achievement of feminist goals, justified through rhetorics of choice and the idealization of (white) motherhood. These strategies cement Barrett as the logical and defensible successor to both Ginsburg’s seat and her legacy of feminist work. I conclude with the implications of this circulation of postfeminist motherhood, with focus on …
Menstrual Justice In Theoretical Context, Vivian E. Hamilton
Menstrual Justice In Theoretical Context, Vivian E. Hamilton
Faculty Publications
This Essay reviews and places into theoretical contexts Bridget Crawford and Emily Waldman’s invaluable book Menstruation Matters. Although the authors themselves do not explicitly label the theoretical approach that undergirds their work, much of Menstruation Matters: Challenging the Law’s Silence on Periods falls within the liberal feminist legal tradition typical of post-civil rights second-wave feminism. Their work also embodies aspects of critical feminist approaches to law. Crawford & Waldman expose the discriminatory effects of facially neutral laws, the limits of formal equality, and the pitfalls of essentializing or making universal claims about categories of individuals—including women and menstruators. In …
Deciding For Others: Local Public Good Contributions With Intermediaries, Andrej Angelovski, Praveen Kujal, Christos Mavridis
Deciding For Others: Local Public Good Contributions With Intermediaries, Andrej Angelovski, Praveen Kujal, Christos Mavridis
ESI Working Papers
Given the prevalence of local public goods, whose broader use is often limited by distance and borders, we propose a potential solution to the free-riding problem by having each participant/beneficiary delegate the public good contribution decision to a non-local intermediary who neither puts in own endowment into the public good nor benefits from it. Intermediaries make decisions under two compensation mechanisms where the incentives for the intermediary are either non-aligned (fixed) or aligned (variable) with those of the beneficiary. We find that the use of intermediaries, regardless of whether their compensation is aligned or not with that of the beneficiary, …
Explaining Guatemalan Vigilantism, Bryant Mcconkie
Explaining Guatemalan Vigilantism, Bryant Mcconkie
Sigma: Journal of Political and International Studies
Ripped from his home in Concepción, Guatemala, the evening of October 13, 2015, Mayor Bacilio Juracán was brutally beaten, doused with gasoline, and burned to death by attackers convinced he had orchestrated the murder of a political rival they supported. In just this one isolated incident, the town hall, various cars, and at least six additional buildings were burned along with the mayor (“Linchan y Queman” 2015). A growing number of similar lynchings—vigilante attacks in which victims of the mob are severely injured or killed—across Guatemala have thrust Guatemalan vigilantism into the public consciousness, perplexing governments and political theorists alike …
The Impact Of Gender On The Acceptance Of Surveillance Technology, Jody Messick
The Impact Of Gender On The Acceptance Of Surveillance Technology, Jody Messick
Sigma: Journal of Political and International Studies
A classic dilemma facing governments and citizens alike is the trade-off between privacy and security. This concept is found in the Constitution’s Fourth Amendment, which implies that citizens have a right to be protected against “unreasonable searches and seizures by the government” (FindLaw 2019). The technological revolution, and its implications for privacy, has complicated the nature of this right. Different types of data require different approaches to the privacy versus security tradeoff. A 2003 panel by Wright et. al asks how “sensor data,” data that is collected through technology that tracks a user’s online or real-world movements, should be approached, …
