The Racist Roots Of The War On Drugs & The Myth Of Equal Protection For People Of Color, Steven A. Ramirez, Andre Douglas Pond Cummings

By 2021, the costs and pain arising from the propagation of the American racial hierarchy reached such heights that calls for anti-racism and criminal justice reform dramatically expanded. The brutal murder of George Floyd by the Minneapolis police vividly proved that the social construction of race in America directly conflicted with supposed American values of equal protection under law and notions of basic justice. The racially-driven War on Drugs (WOD) fuels much of the dissonance between American legal mythology—such as the non-discrimination principle and the impartial administration of the rule of law—and the reality of race in the United States. …

Tort Law Implications Of Compelled Physician Speech, Nadia N. Sawicki

Abortion-specific informed consent laws in many states compel physicians to communicate state-mandated information that is arguably inaccurate, immaterial, and inconsistent with their professional obligations. These laws face ongoing First Amendment challenges as violations of the constitutional right against compelled speech. This Article argues that laws compelling physician speech also pose significant problems that should concern scholars of tort law.
State laws that impose tort liability on physicians who refuse to communicate a state-mandated message often do so by deviating from foundational principles of tort law. Not only do they change the substantive disclosure duties of physicians under informed consent law, …

Social determinants of health (SDoH) are defined as factors, including things such as food security, housing, literacy, finances, and work and school environments, that affect health risks and outcomes (About Social, 2021). Healthcare disparities are often affected by one’s social determinants. National data shows low-income populations present with considerable unmet needs, including food, housing, clothing, and quality health care. Closing the health disparities gap has long been the focus of healthcare organizations across the board. The care coordination model (CCM) enables organizations to improve care through collaboration. CCM looks at care coordination from the perspective of a patient-centered medical home. …

This article examines the relationship among intellectual property (IP) law protections; United States (U.S.) and international law and policy; and the actualization of diagnostics, drugs, and vaccines in the time of the COVID-19 coronavirus. Two key international treaties that relate to IP law--The Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement and the Doha Declaration on the TRIPS Agreement and Public Health (Doha Declaration) - establish international norms for the protection of IP. Forty percent of spiraling US drug costs are based on a mere two percent of all drugs –biologic drugs (biologics) made from living cells that are administered by injection or infusion. These costs will continue to balloon as new biologics are approved; the recently approved Alzheimer’s drug is expected to result in a 50% increase in Medicare spending and cost individuals 40% of their annual income. These drugs are expensive because they cannot be mass-produced, and their cost places important treatments for conditions such as arthritis (Humira) and cancer (Herceptin) out of reach for many Americans. Art therapy has the power to bring healing and wholeness as it expands globally, an awareness of the integral structure of consciousness can benefit an adaptation of this profession that is both integrative and respectful of multiple perspectives and cultural views. The art-making process in art therapy can ground experience, and art materials can serve as vehicles through which different structures on consciousness are elicited, experienced, documented, and integrated. Pay-for-delay settlements arise when the brand drug company compensates the generic in some form to delay entry to market, thereby effectively eliminating the 180-day exclusivity on the market the generic is entitled to under law. At the federal level, the Supreme Court has established factors to determine whether such agreements violate antitrust law, policymakers have introduced legislation to curb the practice, and the Federal Trade Commission continues to actively police such deals. At the state level, California Attorney General Xavier Becerra made headlines for securing legal settlements in July 2019 with several pharmaceutical companies accused of participating in pay-for-delay agreements. …

The theory of racial capitalism offers insights into the relationship between class and race, providing both a structural and a historical account of the ways in which the two are linked in the global economy. Law plays an important role in this. This article sketches what we believe are two key structural features of racial capitalism: profit-making and race-making for the purpose of accumulating wealth and power. We understand profit-making as the extraction of surplus value or profits through processes of exploitation, expropriation, and expulsion, which are grounded in a politics of race-making. Black women in counselor education and supervision (CES) programs have historically been underrepresented in the scholarly literature, making it vital to understand how this group of women cope with the adverse effects of the COVID-19 pandemic. The purpose of this qualitative transcendental phenomenological study was to explore and understand Black women’s lived experiences in CES doctoral programs during the COVID-19 pandemic. Husserl’s phenomenological approach served as the conceptual framework for this research study. Semi structured interviews were conducted with nine Black women enrolled in CES doctoral programs having at least 6 months to 5 years of engagement in their program. …

The practice of meditation for the purpose of increasing mental clarity, health, and healing has grown steadily over the past 50 years or more. While meta-analyses and literature reviews of hundreds of studies have shown that individuals who meditate improve neuro-biopsychosocial functions and recover from illness, few studies have examined these benefits within specific systems of practice. This qualitative study explored the experience of meditation and healing in adults who have trained in the Wim Hof Method (WHM). More than half the population in and outside of the United States experience childhood adversity, which is associated with the risk of developing obesity and overweight problems across the life span. In the United States, overweight affects 73.6% of adults, obesity affects 42.5% of adults, and both are considered a major public health concern. With this qualitative study, 18 adults with early life adversities were explored as to how experience weight loss treatment within their primary care. Does Recreational Marijuana Dispensing Induce Substitution For Alcohol?, Aubrey E. Mange
Economics Masters Project Research Papers
I exploit geographic and temporal variation in recreational marijuana dispensing to estimate its effect on alcohol related prices and mortalities. I interpret the finding of a casual reduction in alcoholic poisonings as evidence for a substitutive relationship, contributing to a growing marijuana policy literature and the divided economic literature exploring substitution between the two goods.

Due to their positive associations with student learning and retention, certain undergraduate opportunities are designated "high-impact." High-Impact Practices (HIPs) share several traits: They demand considerable time and effort, facilitate learning outside of the classroom, require meaningful interactions with faculty and students, encourage collaboration with diverse others, and provide frequent and substantive feedback. As a result, participation in these practices can be life-changing (Kuh, 2008). NSSE founding director George Kuh recommends that institutions should aspire for all students to participate in at least two HIPs over the course of their undergraduate experience—one during the first year and one in the context …

The Fall Enrollment component collects student enrollment counts by level of student, enrollment status, gender and race/ethnicity. In addition, first-time student retention rates and the student-to-faculty ratio are collected. Although the juggernaut of progress continues to provide minority groups, including members of the LGBTQIA+ population, opportunities to achieve equal representation and protection under the law, numerous challenges remain. Significant prejudicial and discriminatory actions, fortified by heterosexism and heteronormativity, not only threaten this community’s continued advancement, but also poses an existential threat to the physical, emotional, psychological, and social well-being of its members. Therefore, it is imperative that psychological clinicians receive adequate academic and practical skills-based training to thoroughly understand and respond to the unique obstacles faced by LGBTQIA+ clients. Impact Of Exercise On Depression And Anxiety In Adolescents With Complex Trauma Living In Residential Treatment Centers, Candace Snodgrass

Depression and anxiety disorders are two of the most frequently reported mental healthproblems for adolescents entering Residential Treatment Centers (RTCs). Many adolescents in RTCs also have a higher rate of traumatic experiences than their peers. Traumatized children frequently develop mental illness disorders of depression and anxiety. Based on the theoretical foundations provided by attachment theory and social cognitive theory, this pilot study, using secondary data, observed the relationship between exercise participation, depression, trauma, and anxiety for 11 youth in an upper Midwest RTC. Adolescents with higher initial depression and anxiety scores tended to exercise less during RTC than those with …
