Returning Attention To Policy Content In Diffusion Study, John M. Fulwider Jan 2011

Returning Attention To Policy Content In Diffusion Study, John M. Fulwider

Department of Political Science: Dissertations, Theses, and Student Research

Policy diffusion research pays virtually no attention to policy content. Yet we should expect content to shape the adoption of any policy--this is what legislators and policy makers, after all, fight about. Thus the extent and speed of diffusion likely critically depend on policy content, which the current literature virtually ignores. This dissertation shows how we can better understand policy diffusion by taking policy content seriously. Paying attention to policy content, including how it is debated and understood by legislators, has immediate payoffs in the sense that two literatures largely ignored until now by diffusion researchers-- policy typologies and policy …

Courts Re-Examine The Application Of Goldfinger-Era Electronic Tracking Cases To Law Enforcement Use Of Gps Tracking Devices, Joshua A. Engel Jan 2011

Courts Re-Examine The Application Of Goldfinger-Era Electronic Tracking Cases To Law Enforcement Use Of Gps Tracking Devices, Joshua A. Engel

Richmond Public Interest Law Review

GPS tracking devices have become inexpensive, small, and can easily be attached to a vehicle quickly. Law enforcement is increasingly using these devices to track the exact location of a suspect's vehicle over a long period of time. In most instances, relying on Supreme Court cases from the early 1980's, law enforcement has not sought a warrant before using these devices. This paper examines how courts have attempted to apply Supreme Court precedents based on "primitive" tracking devices to modern GPS tracking devices. These precedents established that the use of electronic tracking devices on vehicles did not constitute a search …

National History And The Novel In 1930s Britain, Erica Delsandro Jan 2011

National History And The Novel In 1930s Britain, Erica Delsandro

All Theses and Dissertations (ETDs)

Although indebted to scholars whose work has illuminated the distinctiveness of 1930s Britain, "National History and the Novel in 1930s Britain" argues that rather than seeking distinction, writers of the period were more concerned with the task of contextualizing their decade and their own position within a national historiography from which they felt the Great War and military masculinities had excluded them. Focusing on the novelists Christopher Isherwood, Evelyn Waugh, and Virginia Woolf, and the philosopher of history, R. G. Collingwood, I describe how the 1930s inheritors of British cultural privilege found themselves symbolically disenfranchised from a national identity inextricably …

Institutionalization, Technology, And Power: The Ideological Context Of Style Organizations, Dustin Wilson Aug 2010

Institutionalization, Technology, And Power: The Ideological Context Of Style Organizations, Dustin Wilson

All Theses

Organizations have the power to establish the norms of discourse within various fields through organizational style guides. These style guides determine the conventions of discourse that professionals use every day. In this thesis, I explore and articulate the ideological context of some style guides in prominent professions. The institutionalization of discourse is seen through the history of style manuals and is particularly noted within the discourse of contemporary organizations that create style guides. Through an application of the theories of Foucault and Habermas, I discuss how these organizations institutionalize discourse and perpetuate a system of purposive-rational action. In this thesis, …

Nationalizing International Theory: Race, Class And The English School, William A. Callahan Jul 2010

Nationalizing International Theory: Race, Class And The English School, William A. Callahan

Research Collection School of Social Sciences

Much work has been done to deconstruct the links between knowledge and power in IR as "an American Social Science". This topic has arisen again with the re- launching of the English School of IR Theory in 2001. This essay argues that although the English School is critical of the power-knowledge dynamic, it actually exacerbates the problem by deliberately "nationalising" international theory. The essay traces the emergence and logic of the English School and its key concept "International Society". It argues that the English School is tied not only to national identity but to the rules of European Empire. Using …

An Indecent Obsession, Aaron Mcintosh May 2010

An Indecent Obsession, Aaron Mcintosh

Theses and Dissertations

The title of my thesis is appropriately borrowed from a romance novel title, as my work proposes to mine the content, design and culture of romance novels and other erotic texts in order to excavate my own queer romance narrative. The body of work includes large-scale drawings of “stand-in boyfriends” stolen from romance novel covers, pieced fabric text works based on the titles of erotic texts, and a couch covered in erotic reading material. Drawing attention to the ubiquity of heterosexualized images and texts by deconstructing them, my work critically questions larger social constructions of normality and deviance, pleasure and …

Proportionality, Privacy, And Public Opinion: A Reply To Kerr And Swire, Christopher Slobogin May 2010

Proportionality, Privacy, And Public Opinion: A Reply To Kerr And Swire, Christopher Slobogin

Vanderbilt Law School Faculty Publications

In 2007, I published Privacy at Risk: The New Government Surveillance and the Fourth Amendment.' The immediate trigger for the book was the recent upsurge in government use of technology to monitor public and private behavior, and more particularly the tremendous increase in government surveillance after 9/11 using techniques such as data mining, phone and computer intercepts, and public camera systems. The primary analytical target of the book, however, was more general: Supreme Court case law that, read broadly, permits much of this technological surveillance to take place without impinging on any constitutional interests. In an effort to counteract this …

Literary Quests In Sachar's Holes: A Middle & High School Game For Literary Learning, John V. Knapp Apr 2010

Literary Quests In Sachar's Holes: A Middle & High School Game For Literary Learning, John V. Knapp

Reconstruction: Studies in Contemporary Culture

Gaming is a heuristically useful alternative in the literature classroom to such pedagogies as whole-group class discussion, worksheets, and small group arguments. By asking students to play the game titled, Literary Quests, after finishing Louis Sachar's novel, Holes, the teacher employs his/her students' ready-made interest in the computer and board games to the tasks of learning how to read literature. Based on student pairs questioning one another in competitive fashion, quiz-show style, this game includes sets of increasingly difficult literary questions about the novel, and a writing component aimed at student expressiveness concerned both with their understanding of …

Legal Fictions And Juristic Truth, Nancy J. Knauer Jan 2010

Legal Fictions And Juristic Truth, Nancy J. Knauer

St. Thomas Law Review

This Essay reviews the three categories of new fictions outlined above, which I refer to as (1) empirical legal errors; (2) discredited legal regimes; and (3) complex statutory schemes. With respect to each category, I conclude that the appellation of legal fiction is a misnomer and that the integrity of Fuller's classic definition should be retained for its analytic force. The conundrum presented by the legal fiction is that it retains its utility despite its falsity, similar to false statements used in science and mathematics in order to advance a proof or hypothesis. The new legal fictions, however, are different …

The New Capitalism Cultural Transitions Seen In The Works Of Victor Pelevin, Jesse Brown O'Dell Jan 2010

The New Capitalism Cultural Transitions Seen In The Works Of Victor Pelevin, Jesse Brown O'Dell

Theses & ETDs

Russia's transition from Soviet, structured communism to free-market capitalism had a radical effect on the Russian population. Especially in Moscow, the spread of Western capitalism and the inclusion of foreign markets created an economic boom superior to any that took place during Soviet times. Literature was strongly affected by this transition, and the metamorphoses in writing can be seen in many contemporary works. This thesis will seek to contextualize the works of Victor Pelevin within the historical and cultural movements that were in effect as he developed them. The primary focus will be to emphasize the consequences of the fall …

Go Honors!, Joan Digby Jan 2010

Go Honors!, Joan Digby

Journal of the National Collegiate Honors Council Online Archive

It comes to me as quite a surprise—and really a great shame—that honors and athletics are, as Sam Schuman describes, “often seen as, if not hostile, certainly wholly disconnected collegiate endeavors.” For more than thirty years I have had quite a different experience, which includes congratulating four long-distance runners and one Olympic speed-walker as honors valedictorians. I have always cultivated honors athletes, and coaches have always come to me directly to package athletes with honors scholarships. I may have reaped my rewarding experiences with athletes in part because I teach at a Division II NCAA campus where the coaches encourage …

A Model Copyright Exemption To Serve The Visually Impaired, Patrick Hely Jan 2010

A Model Copyright Exemption To Serve The Visually Impaired, Patrick Hely

Vanderbilt Journal of Transnational Law

Copyright law presents visually impaired persons with serious barriers to access of the written word. A recent international effort seeks to remove these barriers to access, in limited instances, by allowing the creation of accessible formats of copyrighted works. While bodies like the World Blind Union--through several South American states--have presented draft treaties to the World Intellectual Property Organization (WIPO), to date the interested parties have not found a mutually agreeable solution. This Note surveys international intellectual property law as it relates to the problem, draws a comparison to the humanitarian concerns entangled with international patent law, and tracks the …

Framing Jewell: A Discourse Analysis Of Newspaper Coverage In The Aftermath Of The Atlanta Olympics Bombing And Discussion Of Legal And Ethical Standards For Such Practices, Anne L. Songy Jan 2010

Framing Jewell: A Discourse Analysis Of Newspaper Coverage In The Aftermath Of The Atlanta Olympics Bombing And Discussion Of Legal And Ethical Standards For Such Practices, Anne L. Songy

LSU Master's Theses

This study examines the newspaper coverage of Richard Jewell during the weeks after the 1996 Atlanta Olympics bombing. Jewell, a security guard working in the Olympic Park on July 27, 1996, was initially hailed as a hero due to his discovery of a bomb minutes before the explosion. After Jewell’s name was leaked to the press as an FBI person of interest in the case, many reporters began to frame Jewell in a negative light and, in some instances, even implied his guilt. Through a discourse analysis of news stories published between the date of the bombing and the date …

Fourth Amendment Federalism And The Silencing Of The American Poor, Andrew E. Taslitz Dec 2009

Fourth Amendment Federalism And The Silencing Of The American Poor, Andrew E. Taslitz

Chicago-Kent Law Review

In Virginia v. Moore, police officers searched Moore incident to an arrest for a minor traffic infraction for which Virginia statutory law in fact prohibited arrest. The officers found cocaine on Moore's person, arresting him for that crime too. The United States Supreme Court ultimately found that the arrest for the traffic infraction and the subsequent search were valid under the federal Constitution's Fourth Amendment. Central to the Court's reasoning was its insistence that the state statute was irrelevant. Any contrary conclusion, explained the Court, would wrongly make the Fourth Amendment's meaning vary from place to place. Professor Taslitz …
