Extending The Case For Workplace Transparency To Information About Pay, Cynthia Estlund Jan 2014

Extending The Case For Workplace Transparency To Information About Pay, Cynthia Estlund

Faculty Articles

This is not uncharted territory; both scholars and policymakers have examined the case for greater transparency of salary information, especially in the wake of the Supreme Court’s Ledbetter decision, in which discriminatory salary disparities were held immune from legal challenge because they had existed, unbeknownst to the plaintiff, for too long. This Article reviews arguments for and against mandatory pay transparency, using the general framework from Just the Facts. I conclude that there is a fairly strong though not uncomplicated case to be made that mandatory disclosure of meaningful salary information would tend to produce less discrimination, less favoritism, and …

When The Author Owns The World: Copyright Issues Arising From Monetizing Fan Fiction, Steven D. Jamar, Christen B’Anca Glenn

Texas A&M Law Review

Fan fiction is amateur writing that imaginatively reinvents a work in pop culture while maintaining the identifiable aspects of the preexisting work. Fans of various books, films, and television series write their own versions of the stories and post them online in fan fiction communities. Fan fiction as practiced today is a way for fans to creatively express themselves and become integrated into the story and world they love. The stories range from highly derivative works, where relatively few plot points are changed, to entirely new plot lines using the same world and characters of the original, underlying work. Some …

The Tempting Of Antitrust: Robert Bork And The Goals Of Antitrust Policy, Daniel A. Crane Jan 2014

The Tempting Of Antitrust: Robert Bork And The Goals Of Antitrust Policy, Daniel A. Crane

Articles

Of all Robert Bork’s many important contributions to antitrust law, none was more significant than his identification of economic efficiency, disguised as consumer welfare, as the sole normative objective of U.S. antitrust law. The Supreme Court relied primarily on Bork’s argument that Congress intended the Sherman Act to advance consumer welfare in making its landmark statement in Reiter v. Sonotone that “Congress designed the Sherman Act as a ‘consumer welfare prescription.’” This singular normative vision proved foundational to the reorientation of antitrust law away from an interventionist, populist, Brandeisian, and vaguely Jeffersonian conception of antitrust law as a constraint on …

“To Corral And Control”: Stop, Frisk, And The Geography Of Freedom, Anders Walker Jan 2014

“To Corral And Control”: Stop, Frisk, And The Geography Of Freedom, Anders Walker

All Faculty Scholarship

This article revisits the emergence of stop and frisk law in the 1960s to make three points. One, the impetus for formalizing police stops arose midst confusion generated by Mapp v. Ohio, the landmark Warren Court opinion incorporating the exclusionary rule to the states. Two, police over-reactions to Mapp intersected with fears of urban riots, leading to a formalization of stop and frisk rules that aimed at better containing inner city minority populations. Three, the heightened control of urban streets coupled with the heightened protection of the private home bore geographic implications, interiorizing liberty in ways that perpetuated a national …

Patent Cases And Public Controversies, Amelia Smith Rinehart Nov 2013

Patent Cases And Public Controversies, Amelia Smith Rinehart

Notre Dame Law Review

The Article proceeds as follows. Part I summarizes the evolution of the current standard for justiciability in declaratory patent cases, including the Supreme Court’s MedImmune opinion and its progeny in the Federal Circuit and the lower courts. Part II discusses the growing trend of public interest patent litigation and the hurdles declaratory plaintiffs face on justiciability grounds despite courts’ approval of patent challenges generally on policy grounds. Finally, Part III introduces a legislative reform that promises to afford justiciability for some members of the public without compromising Article III’s emphasis on private adjudication.

Message from President: Words are less the antonym than the diluted form of action. Nowhere do we see more action in the form of words than in the swirl of seeming inaction surrounding online education. Pundit-educators talk relentlessly about the tsunami of online offerings to come. Knowing the American love of things apocalyptic, they predict the inevitable closure of huge numbers of institutions. Yet, to date, no college or university seems to have shut down owing to online competition. Shares in companies holding online providers seem to fall; only near-bankrupt institutions such as Arizona State University seem to offer more …

Professional Legal Writing Declaring Your Independence, Patrick R. Hugg Apr 2013

Professional Legal Writing Declaring Your Independence, Patrick R. Hugg

Journal of the National Association of Administrative Law Judiciary

This article proposes two controversial assertions about the writing of many lawyers and judges today and offers a central theme for improving that writing. These bold propositions are offered in an effort to awaken and perhaps inspire the legions of overworked, harried legal scriveners inhabiting our legal community to adopt a new methodology of writing. Too many legal writers today are forced by the various (nefarious) circumstances of their work to crank out reams of hastily conceived and poorly edited text. The time has arrived for us to admit to this unacceptable state of affairs and to declare independence from …

Employment Law And Social Equality, Samuel R. Bagenstos Jan 2013

Employment Law And Social Equality, Samuel R. Bagenstos

Law & Economics Working Papers

What is the normative justification for individual employment law? For a number of legal scholars, the answer is economic efficiency. Other scholars argue, to the contrary, that employment law protects against (vaguely defined) imbalances of bargaining power and exploitation. Against both of these positions, this paper argues that individual employment law is best understood as advancing a particular conception of equality. That conception, which many legal and political theorists have called social equality, focuses on eliminating hierarchies of social status. Drawing on the author’s work elaborating the justification for employment discrimination law, this paper argues that individual employment law is …

Michigan Law Review

What is the normative justification for individual employment law? For a number of legal scholars, the answer is economic efficiency. Other scholars argue, to the contrary, that employment law protects against (vaguely defined) imbalances of bargaining power and exploitation. Against both of these positions, this Article argues that individual employment law is best understood as advancing a particular conception of equality. That conception, which many legal and political theorists have called social equality, focuses on eliminating hierarchies of social status. This Article argues that individual employment law, like employment discrimination law, is justified as preventing employers from contributing to or …

An Examination Of The Representation Of Irish Catholic Priests In Contemporary Irish Theatre, James Patrick Jeans Jan 2013

An Examination Of The Representation Of Irish Catholic Priests In Contemporary Irish Theatre, James Patrick Jeans

Master's Theses

Modern Irish theatre can trace its origins to the creation of The Irish Literary Theatre by W.B. Yeats and Lady Gregory in 1899, which later became the Irish National Theatre Society, and eventually, the Abbey Theatre. For more than 100 years, Irish theatre has served as a mirror for reflecting Irish identity and as an oracle of future possibilities. A decade into the Twenty First Century found Irish identity challenged by a child abuse scandal of tragic proportions whereby over 30,000 children suffered at the hands of a duplicitous and negligent Catholic Church. The purpose of this thesis is to …

The Refuge Of Fools, Merrill Lee Girardeau Jan 2013

The Refuge Of Fools, Merrill Lee Girardeau

Honors Theses

The main character of The Refitge of Fools, Mar>’ Canon Israel, resembles H.L. Mencken's iconoclast. Mencken v\Tites that an iconoclast uses an instinct that supersedes the logic of religion, a logic he calls "the refuge of fools." Known as M.C., Mar\- Canon attends a private Christian high school in the South. Instinct acute, however, she regards the "God concept" with extreme suspicion. The Refuge of Fools visits her junior year of high school, each chapter taken from a month of that year. Her lifelong friend Palmer wants to change the nature of their friendship but cannot decide whether to …
