Unpalatable In Word Or Deed: Hostility, Difference And Free Expression, Ian Bryan
SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)
This article conducts a review of the principal tools used in English criminal law, from the early modern period to the present, to impose limits on free expression, particularly the freedom to exhibit hate‘, in pursuit of social order and to police the boundaries at which the acceptable is segregated from the unacceptable. Against this historical backdrop, the article assesses the controversial Racial and Religious Hatred Act 2006, pointing to (dis)similarities with the preceding Bill and with the incitement to racial hatred measures on which the 2006 Act is modelled. The discussion also explores whether, in light of European and …
The Sleepless Ouroboros, Grant Bohl
The Sleepless Ouroboros, Grant Bohl
Electronic Theses and Dissertations
The poems in The Sleepless Ouroboros are about the obsessions which come to define a person. These obsessions are memories, dreams, objects or ideas that cannot be separated from the whole. Poems such as "Thinking of Big Moe" and "It Begins with a Fox" grapple with the limitations of memory, while poems such as "The Python" and "Heirloom" counterpoint memory's weakness with the supposed permanence of physical artifacts. Depression and anger, the anxieties of identity and displacement, and representations of the people and animals that leave lasting impact on a life are all addressed as vital components of the completed …

E. B. White Could Nod Too: Thoughts Occasioned By Reading “Death Of A Pig”, Erik M. Jensen

This is an essay on grammar and writing, with extended consideration of the value of Strunk & White as a guide. Although the essay defends Strunk & White against several of that volume’s strongest critics, it also illustrates that even the best writers—and E. B. White was terrific, as was Antonin Scalia—sometimes make mistakes. (At great, perhaps excessive, length, the essay dissects a problematic passage in White’s “Death of a Pig.”) We should learn from those mistakes, not accept them as inevitable.
The Influence Of The Physical Workspace On Creative Performance: Alternative Mediation Models, Reed James Bramble
The Influence Of The Physical Workspace On Creative Performance: Alternative Mediation Models, Reed James Bramble
Wayne State University Theses
The present study assessed how individuals respond to stimuli in their immediate work environment. Specifically, I conducted a laboratory experiment with a student sample to test the influence of natural stimuli in the workspace on individuals’ creative performance. Additionally, I tested a series of potential mediating variables that could have driven the effect: state positive affect, state openness to experience, and self-regulation of effort. While the results indicated that the hypotheses were broadly unsupported, supplemental analyses revealed that the intervention significantly predicted effort regulation in a high-performing subgroup. Study limitations and recommendations for future directions are discussed.

Protecting Hatred Preserves Freedom: Why Offensive Expressions Command Constitutional Protection, Andrew P. Napolitano
Protecting Hatred Preserves Freedom: Why Offensive Expressions Command Constitutional Protection, Andrew P. Napolitano
Journal of Law and Policy
The First Amendment is not the guardian of taste. Instead, the U.S. Constitution wholeheartedly protects freedom of thought and expression, even if generated and defined by hatred, as long as that expression does not produce immediate lawless violence. Although free speech may lead to tenuous relationships or uncomfortable debates, it must be defended unconditionally. Too many politicians and lawmakers believe that the freedom of speech protected by the First Amendment attaches only to those ideas and expressions that they approve of; this is not so. This article argues that the Founders intended the First Amendment's free speech principle as a …

Supervised Release, Sex-Offender Treatment Programs, And Substantive Due Process, Max B. Bernstein
Supervised Release, Sex-Offender Treatment Programs, And Substantive Due Process, Max B. Bernstein
Fordham Law Review
This Note argues that mandated PPG testing should be eliminated as a condition of federal supervised release. The test infringes on a constitutionally protected liberty interest against unwanted bodily intrusions and, as only the Second Circuit has held, any condition of supervised release that infringes on a constitutionally protected right may be mandated only where it is narrowly tailored to serve a compelling government interest. Because there are a number of viable, less intrusive alternatives, PPG testing as it stands today is not narrowly tailored enough to serve a compelling government interest.

Probably the most famous single season for the excavation of papyri in Egypt was the one that took place in the winter of 1896-1897, under the direction of Bernard P. Grenfell (1869-1926) with the assistance of Arthur S. Hunt (1871-1934) at the ancient city of Oxyrhynchus, present-day al-Bahnasaų. The site fell within the geographical limits of the permit granted by the Antiquities Service to W.M.F. (Flinders) Petrie, but when it proved disappointing in its prehistoric and pharaonic remains, Petrie left it to Grenfell, who was there with Hunt in search of papyri, especially Christian and literary papyri in Greek1 . …

Now & Then: The Appalachian Magazine
Now & Then: The Appalachian Magazine, Volume 32, Issue 02, published in 2016. The theme of this issue is the Future of Appalachia. This issue considers the future of Appalachia at a moment of transition, pairing reflections on change with an awareness of the region's past and present conditions. As the paper magazine is ending, contributors reflect on economic uncertainty, environmental pressures, and shifting cultural forms, while also identifying opportunities for renewal and growth. The future is framed not as a fixed outcome but as something shaped by choices related to land use, industry, health, and community life, often …

The Language Of Race In Revolutionary France And Saint-Domingue, 1789-1792, Jeffery L. Stanley
The Language Of Race In Revolutionary France And Saint-Domingue, 1789-1792, Jeffery L. Stanley
Theses and Dissertations--History
This project studies the historical development of racialist language during the French Revolution as politicians, free people of color, and colonial whites debated the political status of France’s free people of color population. It examines the negotiation of a racialist language that bolstered colonial racial hierarchies with an egalitarian language that sought to level the corporate structures of the Old Regime. I look especially at the ways that language served as a management device to articulate and legitimize new relationships of power in the political culture of the French Revolution. I connect developments in France to the colonies by showing …

Inefficiently Automated Law Enforcement, Woodrow Hartzog, Gregory Conti, John Nelson, Lisa A. Shay
Inefficiently Automated Law Enforcement, Woodrow Hartzog, Gregory Conti, John Nelson, Lisa A. Shay
Faculty Scholarship
For some crimes the entire law enforcement process can now be automated. No humans are needed to detect the crime, identify the perpetrator, or impose punishment. While automated systems are cheap and efficient, governments and citizens must look beyond these obvious savings as manual labor is replaced by robots and computers. Inefficiency and indeterminacy have significant value in automated law enforcement systems and should be preserved. Humans are inefficient, yet more capable of ethical and contextualized decision-making than automated systems. Inefficiency is also an effective safeguard against perfectly enforcing laws that were created with implicit assumptions of leniency and discretion. …
