This monograph is the first in a new Special Series of monographs that stems from the February 2001 and the March 2002 conferences--co-sponsored by the Strategic Studies Institute of the U.S. Army War College and The Dante B. Fascell North-South Center of the University of Miami--that dealt with the "Implementation of Plan Colombia." It provides a careful examination of the so-called "spillover" problems generated by Colombia's three simultaneous wars against illegal drug traffickers, insurgents, and self-appointed paramilitary groups. Cookie Cutter Syndrome: Legal Reform Assistance Under Post-Communist Democratization Programs, The, Cynthia Alkon
Journal of Dispute Resolution
This article begins with a brief background of ADR, democratization programs, and legal reform programs. Section Three describes the Cookie Cutter Syndrome and examines the assumptions that shape legal reform efforts and that impact if and how ADR is used. Section Four examines how legal and judicial reform programs could look more broadly at using various forms of ADR to more effectively change the legal cultures in post-communist societies. The article concludes that legal reform assistance needs to further individualize programs for the conditions in specific countries, and that assistance programs should more fully integrate ADR. The Cookie Cutter Syndrome: Legal Reform Assistance Under Post-Communist Democratization Programs, Cynthia Alkon

Communism ended in most parts of Eastern Europe and the former Soviet Union over ten years ago. However, the legal and judicial systems in many of these nations seemingly defy reform efforts. What I call in this article the "Cookie Cutter Syndrome" describes the standard approach Western nations developed to assist legal reform in the former Communist world.' Despite vastly different conditions in these countries, the model for judicial reform remains very similar, and is rooted in litigation and adversarial practices. The question of whether an adversarial-based approach is appropriate becomes even more acute as assistance efforts focus more on …

Colombia's deeply rooted and ambiguous warfare has reached crisis proportions in that Colombia's "Hobbesian Trinity" of illegal drug traffickers, insurgents, and paramilitary organizations are creating a situation in which life is indeed "nasty, brutish, and short." The first step in developing a macro-level vision, policy, and strategy to deal with the Colombian crisis in a global context is to be clear on what the Colombian crisis is, and what the fundamental threats implicit (and explicit) in it are. Political and military leaders can start thinking about the gravity of the terrorist strategy employed by Colombia's stateless adversaries from this point. …

In Vindication Of Justiciable Victims' Rights To Truth And Justice For State-Sponsored Crimes, Raquel Aldana-Pindell
Vanderbilt Journal of Transnational Law
In this Article, Professor Aldana-Pindell explores the norms establishing a state's responsibility to grant victims of human rights violations adequate rights in the criminal prosecution process as a remedy for their victimization. She argues that victim-focused prosecution norms comport and provide more effective means of promoting respect for human rights, in certain nations in democratic transition from mass atrocities. Moreover, she suggests that, as part of other justice reforms, states plagued with impunity should adopt criminal procedures granting surviving human rights victims greater standing in the prosecution process. This article was prompted when a well-regarded LL.M. candidate at Pace Law School's Center for Environmental Legal Studies was arrested and subjected to extradition proceedings. Faculty, staff, and students became embroiled in efforts, ultimately successful, to challenge the extradition request. In doing so, they confronted the substantive and procedural barriers faced by an accused in current extradition processes and the significant potential for human rights abuses. Thus, this article, which analyzes current extradition law, updates what has been a slowly developing area of the law and proposes changes to address some of the shortfalls. Part I of this Article will provide a brief background to the fight against terrorism as seen from an inter-American legal and institutional standpoint. Part II will discuss the more significant details of the Convention and the negotiations in the Permanent Council's Working Group that produced it. The Challenges Of Fighting Global Organized Crime In Latin America, Luz Estella Nagle

This Article examines organized crime in Iberoamerica. It also examines the international mechanisms implemented to combat it, specifically the 1988 United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances, the 1996 Organization of American States Inter-American Convention against Corruption of 1996, and the United Nations Convention on Transnational Organized Crime of 2000. It then examines whether these efforts have been successful or unsuccessful, and whether multilateral instruments are a formidable tool in the war against international organized crime or merely toothless tigers.

In this Article, the Authors examine Israel's stance on extradition. In Part II, the Article offers an historical timeline of the development of Israel's extradition policies, from common law to reciprocity. In Part III, the Article examines Israel's initial attempts to address the problems inherent in its operating extradition policy. This section also includes an analysis of the reform movement's effect on specific cases. In Part IV, the Article examines the most recent reform of Israel's extradition policy.

Human trafficking has become a fast-growing global criminal activity, affecting just about every country in the world. Each year, at least four million people are trafficked worldwide, with an annual profit of up to seven billion dollars for the trafficking network. Trafficking victims often believe they are accepting jobs in different sectors, but are often taken across borders, sometimes through coercive 31 methods, where they can often end up in exploitative situations. The intention of this paper is to serve in part as a warning to the international community concerned about corruption, to keep the focus based on the critical analysis of empirically verifiable information. In ways similar to how theorists spoke about organized crime in the 1960s and 1970s, articles today attempt to refer to corruption as if there were one agreed upon definition. However, like the concept “organized crime”, the term “corruption” involves diverse processes which have different meanings within different societies.
