Considering The “Special Considerations”: The Treatment Of Female Inmates In The People’S Republic Of China Since 1994, Niklas Berry
Considering The “Special Considerations”: The Treatment Of Female Inmates In The People’S Republic Of China Since 1994, Niklas Berry
Madison Historical Review
The purpose of this paper is to historicize contemporary gendered legal practices in the People’s Republic of China and to demonstrate that, despite rhetoric to the contrary, paternalistic assumptions rooted in Confucianism still inform the treatment of female prisoners today. Though China underwent massive political and economic shifts after the formation of the People’s Republic of China in 1949 and the death of Mao Zedong in 1976, certain longstanding societal principles were preserved in modern China, including long-held paternalistic stereotypes about the physical and mental fragility of women. These precepts undergirded the PRC’s reforms of its judicial and criminal systems …

Rebuilding Lives: Occupational Therapy's Crucial Role In Community Reintegration To Reduce Recidivism Rates, Julie Burgoon, Kari Joyce
Rebuilding Lives: Occupational Therapy's Crucial Role In Community Reintegration To Reduce Recidivism Rates, Julie Burgoon, Kari Joyce
MOT Student Capstones
The integration of occupational therapy (OT) in the criminal justice system provides a promising and unique approach for addressing community reintegration, thereby contributing to the reduction of recidivism rates in the United States. OT impacts recidivism rates by addressing three main areas; occupational deprivation, mental health, and community reintegration. OT addresses the negative consequences of incarceration by promoting engagement in meaningful activities, establishing routine, and assisting individuals in achieving a variety of skills necessary for successful reintegration. OTs can provide valuable interventions that support mental and occupational engagement to decrease recidivism rates. OT led community reintegration program not only improves …

Secrets Clutched In A Dead Hand: Rethinking Posthumous Psychotherapist-Patient Privilege In The Light Of Reason And Experience With Other Evidentiary Privileges, Jared S. Sunshine
Journal of Law and Health
Attorney-client privilege was held by the Supreme Court to extend beyond death in 1996, albeit only ratifying centuries of accepted practice in the lower courts and England before them. But with the lawyer’s client dead, the natural outcome of such a rule is that privilege—the legal enforcement of secrecy—will persist forever, for only the dead client could ever have waived and thus end it. Perpetuity is not traditionally favored by the law for good reason, and yet a long and broad line of precedent endorses its application to privilege. The recent emergence of a novel species of privilege for psychotherapy, …

A Multi-Site Qualitative Analysis Of The Juvenile Justice And Child Welfare Systems: Implications For Dual System Youth, Lauren Morgan
A Multi-Site Qualitative Analysis Of The Juvenile Justice And Child Welfare Systems: Implications For Dual System Youth, Lauren Morgan
Dissertations
Researchers have been studying juveniles who experience both child maltreatment and delinquency for decades. These studies document the prevalence, outcomes, and demographics of youth who navigate child welfare and juvenile justice systems, also known as dual system youth. However, there is a lack of investigation into the complex processes occurring at the intersection of these two systems. This dissertation aims to fill that gap by building on previous research, organizational theory, and the growing area of punishment literature in criminal justice. The goal is to better understand how juvenile justice and child welfare systems organizationally manage dual system youth. Specifically, …

"They Just Needed To Be Given The Opportunity": Judicial Perspectives Of Drug/Dui Courts In South Dakota, Ryleigh A. Christopherson
Honors Thesis
Drug/DUI courts have existed in the state of South Dakota since 2007 when the state became the last to implement a drug/DUI court program. Currently, South Dakota has 17 problem-solving courts which include drug, DUI, mental health, and veterans courts. The drug/DUI court model works to circumvent participants out of the criminal justice system by targeting the root cause of their criminal behavior. The role of the judge in this model is essential. Previous research has found that how participants view the quality of their interactions with the presiding judge is one of the most influential factors for their success …

A Trigger Warning: Red Flag Laws Are Still Constitutionally Permissible And Could Reduce The Suicide Rates In The Country's Most Vulnerable States, Joseph C. Campbell
Journal of Law and Health
Montana, Alaska, and Wyoming lead the United States in a category coveted by no one: the suicide rate. Firearm ownership drives the rate to the disproportionate level it reaches year after year and the states are left with little recourse. This article argues the usefulness and constitutionality of narrowly tailored red-flag laws aimed exclusively at reducing the rate of suicide in these mountain states. The article follows Supreme Court jurisprudence leading up to New York Rifle & Pistol Association v. Bruen and offers an analysis that complies with the hyper textualist history and tradition test laid out by Scalia in …

The Changing Nature Of Education In Youth Justice Centres In New South Wales (Australia), Laura Metcalfe, Cathy Little Dr, Garner Clancey Dr, David Evans Dr
Journal of Prison Education Research
Education is an important protective factor in preventing involvement in crime. For those young people that enter the youth justice system, and especially youth justice centres, education is a critical, but infrequently explored part of their time in custody following generally disrupted schooling experiences. There are currently six youth justice centres in New South Wales, Australia. Each of these centres have an Education and Training Unit which are schools funded by and staffed with Department of Education personnel. There is evidence that young people accessing these schools regard them very positively. However, this article, drawing on publicly available information, raises …

A Most Despicable Hoax: Women, Crime, And Newspapers In Depression-Era St. Louis, Nancy Stiles
Theses
This paper delves into the captivating saga of Nellie Muench, a St. Louis housewife whose life intersected with the burgeoning celebrity culture, evolving media landscape, and shifting gender dynamics of the early 20th century. Muench's involvement as a co-conspirator in the 1931 kidnapping for ransom of a wealthy doctor propelled her into the spotlight, where she navigated media manipulation to attempt to craft her own narrative. Secretly obtaining a baby and passing it off as her own child to gain jury sympathy and blackmail a rich paramour took interest in her case to sensational tabloid (and legal) heights. Drawing from …

This poster shows an overview of the analysis of property crime data in 2022 in relation to geographical regions, state populations, and rural v urban regions. The statistical data from Statista was used in this analysis. The research question was What has a statistically significant effect the property crime rates? I hypothesized that the crime rates in the southwest will be statistically different than the crime rates of the other sections. For the populations, I hypothesized areas with larger populations would have higher property crime rates. Regarding rural v urban regions, I hypothesized that urban areas would have higher property …
Competency To Stand Trial Evaluations: Using Vignettes With Patients Who Lack Insight, Katelyn Fuller
Competency To Stand Trial Evaluations: Using Vignettes With Patients Who Lack Insight, Katelyn Fuller
James Madison Undergraduate Research Journal (JMURJ)
In the United States, an attorney may request a competency to stand trial evaluation if they are concerned that their client is not mentally fit to adequately participate in their case and defense. Patients found incompetent must undergo treatment for restoration of competency, regardless of their willingness. Clinicians and psychiatrists may use vignettes, or hypothetical scenarios, to help restore competency if the patient lacks insight into their mental illness. While vignettes have been well documented in studying attitudes and awareness, decision making, and identifying mental illness, there is little to no research into their use in psychiatric hospitals due to …

Background: People experiencing homelessness co-occurring with substance use or offending (‘severe and multiple disadvantage’ SMD) often have high levels of poor oral health and related health behaviours (particularly, substance use, smoking, poor diet). This systematic review aimed to assess the effectiveness and cost-effectiveness of interventions in adults experiencing SMD to improve oral health and related health behaviours. Methods and findings: From inception to February 2023, five bibliographic databases (MEDLINE, EMBASE, PsycINFO, CINAHL, and Scopus) and grey literature were searched. Two researchers independently screened the search results. Randomized controlled trials (RCTs), comparative studies and economic evaluations were included that reported outcomes …

This study investigates a number of factors that may influence the duration of court case proceedings using court records from three Minnesota counties. Focusing on cases of domestic violence, sexual assault, kidnapping, harassment, stalking, and various other sex crimes, we employ survival analysis methods to explore the effects of various factors on the duration of court case processing. Our analysis considers the effects of factors such as type of crime, form of legal …

Dissertations
This autoethnographic dissertation research explores Critical White Studies (CWS) and racial trauma and their impact on Students of Color in a higher education setting. This study aims to challenge the deficit thinking of white educators who perpetuate racism in higher education. The relationship is examined to dismantle the white ideology of white educators who believe they have the same experiences of their Students of Color regardless of their own similar experiences. Through personal narratives the author will share the complexity of CWS and Racial Trauma. The findings suggest white educators need to examine their white identity and become culturally responsive …

Dating Violence is exceptionally prevalent among young adults. Dating violence includes physical, emotional, sexual, verbal abuse, and stalking. Implementing intervention and prevention tools within higher education is critical to teach young adults the warning signs of dating violence and where they can receive help. This study implemented a 2-session dating violence prevention program developed by the Domestic Violence Center of Chester County in Honors 100; a first-year course taken by all new honors students. We administered a pre-and post-survey to compare learning objectives before and after the education program. Specifically, we focused on recognizing relationship abuse, supporting others who have …

Previous studies have shown that there are several immigrant-specific factors that shape immigrants' perceptions of crime and police (e.g., Correia, 2010; Weitzer, 2014). First, some researchers have found that immigrants evaluate their lives in the host society based on their previous experiences with crime and the criminal justice system in their home country (Sun & Wu, 2018). Second, the social networks that immigrants form in the host society influence their views of crime and police by serving as a source of information for immigrants (Ackah, 2000). Finally, their experiences with crime and the justice system in the host society affect …

Nowadays, Metaverse platforms are utilized globally for social interactions, work-related tasks, leisure activities, and online shopping. Furthermore, fashion brands now recognize immersive Metaverse technology's great potential and focus on reaching more consumers and expanding market share through Metaverse. However, it is unclear if other brands should invest in building a solid presence in Metaverse. Limited studies have investigated how these fashion-related factors influence brand experience, brand awareness, brand attitude, and purchase intention on Metaverse retail platforms. Therefore, this study aimed to explore the Technology Acceptance Model (TAM) and fashion-related …
Let My People Go: A Biblical Theology Of Liberation In The Exodus Motif, Lou Ann Smith
Let My People Go: A Biblical Theology Of Liberation In The Exodus Motif, Lou Ann Smith
Doctoral Dissertations and Projects
Liberation theologians view political liberation as the central theme of the historical Exodus event due to their interpretation of the text through the perspective of the oppressed and the oppressor. I reject the postmodern stance of liberation theologians, which overemphasizes political liberation and fails to consider the links between Yahweh’s supernatural actions on behalf of the Hebrews in light of Yahweh’s covenantal obligations to Abraham’s descendants. This study argues against the use of liberation theologies as the paradigm for interpreting the historical Exodus event and asserts that a biblical theology of the Exodus motif reveals “covenant” as the interpretive key …
