Slapp-Ed Around: Examining The Use Of State Anti-Slapp Laws In Federal Courts, Jacob Dryer
Slapp-Ed Around: Examining The Use Of State Anti-Slapp Laws In Federal Courts, Jacob Dryer
Helms School of Government Undergraduate Law Review
This Note explains Strategic Lawsuits Against Public Participation (SLAPPs) and examines the applicability of state anti-SLAPP laws in federal cases. Currently, the United States Courts of Appeals are split on this issue, and the United States Supreme Court has not granted certiorari to any cases that have addressed this issue. This Note reviews the jurisprudence related to the application of state anti-SLAPP laws in federal court. The author further examines what the various United States Courts of Appeals have held about the applicability of anti-SLAPP laws and the rationales of each decision. Based on this information, this Note argues that …
The Unconstitutionality Of Underfunded Public Defender Systems, Braden Daniels
The Unconstitutionality Of Underfunded Public Defender Systems, Braden Daniels
Helms School of Government Undergraduate Law Review
When a defendant is ineffectively represented by a public defender due to an underfunded public defender system, a defendant whose public defender provides him only cursory representation is entitled to a new trial only if blatantly innocent. The U.S. Supreme Court should follow its precedent and declare systemically underfunded public defender systems unconstitutional, with cases meriting reversal when the underfunding is to blame for unreasonable attorney errors, regardless of prejudice. This stems logically from the Court’s holdings in Gideon v. Wainwright, Strickland v. Washington, and United States v. Cronic. Many have argued for the reversal or modification of Strickland’s prejudice …
Slaughtering Slaughter-House: An Assessment Of 14th Amendment Privileges Or Immunities Jurisprudence, Caleb Webb
Slaughtering Slaughter-House: An Assessment Of 14th Amendment Privileges Or Immunities Jurisprudence, Caleb Webb
Helms School of Government Undergraduate Law Review
In 1872, the Supreme Court decided the Slaughter-House Cases, which applied a narrow interpretation of the Privileges or Immunities Clause of the 14th Amendment that effectually erased the clause from the Constitution. Following Slaughter-House, the Supreme Court compensated by utilizing elastic interpretations of the Due Process Clause in its substantive due process jurisprudence to cover the rights that would have otherwise been protected by the Privileges or Immunities Clause. In more recent years, the Court has heard arguments favoring alternative interpretations of the Privileges or Immunities Clause but has yet to evaluate them thoroughly. By applying the Court’s previously articulated …

Child Sex Trafficking And Professional School Counselor Preparedness In Texas, Devon E. Romero, Claudia G. Interiano-Shiverdecker, Katherine E. Mcvay, Brenda Jones
Journal of Counselor Preparation and Supervision
Professional school counselors in Texas responded to a questionnaire about training received and their needs concerning preparedness to identify and work with youth exposed to child sex trafficking (CST). The study utilized a convergent parallel mixed methods design. Quantitative results indicated many participants did not find that their graduate degree program prepared them to work with CST and less than half felt their school and/or district provided adequate training opportunities. In addition, thematic analysis revealed two themes characterizing Texas school counselors’ needs to identify and work with CST: (a) concerning preparedness: “so much going on” and (b) “specific training”: a …

The Deep Darkness And Impact On Domestic Violence Victims, Lauren Bludworth
The Deep Darkness And Impact On Domestic Violence Victims, Lauren Bludworth
Master of Arts in Human Services
Domestic violence is a prevalent challenge worldwide, and the domestic violence statistics are overwhelmingly high. Domestic violence creates many high-risk challenges for victims, which leads to lifelong consequences and negative impacts on victims. Negative consequences for domestic violence include women's physical, mental, and psychological health. These impacts on victims lead to adverse health effects, such as social and economic challenges for the victims.
This paper aims to take a closer look at the current literature that has proven negative impacts on victims, both children and women. It will move to cover the gaps in literature and then how to apply …

We Are The Ai Problem, Tonja Jacobi, Matthew Sag
We Are The Ai Problem, Tonja Jacobi, Matthew Sag
Emory Law Journal Online
This Essay describes what we call “the Black Nazi Problem,” a shorthand for the sometimes-jarring text and images produced by AI, from the incongruous—such as female Indian popes—to the outrageous—such as depicting minorities as their own historical oppressors, including Black Nazis. These images were the result of overzealous efforts by AI developers to correct for a lack of diverse representation in the training data used to create Generative AI models. The overrepresentation of white, fully-abled, Western men in images of high status categories, and the invisibility of women, people of color, and the disabled, except in low status categories, and …
The Worry Of Food Insecurity And The Manifestation Of Generalized Anxiety In Relation To Perceived Health Status, Ramona Lynnette Taylor
The Worry Of Food Insecurity And The Manifestation Of Generalized Anxiety In Relation To Perceived Health Status, Ramona Lynnette Taylor
Walden Dissertations and Doctoral Studies
This study examined the association between the worry of food insecurity and the manifestation of generalized anxiety, and how these factors related to perceived health status among adults aged 18 years and older in the U.S. The study controlled demographic factors such as gender, age, race, and education. Utilizing data from the 2019 National Health Interview Survey (NHIS), a binomial logistic regression analysis was employed. The findings indicated a significant association between those persons who often worry about food insecurity, severe (OR = 7.324, p < .001) and frequent generalized anxiety (OR = 5.185, p < .001) suggesting that individuals who worry about food insecurity have higher odds of experiencing severe and frequent (more than 3 times per week) generalized anxiety. Furthermore, both the worry of food insecurity in persons not sure (OR = 0.120, p = 0.004) and generalized anxiety (OR = 0.623 for severe anxiety, p = 0.009) were found to be significantly associated with lower perceived health status. These results suggest a potential association between worry about food insecurity and negative impacts on mental health and perceived overall well-being. Overall, these findings underscore the significant impact of food insecurity on mental health. Further research, including experimental and longitudinal studies, is necessary to elucidate the causal relationship between food insecurity and the manifestation of generalized anxiety in order to impact positive social change.

For myself, art has been a way to explore my Chicanx realism a la Cheri Moraga. There are so many conflicting emotions I have experienced as a mestiza indigenous brown individual living on the borderlands. I have lived with much rage, having survived the colorism within my own family, the racism from both lands of the North and South, and the identity crisis that comes with learning to accept myself as de-tribalized and indigenous in a country which refuses to accept that we are natives and not immigrants.
My contribution to this issue is a painting for the issue’s cover …

The purpose of this article is to critically examine the story of the number 41 as a queer signifier in Mexican culture from a decolonial perspective, taking into account archival records in the development of hegemonic masculinity in the 20th century. An examination of hegemonic masculinity and homophobia of early 20th century Mexico is provided by reviewing colonial accounts of indigenous sexuality, as well as uncovering the hidden stories of the corrido/ballad of El Baile de los 41 Maricones. The corrido was used as satire to ridicule the homosexual practices by the bourgeoisie, creating a rift between social classes, and …

Past And Present Of The Cvs: Empirical Research And Evidence-Based Policy, Kevin T. Wolff
Publications and Research
In this keynote address, I emphasized the critical role of accurate crime measurement in developing evidence-based policies. I discussed the "dark figure of crime," highlighting how many crimes go unreported, and stressed the importance of victimization surveys in uncovering these hidden crimes to provide a more complete picture of criminal activity.
I also explored how technological advancements, particularly AI, are transforming how we collect and analyze crime data. While AI offers significant benefits in predictive policing and resource allocation, I cautioned about the risks of bias and privacy issues that must be managed carefully.
Regional collaboration, standardization, and inclusivity are …
Examining The Impact Of De-Escalation Training For Rural Mississippi Leos: Using Simulation To Assess Behavioral Outcomes, Deepali Manoj Dhruve
Examining The Impact Of De-Escalation Training For Rural Mississippi Leos: Using Simulation To Assess Behavioral Outcomes, Deepali Manoj Dhruve
Theses and Dissertations
People with mental illness (PMI) are at a 67% greater risk of arrest and 16 times greater risk of being killed during a police incident than other civilians. Indeed, law enforcement officers (LEOs) report lacking expertise when addressing mental health calls, and existing trainings aimed at reducing violence in LEO encounters with PMI do not account for challenges specific to rural LEOs. Additionally, many trainings are severely lacking in assessing outcome changes pre- and post-training with more than half of trainings relying on survey-based knowledge subject to social desirability bias and inaccurate self-assessment. This study aimed to address limitations in …
Reconceptualizing The Relations Between Impulsivity, Psychopathy, Machiavellianism, And Narcissism Using Variable- And Person-Centered Approaches, Karen Kelley
Theses and Dissertations
Psychopathy, Machiavellianism, and narcissism are three personality constructs collectively associated with antagonism, callousness, and engagement in socially aversive behaviors. These overlapping personality constructs are theorized to have features that meaningfully distinguish each of them from one another, such as variations in impulsivity. However, investigating the interrelations between existing measures of psychopathy, Machiavellianism, narcissism, and impulsivity presents several methodological challenges. Five Factor Model (FFM) approaches to these four multidimensional constructs provide a promising avenue for examining the associations between these personality domains and impulsivity. This study examined a comprehensive, multidimensional model of impulsivity (i.e., the UPPS-P model of impulsivity) in relation …
Evaluating Depictions Of Representation: An Analysis Of Female Law Enforcement Officers In Prime-Time Fictional Entertainment Television, Linda Christine Williams
Evaluating Depictions Of Representation: An Analysis Of Female Law Enforcement Officers In Prime-Time Fictional Entertainment Television, Linda Christine Williams
Theses and Dissertations
This study looked at uniformed female municipal police officers in fictional entertainment television shows that were centered around law enforcement. Building on previous research by Evans and Davies, this replication study uses a content analysis model to look at city level police, as opposed to the female federal agents from Booker’s 2018 study. This project builds on earlier work that looked at portrayals of female law enforcement officers in entertainment television and applies a framework of Representative Bureaucracy, Cultivation Theory, and Social Construction of Reality to find at their intersection, answers about the construction of the street-level bureaucrats who are …

Evaluating The Client Base And Housing Outcomes Of A Community Based Organization Serving Unhoused Adults, Emi Caprio
Doctoral Dissertations
There is a well-documented, bidirectional relationship between mental health and housing instability. When coupled with the complex historical, societal, and political factors contributing to houselessness, the result is a unique set of mental health needs within this community. Despite this, there is a low rate of mental health service utilization and a dearth of research on how to tailor services to meet the needs of unhoused individuals. Additionally, first-hand perspectives are often omitted, as this population is seen as “hard to reach”. The goal of this two-phase mixed-methods program evaluation was to better understand the demographic and mental health profiles …
Strategies For Addressing Substance Abuse And Gambling Among Youth, Kevin T. Wolff
Strategies For Addressing Substance Abuse And Gambling Among Youth, Kevin T. Wolff
Publications and Research
This keynote address opens with a description of recent trends in substance use and gambling among youth, sharing insights from relevant research. I highlight that while some global trends indicate a decline in adolescent substance use, other areas, especially during the COVID-19 pandemic, have seen increases. I emphasize the importance of comprehensive prevention strategies, such as school-based, community-based, and family-based programs, and effective treatment approaches like behavioral interventions and integrated mental health services.
On the topic of youth gambling, I highlight the rising normalization and accessibility of gambling, particularly through the internet. I describe specific challenges in regions like South …
Predictors Of Antisocial Behavior Among Hispanic Adults, Mara Page
Predictors Of Antisocial Behavior Among Hispanic Adults, Mara Page
Walden Dissertations and Doctoral Studies
Antisocial behavior can lead to serious social and legal consequences such as long-term involvement in criminal activities. Although there has been much research on predictors of antisocial behavior, such as perceived economic status, parental communication, impulsivity, substances, parenting styles, and parental involvement, little has been researched on how these apply to the Hispanic population. Grounded in Gottfredson and Hirschi’s general crime theory, the purpose of this nonexperimental correlational survey design study was to assess whether sensation-seeking behavior, self-control, parental monitoring, religious coping, perceived social support, and rugged resilience predicted antisocial behavior among Hispanic adults. A sample of 167 Hispanic adult …
The “Constitutional-Claims Exclusion” Fallacy: The Courts’ Attempt To “Back-Door” Constitutional Claims Into The Federal Tort Claims Act, Brent Dugwyler
The “Constitutional-Claims Exclusion” Fallacy: The Courts’ Attempt To “Back-Door” Constitutional Claims Into The Federal Tort Claims Act, Brent Dugwyler
Liberty University Law Review
When federal agents violate a citizen’s constitutional rights, justice demands that someone be held accountable and the plaintiff be redressed for his injuries. While a plaintiff can sue the agents in their individual capacities, it is unclear whether the federal government itself can be held liable. Under the Federal Torts Claims Act (FTCA), plaintiffs can sue the federal government for the torts of its employees. But there are limitations and exceptions. For example, the FTCA applies only to state-law torts, not to federal constitutional violations. Further, the FTCA’s “discretionary-function” exception immunizes federal agents’ conduct when they act within their discretion. …

The Lived Experiences Of Cisheteronormativity By Nonbinary Sexual Assault Survivors, Emma Jackson Smith
The Lived Experiences Of Cisheteronormativity By Nonbinary Sexual Assault Survivors, Emma Jackson Smith
Harold L. Hodgkinson Award for Outstanding Dissertation
Gender minorities experience higher rates of sexual assault (SA) victimization and psychological distress, including posttraumatic stress disorder (PTSD) than their cisgender counterparts. Nonbinary individuals, in particular, face elevated levels of victimization, post assault distress, and unique barriers to receiving competent care both in general and specific to their assault experiences. Current research highlights the need for culturally competent care for nonbinary and transgender individuals, as well as for SA survivors. Although the experiences of SA survivors have been previously explored, specific information regarding the experiences of nonbinary survivors remains scarce. The purpose of this hermeneutic phenomenological study, grounded in Heideggerian …

"We'll Handle Our Business": How Immigrant Perceptions Of Police And Police Legitmacy Influence Legal Cynicism And The Mobilization Of Law, Patricia Espiritu Advincula
Master's Theses
Using a qualitative, exploratory approach, semi-structured interviews with first-generation and second-generation immigrants residing in San José, CA who were victimized by a crime were conducted to explore immigrant perspectives of the criminal justice system and the law. The guiding research questions of this study are: (1) what influences immigrants to report crimes and what are the barriers to crime reporting? and (2) what are immigrant perceptions/attitudes of local law enforcement? A total of 39 semi-structured interviews were thematically coded to understand immigrant experiences with police officers and how these perceptions of local law enforcement influence the mobilization of law and …
