Women Serving In Special Operation Forces: Practical Recommendations For Mental Health Providers, Kashvi Khanna, Jessica Salaz, Nicholas Boyd, Alexandra Reeves, Kaethe Hoehling
School of Leadership and Education Sciences: Faculty Scholarship
Women have faced limited access to needed and appropriate services in many professional and societal conditions. Military Special Operations Forces (SOF) is one of these domains. However, despite recent changes that have allowed the inclusion of women into these units, they continue to endure cultural and systemic barriers as well as several subsequent mental and physical health issues. Experiences of gender discrimination, sexual harassment, nonacceptance, and the unique demands of SOF roles can create various health concerns for women in SOF, including PTSD, depression, trauma, and reproductive health issues. These significant concerns highlight the need for clinical and practical recommendations …

From Custom To Courtroom: The Informal And Formal Justice Systems In The Manang And Narphu Valleys, Clarissa Sayre
Nepal: Tibetan and Himalayan Peoples
This research paper aims to depict the structure and some of the current changes of the justice system in the Narphu and Manang Municipalities. The new Constitution of Nepal in 2015 mandated the establishment of one judicial committee in each municipality and rural municipality in the entire country. That’s 753 judicial committees. This is just one example of the recent and rapid change that the justice system in Nepal is currently undergoing. These new implementations of government bodies for justice aim to “mitigate the inefficiencies of the formal legal system and bridge the formal/informal justice divide. ” In both Narphu …
The Constitutional Right To Peremptory Challenges In Jury Selection, Richard Lorren Jolly
The Constitutional Right To Peremptory Challenges In Jury Selection, Richard Lorren Jolly
Vanderbilt Law Review
The peremptory challenge is one of the oldest and most well-established jury selection procedures. Its use dates back to the earliest days of English common law, and it was a firmly established and protected practice at the United States’ founding and into the early twentieth century. But while peremptory challenges are foundational, they remain perhaps the most controversial aspect of jury selection today. This is because they are regularly used by the government and private parties to advance racist, sexist, and bigoted ends. For this reason, over the last three decades, calls to abolish the practice have been regularly made …

Online Crime Reporting: A New Threat To Police Legitimacy?, Kris Henning, Kimberly Kahn, Kathryn Wuschke, Christian Peterson, Stephen Yakots
Criminology and Criminal Justice Faculty Publications and Presentations
Police are more likely to be perceived as legitimate when officers are procedurally just during interactions with the public (i.e. impartial, transparent, fair and respectful). Efforts to reinforce these skills have largely focused on contacts initiated by officers. Less attention has been paid to interactions with crime victims. Moreover, in recent years many police departments have sought to increase efficiency by directing victims to report online, rather than communicating directly with an officer. Very little is known about how victims experience online reporting systems. This study surveyed 1,198 property crime victims who used a large US police department’s online reporting …

Reaching wide and varied audiences for our academic work through book publishing served as the focus on this pipeline program panel. Through a dynamic conversation among leaders in book publishing from the academic and editorial sectors, we discussed the nuts and bolts of book publishing.
We are indebted, for this important dialogue, to American University Washington College of Law, NPOC, and all the conference’s co-sponsoring schools. We particularly want to thank Vice Dean Susan Carle of American University Washington College of Law, whose idea it was to host this panel. We were joined by the following expert book authors for …
Ai Regulation In A Chatgpt Era: Cross-Border Cooperation And Hope In A Sudden Storm, Heidi L. Frostestad
Ai Regulation In A Chatgpt Era: Cross-Border Cooperation And Hope In A Sudden Storm, Heidi L. Frostestad
College of Law Faculty Publications
This article addresses the complex and burgeoning issue of worldwide and national AI regulation in a legal context, with insights from international business law. The present regulatory efforts throughout the globe are a messy tapestry of initiatives with varying approaches that do not coalesce for cross-border multinational corporate entities (MNE). Most AI technologies are developed by multinational enterprises that need a more uniform international regulatory environment and structure for “responsible AI” enforcement. The human rights models of corporate social responsibility and human rights mechanisms that regulate the protection of fundamental rights and “responsible AI” to prevent harms in the context …
Intimate Partner Violence: Access To Protection Beyond The Pandemic, Rachel J. Wechsler
Intimate Partner Violence: Access To Protection Beyond The Pandemic, Rachel J. Wechsler
Faculty Publications
Civil protection orders are the most common legal remedy victims pursue in response to intimate partner violence (IPV). They are more empowering for victims than the criminal legal system because victims themselves drive the process, instead of prosecutors, and they offer more flexible and tailored relief. This Article argues that victims should be able to choose how they file petitions and participate in civil protection order hearings, and that judges should be required to honor those preferences absent good cause. This conclusion is driven by two new, original sets of empirical data collected from IPV survivors who have sought civil …

From Theory To Screen: Strain In The Gallagher Experience, Caroline H. Peabody
From Theory To Screen: Strain In The Gallagher Experience, Caroline H. Peabody
OUR Journal: ODU Undergraduate Research Journal
This paper applies Agnew’s General Strain Theory to the hit television series Shameless (US), primarily focusing on three of the show’s central characters. The paper argues that the characters’ criminal and deviant actions can be attributed to strain, as defined by Robert Agnew’s General Strain Theory (GST). The paper provides a basic overview of GST as well as a synopsis of the show before implementing the theory into an analysis of the show. In addition, this paper explores how criminality highlights the themes of Shameless and acts as an implicit call to action to address strain variables in underprivileged communities. …
Samia V. United States: The Ghost Of Sir Walter Raleigh Haunts Again, Rebekah S. Atnip
Samia V. United States: The Ghost Of Sir Walter Raleigh Haunts Again, Rebekah S. Atnip
Denver Law Review
In Samia v. United States, the United States Supreme Court grappled with whether the admission of a nontestifying codefendant’s redacted confession that implicates a nonconfessing codefendant violates that nonconfessing defendant’s right to confront opposing witnesses. The Court’s majority framed this issue as a conflict between defendants’ rights and judicial economy and then declared judicial economy the winner. This resolution threatens to elevate governmental interests over defendants’ rights to face their accuser and to test opposing witnesses’ memory and sincerity. Moreover, and perhaps more importantly, in holding that introducing such a confession does not violate the Confrontation Clause, the Court endangers …

This project examines the landscape of available scholarship and identifies key concepts, frameworks, and mechanisms that have been developed and are central to the creation of partnerships between Tribal and state public health professionals. Public health professionals, both on and off of Tribal lands, need data to inform decision making for health and education, funding, and resource allocation. Effective collection and use of data that includes Tribal Peoples must engage best practices for data stewardship and protection, recognizing the embedded biases of frameworks and theory, while finding mechanisms to enable public health actions and policy making in real time. Data …

Administrative Subordination, Bijal Shah
Administrative Subordination, Bijal Shah
University of Chicago Law Review
Much of the scholarship on immigration enforcement and environmental justice assumes that agencies negatively impact vulnerable and marginalized people as a result of individualized bias or arbitrariness in administration. This Article argues that, beyond idiosyncrasies or flaws in administrators themselves, the poor impact of administration on minorities emanates from institutional systems. In doing so, this Article introduces a framework of institutional oppression into the study of administration that illustrates how agencies subordinate minority interests to the ends of administrative competence and self-preservation.
A healthy federal bureaucracy is sustained by administrative efforts to reduce institutional burdens, improve efficiency, conserve resources, and …
Professional Mourning: Billie Holiday’S “Strange Fruit” And The Remaking Of Black Consciousness, Samuel Galen Ng
Professional Mourning: Billie Holiday’S “Strange Fruit” And The Remaking Of Black Consciousness, Samuel Galen Ng
Africana Studies: Faculty Publications
This article examines the impact that Billie Holiday’s singing of “Strange Fruit” had on African American audiences from 1939 until Holiday’s death in 1959. It argues that Holiday’s performances embodied and induced a state of collective mourning by way of their politically strategic efforts to frame Black existence as a site of ongoing endangerment and corresponding fear. With carefully crafted, professional expertise, Holiday’s singing generated a feeling of shared vulnerability among her Black audiences and, furthermore, presented that feeling as the very foundation of Black being. Effecting its intended political work, her singing thus prompted some of these listeners to …

Torture And Its Sequelae Among Prostituted Women In The United States, Melissa Farley, M. Alexis Kennedy
Torture And Its Sequelae Among Prostituted Women In The United States, Melissa Farley, M. Alexis Kennedy
Criminal Justice Faculty Research
Background: Extreme violence and psychological abuse have been extensively documented and are pervasive in prostitution. Survivors of prostitution report high levels of posttraumatic stress disorder, dissociation, depression, and self-loathing. These are the same sequelae reported by torture survivors.
Objective: Severe forms of violence have been categorized as torture by experts. The authors note that torture is commonly suffered during prostitution and should be appropriately named.
Method: Using standardized measures and including a new measure of torture, we interviewed 45 women in the United States about their torture experiences in prostitution and their symptoms of PTSD, dissociation, childhood trauma, health status …
