Interference With The Democratic Process As Public Nuisance, Richard C. Boldt, Donald G. Gifford

This Article argues that the tort of public nuisance provides a vehicle for holding accountable those engaged in antidemocratic conduct. Recent history suggests that neither the criminal justice system nor Constitutional checks and balances are always up to the task. Following the 2020 election, some supporters of President Trump stormed the Capitol to prevent the counting of the electoral votes, tampered with election machines, and intimidated election workers and voters. Depending on the results of the 2024 election, criminal charges against Trump and some of his followers may be dismissed. The Senate failed to convict the President on articles of …

Although competency to stand trial holds a vaunted position among the due-process rights in our criminal justice system, its current application is a mere shadow of the original promise articulated in Dusky v. United States. The competency-to-stand-trial requirement is supposed to protect the mentally ill and the mentally impaired from criminal trial, but the requirement has been continually chipped away, both doctrinally and practically. As a result, it no longer protects the most vulnerable. People with dementia, most often elderly with cognitive impairments, face a perilous ordeal when caught in the criminal justice system. This dissertation is a phenomenological study exploring the educational lived experiences of institutional community and technical college Board of Governors members in relation to their preparation and training to serve. Board of Governors members carry a great deal of responsibilities serving in this role. The researcher will investigate the educational backgrounds of institutional board members who serve in this capacity. Adverse childhood experiences (ACEs) as defined by Drs. Felitti and Anda are prevalent in the general population of the United States. These childhood traumas have a profound and lasting impact on emotional, psychological, and social development, often disrupting academic trajectories and life outcomes. This qualitative phenomenological study explored the lived experiences of six college graduates in a suburb of Minneapolis, Minnesota, who endured high levels of ACEs yet succeeded in overcoming adversity to achieve academic and personal success. Guided by Bronfenbrenner’s Ecological Systems Theory and resilience theory (Garmezy & Streitman, 1974), semi-structured interviews were conducted to examine the effects of …

The drafters of the Bill of Rights and its proponents envisioned a document constitutionalizing protections against some of the worst abuses they had experienced under English rule. Prominent businessmen—many of them engaged in smuggling— found their homes ransacked in search of contraband on flimsy evidence and without any reason given for the disruption of their business and consequent enrichment of government agents. The Fourth Amendment addressed the use of general warrants and writs of assistance to allow government agents to conduct broad searches with limited scrutiny. Abstract
This paper explores how postmodernism shifts communication ethics, cultural norms, and perspectives. It explores how postmodernism disrupts established ideas of ethical responsibility, identity, power, and truth. Some of the important issues examined include the decentered self, multiculturalism, and the challenges of decision-making about moral values today. The work also has a strong reliance on Michel Foucault and Seyla Benhabib, to think about how the shifting of social norms and relations of power produce certain kinds of communication.

Chenoweth Prevails: The Connection Between Social Standards And The Marimba’S Development In The Western Art Music Tradition, Jackson Hall

Among percussionists, the names of many marimbists come to mind before that of Vida Chenoweth (1928-2018), the pioneer of the modern marimba recital. Chenoweth began her first recital tour in the early 1950s at a time when the marimba did not yet have a dedicated solo repertoire, and women were largely excluded from performing on orchestral instruments. This thesis explores the musical and social contexts in which Chenoweth performed and worked, with particular attention to her recital history, critical reviews, and, through works written specifically for her performance, her technical abilities. The purpose of this case study is to provide direct insight into effective strategies for designing and implementing an in-prison restorative justice program. Mass incarceration remains a deeply entrenched characteristic of the U.S. criminal justice system, and prisons pose unique challenges to restorative practices, which literature on the subject often describe in general terms. By focusing on one organization successfully implementing in-prison restorative justice, the study aims at specifically illustrating how the prison system impedes attempts at providing restorative services and what practitioners might do to circumvent or otherwise mitigate those challenges. The United States incarcerates more people than any other country. In recent years, mandatory minimums, probation revocation, and other laws have led to increased periods of incarceration, even for low-level offenses. When a parent becomes incarcerated, their children are often left in the hands of the state, and a countdown to the termination of parental rights begins. Even if the parent has never been accused of child abuse or neglect, parental rights can be terminated on the grounds that the parent is unable to care for their children while incarcerated. Parental criminal justice system involvement (CJSI) affects a significant portion of our children in a multitude of ways, including increasing the child’s risk for developing antisocial behaviors and, in doing so, perpetuating the intergenerational cycle of criminal offending that uniquely and unjustly afflicts marginalized communities of color and leaves behind what many have termed the ‘hidden victims’ of CJSI. This study investigated the literacy experiences of Black fathers and their recommendations for enhancing literacy instruction for Black male children from birth through Grade 12. Grounded in African American Male Theory, the research aimed to address knowledge gaps in understanding Black male literacy experiences and provide insights for improving Black male literacy education. Using participatory action research with an initial modified Delphi approach, the study gathered potential areas of consensus among Black fathers on essential curricular revisions to promote positive Black male literacies. Sexual assault cases experience extremely high rates of case attrition, especially in early stages (Morabito et al., 2019). Unlike in other criminal cases, in sexual assault cases survivors are judged harshly, evaluating their background and sexual history (Pattavina et al., 2021). Survivors of sexual assaults often are deterred from even reporting their assaults due to the stigma and treatment they receive after reporting. Law enforcement officers have been reported as acting uninterested or blame the survivors for their assault (Murphy-Oikonen et al., 2022). Victim-blaming is often a main reason behind survivors not reporting their assaults, for the fear of being …

This literature review examines restorative justice practices in secondary education, focusing on academic outcomes and comparison with traditional disciplinary methods. Drawing from research published between 2013-2024, this review analyzes how restorative practices impact student achievement while exploring implementation challenges. The review addresses two questions: the impact of restorative practices on academic outcomes in secondary education, and how these practices compare to traditional methods regarding implementation requirements, sustainability, and student outcomes. After establishing theoretical and historical context, the review systematically examines empirical studies, identifying key implementation factors including professional development, stakeholder engagement, and resource allocation. The Convention on the Prevention and Punishment of the Crime of Genocide is a vital tool for addressing genocide. As mechanisms of global governance fail to stop atrocity, the International Court of Justice has become a legal and political arena for the enforcement of the Genocide Convention. This study asks the question of how the use of the Genocide Convention at the International Court of Justice changed over time? The purpose of the following study is to identify components of the National Incident Management System (NIMS) that can be used to improve first responder deployment in critical incidents, such as in the occurrence of an Active Shooter (AS) and Active Deadly Threat (ADT). The Incident Command System (ICS), a component of NIMS, is the on-scene emergency management organization designed to aid in managing resources during planned and unplanned catastrophic events. An AS/ADT incident is typically planned by the perpetrator and unexpected to first responders, leaving them with limited time to respond to and neutralize this type of threat effectively. …
