Quantitative Analysis Of The Impact Of State Gun Laws And Gender Distribution On Illicit Firearm Trafficking: A Multiple Linear Regression Study Using Data From 2017–2021, Celeste Marre Quinn

Harold L. Hodgkinson Award for Outstanding Dissertation

This quantitative, correlational study examines the impact of state gun law stringency and gender distribution among firearm possessors on illicit firearm trafficking, focusing on three key outcomes: firearm traces, perfected firearm traces, and straw purchases. In response to the pressing need to understand factors driving firearm trafficking, this research aims to inform public safety initiatives and policy strategies. Guided by deterrence theory, the study investigates how legislative strength and gender-based possession patterns influence trafficking indicators. Secondary data were analyzed using multiple linear regression to assess relationships between the IVs of state gun law stringency and gender distribution of firearm possessors …

Measuring Operational Vs. Organizational Stress Among Rural Law Enforcement In Western Colorado, Michael Stephen Scotto Jan 2025

Measuring Operational Vs. Organizational Stress Among Rural Law Enforcement In Western Colorado, Michael Stephen Scotto

Walden Dissertations and Doctoral Studies

New research on rural law enforcement stress levels reveals concerning implications for police reform and community safety, particularly in western Colorado where officers face unique challenges. This quantitative study examined age group differences in operational and organizational stress among rural law enforcement officers using one-way ANOVAs with post-hoc Tukey's HSD tests. The study of 191 rural officers found significant differences across age groups for both operational stress (F(2, 188) = 4.08, p = .018, η2 = .042) and organizational stress (F(2, 188) = 4.15, p = .017, η2 = .043), with officers aged 24-27 experiencing the highest stress levels. Organizational …

Obstacles For Women In Policing Seeking Leadership Positions, Catina Dukes Jan 2025

Obstacles For Women In Policing Seeking Leadership Positions, Catina Dukes

Walden Dissertations and Doctoral Studies

Women’s representation in policing has grown throughout time, yet women continue to be underrepresented in policing as well as higher-ranking leadership positions. Despite efforts to increase their representation, many women in policing have yet to receive the proper promotion that they are due over their male counterparts. Further, when women are promoted, they are usually assigned to deal with crimes such as sexual assault, child abuse, human trafficking, and domestic violence against women. While prior research has addressed these gaps, there are a lack of data on the challenges women encounter while working toward leadership positions in the police workforce. …

Staff Education Project Staff Education To Increase Confidence In Administering Methadone Maintenance, Christelle Meli

Walden Dissertations and Doctoral Studies

Education of health care providers is fundamental in deterring the upward trend in deaths related to opioid drug overdoses. The aim of this staff education project was to educate clinical staff on the importance of administration, and monitoring of methadone maintenance treatment (MMT) to improve treatment rates and patient outcomes in patients with opioid use disorder (OUD). The practice-focused question was, Does an educational program on the importance, administration, and monitoring of MMT increase clinical staff's self-rated confidence in administering MMT? Evidence supported the gap in practice, barriers to MMT, and the need for educational interventions to address gaps in …

The Role Of School-Based Law Enforcement Officers In Student Discipline, Marlaina Mahler

Walden Dissertations and Doctoral Studies

An increase in police presence in schools has led to an increase in research covering school police. The purpose of this qualitative study was to investigate the overall role of SBLE officers, specifically their role in student discipline. This narrative inquiry study answered two research questions about the narrative experiences of SBLE officers as law enforcers, educators, and mentors in Texas public schools and how might Texas SBLE officers’ lived experiences benefit their peers’ understanding of their role regarding student discipline. Role theory and role conflict theory were used as the theoretical foundation. Data were collected through interviews with ten …

A Qualitative Exploration Of The Milwaukee Chapter Of My Brother’S Keeper Community Challenge Program, Courtney Santanna Hayward

Walden Dissertations and Doctoral Studies

Although the mayor of Milwaukee and other stakeholders launched and committed resources to the My Brother’s Keeper (MBK) program, it was unclear whether the program was meeting its goal of increasing graduation rates and college readiness of young Black males in Milwaukee. The purpose of this generic qualitative study was to explore administrators’ perspectives on whether the current funding resources of the MBK program in Milwaukee were adequate to ensure the program’s ability to meet its goal of increasing graduation rates and college readiness of its participants. Resource dependence theory and the teleological process theory guided the study. Braun and …

Determinants Of Socially Responsible Ai Governance, Daryl Lim

Duke Law & Technology Review

The signing of the first international AI treaty by the United States, European Union, and other nations marks a pivotal step in establishing a global framework for AI governance, ensuring that AI systems respect human rights, democracy, and the rule of law. This article advances the concepts of justice, equity, and the rule of law as yardsticks of socially responsible AI—from development through deployment—to ensure that AI technologies do not exacerbate existing inequalities but actively promote fairness and inclusivity. Part I explores AI’s potential to improve access to justice for marginalized communities and small and medium-sized law firms while scrutinizing …

The Law Of Ai For Good, Orly Lobel Jan 2025

The Law Of Ai For Good, Orly Lobel

Florida Law Review

Legal policy and scholarship are increasingly focused on regulating technology to safeguard against risks and harms, neglecting the ways in which the law should direct the use of new technology, particularly artificial intelligence (AI), for positive purposes. This Article pivots the debates about automation, finding that the focus on AI wrongs is descriptively inaccurate because it undermines a balanced analysis of the benefits, potentials, and risks involved in digital technology. Further, the focus on AI wrongs is normatively and prescriptively flawed, as it narrows and distorts the law reforms currently dominating tech policy debates. The Law-of-AI-Wrongs focuses on reactive and …

Presuming Trustworthiness, Ronnell Andersen Jones, Sonja R. West Jan 2025

Presuming Trustworthiness, Ronnell Andersen Jones, Sonja R. West

Florida Law Review

A half-century ago, the U.S. Supreme Court often praised speakers performing the press function. While the Justices acknowledged that press reports are sometimes inaccurate and that media motivations are at times less than public-serving, their laudatory statements nonetheless embraced a baseline presumption of the value and trustworthiness of press speech in general. Speech in the exercise of the press function, they told us, is vitally important to public discourse in a democracy and therefore worthy of protection even when it falls short of the ideal in a given instance. Those days are over. Our study of every reference to the …

State Power And Anticompetitive Conduct, Gregory Day Jan 2025

State Power And Anticompetitive Conduct, Gregory Day

Florida Law Review

States can and do suppress competition when it harms marginalized communities. For example, states have monopolized prison markets, forcing society’s least powerful to pay high prices for medicine, snacks, and other goods. It is also common for states to organize licensing agencies who can protect incumbent interests by refusing to grant licenses to immigrant entrepreneurs such as African hair braiders, street vendors, and more. From current and historical perspectives, anticompetitive practices have quietly entailed one of the most effective methods of oppressing marginalized people. That said, states are exempted from antitrust review due to federalism, which concerns constitutional power sharing …

Ready Or Not Congress, Here It Comes: The Expansion Of Facial Recognition Technology Makes Its Way Into Police Practices, Anabelle Roy Jan 2025

Ready Or Not Congress, Here It Comes: The Expansion Of Facial Recognition Technology Makes Its Way Into Police Practices, Anabelle Roy

Florida Law Review

“Good, old-fashioned police work” does not have the same meaning it had just two decades ago. The use of facial recognition technology by law enforcement agencies across America has proliferated within just the last decade, with some jurisdictions installing thousands of cameras across their cities. Local law enforcement agencies have tracked online social movements to expect demonstrations before they occur so that the agencies can increase police presence ahead of time. The expansion of the Black Lives Matter movement contributed to an increasing call for criminal justice reform from Americans demanding transparency and accountability from law enforcement agencies. Persons of …

Defeating De Facto Disenfranchisement Of Criminal Defendants, Neil L. Sobol Jan 2025

Defeating De Facto Disenfranchisement Of Criminal Defendants, Neil L. Sobol

Florida Law Review

In a democracy, voting is not only an important civic duty but also a right that governments owe to their citizens. However, by operation of law, forty-eight states deny voting rights to individuals based on criminal convictions. Activists and scholars attack de jure disenfranchisement as an improper collateral consequence that disproportionately impacts people of color. Although recent years show substantial reforms to re-enfranchise defendants, an estimated 5.17 million defendants remained ineligible to vote in 2020. While efforts to address de jure disenfranchisement remain necessary, a problem that has received considerably less attention is the de facto disenfranchisement of criminal defendants …

Innocent Until Predicted Guilty: How Premature Predictive Policing Can Lead To A Self-Fulfilling Prophecy Of Juvenile Delinquency, Nadia Rossbach

Florida Law Review

Predictive policing is an innovative, evolving approach to crime prevention that law enforcement has recently embraced. These programs are designed to detect crime patterns by employing machine-learned algorithms to identify high-crime areas as well as likely offenders. In doing so, law enforcement hopes to implement a proactive approach in which officers will be able to prevent crime rather than merely respond to it. However, these programs can be plagued with inaccuracies and racial and socio-economic bias. With juveniles, in particular, the programs impress far too great of consequences while failing to accurately predict adolescents’ future criminality. The impressionable and developing …

The New Pornography Wars, Julie Dahlstrom Jan 2025

The New Pornography Wars, Julie Dahlstrom

Florida Law Review

The world’s largest online pornography conglomerate, MindGeek, has come under fire for the publishing of “rape videos,” child pornography, and nonconsensual pornography on its website, Pornhub. In response, as in the “pornography wars” of the 1970s and 1980s, lawyers and activists have turned to civil remedies and filed creative anti-trafficking lawsuits against MindGeek and third parties, like payment processing company, Visa. These lawsuits seek not only to achieve legal accountability for online sex trafficking but also to reframe a broader array of online harms as sex trafficking. This Article explores what these new trafficking lawsuits mean for the future regulation …

Reassigning Batson: A Modern Approach, Max Angel Jan 2025

Reassigning Batson: A Modern Approach, Max Angel

Florida Law Review

In Batson v. Kentucky, the Supreme Court of the United States held that using peremptory challenges to strike jurors solely on their race violates the Equal Protection Clause. Following that decision, the Supreme Court extended Batson to gender-based peremptory challenges, holding that state-sponsored group stereotypes rooted in historical prejudice that bars a potential juror from serving on a jury violates that juror’s equal protection right. As it currently stands, there is no federal statute prohibiting peremptory strikes on the basis of sexual orientation or gender identity. And although some courts at the state and federal level have held such …

Models Of Bail Reform, Brandon L. Garrett Jan 2025

Models Of Bail Reform, Brandon L. Garrett

Florida Law Review

Bail reform is an urgent topic in the United States and internationally, but what constitutes reform and how to accomplish reform goals is contested. Jails are a modern epicenter of incarceration, with a stunning growth in American jail populations over the past four decades despite declines in both arrests and crime. As many as sixty percent of the half million people currently in jails have not been convicted but are instead detained pretrial. Prior waves of bail reform produced a system largely reliant on secured bonds, which require up-front cash payments to avoid jail time before trial. More recent reform …

Holy Day Surveys And Political Attitudes In Israel, Hannah M. Ridge Jan 2025

Holy Day Surveys And Political Attitudes In Israel, Hannah M. Ridge

Political Science Faculty Articles and Research

Researchers regularly use large survey studies to examine public political opinion. Surveys running over days and months will necessarily incorporate religious occasions that can introduce variation in public opinion. Using recent survey data from Israel, this study demonstrates that giving surveys on religious occasions (e.g., the Sabbath, Hannukah, Sukkot) can elicit different opinion responses. These effects are found among both religious and non-religious respondents. While incorporating these fluctuations is realistic in longer-term surveys, surveys fielded in a short window inadvertently drawing heavily on a holiday or holy day sample may bias their findings. This study thus urges researchers to be …
