Abstract
This study explores the complex nature of human rights violations in the context of countering terrorism in Nigeria. Consequent to the persistent threat of terrorism, especially since the 2009 Boko Haram terrorist' attacks, the Nigerian government has enforced several measures in order to provide national security and save its citizens from terrorist attacks. However, the implementation of these counterterrorism strategies has constituted human rights abuses. While these articles focus on Nigeria, they generally have legal and criminal justice implications for Africa. Africa still faces many dilemmas in finding ways to eliminate terrorism from below and above, causing enormous havoc for political, economic, cultural, and religious instabilities. Intimate partner violence (IPV) is a pervasive social issue that affects individuals and communities, often rooted in early life experiences such as adverse childhood experiences (ACEs). Understanding the link between ACEs and IPV is crucial for developing effective prevention and intervention strategies. This quantitative research explored the potential link between ACEs encountered during early adolescence and the subsequent occurrence of IPV in adult domestic relationships, building upon the foundational work of Felitti et al. Using a quantitative survey design, 30 participants aged 18 and older who had experienced at least one ACE were recruited via social media and surveyed. Bandura's …

Most law enforcement officers (LEOs) enter their profession with the intent to positively impact their communities. However, the emotional and psychological toll of their work often goes unaddressed, leaving officers to navigate repeated exposure to trauma with limited support or preparation. While research has examined the effects of trauma on LEOs, there remains a gap in understanding the impact on African American LEOs. This study explored the effects of frequent on-the-job traumatic events from the perspective of African American LEOs and the barriers to seeking mental health treatment. This Case Note is about Maine’s Extreme Risk Protection Order law, Title 34-B, Section 3862-A, of the Maine Revised Statutes. The purpose of Maine’s law and others like it is to proactively take firearms away from individuals who present a substantial risk of violently harming themselves or others. In the aftermath of the mass shooting which occurred in Lewiston, Maine on October 25, 2023, there was debate over whether law enforcement could have used Section 3862-A to proactively prevent the shooting, as well as over whether Section 3862-A was an effective tool for preventing violence in the first place. The United States Constitution guarantees both the right to a speedy trial and the right to be competent to stand trial. United States Supreme Court decisions have recognized both of these rights but left the hard work of implementing them to legislatures and rulemakers. After turning the technicalities over to the states, the Supreme Court has generally stayed out of the business of setting bright-line rules to follow, both for setting speedy trial limits and ensuring defendants are evaluated and restored to competency. Despite substantial foreign aid investments in road construction projects in Turkana County, Kenya, anticipated benefits of improved access to social facilities, economic development, and rural and urban growth have not been fully realized. This study involved assessing the impact of foreign aid for road construction in Turkana County. Grounded in the social constructivism perspective, the research acknowledges subjective realities shaped by individual and societal experiences. The agency theory served as the theoretical foundation, framing the donor-recipient relationship as one where donors act as principals imposing conditions on recipient communities as agents. Domestic violence and DV-related firearm use are a grave and persistent issue in the United States and have an extensive harmful and deadly impact in the lives of many women. In its 2024 Rahimi decision, the United States Supreme Court held that, as applied to the facts of the case, 18 U.S.C. § 922(g)(8), which bans firearms possession by those subject to a DV protective order, is facially constitutional under the Second Amendment. The Court upheld § 922(g)(8) under Bruen’s “Nation’s historical tradition of firearm regulations” test, finding that founding era laws included provisions preventing individuals who threaten physical …

This Article explores the representation of those accused of committing acts of intimate partner violence (IPV) and domestic violence (DV) in the civil context and the professional duties that flow from the lawyer-client relationship. Resolving ethical questions that arise in the representation of the accused demands an understanding of how the two prevailing responses to intimate partner violence—criminal prosecution and civil protection—differ in purpose and outcome. All attorneys should know about domestic violence. The misconception that it appears only in family law matters is not only mistaken, it is downright fatal. Domestic violence is a pervasive, stigmatized crime, affecting more than twelve million people annually. The nature of this hidden crime invites myriad crossover legal issues with nearly every area of the law. Violence within domestic relationships remains a persistent form of discrimination against women. Initially characterized by overt acts such as wife-beating, contemporary manifestations include various strategies employed by men to assert dominance over their partners. In the early twenty-first century, scholars like Evan Stark sought to understand this issue through the concept of coercive control, which was later recognized as a criminal offense in the United Kingdom in 2015. Today, as digital tools and diverse relationship dynamics have become commonplace, controlling behaviors have evolved to operate independently within domestic relationships, sometimes without overt coercion. The Words We Choose: An Analysis Of Terms Used In Domestic Violence Law, Evan Lovell

In the field of domestic violence law, there is a lack of uniformity in the terms used to refer to those who harm others and those who experience that harm. This Article examines the meaning and cultural and legal prevalence of the terms: Victim, Survivor, Victim-Survivor, and Battered Wife/Spouse; and Abuser, Batterer, Perpetrator, and People who have Caused Harm, as well as Offender, Respondent, and Defendant. As an essential tool of persuasion, an analysis of these terms reveals that understanding the impact of these words is tantamount to respectful and empathetic advocacy.

The majority of human trafficking victims are obtained by someone they know, and frequently that person is an intimate partner. While education on human trafficking spreads, what remains is a very thin line between domestic violence and human trafficking, leaving victims, law enforcement, and legal professionals in the dark about how to identify the difference. With a massive overlap in how traffickers and abusers operate and the tools they use to maintain control over their victims, it is not surprising that many trafficking victims are unaware that they are being trafficked. Developing a strong cybersecurity posture is essential for protecting critical infrastructure, especially in the utility industry. This study analyzes a multi-layered cybersecurity approach that integrates risk management, technology, governance, and workforce training. Based on an examination of industry literature, six key steps were identified. These include assessing security posture, developing policies, implementing security controls, employee training, incident response planning, and regular audits. Each step plays a vital role in mitigating cyber threats and ensuring operational resilience. A comparative analysis of cybersecurity frameworks and real-world incidents highlights the necessity of proactive security strategies. Approximately 40% of the United States military is no older than 25. Despite the robust and continued prevalence of young people serving in the Army, Navy, Air Force, Marines, Coast Guard, and Space Force, no special consideration is explicitly given to a servicemember’s age when considering upgrades for those discharged under less-than-honorable conditions. These young people volunteer to risk their lives, expecting to be honorably discharged and eligible to receive the benefits promised to them during recruitment and enlistment; however, many instead find themselves with a less-than-honorable discharge, thereby barred from the benefits that motivated them to join in the …

Discrimination, Private Liberty, And Public Accommodations Law, Jacob Eisler

In 303 Creative LLC v. Elenis, a fiercely divided Supreme Court opined that commercial vendors enjoy First Amendment protections to decline to serve customers, even where such a choice is prohibited by state public accommodations regimes. In identifying a clash between personal liberty and state instruction, the decision could radically reshape the public accommodations statutory regime, which prevents discrimination against customers from minority and vulnerable groups. Standard constitutional interpretation cannot explain 303 Creative, and existing doctrinal and scholarly frameworks will struggle to integrate the decision into the already convoluted narrative of public accommodation law.

Prosecutors are often seen as the villains of the criminal justice system. And the most villainous thing a prosecutor can do is to commit an intentional Brady violation by withholding favorable and material evidence from the defense. Not surprisingly, there is a wide literature criticizing prosecutors for flagrant misconduct.
But not all Brady violations are intentional. Prosecutors sometimes—perhaps often—commit accidental Brady violations by inadvertently failing to recognize favorable evidence. Because many prosecutors are inexperienced, overworked, and under-trained, they do not recognize exculpatory or impeachment evidence when it is in their files. Additionally, prosecutors also fail to disclose evidence that is …
