Dangerous Legitimacy: The Risks Of Normalizing Hamas As A Fundamentalist Terror Group In Western Discourse, Shevach Berkovits, Darnell Downes, Hunter Lacroix, Michael Dobkowski

This article examines the dangers of Western discourse misrepresenting and normalizing Hamas, a fundamentalist terrorist group, as a legitimate actor in regional crises and conflicts. It explores Hamas' origins as a global terrorist organization, its history of armed conflict with neighbors and the broader Western world, and its ideological roots in religious fundamentalism and totalitarianism. The article argues that Hamas’ principles and actions are fundamentally incompatible with Western democratic ideals, posing a significant threat to regional and global security. It also addresses the ongoing challenges of "Western washing" Hamas through propaganda spread via social activism and social media. The article …

Credit price personalization, where lenders set prices based on individual borrower and loan characteristics, is a common practice across many loan types, with conventional accounts of its harms focusing on the ways in which risk-based pricing, or setting prices based on borrowers’ credit risk, can lead to disparities for protected groups like racial minorities and women. This Article examines an often-overlooked yet potentially harmful form of price personalization — charging borrowers different rates based on their willingness-to-pay, known as price discrimination — and argues that this practice can exploit vulnerable borrowers, including protected groups like racial minorities and women, by …

The Vocational and Life Skills (VLS) program was created by Nebraska Legislative Bill 907 in 2014 with the purpose of easing the transition for individuals who reenter the community after incarceration. The VLS initiative is evaluated by the Nebraska Center for Justice Research (NCJR) to identify the impact service providers and programming have in increasing meaningful employment and prosocial lifestyle improvements among the justice-involved population. As part of the evaluation, NCJR provides trainings to support grantees as needed and provides feedback and information to the Nebraska Department of Correctional Services (NDCS) regarding the implementation process and data updates on a …

Fairness principles enumerated in the seminal case Gideon v. Wainwright stand for the proposition that fundamental fairness and due process require appointment of counsel for indigent litigants. However, this principle has been constrained to criminal contexts. Many other types of litigation are just as impactful as a criminal proceeding, including juvenile dependency proceedings. Nevertheless, indigent parents do not enjoy an unqualified representation right.
This Comment traces the history of the representation right and how it has been treated in a juvenile dependency context, beginning with Gideon itself and examining other cases such as Eldridge and Lassiter. It then examines …

This Article builds on prior work by empirically analyzing the effect of federal intervention in local police departments on crime and clearance rates, using updated data and methodologies.
Congress passed 34 U.S.C. § 12601 (formerly 42 U.S.C. § 14141) in 1994 to give the United States Attorney General the authority to seek equitable relief against local and state law enforcement agencies engaged in patterns or practices of misconduct. Since its passage, the Department of Justice has investigated and intervened into dozens of American police departments, including some of the largest police departments in the country. Incarceration is a life-changing event. It is humbling to be surrounded by three cement walls and a row of metal bars reaching from the floor to the ceiling. Millions of individuals are impacted by the adverse effects of incarceration, but millions more feel the effect of their incarceration as well. There are obvious negative impacts on those who have personally experienced incarceration, but one of the largest impacts is widely overlooked; one that comes from beyond the cell. A fundamental precept of the law of conspiracy is that all members of a conspiracy are partners in crime. This precept is the rationale for many doctrines of conspiracy law, including the controversial judge-made rule that all members of a conspiracy are vicariously guilty of substantive crimes foreseeably committed by one member of the conspiracy even if the other members did not commit the substantive offense, intend the offense, or aid or abet its commission. Founding Father and Federalist Paper author Alexander Hamilton opined that “clemency was vital to temper the harshness of criminal codes because ‘without an easy access to exceptions in favor of unfortunate guilt, justice would wear a countenance too sanguinary and cruel.’” Hamilton and his contemporaries understood the need for a justice system that balanced strict enforcement of the law with the ability to recognize individual circumstances and extend compassion where warranted. Without the ability to make exceptions for people who are guilty but nonetheless deserving of compassion, the justice system would appear excessively harsh, violent, and unkind. The justice system …

Analyzing Public Opinion As An Input In The Systems Theory Framework By Examining The Democratic Responsiveness Of The Pennsylvania Legislature In The 2023-2024 Legislative Session, Donovan M. Villegas

I examine the 2023-2024 legislative session of the Pennsylvania General Assembly to determine the role public opinion plays in the content of legislation. I use a public policy systems and theories framework as my main theoretical model. Using quarterly polling that identifies the top issues for voters, I find that the Pennsylvania legislature responded to those top issues. This suggests that public opinion does play an influential role in legislative action. These results are consistent with what the systems and theories framework would predict.

This body of work examines higher education with and for justice-involved people from a descriptive, theoretical, and empirical perspective—pulling together multiple disciplines and employing different methodologies from the humanities and social sciences. The investigation is written from a philosophical perspective via educational foundations and a social science perspective via qualitative research, including an examination of carceral higher education’s connections to teaching and experiential learning. This approach reflects the interdisciplinary nature of both the author’s degree program and the topic itself, which (as a field of academic inquiry) is part theoretical and part empirical (both qualitative and quantitative). The Millon Adolescent Clinical Inventory – Second Edition (MACI-II; Millon et al., 2020) is an adolescent self-report measure of personality and psychopathology. Its predecessor, the Millon Adolescent Clinical Inventory (MACI; Millon et al., 1993) is one of the most frequently used measures in forensic evaluation of justice involved youth (Archer et al., 2006; Baum et al., 2009; Viljoen et al., 2010). Prosecutors face criticism for prosecuting too many minority members and too few police. Recently, some reformers have won prosecutorial elections by pledging to change these priorities. Yet scholars have identified two impediments to police prosecutions. First, county prosecutors often answer to suburban voters indifferent to the excesses of city police. Second, prosecutors depend on those police to investigate their cases and to endorse them as effective. This Article argues that the influence of residents and police on prosecutorial decisions depends on the political geography of a prosecutor’s office. On December 21st, 2023 the South African Government filed an urgent application to the International Court of Justice (ICJ) in the wake of Israel's military activities in Gaza in response to the attack in Israel on October 7th in which more than 1,200 Israeli citizens were killed and several hundred were taken as hostages. The Israeli government responded to the attacks and the taking of hostages by launching a military campaign into Gaza, with the express purpose of destroying Hamas and especially its ability to attack Israel in the way that it did on October 7th. IPV is the physical, psychological, or sexual aggression by a married, unmarried, or live-in partner (Patra et al., 2018).
- Male perpetrators are reported for 92% of the IPV cases compared to females and are more likely to severely injure or kill their partners (Levitt et al., 2008).
- In a traditional community that had lax attitudes toward IPV, there was an 80% increase in the likelihood of perpetration and women’s consent to the violence increased their likelihood of victimization by 11% (Linos et al., 2013).

Conventional narratives tend to represent the post-World War II international criminal proceedings as a men’s project, thus obscuring the many women who participated, as lawyers, journalists, analysts, interpreters, witnesses, and defendants. Indeed, two women stood trial before Nuremberg Military Tribunals. This article examines the case of the only woman found not-guilty: Inge Viermetz, who had been an administrator at Lebensborn, the Nazi SS adoption and placement agency. The article outlines the prosecution’s child-taking case against Viermetz, as well as her successful gendered self-portrayal as a conventionally feminine caregiver. Criminalizing wage theft is a popular idea. This Article argues that--based on practitioners' experience with human trafficking--workers' rights groups, legislators, and prosecutors should reconsider embracing the criminalization of wage theft as an effective response to preventing this form of abuse. Twenty years of experience with trafficking cases and data show that criminalizing wage theft is likely not only to be ineffective but also to cause further harm to the victims and vulnerable communities who suffer the most from wage theft.
