Does The Provision For Irish Prisoners To Keep In Contact With The Outside Environment Require Reform?, Adrian Berski Jan 2015

Does The Provision For Irish Prisoners To Keep In Contact With The Outside Environment Require Reform?, Adrian Berski

Reports

The law of the Republic of Ireland provides that prisoners’ maintain rights in order to conduct connections with the outside world. It is important to mention that currently they are 3,747 people in Irish prisons[1]. This population have rights before the law and they shouldn’t be unreasonable deprived of rights or liberties.

By maintaining a connection with the outside world means that normal elements of the reintegration process can be maintained. This has a significant impact for further prisoner reintegration. It includes rights to visits, correspondence, voting, etc.

The main sources of law, which regulates prisoners’ rights in …

Hands Up, Don't Shoot: Policing, Fatal Force, And Equal Protection In The Age Of Colorblindness, Zach Newman Jan 2015

Hands Up, Don't Shoot: Policing, Fatal Force, And Equal Protection In The Age Of Colorblindness, Zach Newman

UC Law Constitutional Quarterly

This note discusses race, policing, the use of fatal force, and the Black Lives Matter movement, contextualizing it within the "prison industrial complex," the "New Jim Crow," the hegemony of colorblindness and postracialism, and jurisprudential limitations placed on Equal Protection. It argues that narrow legal reforms of policing, like body cameras or increased training, cannot be conceived of as complete solutions. Although these reforms are important, they must be connected to critiques of and actions against overarching structures of stratification, subordination, and social control in advanced capitalism. Contemporary policing is one manifestation of a deeply flawed and racialized criminal punishment …

Pathologizing The Poor: Implications For Preparing Teachers To Work In High-Poverty Schools, Kerri Ullucci Jan 2015

Pathologizing The Poor: Implications For Preparing Teachers To Work In High-Poverty Schools, Kerri Ullucci

Education Faculty Publications

The recent economic downturn highlights that poverty continues to be a significant social problem. Mindful of this demographic reality, it is imperative for teacher educators to pay close attention to the manner in which teachers are prepared to educate students from impoverished backgrounds. Given the number of frameworks that offer reductive recommendations for teaching students from impoverished backgrounds, we seek to accomplish two goals with this work: (a) to summarize mythologies about poverty that impact student–teacher relationships and (b) to offer new perspectives on educating students from impoverished backgrounds by providing anchor questions teacher educators can explore with pre-service teachers.

Restructuring Clemency: The Cost Of Ignoring Clemency And A Plan For Renewal, Rachel E. Barkow, Mark Osler Jan 2015

Restructuring Clemency: The Cost Of Ignoring Clemency And A Plan For Renewal, Rachel E. Barkow, Mark Osler

Faculty Articles

The use of the pardon power is a necessary element in a fully functioning system of criminal law. Recent presidents, however, have largely ignored this powerful tool, even as many have sought to expand the power of the office in other ways. This Essay seeks both to describe the costs of this trend and to propose important structural reforms to reverse it. Specifically, we advocate for the creation of a clemency commission with a standing, diverse membership. While this commission should have representation from the DOJ and take the views of prosecutors seriously, the commission itself should exist outside the …

Youth Matters: The Need To Treat Children Like Children, Vincent M. Southerland Jan 2015

Youth Matters: The Need To Treat Children Like Children, Vincent M. Southerland

Faculty Articles

In 2012, the United States Supreme Court's decisions in Miller v. Alabama and Jackson v. Hobbs marked a sea change in the sentencing of children convicted of serious offenses. Miller ended mandatory life without parole sentences for youth who committed crimes when they were under the age of 18. The Court looked to the fundamental distinction between youth and adults to impose a categorical bar on mandatory life without parole sentences for adolescents. This article surveys the state of juvenile sentencing two decades before Miller emerged. In the early 1990s, racial stereotypes about the perceived typical juvenile criminal transformed the …

Essays In The Economics Of Crime And Discrimination, Michael George Mueller-Smith

Dissertation Awards

This dissertation studies marginalized populations in the United States and Western countries, with a broad focus on how legal and social institutions affect individual economic outcomes and wellbeing. The first chapter examines the impacts of incarceration on criminal defendants in Houston, Texas, documenting patterns of worsening criminality, diminished earnings and social detachment after exposure to the prison system. The second chapter develops a framework to consider the interplay between discrimination and concealment of minority status in the context of sexual orientation and shows empirical evidence from the United States on the large magnitudes of concealment costs. The third chapter considers …

Disproportionate Contact: Youth Of Color In Maine's Juvenile Justice System, Robyn Dumont, Erica King Msw, George Shaler Mph

Justice Policy

Research staff at the USM Muskie School work in partnership with Maine’s Juvenile Justice Advisory Group (JJAG) in support of the goal of producing information to enhance Maine’s understanding of disproportionate minority contact (DMC) in the state. This research documents the rate of disproportionate minority contact (DMC) for youth involved in Maine’s juvenile justice system, differences in pathways to detention for youth of color, and the experiences of youth and families of color who have had contact with Maine’s juvenile justice system. It uses a relative rate index (RRI) to demonstrate how youth of color are treated in comparison to …

What follows is a fictional account. Our “characters” bear our real names; the other eight are composites of students we have taught and from whom we have learned; activists with whom we have worked; and staff, faculty, and administrators we have trained in venues such as Safe Zone. We portray our ally (Lisa)-lesbian (Kathryn) relationship this way for two reasons: one, we had not secured permission from real students, colleagues, or community members to represent their lives and experiences, and two, we seek a way to show our partnership, both personal and professional since 2000, in action. To each of …

The Threat Lives On: How To Exclude Expectant Mothers From Prosecution For Mere Exposure Of Hiv To Their Fetuses And Infants, Shahabudeen K. Khan Jan 2015

The Threat Lives On: How To Exclude Expectant Mothers From Prosecution For Mere Exposure Of Hiv To Their Fetuses And Infants, Shahabudeen K. Khan

Cleveland State Law Review

There is a renewed interest in HIV/AIDS issues given that better treatment is available. The Department of Justice (DOJ), Civil Rights Division, recently published best practice guidelines to reform HIV-specific criminal laws to conform to modern science. The DOJ’s latest guidelines urge states to “reform and modernize” the laws to reflect modern science. There is a lot of unfinished work regarding the ineffectiveness and stigma associated with HIV criminal transmission laws as a whole. These laws are “no good” and counterintuitive in the fight against this unfortunate disease. There have been calls to repeal these laws in their entirety. That …

The Adoption Of Restorative Justice As A State Policy Response To Criminal Justice Concerns: A Mixed Methods Inquiry, Shannon Marie Sliva

Social Work Dissertations - Archive

Over the past two decades, 32 states have enacted legislation supporting the use of restorative justice as crime response. The purpose of this study is to explore the contexts in which restorative justice has been adopted as a policy solution for juveniles and adults by answering the following questions: (1) Are internal characteristics of American states correlated with the adoption of restorative justice legislation between 1988 and 2014? (2) How have social, economic, political, or other factors promoted or impeded the adoption of restorative justice legislation in key states? This study uses a convergent-parallel mixed-methods approach to develop an empirically …
