Stepping Beyond Nuremberg’S Halo: The Legacy Of The Supreme National Tribunal Of Poland, Mark A. Drumbl
Stepping Beyond Nuremberg’S Halo: The Legacy Of The Supreme National Tribunal Of Poland, Mark A. Drumbl
Scholarly Articles
The Supreme National Tribunal of Poland (Najwyzszy Trybunal Narodowy (Tribunal)) operated from 1946 to 1948. It implemented the 1943 Moscow Declaration in the case of suspected Nazi war criminals. This article unpacks two of the Tribunal’s trials, that of Rudolph Hoess (Kommandant of Auschwitz (Oswiecim) and Amon Goeth (commander of the Krakow-Plaszow labour camp). Following an introduction, the article proceeds in four sections. Section 2 sets out the Tribunal’s provenance and background, offering a flavour of the politics and pressures that contoured (and co-opted) its activities so as to recover its place within the imagined spaces of international criminal accountability. …
Elite Deviance, Organized Crime, And Homicide: A Cross-National Quantitative Analysis, Carol L.S. Trent
Elite Deviance, Organized Crime, And Homicide: A Cross-National Quantitative Analysis, Carol L.S. Trent
USF Tampa Graduate Theses and Dissertations
Both elite deviance, committed by the upper echelons of society, and organized crime threaten development and the rights and security of people across and within nations; however empirical research on these topics is limited, especially in the field of criminology. This study addresses this gap in the literature by testing hypotheses derived from Simon’s symbiotic theory of elite deviance, which posits that direct and indirect relationships exist between elite deviance, organized crime, and conventional crimes exist (2008). The intervening effects of national culture and political economic ideology are also considered.
To test the research hypotheses, this study uses homicide rates, …

Critical-Incident Trauma And Crime Scene Investigation: A Review Of Police Organizational Challenges And Interventions, Richard D. Clark, Catherine Distelrath, Gloria S. Vaquera, Daniel Winterich, Ernest Dezolt
Sociology
It is hypothesized that exposure to critical-incident trauma affects crime scene investigators. Individual and organizational attribution factors are analyzed through the use of self-report data collected from crime scene investigators working in a large Midwestern state. This paper analyzes key variables in the job of a crime scene investigator in an effort to determine the level of stress related to CSI work and the nature of organizational support available to the investigator. Although initial findings suggest a high level of satisfaction with the job, the nature of the job can lead to high levels of both professional and personal stress, …

Nip It In The Bud: Compassionate Use Of Medical Cannabis Pilot Program Act Does Not Provide Employees A Legal Remedy For Adverse Action Based Upon Use In Compliance With The Statute, 49 J. Marshall L. Rev. 193 (2015), Tyler Duff
UIC Law Review
This legal dichotomy, the federal illegality and state legality, is the reason why Illinois, with its passing of the Compassionate Use of Medical Cannabis Pilot Program Act (“the CUA”), and its promises of protection for patients, may not prevent an employer from terminating an employee for marijuana use in compliance with the CUA. This comment provides that the CUA does not, and could not, provide registered users a viable cause of action for such discipline.
2015 Maine Crime Victimization Survey: Informing Public Policy For Safer Communities, Robyn Dumont Mppm, George Shaler Mph
2015 Maine Crime Victimization Survey: Informing Public Policy For Safer Communities, Robyn Dumont Mppm, George Shaler Mph
Maine Statistical Analysis Center
Executive Summary:
The purpose of the Maine Crime Victimization Survey (MCVS) is to understand the extent of criminal victimization in Maine. This study includes findings from the most recent MCVS and features comparisons with other MCVS surveys done in 2006 and 2011. Several states do their own crime victimization surveys because findings from the National Crime Victimization Survey (NCVS), cannot be analyzed at the state level. As of July 2014, 14 states had developed and administered their own crime victimization surveys. Utah and Idaho have administered their surveys six and four times respectively. The MCVS supplements other crime findings, most …
Immigration Law By Proxy: The Case Of Colorado’S Human Smuggling Crime, César Cuauhtémoc García Hernández
Immigration Law By Proxy: The Case Of Colorado’S Human Smuggling Crime, César Cuauhtémoc García Hernández
Sturm College of Law: Faculty Scholarship
Despite the federal government’s well known expansive reach in creating and enforcing immigration law, the states retain substantial authority to play an important role in migrants’ lives. Through their traditional powers to adopt criminal statutes and police their communities, states can indirectly — but intentionally — inject themselves into the incidents of ordinary life as a migrant. Colorado’s human smuggling statute, currently being challenged before the state supreme court, illustrates this type of state regulation of migration. This essay addresses the statute’s reach, its shaky constitutional footing, and places it in a broader context in which states criminalize immigration-related activity.
Dignity And The Eighth Amendment: A New Approach To Challenging Solitary Confinement, Laura L. Rovner
Dignity And The Eighth Amendment: A New Approach To Challenging Solitary Confinement, Laura L. Rovner
Sturm College of Law: Faculty Scholarship
The use of solitary confinement in U.S. prisons and jails has come under increasing scrutiny. Over the past few months, Supreme Court Justice Anthony Kennedy all but invited constitutional challenges to the use of solitary confinement, while President Obama asked, “Do we really think it makes sense to lock so many people alone in tiny cells for 23 hours a day for months, sometime for years at a time?” Even some of the most notorious prisons and jails, including California’s Pelican Bay State Prison and New York’s Rikers Island, are reforming their use of solitary confinement because of successful litigation …

Disquieting Discretion: Race, Geography & The Colorado Death Penalty In The First Decade Of The Twenty-First Century, Meg Beardsley, Sam Kamin, Justin F. Marceau, Scott Phillips
Sturm College of Law: Faculty Scholarship
This Article demonstrates through original statistical research that prosecutors in Colorado were more likely to seek the death penalty against minority defendants than against white defendants. Moreover, defendants in Colorado’s Eighteenth Judicial District were more likely to face a death prosecution than defendants elsewhere in the state. Our empirical analysis demonstrates that even when one controls for the differential rates at which different groups commit statutorily death-eligible murders, non-white defendants and defendants in the Eighteenth Judicial District were still more likely than others to face a death penalty prosecution. Even when the heinousness of the crime is accounted for, the …

Alternate Judges As Sine Qua Nons For International Criminal Trials, Megan A. Fairlie
Alternate Judges As Sine Qua Nons For International Criminal Trials, Megan A. Fairlie
Faculty Publications
When one of the three judges hearing the case against Vojislav Šešelj at the International Tribunal for the former Yugoslavia (ICTY) was disqualified during the deliberations phase of the prosecution, many observers assumed that the multi-year trial would have to be re-heard. Instead, the ICTY opted to begin deliberations anew once a judge — who has not spent a single day participating in the proceedings — has familiarized himself with the trial record. This article demonstrates why the plan to proceed with a new judge is both procedurally illegitimate and markedly at odds with the ICTY’s statutory guarantee of a …
