Jennings V. Stephens And Judicial Efficiency In Habeas Appeals, Eric O'Brien

Duke Journal of Constitutional Law & Public Policy Sidebar

This commentary previews the Supreme Court case Jennings v. Stevens which deals with several areas of federal habeas corpus law and procedure. The Court will consider, inter alia, whether a habeas petitioner who succeeds in federal district court nevertheless needs to request a certificate of appealability to bring an alternate grounds for habeas relief at the appellate level. Further, the Court can resolve a major circuit split on whether a court considering an ineffective assistance of counsel claim should consider each instance of ineffective assistance as a single claim or as all parts of one claim. Eric O'Brien suggests …

Does Wilderness Therapy Reduce Recidivism In Delinquent Adolescents?: A Narrative Review, Jamie M. Clem, Stephanie Grace Prost, Bruce A. Thyer

Journal of Adolescent and Family Health

Adolescent recidivism rates remain high in the United States despite the fact juvenile crime has declined since the 1990’s. Wilderness therapy (WT) is an emerging treatment approach for adolescents involved in the juvenile justice system. This review examines outcome studies utilizing a wilderness therapy program in an effort to reduce adolescent recidivism. Studies were eligible if they: (a) evaluated a WT intervention, (b) utilized an adolescent population, (c) included a measure of recidivism as an outcome variable, and were (d) published in English between 1990 and June of 2010 in a peer-reviewed journal. A total of seven studies on WT …

Prevention, Not Prejudice: The Role Of Federal Guidelines In Hiv-Criminalization Reform, Sarah J. Newman Jan 2015

Prevention, Not Prejudice: The Role Of Federal Guidelines In Hiv-Criminalization Reform, Sarah J. Newman

Northwestern University Law Review

Thirty-four states and two U.S. territories have criminal statutes that specifically impose criminal liability for HIV transmission, exposure, or nondisclosure. With possible sentences ranging up to thirty years, these statutes have even provided the basis for convicting HIV positive individuals who never actually transmitted the virus. To address the unreasonable prosecutions of these individuals, Representative Barbara Lee of California introduced the Repeal Existing Policies that Encourage and Allow Legal HIV Discrimination Act (REPEAL Act) to the U.S. House of Representatives on September 23, 2011. If passed, the REPEAL Act would require a systematic review of these statutes and the development …

Pirker And Beyond: Questions Of Policy Versus Law On Unmanned Aerial Systems (Uas), Sarah Nilsson

Aviation / Aeronautics / Aerospace International Research Conference

The regulatory versus policy landscape for unmanned aerial system (UAS) users in the United States (US), as of February 2015, is not an easy one to navigate. The whole country is buzzing with the sound of this new technology, not just in terms of engine noise but more so in terms of the public outcry to the invasion of privacy. The federal government is currently drafting laws that will safely integrate these systems within the National Airspace System (NAS). Concurrently, at least 20 states, unable to wait patiently in the sidelines for such legislation, have implemented their own statutes to …

Felony Disenfranchisement: A Literature Review, Carter A. Wilson Dr. Jan 2015

Felony Disenfranchisement: A Literature Review, Carter A. Wilson Dr.

Conference Presentations

This paper examines and critiques legal arguments supporting and opposing felon disenfranchisement laws. It reexamines Richardson v Ramerez, the Supreme Court decision upholding the constitutionality of state laws that deny voting rights to voting aged cities with felony convictions. It summarizes the literature on case law, legal theory, democratic theory and comparative governments related to voting rights and felon disenfranchisement. It presents a typology of different levels of felon disenfranchisement practice. It concludes that the arguments supporting the more severe practices of felon disenfranchisement tend to focus on the 14th amendment while ignoring the 15th amendment; tend to trivialize the …

Effectiveness Of The Cure Violence Model In New York City, Jeffrey A. Butts, Kevin T. Wolff, Evan Misshula, Sheyla A. Delgado Jan 2015

Effectiveness Of The Cure Violence Model In New York City, Jeffrey A. Butts, Kevin T. Wolff, Evan Misshula, Sheyla A. Delgado

Publications and Research

New research from the John Jay College Research & Evaluation Center (JohnJayREC) suggests that the Cure Violence strategy may effectively reduce the incidence of homicide. Researchers at John Jay worked with analysts at the New York Police Department (NYPD) to assemble information about violence in New York City neighborhoods and compared areas with and without Cure Violence programs. The analysis focused on programs in three areas: two in Brooklyn and one in Manhattan. All three areas were operating Cure Violence programs as of 2010, and homicides were tracked through 2013. When the study compared homicide rates in those areas with …

Cogs In A Cosmic Machine: A Defense Of Free Will Skepticism And Its Ethical Implications, Sacha Greer Jan 2015

Cogs In A Cosmic Machine: A Defense Of Free Will Skepticism And Its Ethical Implications, Sacha Greer

USF Tampa Graduate Theses and Dissertations

Free will skepticism denies that humans possess the type of freedom required for moral responsibility (FMR). While not the most popular position in scientific, philosophical, or mainstream communities, I contend that this lack of acceptance is due not to flaws inherent in the position, but to misconceptions concerning its ethical and practical implications. In my dissertation, I endorse free will skepticism, beginning with a refutation of contrary positions, followed by a response to objections, and ending with a defense of social reforms necessitated by the denial of free will. Ultimately, I support Derk Pereboom's optimism that a global acceptance of …

Cambodian Family-School Partnership: Toward An Evolving Theory, Peter Tan Keo Jan 2015

Cambodian Family-School Partnership: Toward An Evolving Theory, Peter Tan Keo

Journal of Southeast Asian American Education and Advancement

This article explores the current debate around family-school partnerships. Traditional family-school partnership theories do not account for the intended voices of Cambodian families. This article draws from existing research on Southeast Asian families more generally in order to develop a research-based, data-driven family-school partnership conceptual framework for Cambodian American families. It is believed that a pro-ethnic, voice-centric family-school partnership fosters an inclusive, supportive learning environment for Cambodian children. The logic undergirding that belief assumes that this partnership is likely to increase cultural awareness between critical home-school partners. At the very least, the proposed concept model serves as a theoretical building …

Were The Terror Attacks In Paris Motivated By Radical Islam?, Donald Roth

Faculty Work Comprehensive List

"Were the terror attacks in Paris motivated by radical Islam? In an interview published on January 13 by the Weekly Standard, White House press secretary Josh Earnest explained why the Obama Administration is intentionally distancing itself from French Prime Minister Manuel Valls’ statement that France is “at war against terrorism and radical Islam.” This logic used by Mr. Earnest to support this rhetorical decision is deeply problematic."

Resistance To Unjust Immigration Restrictions, Javier S. Hidalgo Jan 2015

Resistance To Unjust Immigration Restrictions, Javier S. Hidalgo

Jepson School of Leadership Studies articles, book chapters and other publications

State employees use force or the threat of force to restrict immigration.Border guards forcibly detain and incarcerate foreigners who immigrate without state approval. When migrants evade or resist immigration restrictions, border agents sometimes deploy tasers to incapacitate migrants, pepper spray them, shoot them with rubber bullets, and, less frequently, beat migrants with batons, and even fire live ammunition at them. Thousands of migrants perish annually in attempts to evade border agents. 2 State officials also capture and deport migrants who reside in their borders without official authorization. Affluent states have deported millions of unauthorized migrants in recent decades.
