Targeting And Detention In Non-International Armed Conflict: Serdar Mohammed And The Limits Of Human Rights Convergence, Aurel Sari, Sean Aughey
International Law Studies
In recent years, the United Kingdom has seen a steady flow of legal challenges arising out of its involvement in the armed conflicts in Afghanistan and Iraq. Among these, the case of Serdar Mohammed, decided by the English High Court in May 2014, is of particular interest because of its wider implications. In essence, the High Court’s judgment in Mohammed questions the existence of a legal basis under the law of armed conflict for the conduct of status-based operations in non-international armed conflicts. This article demonstrates that the restrictive approach adopted by the High Court in Mohammed is mistaken as …

Prenatal And Neighborhood Correlates Of Oppositional Defiant Disorder (Odd), Andrea A. Russell, Claire L. Johnson, Arwa Hammad, Kelly I. Ristau, Sandra Zawadzki, Luz Del Alba Villar, Kendell Coker
Psychology Faculty Publications
This study investigates the link between prenatal exposure to alcohol and drugs, parental perceptions of neighborhood safety and support, and the diagnosis of oppositional defiant disorder (ODD) among a nationally representative sample of youth. A subset of variables from a larger study, the 2001–2004 National Comorbidity Survey-Adolescent Supplement (NCS-A), as well as its supplemental parental surveys, was analyzed in this study. This study used a specific selection of 5,924 adolescents and their parents from the NCS-A. Results suggest a correlation between prenatal caffeine use and a subsequent ODD diagnosis in female adolescents. Overall correlations between neighborhood drug use/sales and minority …

Student Criminality: The Influence Of Strain, Family And Peers, Annie Cvetan
Student Criminality: The Influence Of Strain, Family And Peers, Annie Cvetan
Theses and Dissertations
General strain theory suggests that a number of conditioning factors affect who is more likely to respond to strain with crime. Research has also demonstrated that an individual's self-complexity plays a role in how an individual responds to strain. Self-complexity refers to (1) the number of identities individuals perceive as important to themselves; and (2) the varied characteristics they ascribe to these identities. This research study analyzed if college students were committing crime, whether the crimes were major or minor in nature, and if criminality was a new behavior or an imported one. This study also looked at who, if …

The Universal Remedy For Attorney Abandonment: Why Holland V. Florida And Maples V. Thomas Give All Courts The Power To Vacate Civil Judgments Against Abandoned Clients By Way Of Rule 60(B)(6), Stephen White
Pepperdine Law Review
This Article argues that Federal Rule of Civil Procedure 60(b)(6) is the only remedy that courts can always rely on to enforce this power. The universal availability of this statutory rule, which states that courts can vacate judgments against parties “for any . . . reason that justifies relief,” ensures that courts can safeguard clients from the conduct of attorneys who have abandoned them. Part II of this Comment provides an overview of the distinct models the Supreme Court has utilized to evaluate attorney misconduct and the circumstances that bind clients to that misconduct. Part II also describes in detail …

Extortion Through The Public Record: Has The Internet Made Florida’S Sunshine Law Too Bright?, Michael Polatsek
Extortion Through The Public Record: Has The Internet Made Florida’S Sunshine Law Too Bright?, Michael Polatsek
Florida Law Review
In recent years, privately owned websites around the country have begun to gather arrest records directly from law enforcement websites and republish them on their own sites. Often, the images are displayed without regard to the ultimate disposition of the arrestee’s case. Images and arrest records of individuals who were eventually convicted or acquitted are stored on these websites indefinitely, and specifically designed search algorithms ensure that potentially damaging information is just a click away on commonly used search engines such as Google. Some websites categorize images under derogatory headings based solely on the individual’s appearance and allow users to …
